officer continues the community is mourning the loss and expressing their outrage. good evening and thank you for joining us. i'm dionne lim. the investigation continues into the shooting death of 36 year old oakland police officer tuan lay. lay was in plain clothes at the time. he was shot and killed early friday while responding to a burglary near a cannabis business. it all happened near the city's waterfront by embarcadero and fourth. tonight, community leaders tell abc seven news reporter suzanne phan how devastating this loss is for his family. the asian american community and the city of

oakland. on this saturday, the stars and stripes are flown at half staff around the city of oakland in side the police department. a growing tribute for fallen officer tuan lay. lay had been with the department for four years. he leaves behind his wife and his mother, oakland councilwoman carol fife says this loss is particularly hard on so many levels. i've been in conversation with the family and they are heartbroken. >> this is not something that anyone should be dealing with during the holidays. so my love and support goes out to the family. >> lay was a community resource officer for the past two years. really getting to know the neighborhoods and businesses and making sure they knew him. >> people in the community remember seeing him over the last couple of years supporting our communities. >> lay's presence was a big deal to the asian community, says the president of the oakland vietnamese chamber of commerce. >> oftentimes, our communities don't speak up, and so our officers reassure them that, you know, by filing reports and by building a relationship with the

officers, then their concerns are going to be heard. >> lay was killed in the line of duty while responding to a burglary in progress that has rattled some residents and business owners in oakland's little saigon in chinatown, this has come to a shock to our communities because as they're weathering the fear and trauma about being the next victim to violent crime or property crime or vandalism, um, they would think that at least with the police officers, they would feel a little bit more safe. tran says lay's death raises all sorts of questions about the safety and security of oakland's neighborhoods and communities. >> what is the response from our leadership and what actions are they going to take, particularly around the state of the chief and opd? and these are questions that we are asking, not just in the vietnamese community, not just in the aapi community, but the larger oakland community. >> for now, the community is heartbroken. an officer committed to keeping oakland safe is gone. >> everyone in the city of oakland is devastated, and we're

just coming together as one. oakland to support each other, and that's how we need to move forward to make everything safer for everyone who calls oakland home in oakland, suzanne phan. >> abc seven news. new details now on a crash involving a police cruiser in san francisco. police say the driver of the suv involved in the collision failed to stop for officers during a traffic stop. you can see that suv flipped on its side next to a mangled patrol car. the accident happened at about 1030 last night on third street and cesar chavez. four officers were injured and taken to the hospital. all will be okay. the driver of the suv was taken into custody. over on the peninsula, high tides and rough surf prompted warnings today in pacifica. the area has already been hit with dangerous waves and flooding, and despite the numerous warnings, police say the waves have attracted some people to the beaches. one resident traveled from walnut creek to get a closer look at the waves. >> well, i've been watching it

on channel seven and, you know, and, uh, kind of knew i was going to get what i was going to get when i got here, and it's not disappointing. i seen people get, uh, knocked over practically down there, but they were on that side where they're not supposed to be. >> the national weather service issued a high surf advisory for the san mateo county coast. the tides there did cause some flooding and road closures. moving on south, the high surf rages on in southern california, the strong tides are prompting urgent safety warnings in coastal areas like manhattan beach after damaging waves hit that area. emergency officials are also urging people to avoid the beach, as those large waves return. many beaches in ventura and los angeles county will remain closed through new year's eve weekend. all right, turning now to our weather. and it looks like the rain is finally moving on out just in time for new year's. spencer is standing by with the 24 hour accuweather forecast. all eyes will be on

the skies. spencer >> you're right about that. dion. hoping to see those fireworks tomorrow night. well right now as we look at live doppler seven, you can see that we have just a few isolated sprinkles. light sprinkles around the bay area. most of this moisture is not even hitting the ground. however as we animate the maps here, you can see another batch of clouds and some moisture moving in our direction. so it's not going to be a cloud free day tomorrow. here's our day planner forecast 7:00 tomorrow morning. lots of clouds hanging around. temperatures will range from mid 40s inland to upper 40s at the bay and coast throughout most of the day we'll have those lingering clouds in a pretty good chance of some showers in the afternoon and into the evening hours tomorrow, with temperatures not getting above the mid to upper 50 tomorrow. how ever late tomorrow night we expect those clouds to break up a bit and give us some better viewing conditions. i'll have the accuweather seven day forecast in just a few minutes. dion >> all right, sounds good. and speaking of, preparations are well underway for san francisco's annual new year's eve fireworks show. the fire works on the waterfront start at the stroke of midnight on new

