to django reinhardt. he bends the notes, he plays behind and ahead. he's almost like a jazz guitar player in that way. ♪ there's a fire. >> frightening moments to start off 2020 for passengers in fear. forced to evacuate from a bart train when it derailed and caught fire. and now it's a race to get things back on track for the workweek. good evening, and thank you for joining us. i'm ama daetz there is good progress tonight in getting things back on track. this all happened just after nine this morning near the orinda station on the yellow line. nine people were sent to the hospital. it was a big shakeup for many who say they were on their way to work or coming home after celebrating new year's eve. for more on the work to fix the track, we go to

abc seven news reporter cornell bernard. he is live in orinda with an update tonight. hi cornell. >> hey there ama yet? track inspections happening behind me tonight. the derailed bart car was just lifted back onto the tracks and towed to the orinda station tonight. bart telling us that normal service could resume for the tuesday morning commute. a giant crane was brought in monday night to lift his derailed bart car back onto the tracks. two lanes of eastbound highway 24 were closed to accommodate the heavy equipment. here's a time lapse of the maneuver, which took hours to pull off. bart says damage to the track is not extensive. >> i would say there's a good chance that we could return to normal service in the morning, and if not at least single track using one of the two tracks which would create about a 10 to 20 minute delay. >> cell phone video capturing the scary moments when the bart train derailed and caught fire near the orinda station on new year's day morning. we're still kind of on fire.

>> another car, 3024, is on fire like a derailed. >> passengers say the train stopped twice, then moved backwards as it derailed. then a mad dash to evacuate as the car filled with smoke. >> somebody behind us was like, just jump, just jump. so we just jumped in the outside like. like mission impossible almost. but like, not in a cool way. like in a very bad way. like scary. we all kind of had to jump off a good distance from the train onto the tracks. >> it was pretty scary. it was pretty dramatic. and, uh, yeah, yeah, it was crazy. and we ultimately got got off safely. >> reporter. the antioch bound train derailed and caught fire at an interlocking connecting two tracks. >> the operations control center was unable to communicate with the interlock going to move the tracks into the proper position. >> we had everybody off the train. they're all walking toward a station. >> terrifying day for passengers on their first trip of the new year. >> not how we want to start 2024, you know, you say you want to start with the bang, but not

like that. >> yeah, a scary day for sure. a bus bridge has been in effect most of the day between rock bridge and the walnut creek station. and tonight we're told, the public utilities commission in california is launching an investigation into today's derailment. and we're live in orinda tonight. i'm cornell bernard, abc seven news. all right. >> cornell, thank you so much. and this is the fourth bart derailment in the last 15 years, all in the east bay. the mostrillionecent was in june of 2022. excessive heat on the tracks, upwards of 140 degrees caused a train to derail between the concord and pleasant hill stations in february of 2014. uneven track wear caused an out of service train to derail. also near the concord station. in march of 2011, uneven track wear, again near the concord station, caused two cars to derail. three minor injuries were reported, and in december of 2009, a train derailed between the lake merritt and 12th street stations in oakland, and we are making sure to keep you updated through the abc seven news bay area mobile app.

be sure to get the very latest live coverage of the delays and traffic with our abc seven mornings team that begins at 5 a.m. we're getting new details tonight on a new year's fireworks tragedy. a mishap on treasure island in the early morning killed an 18 year old. police and firefighters were called just after midnight for a head injury from an exploding firework. 50 people were there for a new year's eve gathering. a police officer gave first aid, but the man died at the scene. >> came outside and i seen there was a lot of commotion and a lot of people over there. a couple people mentioned that someone had passed away due to a firework going off and hitting them. >> a san francisco fire department spokesperson said all fireworks are extremely dangerous. fire officials urge you to leave fireworks to the professionals as. all right, we turn to outside now with a live look out at the san francisco skyline. tonightrillionain is returning tomorrow after that very stormy week last week. so let's bring in abc seven news

weather anchor spencer christian. he is tracking what we can expect. spencer. >> okay, i'm of the new year. got off to a sunny start today. not so sunny on january 2nd. here's a look at our day planner for tomorrow 7:00 tomorrow morning. skies will be cloudy ahead of the arrival of rainfall. by noon. we'll see north bay showers developing, temperatures by noon in the mid to upper 50s from coast to the inland areas. by 4 p.m. there will be showers and downpours across the entire bay area. the evening commute is going to be a challenging one with heavy rain in some spots and of course slick roadways. temperatures at 4 p.m. mid to upper 50s from coast to inland and then by 7 p.m. we'll still have wet weather showers will linger not only into the evening hours tomorrow, but all the way into wednesday. i'll have the accuweather seven day forecast a little bit later. i'm all right, spencer. >> we will check back with you and you can track the rain yourself with the same live doppler seven that spencer and our weather team use. just search abc seven bay area in your device's app store to download it. happening tomorrow, california will conduct its first snow survey of the season. the state water experts are

