mill valley today, an effort to prevent more damage from tonight's incoming storm. we have a look at the rain falling at highway 101. this was a short time ago in the area of san rafael and novato, and you can see it's raining across many parts of the bay area as we speak north bay, east bay, san francisco, and more is on the way. >> yeah. let's get a first look at the forecast with spencer, christian and spencer that live doppler seven totally lit up in green. >> oh, you're right about that, diane. let's take a look at it. right now. you can see that the rain has returned and more a happy returns are on the way. we've got rain falling steadily and heavily now from the north bay, from santa rosa, all the way down to the golden gate. and it's expanding. so this heavy rain is going to cover a wider area over the next hour or so. in fact, it's just about to move through the golden gate right now and drench san francisco, parts of oakland, berkeley and beyond. so let's take a look at this storm on our exclusive abc seven storm impact scale. it's a level one storm for this evening. the remainder of the evening look for periods of showers with some heavy

downpours. it will be breezy with gusty winds at times wet and slippery roadways. nonetheless uh- obvious right now and the evening commute is going to be a wet and slippery and challenging one. here's the forecast animation starting at 5 p.m. notice we get a little bit of a pause after about 7 or 8 p.m, they'll still be some trailing showers, but the rain won't be so widespread or heavy in the late evening hours. but after midnight, we'll start to see areas of showers swinging through the bay area again, through the morning commute and into midday tomorrow before it winds down by midday tomorrow, we expect rainfall totals to range, generally from about a half inch to nearly an inch in the wettest locations, and there's going to be snow in the sierra. winter storm alerts are in effect, a storm warning for the western slopes and an advisory or watch for the eastern slopes. we could see 9 to 15in of snow in the hardest hit, highest elevations. i'll give you a closer look at that a little bit later, diane. >> all right. sounds good. spencer. thanks. now from snow to surf, get ready for more of high surf. today, the national

weather service issued a high surf advisory starting tomorrow morning for waves between 19 and 23ft. you're looking at video from earlier today along the san mateo county coast. now experts say while it is fun to check out the waves, it can be dangerous. those waves can easily pull people into the ocean from rocks, jetties and beaches and a reminder you can track the rain yourself with the very same live doppler. seven that spencer and the entire weather team use. just search abc seven bay area in your device's app store to download it for free. >> several people have been arrested in connection with that fatal shooting of oakland police officer tuan lay. >> lay was shot early friday morning while he and another officer responded to a burglary in progress at a cannabis business. abc seven news reporter anser hassan has more. the oakland police department says several arrests were made over the weekend in connection to friday's shooting that killed officer tuan lay has been extremely, extremely difficult, especially, you know, new year is a time that you want to

celebrate with a family. >> carl chan is president of the oakland chinatown foundation. he knew officer lay personally. he says the family is still coping with the sudden loss, but they are thankful arrests have been made. >> these people are being, uh, you know, killing and hurting people. uh- would not be on the street hitting other people. so the family members are very, uh, happy that, you know, they are no longer out there hurting other people. >> the oakland police officers association confirming that members of the united states marshals service arrested a key suspect in livermore. >> they can see that, um, the work has been done by the police department, and especially they want to thank all the police departments from all across, not only from opd, but, uh, for those, uh, have been involved. >> this was happening during another incident of, you know, property crimes and for our communities to be afraid that they're going to be the next victim and, and that our officers might not be safe. it

sends fear into the community. >> doctor jennifer tran is president of the oakland vietnamese chamber of commerce. she says these arrests are helping the community to heal. >> it really hit home not only because he was vietnamese american, but he really exemplified what it is that we're trying to strive for with our public safety and for our police officers to be from oakland to be rooted in our community. >> reporter in a statement, the oakland police department says this is just the beginning of a lengthy legal process. we are hopeful that it will start the healing for officer lee's grieving family and our entire opd family in oakland, anser hassan. abc seven news. >> an ace train hit and killed a bicyclist in fremont today. sky seven was over that incident this morning near the train tracks at auto mall parkway. we've not learned yet the identity of the victim. union pacific railroad is investigating. >> bart trains were on the move once again today in the east bay on the busy yellow line, where a train derailed and caught fire yesterday morning.