year's eve and last about 15 minutes. spectators are encouraged to grab a spot early along the promenade to get the very best view. the city also urges revelers to visit shops and restaurants at pier 39 and the ferry building. before the show, so a very busy holiday travel season continues tonight, with thousands of people looking to get to their new year's eve destinations. no significant delays reported today at any of the bay area's major airports. that is the good news. the sfo has had just three canceled flights that is, according to the website flight aware. the on time flights are welcome news to travelers. >> no, it was actually really convenient. it was great. i don't know why everybody is so scared to travel these days. >> for weeks, the tsa has been predicting us air travel. this holiday season would be its busiest since before the pandemic. the latest numbers show this week about 250,000 more passengers have passed through tsa checkpoints each day on average, compared to last

year. well, the final powerball jackpot of 2023 will roll over into 2024. no one matched all six numbers in tonight's drawing , worth a whopping $760 million. it is the 34th straight powerball drawing without a winner. now if you'd want to check, here's a look at tonight's numbers there on your screen. ten 11, 26, 27, 34 and the power number of seven. the next drawing takes place on monday. and the jackpot is expected to grow. to about $810 million. all new at 11. the rose parade is new year's tradition and is highlighted by some spectacular floats, a 19 year old bay area man who has beaten the odds is going to get the opportunity of a lifetime and will ride on one of them. his story pretty amazing. abc seven news reporter tara campbell spoke with him tonight. i i had tears yesterday. >> i just elena munoz is talking about this behind the scenes

look at rose parade preparations . you see every detail, every person they're working and they all have a story. it's been like amazing. >> her son joseph is the recipient of three separate organ transplant outs and selected as the stanford children's hospital's honoree to ride in its float, witnessing the donor family being able to put their loved ones picture that looks so real on the float. >> i just started crying, joseph affectionately called jojo by hospital staff and surgeons, is often referred to as a miracle patient, and he says he's excited to represent. >> like i'm happy being decorated and turning proud to get to go on the float. >> at just seven months old, joseph was diagnosed with cancer, a liver transplant soon followed. seven years later, a new kidney and this year a new heart. and now he's ready to rock the rose parade. >> i'm going to be waving and

right here on abc seven, starting at 7 p.m. on sunday. robin roberts has the year 2023 countdown to 2024. dick clark's new year's rockin eve with ryan seacrest follows that, and then abc seven news is on at a special time at 10 p.m, so we can take you back to ryan seacrest at 1030 for that countdown to midnight. all right. did our storm system dump snow in the sierra? see for yourselves. the uc berkeley sierra central sierra snow lab in soda springs said this morning that it received just two inches of snow over the last 24 hours. there are more storms in the forecast for the tahoe area next week. the snow lab says it hopes to bring a bigger boost to those snow totals. and i have friends who are in tahoe right now who are a little bit disappointed. >> of course they want to see the snow this was a warm storm, so of course it didn't produce much snow. now, the storm that we see developing for next week looks like a storm associated with colder air, which is likely to produce more than two inches

of snow. >> so we shall see. hopefully it's not like as much snow we saw last year. >> oh no, that was quite a bit too much. yeah. too much. we need to find that sweet spot right in between. here's a look at what's happening with our weather right now. here's a live doppler seven. we had drenching rain this morning. not much at all right now, except perhaps an isolated sprinkle or two. most of the green showing up there on the radars, not even hitting the ground, but the satellite animation shows another approaching batch of clouds and moisture that will certainly bring us cloudy skies overnight and tomorrow. much of the day on new year's eve, and possibly some showers in the afternoon and evening tomorrow. right now, though, we have calm conditions, wind speeds in the single digits if measurable at all. it's a bit cooler than last night at this time, about 4 to 7 degrees cooler. generally across the bay area than at this time last night. so let's take a look at current temperature readings while we look out over san francisco where it's 52 degrees right now. also 52, in hayward, san jose, 5551 san mateo, and a cool 48 at half moon bay. and looking along the bay bridge, it it's a clear shot, but we do a

