storm is delivering. good evening. >> i'm ama daetz and i'm dan ashley. thanks for joining us. today's storm ranks one on the exclusive abc seven news storm impact scale. it's bringing us wind and rain. and the pitter patter of the raindrops this afternoon in san francisco. the umbrellas came out along the embarcadero. although it appeared some people were caught off guard. >> this is what it was like in the north bay. it was absolutely pouring in. sebastopol this afternoon. and look closely can see a double rainbow in san jose. it's nice. yeah, it certainly is. abc seven news meteorologist sandhya patel is here. >> yeah, she is tracking the rain with live doppler seven. sandhya. >> yeah, and dan. and as we check out live doppler seven, you will notice that just about everyone is dealing with the wet weather. so let's get right to street level radar, and i'll show you where the heaviest rain is falling right now. as we get you into the livermore area.

dublin six 8-80 pleasanton, san ramon, you will notice street level radar. acosta boulevard. we are seeing some downpours. notice right around the 680 junction. it is also coming down pretty hard. livermore 580 las positas road. it's going to be a little bit of a tough go. also seeing some heavy rain right around the peninsula. so when you look at some of these rain rates across this region, we're looking at over three inches per hour. if it holds together. so watch out from san francisco down the peninsula heading into san bruno, highway 101, burlingame. you will notice some light to moderate rain. california drive. and in the north bay we are seeing the steady rain across parts of yountville. silverado trails. so it is definitely going to be a soggy night ahead with the south bay beginning to see some of that rain as well. from san jose to the santa cruz mountains. as we widen the picture here, this level one storm has been responsible for lightning off the northern california coast. so we're going to put it in the

on the embarcadero. it's the department's first line of duty. death in more than a decade. abc seven news reporter anser hassan in oakland got reaction to news of the arrest at the oakland police department, says several arrests were made over the weekend in connection to friday's shooting. >> that killed officer tuan lay has been extremely, extremely difficult, especially, you know, new year is a time that you want to celebrate with your family, carl chan is president of the oakland chinatown foundation. he knew officer lay personally. he says the family is still coping with the sudden loss, but they are thankful arrests have been made. >> these people are being uh, you know, killing and hurting people would not be on the street hitting other people. so the family members are very, very, uh, happy that, you know, they are no longer out there hurting other people. >> the oakland police officers association confirming that members of the united states marshals service arrested a key suspect in livermore. >> they can see that, um, the work has been done by the police department and especially they

want to thank all the police departments from all across, not only from opd, but, uh, for those, uh, have been involved. >> this was happening during another incident of, uh, you know, property crimes. and for our communities to be afraid that they're going to be the next victim and that our officers might not be safe. it sends fear into the community. >> doctor jennifer tran is president of the oakland vietnamese chamber of commerce. she says these arrests are helping the community to heal. >> it really hit home not only because he was vietnamese american, but he really exemplified what it is that we're trying to strive for here with our public safety, right? and for our police officers to be from oakland, to be rooted in our community. >> reporter in a statement, the oakland police department says this is just the beginning of a lengthy legal process. we are hopeful that it will start the healing for officer lee's grieving family and our entire opd family in oakland, anser hassan. abc seven news.

abc7 news i-team and released in the latest citywide crime report. as of late december, show robberies are up 38% from 2022. but when compared over the last decade, are actually down slightly. burglaries are up 23% and motor vehicle thefts are up 44. both stand out to be at the highest rate we've seen since 2013. burglaries towering over the last spike seen in 2019, with nearly 15,000 reported to more than 75,000 reported in 2023, and motor vehicle thefts steadily rising since 2020. as for homicides, there were 92 in 2013 and that went up to 126 last year. all of this comes as residents demand a state of emergency. >> it's just chaos and the city of oakland just cannot afford the chaos. >> retired alameda county judge brenda hardin, 40, was removed from the oakland police commission by mayor xiang tao. she says a year without a police chief is unacceptable. i like to