>> abc seven news reporter leslie brinkley joining us live at the orinda bart station that was the epicenter of the derailment that sent nine people to the hospital with minor injuries. so what's the latest on the investigation? leslie into the cause of the derailment ? >> larry and diane, that is the big question. what happened? as commuters were certainly relieved this morning as train service resumed at the crack of dawn. but what caused the derailment aren't got out of the gate on time. after a night when an immense crane lifted derailed cars and moved them to the concord yard, and crews repaired track damage and on fire. >> another 3024 is on fire like a derailed. >> it was a difficult start in this new year for bart, as the eastbound train caught fire and derailed near orinda at 9 a.m. yesterday, traumatizing over 100 riders and delaying thousands of other passengers.

>> now we turn to the phase of what really happened, bart director deborah allen said. >> the transit agency is still interviewing operators on staff as they try to put together the pieces. >> there's an investigation pending, so lots of things could come out that we don't know right now, but what we believe right now is it was not a track issue. it was not a train issue. so those have sort of been ruled out. um, what we are left with and what what most of what we know points to is human error. >> she said the interlocking device was new, the train car was new, the track was new. bart said they were unable to operate the interlocking to change tracks remotely, and asked the train operator to do it manually . passengers described the train stopping and moving backwards. the fiber optic network went down due to some software issues, and that was what created the condition from the start. >> that that the train operator

had to manually realign these tracks. it's the fourth bart derailment in the last 15 years, all in the east bay. >> the incident is a setback for bart, as the agency needs to build ridership in 2024 to secure funding after declines due to safety issues and the pandemic. >> at least we were able to open for business this morning on time and providing reliable service today, and so that's what we need to do. moving forward. we can't really have too many of these types of incidents at and expect the public to trust us. >> i am really hoping that we get something out to the public and say, this is what happened and we are very sorry for the people who were impacted by this that bart director told me they hope to have definitive answers, perhaps by next week. >> meanwhile, the public california public utilities commission was on site yesterday and they are conducting a larry and diana separate investigation

those heavier patches of rain in the north bay, such as spencer mentioned moments ago, we are also looking live at our exploratorium camera, where you see all of that precipitate on the lens. we will have the full forecast with spencer coming up in just a few minutes, and the storm is expected to bring some much needed snow to the sierra today. >> the first snow survey of the year took place is actually a pretty dismal report, but as abc seven news south bay reporter dustin dorsey explains, no reason to panic just yet. >> it wasn't exactly a white christmas and not much of a white new year either. in the sierra. a little different look to the annual california department of water resources snowpack survey from the record breaking 2023 report here at phillips station last winter, they were standing on almost five feet of snow, but now the survey today recorded a snow depth of 7.5in and a snow water content of three inches. >> that results in 30% of average to date and 12% of the april 1st average. here at this location across california, the

statewide snowpack sits at 25% of average to date, compared. to 177% january 2023. >> and abc seven news meteorologist drew tuma says it's not just california who's not seeing the snowy conditions the country as a whole. >> december temperatures were well above average across the entire lower 48, and we saw very minimal snow. like you said, only about 20% of the country has some sort of snow on the ground right now. >> locally here in the south bay, a low snowpack is never a good thing for santa clara valley water district, who imports more than 50% of their water from outside of the county, including from the sierra. but with our true wet months here in northern california still ahead, there's not much reason for too much concern just yet, because we had such a robust winter last winter and our allocations were at 100% for both the federal and state programs. >> um, our water supply situation is in a much better place this year compared to last year.