clear view, i should say. but we do have clouds above. it's 48 degrees right now at santa rosa, petaluma. 4550 at napa, and concord and livermore, and 49 at fairfield and looking across the embarcadero from our rooftop camera. these are the forecast headlines overnight, a chance of some isolated showers. new year's eve day, a late day shower chance and going into the evening tomorrow. also a chance of showers. but then on new year's day, a sunny start to 2024. so we'll be off to a sunny start monday even if we don't see the fireworks tomorrow night . here's a forecast animation taking us into the overnight hours. mostly cloudy early tomorrow morning. you might see a spot or two of isolated showers late in the afternoon and evening. tomorrow is our better chance for some more organized showers, but by late tomorrow night, 11:00 or so, we think the showers will be all over. maybe some lingering clouds with some hint of some clearing so we might be able to see the fireworks tomorrow night. tonight look for low temperatures, mainly in the mid to upper 40s high temperatures tomorrow, generally in the mid

to upper 50s. very few locations will top out at 60 degrees tomorrow, although san jose is likely to reach that temperature level. and here's our futurecast animation going into early next week. starting tuesday afternoon. our next rain wet weather system will be approaching. they'll start to produce rainfall tuesday night into wednesday through the day wednesday into wednesday night. then we get some clearing on thursday before the next wet weather system arrives on friday afternoon friday evening and that is likely to produce rainfall into saturday. and notice it looks like some a pretty good snowfall may occur over in the sierra from the approaching storms next week. here's the accuweather seven day forecast. so for tomorrow, mainly cloudy during the day. maybe some showers again in the afternoon and evening, but we're hoping for some clearing late tomorrow night and it looks like that actually may occur. then on monday, new year's day, sunny start bright skies, high temperatures up to about 60 degrees but cooling down a little bit on tuesday as clouds increase. rainy and breezy with

thousands of protesters are demanding israeli prime minister benjamin netanyahu, who stepped down over his handling of the

war with hamas. they believe netanyahu has botched negotiations options for the release of more than 100 people still being held hostage by hamas. protests have been underway for more than a day in israel. >> i want them to put this, uh, topic first priority more than anything, more than military targets, more than any other political aspirations. >> netanyahu said today the war will likely continue for many months. the fighting in southern gaza is intensifying as israeli troops expand their ground offensive. meanwhile, the humanitarian crisis there is worsening by the hour. refugees have set up makeshift camps in front of mosques, and the un reports a surge in people fleeing further south. moscow is accusing ukraine of deadly air strikes on southwest russia. 20 people are reportedly dead as a result of the attack, which comes one day after russia unleashed its own large scale assault. here's abc's lama hasan

. >> according to russia's defense ministry, shelling in the center of the russian border city of belgorod has killed more than a dozen people, including children, and injured more than 100. this comes after russian officials claimed ukraine unleashed more than 30 drones over western cities in russia, including moscow. russia's defense ministry did not report any casualty from those attacks and said all of the drones were destroyed by its air defenses. russia officials say these attacks by ukraine were launched in response to the massive siege by russia, in which over 150 missiles and drones hit more than six major cities in ukraine , including the capital kyiv, killing at least 39 people and injuring 150 others. in kyiv, civilians gathered in an underground station in waiting for the air alarms to end. it was scary and terrifying thing, this woman said in the dnipro. multiple strikes hit this small,

money back, but in the past, that has been challenging for most people. abc seven news reporter melanie woodrow explains. >> come january 1st, for the first time, californians will be charged a deposit fee on wine and liquor bottles and containers. they'll also be able to get that deposit back if they recycle properly. consumer watchdog president jamie court says it's time. >> it's a win win win all around . uh- for the winemakers, for the consumer, for uh- and for the environment. the question is how is this going to be rolled out and how is it going to be worked? and the devil's in the details and that's in the hand of the recycling regulators. >> calrecycle director rachel wagner, where we would typically recycle is where you would recycle your bottles from your your festivities, which is where things get a little tricky. are there enough centers for the volume of bottles that people are going to have to redeem? >> we recognize that for some, especially, either very urban areas or very rural areas, that it is difficult to cite