say that this mayor has blood on her hands and we just can't afford to have her in office any longer. in september, mayor tao said she would declare a state of emergency if a new police chief is not selected by the end of the year. instead last week, she rejected the three recommendations made by the police commission, delaying the process until march. >> it's been just a laziness and a lack of urgency to get a new police chief to restore public safety to oakland, seneca scott, the executive director for neighbors together oakland, who's also pushing to recall the mayor, says the delay in the search is costing taxpayers. i may have spent over $100,000 on consultants over the past, which is only continuous been delayed. >> the i-team asked the mayor's office how much money was spent on consultant fees for the ongoing search for a police chief, but we're still waiting to hear back. now, speaking of cost, oakland is also ranked as one of the us cities with the

highest cost of crime per capita , according to a recent report analyzing fbi crime data. oakland is ranked 12th on the list, with an average per capita crime cost of more than $5,700. now, that's higher than both philadelphia and atlanta, which are both bigger cities. exactly right. so it puts it in perspective. >> okay. thanks, stephanie. >> absolutely. >> and we want to make sure that you have the full picture of crime where you live with the abc seven neighborhood safety tracker shows you a wide range of public safety statistics over the years for san francisco, oakland and san jose. you will find it on abc seven news.com. >> new details on an issue we've been following since november. a 90 day street vending ban in san francisco. a number of vendors now say they're having trouble keeping their homes as a result. abc seven news reporter luz pena spoke with a couple who is in a shelter. she's in the newsroom now with the story. luz >> that's right. dan. the mission street vending ban went into effect on november 27th. it's been more than five weeks, and we're now seeing the results. mission street is clean. most of the time, but now

several permitted street vendors are blaming the ban for contributing to them, ending up homeless. for the last decade, luis and luz ledesma have been street vendors in the mission district. we met them last month setting up their table days before the city implemented a 90 day street vending ban on mission street. during the holidays, the van that transports their merchandise became their home. >> i move everything, we are sleeping one week in the in the in my bench. >> after one week in the van with their two year old daughter, the city provided a shelter for them. this was one of their last photos at home. now everything else they own is in a storage unit. they blame the 90 day ban for blocking them from selling outdoors on mission street and ending up homeless. >> i go in the deep sleep in the shelter because no, not have the money for the rents. uh- the supervisor are hillary. so moving everything people's louise said they used to make $1,300 a week. this is my car.

>> he showed us the back of their van where they had their holiday inventory ready to sell everything. still in bags, the city opened two sites for vendors to sell indoors on mission street. we went by one of them today. there were only four vendors in a space that has room for over 40, luis said. they tried selling in here, but only made $25 in a week. >> i had a permit. i pay my taxes. i had everything i followed the rules, the system, everything. >> supervisor hillary ronen proposed a ban to tackle illegal activity on mission street. santiago lerma is the mission neighborhood street crisis response coordinator. he confirmed that several vendors are now reporting housing insecurity. >> it's very unfortunate if that is what has caused them to lose their housing. um, but, you know , we cannot say that this is not a ban in the whole city. uh, this is a ban on one specific street. >> last night, luz ledesma recorded this video of illegal

are no chain controls at this time. however, that could change in just a matter of hours when a winter storm warning takes effect. >> well, today's snow survey, the first of the year, revealed really a dismal report, unfortunately. but as abc seven news south bay reporter dustin dorsey explains, no reason to panic. >> it wasn't exactly a white christmas and not much of a white new year either. in the sierra, a little different look to the annual california department of water resources snowpack survey from the record breaking 2023 report here at phillips station last winter, they were standing on almost five feet of snow, but now the survey today recorded a snow depth of 7.5in and a snow water content of three inches. >> that results in 30% of average to date. and 12% of the april 1st average here at this location across california, the statewide snowpack sits at 25% of average to date, compared to 177% january 2023. >> and abc seven news meteorologist drew tuma says it's not just california who's