already expecting the results to be well below normal for this time of year. the official measurement will be tomorrow afternoon at phillips station in the sierra. last week, the uc berkeley central sierra snow lab reported snow levels were around 33% of normal, but that was before a storm system arrived over the holiday weekend in southern california, a giant sinkhole. look at this is swallowing up part of a parking lot in orange county. high surf and rain battered the coastline the past several days. the city came in with a couple of water pumps to try to remove the floodwater, but not everyone thinks mother nature is to blame for the mess. >> with the force of that pump, they could have pumped out all that sand and caused that the sinkhole appeared yesterday. >> it's about two parking stalls, wide and three feet deep. demonstrators were up extra early on this new year's day, chanting in front of congresswoman nancy pelosi's home in san francisco. their demand for a ceasefire in gaza.

around 100 people marched around the speaker emeritus neighborhood. they say instead of sending military aid to israel, more money is needed here in san francisco, saying this new year holiday was the perfect time to get their point across. >> we know that congress is on recess and it's a great time to bring messages to representatives when they're at home. it comes as today, israel's military said it's shifting thousands of soldiers out of the gaza strip in the first significant drawdown of troops since the war with hamas began. >> nearly 22,000 deaths in gaza have been reported by the hamas run ministry of health in the north bay, sonoma county's poultry industry is being hit again by a wider spread of avian flu. the u.s. department of agriculture is reporting outbreaks at two more commercial egg farms. the farms have been ordered to euthanize more than 91,000 birds, more than a million birds have been euthanized on nine farms in sonoma county since thanksgiving. marin county also recorded its first outbreak last week. a lot of new laws come

with the new year. everything from recycle ing to marijuana to minimum wage. so for tonight's abc seven news, deep dive at 11, we're spending some extra time to take a closer look. reporter irene cruz from our sister station in los angeles has some of the laws that could impact you in the coming year. california is set to see some changes in 2024. >> here's a breakdown of a few. first up, california's minimum wage. today that goes up to $61 an hour starting in april, fast food workers jumped to 20 bucks an hour minimum wage for health care workers goes up to $23 an hour by june next. some laws are targeting the state's housing crisis, tightening restrictions like no fault evictions. they also loosen other restrictions, like where affordable housing can be built. and ab 12 now forces landlords to only charge a month's worth of rent for a security deposit. pot smokers are also seeing new protections. it's now illegal for employers in california to fire someone for using marijuana outside of

work. also so six cities are installing speed cameras. cameras will ticket drivers going at least 11 miles over the speed limit. fines range from 50 to $500. undocumented immigrants now qualify for health insurance in the state. california is the first state to offer it via medi-cal 700,000 people are now eligible. plus, say goodbye to strict cancellation rules for airbnb. you can now cancel without penalty within 24 hours of your reservation being confirmed, and the reservation must be made at least 72 hours before check in. and a new law targets hidden fees. starting july, websites and apps will be required to display the actual cost of any item or service. irene cruz, abc seven news and if you are looking for more, we have the whole list of notable laws taking effect in the new year. >> it's on the front page of our website, abc seven news.com.

so easy. and that's where we come in. >> good morning america. we want you to know every morning we're right here. >> and we got you. >> new developments in the massive 7.5 magnitude earthquake that rocked japan. local officials say the death toll has jumped to at least 30, with more feared to be in the rubble numerous buildings were damaged and now hundreds of emergency personnel are helping to search, rescue and clean up at least 40,000 power lines were knocked out. western japan is an accustomed to earthquakes of this size. it hit just after 4 p.m. local time. that was around 11 p.m. on new year's eve. here in the bay area. initial tsunami waves of about ten feet were

reported in surrounding areas, which have since calmed. and now to new details on a concerning cyber kidnaping trend targeting foreign exchange students from china. it comes as a 17 year old student was just rescued in the utah wilderness. he was apparently convinced his parents were being harmed. tonight. abc news reporter zohreen shah has more on the warning from law enforcement tonight. >> police in riverdale, utah, say they found 17 year old kai huang in a snowy camping area about an hour outside salt lake city, where temperatures dropped to freezing at night. police say what happened to huang is part of a disturbing criminal trend called cyber kidnaping, and that kidnapers threaten young foreign exchange students and their families and they demand ransom. the victims are told to isolate themselves and then closely watch through facetime calls and or skype. they're told to send photos of themselves to cyber kidnapers under duress, which are then sent to the parents, making it seem like they're held captive. the victims are told their families will be harmed if

