resume train traffic through this area for over, you know, the foreseeable future from start to finish. when the crane gets here in place to when we are able to clear the freeway, that it would be about six hours and the cleanup is just beginning. >> good evening. i'm ama daetz and i'm kristen sze the bart train derailed just after 9:00 this morning. >> it's going to be a while before the line is back on track. >> abc seven news reporter leslie brinkley is live with the latest developments for us tonight. leslie. >> all. good evening. uh. bart says so far the repairs are going a little slower than they had hoped. today's derailment, of course, disrupted plans for tens of thousands of passengers in the bay area who couldn't get back or forth from this area of the east bay. now, behind me, it's very dark, but there is a big crane back there that's trying to lift the train cars. uh- you can imagine people coming back from new year's celebrations jolted into reality by this derailment this morning,

a deeply shaken passenger who escaped the burning bart train shot this video on his cell phone as first responders converged on the orinda bart station on new year's morning. not how we want to start 2024. >> you know, you say you want to start with the bang, but not like that. >> just past the orinda station at 9:00. the eight car eastbound passenger train on bart's busy yellow line from sfo to antioch derailed and caught fire at an interlocking connecting two tracks. the operations control center was unable to communicate with the interlocking to move the tracks into the proper position. passengers described the train's stopping twice and then starting to move backwards as it derailed. >> the screeches, the screeches were different. >> it wasn't like usual screeches. it was like weird. and then it smoked on the outside, and then it smoked. and the inside of the cart everywhere saw smoke. and then

you saw, like from our view, it's just fire. like orange and just pop. pop. so then we tried to get to the next car. we open our car door and the next car door was like angled in a and we tried to open it. me and the guy in front of me, the first two people, we were trying to open it. so somebody behind us was like, just jump, just jump. so we just jumped in the outside like like mission impossible almost. but like, not in a cool way. like in a very bad way. like scary. >> we all kind of had to jump off a good distance from the train onto the tracks. >> it was pretty scary. it was pretty dramatic. and, uh, yeah, yeah, it was crazy. and we ultimately got got off safely. >> bart reported no serious injuries, but nine people were taken by ambulance with minor injuries. other trains stuck on the track were also evacuated, with passengers walking over the rocky track to the orinda station, where they found themselves stuck. bart said because of the holiday, it took longer than usual to coordinate a bus bridge, angering some

stranded riders. late in the afternoon, bart moved an immense crane through the caldecott tunnel to hopefully lift the derailed cars up and back onto the track again, so they can be cleared out of the way. there again. extensive track repairs can get underway. the california public utilities commission is launching an investigation into why the train derailed hope is that those derailed cars will be back on track and pushed by the other train cars back into the concord yard tonight, right. so what should you expect right now? the next few hours east, several lanes of eastbound 24 will continue to be closed as they do this work. bart is not operating on this line at all right now. there is a bus bridge. from what i understand, running between the walnut creek and the rockridge stations for those displaced riders and track

repairs again over tonight, going so far a little slower than expected. fingers are crossed. bart just told me minutes ago they do have high hopes that the bart trains will be running, as normally for the morning commute tomorrow, but they also shaved that with a little word of caution to not a bad idea to have a backup plan in mind just in case they run into some obstacles overnight. report live from orinda. bart. i'm leslie brinkley, abc seven news. >> all right. leslie thank you so much. and this is the fourth bart derailment in the last 15 years, all in the east bay. the mostrillionecent took place in june of 2022. excessive heat upwards of 140 degrees on the tracks caused a train to derail between the concord and pleasant hill stations in february 2014. uneven track where caused an out of service train to derail near the concord station. in march of 2011, uneven track where again near the concord station caused two cars to derail and in december of 2009, a train derailed between the lake merritt and 12th street stations

in oakland. >> now to new details about the person who died after suffering fireworks related injuries in san francisco, abc7 news reporter luz pena went to treasure island, where residents are mourning this death. >> less than an hour into the new year, san francisco police officers responded to a chaotic scene involving a fireworks injury on treasure island in the background, a woman can be heard in distress as officers and paramedics responded, where's my baby? casey >> where is he? >> a neighbor said a group was shooting fireworks when one of the large explosives hit a teenager in the head. >> exploto en su cabeza. >> sfpd said the victim was given first aid but died on scene. >> san francisco fire department did respond for a traumatic injury. um, associated to new year's eve. san francisco police department is investigating that incident today. >> fireworks debris was visible in a trash can outside of a home

. off camera from one of the windows. a friend of the victim said he was 18 years old and visiting the area to celebrate the new year with friends. today, neighbors were shocked to hear that teen die side came outside and i seen there was a lot of commotion and a lot of people over there. >> a couple people mentioned that someone had passed away due to a firework going off and hitting them. >> a death that has shaken this community who've left candles to remember the teen. >> that's pretty sad. i didn't know that. and that makes me upset a little. you know, because people are supposed to be safe. i'm not sure what happened, but it is suck going into the new year here, and that san francisco fire is urging the public to call 311 and report illegal fireworks activity to keep community safe. >> they're extremely dangerous. and again, no matter if it's a safe and sane firework or a so-called safe and sane firework or a professional or commercial grade firework that's being used by a nonprofessional, um, any of those can ignite a fire. that fire can cause injuries. it can