>> it is still an el nino winter , and it still means that we can see not only colder storms, but also stronger storms over the next couple of months. so it's a little too early to say that we are going to end this winter with below average snowfall, and with two colder storms expected to bring over a foot of snow to the sierra by the start of next week, the february snow survey could look a lot different than january's dustin dawsey, abc seven news and right now it's smooth sailing. >> if you're heading to tahoe, sunny interstate 80 and highway 50 both clear, so that means no chain controls at the moment. of course, you know, if you've made this trip, it could change instantaneously with a storm that's expected to hit the mountains. so if you're going to make that drive, just be prepared and check out the forecasts. yeah lest we forget, last year, remember yes, tons of rain, tons of snow. yeah. >> and you care about the rain for a whole different reason. >> well, i would like the plentiful water supplies. helps helps our our bill spencer. christian. we need this rain desperately. little concern

there for home water usage. >> is that what we're talking about? let's take a look at live doppler seven. there's lots of water in the area right now and is hitting the ground. as you can see, we're getting wave after wave of steady rain and some heavy downpours. heavy rain right now, still up in the north bay from san rafael down to the golden gate. and you can see there's more of it developing and moving towards san francisco and oakland and other parts of the central bay area. a wider view on the satellite radar composite map shows a several waves wave after wave of moisture moving in our direction, so we'll get little breaks here and there. but it's going to be a wet period of weather tonight and early tomorrow. it's getting gusty as well, especially near the coast and bay. we have gusts right now ranging from 20 to about 2520 six miles per hour. here's a view across the embarcadero where it is wet 55 degrees right now in san francisco, oakland 57, hayward 5961. in san jose, mid to upper 50s at half moon bay and san mateo. and it's wet at the golden gate and breezy there as well. other temperature readings at this hour. 52 degrees at petaluma and santa

rosa, 51 at napa and fairfield, mid 50s at concord and livermore . and these are our forecast headlines. we'll continue to see waves of downpours with gusty wind from time to time during the evening hours. sierra snow. we can expect about 9 to 15in of snow from this storm above 6000ft. and we expect more rain and more sierra snow on friday and saturday as yet another storm develops and moves through the bay area. let's take a closer look at our current storm on the exclusive abc seven storm impact scale. this is a level one storm, so for the remainder of this evening and even into the late night hours, we expect showers, occasional downpours. it will be breezy to gusty at times. and of course we already have wet and slippery roads and those conditions will only get worse. here's the forecast animation starting at 5 p.m. the current wave of downpours will have moved over into well beyond the east bay, out into the central valley by about 7 p.m, but many places in the east bay and south bay will still be getting some pretty good rain at

7 p.m, but a little bit of a pause in the action not to the rain is going to stop, but its intensity will diminish and that will be between now and about between 7 p.m. and about 11 p.m. and then after midnight, we'll see more waves of showers passing through the area, and that will continue through the morning commute tomorrow. rainfall totals by about noon tomorrow. generally about a third of an inch to about three quarters of an inch, and over the sierra we have a winter storm. it alerts in effect from 10:00 tomorrow morning to 4 a.m. on thursday. the heaviest snow will be, of course, in the western slopes where we have the warning. and over in the greater tahoe area and on the eastern slopes, it's a winter weather watch. back to the bay area. low temperatures tonight, mainly mid to upper 40s. highs tomorrow. very narrow range, about 56 to 58 degrees across the entire region. and a high surf advisory will be in effect from 10 a.m. tomorrow to 4 a.m. thursday. wave heights could reach 15 to 23ft. of course, dangerous surfing and swimming conditions. here's the accuweather seven day forecast. we get a little bit of a break on thursday under mostly

9 to 15in of snow from this storm. more a little bit later. larry. >> thank you. spencer in san francisco, the 90 day street vending ban is still in effect. and now multiple street vendors are reporting housing insecurity as a result, abc seven news reporter luz pena has been covering this for months and spoke to a couple now in a shelter and lose joins us live now from the newsroom. louis >> that's right. larry, the mission street vending ban went into effect on november 27th. it's been more than five weeks, and we're now seeing the results. mission street is clean. most of the time, but now several permitted street vendors are blaming the ban for contributing to them, ending up homeless for the last decade, luis and luis ledesma have been street vendors in the mission district. we met them last month setting up their table days before the city implemented a 90 day street vending ban on mission street. during the holidays, the van that transports their merchandise became their home and moved everything. >> sleeping one week in the in the in my bench.