recycling centers. >> it's for that reason that the legislation allows for retailers to get together and create dealer cooperate lives, creating a system that will work for their individual communities. but that won't go into effect until early to mid 2025. right now, retailers will have the option of paying $100 a day to opt out of in-store takeback until that ends in 2025. californians can redeem their bottles at existing redemption centers, which may be few and far between depending where you live. >> there is one recycling center at the edge of town in south san francisco, where you can go and recycle. that's the only recycling center left in san francisco, wagner says. >> there are pilot projects around the bay area, including backdrops, though she recognizes. i know that it's been a little bumpy redemption rates range from 5 to $0.25, depending on the material and size of the bottle or container, beverage manufacturers have until july of 2025 to make sure their label is correct, but will start paying january first, 2024, even if there isn't a crv label on the bottle, and

of disappointment when we fail to keep the resolution. abc seven news anchor karina nova spoke with director of behavioral health at blue shield of california. >> january 1st comes around and we all want to improve. we all want to get better. we want to make that resolution. why do we make these new year's resolutions as humans? yeah that's a great question, karina. >> and thanks again for having me. i think, um, the new year's is kind of like a it's a turnover in the calendar. sometimes this happens on birthdays or at the beginning of the school year, uh, beginning of the week even. but we particularly focus in on the beginning of a new year to say, kind of pause and reflect on what's going well, what's not going well, what do i want to do differently? tsay what do i do want to do more or less of? and so we put a lot of pressure on that new year to make changes. um and so a really natural thing

to do. and at the same time, not always really stick when you lump it all in and into that just one time of year. um, i'm a big proponent of essentially having a new year's resolution to not just have a one time resolution to have a period of kind of pause and reflect and, and change throughout the year, picking different times that give you a chance to focus in, um, you know, readdress on what's going on and see if any of the goals that you might have set need to be changed. >> and but how do we get our resolution to stick? any advice for us really? >> the first one is to be specific. a lot of the time when we're setting new year's resolutions or other goals, it's easy to be kind of a bit vague about it. so, for example, i might say, well, i want to exercise more versus saying something to the effect of or setting a goal that looks like i want to exercise xyz for 30 minutes, at least four times a week. so the latter is a lot

more specific and also gives me a much more kind of distinct target for my behavior change, and which means i'm going to be likely more successful in that. so again, being specific i think is important. second, really, um, having a buddy, you know, that can be it can be anyone. it can be a coworker family member. you can be your spouse. it can be your kid. it can be a friend. doesn't matter. again, it's somebody who can partner with you in your goal, who may or may not have a similar or same goal right. and who can. >> they don't even have to be someone that lives in the same city as you. you can. that's right across the country that you can text. and i hit my goal of walking 30 minutes today. yeah that's a great call out. >> yeah. and very good reminder. it's somebody who you can celebrate with you. it's somebody who can also hold you accountable on the days where you're like, oh gosh, i just really can't get to the gym today. but but that's somebody who can help you kind of push yourself out the door and get where you need to go.

>> the last thing? >> yes, the last thing. so this is also a favorite of mine, i think. and that is to assign a purpose and be really clear with yourself about it. oftentimes when we're talking about setting resolutions or goals, there's a reason why we're doing it. but we forget to connect it really deliberately to what it is we're trying to do. so for example, going back to the exercise or being, uh, healthy or goal that i described earlier, what's my reason for doing that for me? me personally, something like that would be about not just being healthier, but i want to be healthier because specifically, i want to age gracefully. i want to get the biggest, you know, chance i can to be a grandparent one day. okay? >> so be specific. find a buddy and connect to a why. and with your help, i think we can all hopefully stick to our resolutions. if anything a little bit longer. doctor stelter, thank you so much for your time. >> i think our director, josh,