cause death. >> we spoke to a neighbor who said the fireworks were excessive, and they heard an older adult ask the group to stop shortly after an explosion took place. now sfpd is asking anyone with information to contact them in the newsroom. luz pena, abc seven news, rsv, flu and covid are on the rise again. >> wastewater data is showing higher than normal levels of all three viruses. >> abc seven news south bay reporter dustin dorsey looks at the numbers as we ring in the new year. >> we turn the page on the holiday season calendar, but you, doctor peter chin-hong, says what's left over are respiratory diseases, including covid. what we've seen in the last few years is a typical pattern of a 123 punch with thanksgiving, christmas, hanukkah and then new year's, followed by uh- increased cases in the community and some spillover in the hospital. the new gen one variant is rapidly spreading nationwide, and the wastewater scan dashboard shows

us the bay area is not immune. santa rosa, san francisco, oakland and san jose, all with high levels of covid, to name a few. the south bay city showing the third highest level since 2021, according to santa clara county data. >> we're still seeing a lot of covid in the community. a lot of people are getting sick. it's causing a lot of disruption. it seems that everybody uh- i know or almost everyone has some sort of respiratory illness right now, including covid. >> and that's what has doctors concern. right now. it's not just covid. ucsf doctor george rutherford says there are rising trends of influenza and rsv nationwide as well. >> there are substantial increases in respiratory syncytial virus cases and hospitalizations, rsv in adults and substantial increases in influenza hospitalizations and cases. uh- and tests, um in adults and children. these experts say keeping hospitalizations down in spite of rising wastewater is key.

a look at the laws that could affect you. >> california is set to see some changes in 2024. here's a breakdown of a few. first up, california's minimum wage. today that goes up to $16 an hour starting in april, fast food workers jumped to 20 bucks an hour minimum wage for health care workers goes up to $23 an hour by june next. some laws are targeting the state's housing crisis, tightening restrictions like no fault evictions. they also loosen other restrictions, like where affordable housing can be built, and ab 12 now

forces landlords to only charge a month's worth of rent for a security deposit. pot smokers are also seeing new protections. it's now illegal for employers in california to fire someone for using marijuana outside of work. also, six cities are installing speed cameras. cameras will ticket drivers going at least 11 miles over the speed limit. fines range from 50 to $500. undocumented immigrants now qualify for health insurance in the state. california is the first state to offer it via medi-cal. 700,000 people are now eligible. plus, say goodbye to strict cancellation rules for airbnb. b you can now cancel without penalty within 24 hours of your reservation. being confirmed. the reservation must be made at least 72 hours before check in and. and a new law targets hidden fees starting july. website sites and apps will be required to display the actual cost of any item or

service. irene cruz, abc seven news in the bay area, the average minimum wage is. now $17.39 an hour. >> mountain view has the highest minimum wage at $18.75, up $0.60 over last year. the statewide hourly pay increase is part of california law that has gradually raised the minimum wage from $10 in 2017. >> all right. new year, new weather pattern, perhaps. >> definitely not the same as today. coming tomorrow. spencer >> that's true. it was new for one day, and it'll be new again tomorrow. but a different type of newness. here's a look at what's going on. you can see on the satellite radar composite image a large mass of moisture moving in our direction. this system, this storm system will bring some rain, some heavy rain at times, some gusty wind from time to time as well. at the moment though, the wind is very light, very calm. the wind speeds under ten miles per hour all across the bay area. that may not last very long. here's a live view looking toward the embarcadero from the exploratorium. camera 55 degrees in san francisco right now. also

55 in hayward and san jose. low to mid 50s at oakland, san mateo and half moon bay. looking along the bay bridge under calm and pleasant conditions right now are the temperature readings 54 degrees in santa rosa down to 48, a chilly 48 at petaluma and low to mid 50s at napa, fairfield, concord and livermore. let's check out our forecast headlines tonight. we'll see increasing clouds, especially in the late night and overnight hours tomorrow. showers and downpours will begin in the north bay in the early morning hours. as this system may not have much of an effect on the morning commute as the rain will arrive in most of the bay area later in the day, but it will certainly affect the evening commute and for the remainder of the week, we're talking about mainly wet and unsettled weather for tonight. as the clouds increase, look for low temperatures mainly in the low to mid 40s, up to the north bay, the far north a little bit chillier with lows there in the upper 30s at ukiah, lakeport and santa rosa. then tomorrow's highs even as the rain starts to sweep southward, pretty mild over much of the bay area south and east of the golden gate. highs there in the low to mid 60s up in the north bay where it

will be raining and it will be cooler with highs mainly in the upper 50s. so let's take a look at the approaching storm on the exclusive abc seven storm impact scale. it ranks a level one for tomorrow. showers and some downpours. breezy. gusty at times and of course wet and slippery roadways. forecast animation starting at 8 a.m. shows the arrival of rain in the north bay between 8 a.m. and about 12 noon. it becomes heavier, more widespread, much heavier. in fact, by about three in the afternoon. and then after that it sweeps to other parts of the bay area, so we'll all get a pretty good drenching out of this storm before it starts to lose some of its intensity late tomorrow night. but it will still be followed by more showers into wednesday and rainfall totals by late wednesday night will range from about an inch to an inch and a half in the north bay, to between half an inch and an inch in the rest of the bay area. here's the accuweather seven day forecast. looks like the only day we might get a break during the week this week is thursday, when it will be partly cloudy and dry, but we'll have morning showers on wednesday and then on friday, a late day system develops and continues to rain