>> after one week in the van with their two year old daughter, the city provided a shelter for them. this was one of their last photos at home. now everything else they own is in a storage unit. they blame the 90 day ban for blocking them from selling outdoors on mission street and ending up homeless. >> i go in the deep sleep in the shelter because no, not have the money for the bed. the rains uh- the supervisor hillary. so move with everything people's. >> he said they used to make $1,300 a week. >> this is my car. >> he showed us the back of their van where they had their holiday inventory ready to sell everything. still in bags, the city opened two sites for vendors to sell indoors on mission street. we went by one of them today. there were only four vendors in a space that has room for over 40, luis said. they tried selling in here, but only made $25 in a week. >> i had a permit. i pay my taxes. i had everything, i followed the rules, the system,

everything. >> supervisor hillary ronen proposed a ban to tackle illegal activity on mission street. santiago lerma is the mission neighborhood street crisis response coordinator. he confirmed that several vendors are now reporting housing insecurity. >> it's very unfortunate if that is what has caused them to lose their housing. um, but, you know, we cannot say that this is not a ban in the whole city. uh, this is ban on one specific street. >> last night, luis ledesma recorded this video of illegal vending still happening on 24th street this morning. >> gone right now the results that we are seeing on mission street are incredible. there's been a very big benefit to the community as a whole. >> luis got emotional because she says they're collateral damage. esperar. i'm just hopeful. that this is not going to last forever either. >> vamos a estar bien. >> now we're gonna be okay in japan, a balloon that reads happy new year.

>> there's no happy. it's no happy new year. it's a terrible new year's. it's not happy. >> and the ledesma family has opened a gofundme account as they hope to get back on their feet. the street vending ban is set to end next month, but the city is looking into extending it and also adding more public works inspectors to the area in the newsroom. luz pena, abc seven news. >> luz, thank you. a new report claims the migration of local tech workers during the pandemic didn't hurt san francisco's status as a tech hub, according to the harvard business review. san francisco remains a significant hub in the tech world, the authors label. it as a meta city. they say meta cities are connected locations that operate as distinct units and are attached to a major, often global, economic hub. in fact, one of the authors told sf gate that san francisco quote remains as the sun on which the planets orbit. well another new report shows california's population decline has slowed to

a trickle. estimates from the state's department of finance show california's population dropped by 37,200 people. that's between the time of july 2022 and june 30th of last year. that's a 0.1% decline. san francisco recorded the highest population growth in the state, up 4700 people. alameda and santa clara counties ranked in the top five for growth. we spoke with the finance department's deputy director about these trends during our 3 p.m. show, getting answers what we see going forward is a return to somewhat normal year over year growth. >> certainly not at the level of the growth that we saw in the peak of the 50s and 60s and 70, to be sure, but slower rates of growth of for a lot of things that are happening demographically that are particular to california, but also happening nationwide. and now one of those things is lower birth rates. >> for context, california's

moment. >> yeah. i don't think you're going to necessarily run faster, but like i said, it gets your attention. and it worked enough for michigan to advance to the national championship. so wait, keep doing what you're doing. >> let us also remember, they're also just very talented athletes. perhaps there's that. >> there's that. >> yeah. but you know, at that level any any little any little advantage, you know, might make a difference. so they're all searching for a little edge. >> yeah. well moving on work and home stress are leaving many people to put off sleep in order to relax. but that might not be what's best for you. as reporter denise dador found out, stressed out folks often stay up way too late pursuing leisure and mindless entertainment that don't really add any positives to one's life. >> the doom scrolling or scrolling thing, um, you know, social media and social media never ends. it can keep going and keep going, doctor roth says. >> that's the procrastination part. the revenge aspect is where you retaliate against the day because you feel you didn't have enough time for yourself. for example, a new parent or someone who has a very busy work