not seeing the snowy conditions the country as a whole, december temperatures were well above average across the entire lower 48, and we saw very minimal snow. >> like you said, only about 20% of the country has some sort of snow on the ground right now. >> locally here in the south bay, a low snowpack is never a good thing for santa clara valley water district, who imports more than 50% of their water from outside of the county, including from the sierra. but with our true wet months here in northern california still ahead, there's not much reason for too much concern just yet because we had such a robust winter last winter and our allocations were at 100% for both the federal and state programs. >> um, our water supply situation is in a much better place this year compared to last year. >> it is still an el nino winter , and it still means that we can see not only colder storms, but also stronger storms over the next couple of months. so it's a little too early to say that we

are going to end this winter with below average snowfall, and with two colder storms expected to bring over a foot of snow to the sierra by the start of next week, the february snow survey could look a lot different than january's. >> dustin dawsey, abc seven news so there's always hope. >> there is absolutely. and we are getting some rain here. >> we are. meteorologist sandyha patel tracking that for us. sandhya. >> yes. and dan and amna we are seeing the winds picking up in the sierra right now. take a look at a live picture from zephyr cove where the wind is blowing. light snow at blue canyon right now. flurries being reported in truckee. so let's check out the sierra snowpack as dustin just mentioned. first survey of the season done statewide, the snowpack is at 25% of average. but at the phillips station it is 30% of average with a snow depth of 7.5in. it is too soon to say what's to come because we are in a strong el nino year. that does not guarantee that we're going to see a snowy season or a lot

of rain, but there is potential for more storms to come because we do have winter to go several more months. so we do have a winter storm warning for the sierra that starts at 7:00 tonight. it runs until 10 p.m. tomorrow. we're talking about 10 to 19in of snow above 4000ft. up to two feet for the highest peaks. when you combine that with the gusty winds, it's going to be hard to get over the west slope of the sierra into the tahoe area. very difficult travel carrier chains and prepare for delays. the tahoe side going under a winter weather advisory starting at 7:00 tonight. here's a look at the area of low pressure off the coastline. we've been seeing those lightning strikes just off the coast. snow in the mountains right now, falling in the sierra as well. and here in the bay area, of course, we are tracking rain. so let's get you in to the local radar here and get you into street level radar where it is coming down. so we are looking at danville, san ramon, al costa boulevard out towards blackhawk, diablo road. watch out because it is pouring lighter rain from san jose to

willow, glempll area. and as we pan around to other parts of the bay area, fairfield right now the cordelia area, you are noticing some moderate pockets of rain from san bruno heading down the peninsula into san mateo. right now, belmont, san carlos, san carlos avenue seeing some downpours. here's a live view from sfo camera where we are seeing arrival delays right now of about a half an hour due to the wind and the rain, temperatures right now from san jose camera, you can see just a gray sky with rain. santa rosa at 52 degrees along with napa concord 53. and here's a live view from our kgo roof camera, where the roads are slippery. headlines tonight. downpours at times. gusty winds, winter storm warning for the sierra snow above 4000ft. believe it or not. and an unsettled pattern for later in the week. so the snow levels initially will be higher tonight, but they drop down to about 4000 overnight level one storm tonightrillionain briefly heavy at times, breezy to gusty

surf will be building and there is a slight chance of thunder. so 7:00 tonight. pretty widespread rain across the region. we're going to see some pockets of moderate to heavy rain around 9 p.m. this continues at 11 p.m. and i would not be surprised if we start to see a little bit of rain. snow mix over mount hamilton late tonight as we head towards tomorrow morning. still some damp roadways due to those scattered showers, so plan accordingly. the showers will be mainly in the morning, but an isolated pop up shower in the early afternoon. not out of the question. rainfall additional rainfall i should say, will be between a quarter to a half an inch. some of the higher elevations and wettest spots picking up about an inch or so before all is said and done. right now, wave heights are 2 to 10ft. a high. surf advisory is going to go up at 4:00 tomorrow morning as the storm is kicking up the swells, it runs until 4 a.m. thursday. large breakers 19 to 23ft means dangerous swimming and surfing conditions. so stay back, stay off the rocks and jetties and never turn your back to the ocean. you know the