they don't comply. police say huang's parents in china alerted them that he had been kidnaped, leading police to discover that he had bought camping gear. they say after analyzing and assessing bank records purchases over the last month, cell phone ping records and the camping incident, they were able to pinpoint where he might have isolated himself. they found him in the brigham city canyon area with very little heat and food, but with several phones that were presumed to be used to carry out the cyber kidnaping, and that huang only asked to speak with his family and a warm cheeseburger. police are warning families, especially foreign exchange students, that if you think you're a target of cyber kidnaping, call your local police department. don't wait, send money and stop talking to the people who are calling you. zohreen shah, abc news, los angeles. >> so scary. well, the start of the new year means as of today, a piece of disney's iconic mickey mouse is now open for public use. the steamboat willie character is now clear of any copper copyright protection. the law. by law, copyright

haven, connecticut. take a look at them. seven maurice, on the right, arrived at 11:59 p.m. on december 31st, weighing in at 6 pounds, nine ounces. then came his twin sister, sully, on the left also at 6 pounds nine ounces. she arrived just three minutes later at 12:02 a.m. on january 1st. families doing great and getting some welding deserved rest. wow oh, they are so cute. >> yeah, absolutely. all right. >> we got to get to the weather because more rain is rolling in. >> it certainly is. i'm getting really close right now. so here's a look at our satellite radar composite image. you can see the storm approaching the northern california coast in the eureka area right now. and some of that rain will be pushing into the north bay here in the bay area, probably as the morning commute is getting underway right now, we're looking at quite a drop in temperatures from this time last night, six degrees cooler in concord, three degrees cooler in oakland. excuse me, seven degrees cooler in novato. and i'm losing my voice. looking toward embarcadero center, let's check out the current temperature readings 51 degrees here in san francisco. upper 40s

at oakland, hayward, san jose, and san mateo, and 43 at half moon bay. nice view of the golden gate, the golden gate, the bay bridge right now from emeryville. skies are not cloudy yet, but they will get cloudy overnight, so we've got some clear camera views right now. 43 degrees in santa rosa, petaluma is our coolest location at 41 and low to mid 40s at napa, fairfield, concord and livermore. now as a look across the embarcadero, we'll also check out the forecast headlines . overnight clouds will increase as showers approach the bay area tomorrow. showers and downpours throughout the day. they'll start first up in the north bay and then swing southward and eastward to the remainder of the bay area. the evening commute is likely to be severely affected by these downpours, and for the remainder of the week, we can expect mainly wet and unsettled weather, with a few breaks here and there overnight, lots of clouds and light showers may arrive even before the morning commute begins. in the northern most part of our viewing area. it'll be pretty chilly up north in ukiah, lakeport, santa rosa

with low temperatures in the upper 30s. most of the remainder of the bay area will see lows in the mid to upper 40s, then highs tomorrow well south and east of the golden gate. mainly low 60s, even some mid 60s down in the san jose area, but up in the north bay as the rain pushes in and with the cloud cover it will be a bit cooler with highs only in the upper 50s. now let's take a closer look at the storm with the exclusive abc seven storm impact scale. the approaching storm is a level one light storm, but it won't be light all day. we expect showers and some occasional downpours, which could become widespread at times . breezy and gusty from time to time. and of course, wet, slippery roads, especially for the evening commute. here's the forecast animation starting at 8:00 tomorrow morning, at which point they'll probably already be a few light showers in the northern most part of our viewing area. by noon, showers become more widespread over the north bay, and then between noon and about 3 p.m, we'll see heavy, widespread downpours sweeping southward and eastward to all parts of the bay area once again likely to be a very wet and slippery evening

commute. and even after the storm sort of eases up its intensity a bit going into the late hours tomorrow night, we'll see showers trailing the main part of that storm into wednesday. so wednesday is going to be a wet day as well. by wednesday night, rainfall totals will range generally from about a half inch up to an inch across the bay area. and here is the accuweather seven day forecast. so with the showers lingering into wednesday, we're posting a level one storm ranking for wednesday as well. thursday partly cloudy to mostly sunny and dry, but late day showers will develop again on friday and it will continue to rain into saturday, so once again, another level. one storm coming in. but next sunday and monday should be sunny and dry. but that's little comfort as you look at the rain that we're going to get before then. >> yeah, that's true, but it's nice to get these small storms coming and then some breaks in between. we need those breaks. but we need an atm from our bank unless you want to spend a small fortune in fees.