schedule might delay sleep so they can finally relax. while it might feel good at the moment, doctor roth says that lack of sleep will catch up with you in the long terme. >> this can go from a choice, you know. i'm choosing not to go to sleep into an insomnia where i can't fall asleep because if this is something that you do routine early, your body and your brain are going to start to learn. i get into bed and i scroll. >> doctor roth suggests using electronic devices in another room so your bed is not associated with technology. experts also add consider a bedtime ritual like drinking non caffeinated tea and making lists so you can put your worries to bed. >> all right. denise dador reporting i have to say with a small baby at home, i'm very familiar with the 3 a.m. instagram scroll. it's so hard isn't it, dan? like you just want to have something mindless to look at. >> yeah, i know, and it's true. it's easy to. it's an

interesting point she makes about tipping from just won't sleep to can't sleep. but you know sometimes a little mindless relaxation and watching something is enjoyable, especially if you've had a stressful day. but you can get hooked on that in the middle of night on i know and you go to the next thing, go to the next thing, it just keeps on rolling. >> and spencer, i know sometimes after the 11:00 newscast, it's really easy to start a show and then it's like one episode becomes 2 or 3. >> i've been there, done that. yeah, i did that. i binge watched things sometimes not intending to. i'm just going to sit down and watch a little bit. next thing you know, you know, it's 2:33 a.m. they do a good job on those shows of keeping us hooked. >> yeah they do. i got to see what happens. yeah that's right. >> yeah. you get to the last minute and you go, oh no no no, i have to make a decision here. am i going to continue with this or go to sleep this one more episode right uh- americans are cutting the cord and now they're cutting streaming services as well. new research shows customer defections from popular streaming services rose 6.3% in november. that's up

significantly from november of 2022. overall about 25% of all subscribers have canceled at least three streaming services over the past two years. dan, you and i were just talking about this like a week ago, right? what has to happen? essentially, all the streaming is going to resemble what cable television even resembled when it first came on, and there needs to be a bundle and a bunch of these things, you know, companies merge because it's just not sustainable. you're not going to be paying all these services. no. and the price keeps increasing on those too. >> right. and now you're paying. some people are still paying a cable bill, which i am. then you have one, two, 3 or 4 streaming services. and they keep inching up those prices. pretty soon you're paying the equivalent of two cable bills, right? >> yeah. that's right. and i can also imagine too, how many times have you said, oh, what platform does that show stream on. and then the hecticness of trying to find it, spencer, is another problem. >> i had the same problem, and i have a whole bunch of those streaming services you saw on that grid there, along with the cable. it does get pretty pricey, but some of those shows

are so good i don't want to give up the platform. they're on. >> i know it's true, but like larry said, we were we were talking about this at some point. i think they're going to have to bundle them like you do a cable package and you get all these, you pay one fee and you get three or 4 or 5 different streaming services. >> yeah, that would make it more convenient. all right. finally, now more parents are pulling their kids out of school to go on vacation. this was not the case when i was in school. families say traveling during the off season is more affordable. i get that destinations less crowded. some educators are worried about the impact, though, of missing classes and disrupting student routines. the majority of american families still, though vacation during the summer. i don't know. i was always told growing up that school is number one priority, always. anything fun can wait for later, for i don't know where this shift comes from. dan >> you know, i think that's how we grew up and things have changed a little bit, i suppose. but i would say this there's a difference sometimes vacation can be educational, and i think taking a kid out of school for a

week to do something that is, you know, if you're going to take your child to washington, dc and go see the museums and go to other things or take them to europe for the sake of argument and see other cultures, i think that's as good as a week in class, to be honest. you can make up that work if you do it all the time. that's one thing, you know, going off just to go to a resort and sit in the sun, that's a different animal altogether. but you can have educational vacations that are as good as going to school. in my book you can indeed. >> i provided educational vacations for my kids when they were growing up, but we didn't do a ski week. you know, just because we could, right? >> by the way, dan, i can find educational experiences at the beach in the sun very, very easily. so there's that. but i think it's really it's an age appropriate thing. i remember when, you know, when the girls were like, we're in kindergarten first or second or third grade, it wasn't that critical. once you get into, you know, high school years, you miss a week. it really sets you back, especially if you're trying to get ready to apply for colleges. so i think you can keep up, though. >> yeah. for true intellectual stimulation, i go to the sports