busy yellow line in the east bay after a train derailed and caught fire monday morning. bart officials say investigators are still trying to determine exactly why two cars jumped the tracks near the orinda station, sending nine people to the hospital with minor injuries. lots of things could come out that we don't know right now, but what we believe right now is it was not a track issue. >> it was not a train issue. what we are left with and what what most of what we know points to is human error. >> if human error is indeed to blame, there will be changes, including new training and new protocols. this was the fifth bart derailment in the last 15 years. all happened in the east bay. well bart increased fares in the new year, but there's also now a bigger discount for riders through clipper start. it's a program for low income people that gives 50% off bay area transit services, including bart, to get a clipper start card, you must be an adult living in the bay area. there are income limits. keep that in

it's going to be dicey getting around right now as it is drencher across parts of the bay area. not everywhere, but seeing some moderate to heavy rain across blackhawks and ramon crow canyon road. you will notice right around danville. high surf advisory starts at 4:00 tomorrow morning, runs until 4 a.m. thursday with those breakers 919 to 23ft. those wave heights are building. keep that in mind. it's a level one storm for tonight. rain briefly heavy at times, breezy to gusty. surf builds and a slight chance of thunder. i'll be back with a look at that timeline coming right up. ama dan thank you sandhya. >> the avian flu is hitting california hard. more than 3 million birds have been euthanized. at least a third of those in sonoma county alone. >> now, the first sonoma county outbreaks were detected in petaluma one month ago. at that time, 250,000 birds were put down that number has since quadrupled. >> abc seven news reporter suzanne fawn has an update. >> it's a busy kitchen at mr. mom's cafe in petaluma. the eggs are always a hit.

>> the eggs have always been good here. >> petaluma is known for producing eggs. >> this used to be the egg capital of uh- cal, but the avian flu has changed a lot. >> it really is devastating and it's crippling our entire poultry industry in sonoma county. >> the avian flu has hit sonoma county's $50 million poultry industry. really hard so far, more than a million birds have been euthanized since thanksgiving week. several local poultry producers have been euthanized. chickens and ducks because of the avian flu. there were two more outbreaks in sonoma county last week. >> there's going to be an effect on the market. we're going to see perhaps eggs not available in the market. we may see the price of eggs increase. >> i was shopping yesterday at lucky's here in petaluma and they had no eggs. none not an egg on the shelf in the bay area. >> there's a lot of wonderful restaurants that rely on local duck production and ultimately right now, that production has completely ceased. >> there's been an outpouring of financial support online for

liberty ducks family farm. it provides ducks for many bay area restaurants, according to the california poultry foundation. the losses statewide in the past two months have been staggering. >> well, california, we've lost, um, probably over 3 million so far. egg layers, uh- chickens, uh, ducks, turkeys. >> what's being done to protect these birds? >> basically, the farms are locked down and that we don't let people in and out of the facilities. liz. >> the california poultry federation says poultry producers are taking extra measures to protect their birds. but the warning extends to backyard chickens. >> people own backyard chickens and they can get wiped out even if they only have five chickens. so they've got to be sure when they go into their backyards every morning. they have clean clothes, clean shoes, clean everything because otherwise that can spread to the neighbor, etc. >> in petaluma, suzanne phan abc seven news ace train hit and killed a bicyclist in fremont

today. >> sky seven was over the scene this morning near the train tracks at auto mall parkway. we've not yet learned the name of the victim. union pacific railroad is investigating. a former rock musician has been arrested in connection with the murder of his ex-girlfriend, capitola. police released this image of theo lengyel being taken into custody this morning. he's also known as milo stone and is an ex-member of the rock band mr. bungle. the 54 year old is accused of killing his ex girlfriend alex herman, who went missing on december 3rd. her remains were later found at tilden regional park in berkeley . authorities launched a search for lengyel after he was identified as a person of interest. in this case, he has since been booked into santa cruz county jail. >> san francisco's da's office filed misdemeanor criminal charges today against a former city building inspector. van zeng is accused of signing off on an inspection of his own home , as well as two projects involving his father's construction company. zeng pleaded not guilty. today, he

faces up to a year in jail if convicted. the president of harvard university has decided to step down after just six months and two days on the job making it the shortest presidency in the university's history. claudine gay announced her resignation today in a letter to the harvard community. it comes after growing allegations of plagiarism and criticism over her response to anti-semitism on campus. there's no decision yet on who will serve as interim president overseas. >> now in japan, a passenger plane and coast guard plane collided, bursting into flames. everyone on board the japan airlines jet, 367 passengers and 12 crew is okay. thank goodness they evacuated before flames engulfed the entire plane. five people on the japanese coast guard plane, however, were killed. only the captain made it out alive. the collision happened at haneda airport in tokyo around 6 p.m. local time, as the japan airlines jet was landing. it's a rare incident given japan airlines impeccable safety record.

>> the airplane did its job here . what we think what happened is that this was a pilot error. somebody probably on the japanese coast guard side uh- taxied onto that active runway when they weren't supposed to. >> that coast guard jet was preparing to deliver earthquake relief supplies. and on that subject, at least 57 people died in the magnitude 7.5 quake that hit japan on new year's day. it flattened buildings, severed power lines and triggered a tsunami warning. those have all now been lifted. and the focus now is on the search for survivors. people are still being jolted by aftershocks. 147 and counting, although most are very small. seismologists say the shaking could continue for months. >> japan has about three times as many earthquakes as california because it's sitting at a very complicated part of the plate tectonic puzzle, where four plates come together water

starting the new year with an increase in their social security benefits. the annual cost of living adjustment is 3.2. that comes out to an average of more than $50 per month. however it is a much smaller increase compared to the past two years, and with the new year, the cost of wine and liquor in california is a few cents higher. >> that's because of a new crv deposit, but californians already pay 5 or $0.10 on nearly all bottled beverages, as the cost depends on the size of the container. a bottle of wine now has a ten cent crv deposit. small bottles add $0.05, but wine has a 25 cent crv deposit. you can get the crv money back, but you have to take the containers to a recycling center, which can be hard to find and near you. and with the new year, a crv deposit is also being added to large sizes of fruit and vegetable juice containers. as well, and you can find out what else changed in the new year with this article about california's new laws. there are a lot of them. it's on the home page of our website,

bit. >> meteorologist sandhya patel is back. sandy. >> yeah. through tonight, at least. you'll be seeing the wet weather and some showers tomorrow morning. so dan and anna, let's take a look at live doppler seven. right now i'm going to get you into the street level radar, where we're seeing some pockets of moderate rain right around tassajara blackhawk , 680 san ramon, heading across dublin. 580 and across the south bay. we are seeing some downpours. santa clara, san jose, some heavy rain falling also right around los gatos. as you will notice, highway nine and the santa cruz mountains is seeing some steady moderate to heavy rain at times right now in the north bay, it is lighter right around penngrove and petaluma tomales road. it's a level one on our storm impact scale. rain briefly heavy at times, breezy to gusty. the strongest winds are over the hills with the surf building and a slight chance of thunder. we're going to go hour by hour. 730 tonight. you see the widespread rain. this continues at 930. could be a little bit of snow mixing in with rain at 1130 over mount hamilton and some of the higher elevations in the

north bay. so don't be surprised if you do see that as that colder air filters in scattered showers tomorrow morning between five and about 9 a.m, and then we'll go with maybe an isolated chance. and that's about it. our biggest storm concerns for tonight. standing water on the roadways, a high likelihood localized flooding in that medium category. power outages. low and sierra snow high. category winds right now gusting to 30 miles an hour in the oakland hills. your temperatures in the 40s and the 50s. so not terribly cold. and as you look at live doppler seven, some lightning strikes off the bay area coastline, which is why we have it in the forecast. but we also have some snow coming. so through tomorrow night, looking at about 12in donner, 14in at blue canyon. you add the additional snow that's coming. and by this weekend we could be talking about 40in at kirkwood blue canyon, 25in tomorrow afternoon. highs will be in the 50s, primarily 49 at lakeport. and the accuweather seven day forecast keep the umbrellas handy tomorrow morning. we do have scattered showers with a
