will sweep across the region. you can see we are having heavier showers and parts of the north bay along the coast, and will be in and out of the showers until about 10 a.m. this morning. here's the storm impact scale. we're at a level one through 10 a.m. we have scattered showers that will create some slick roads. as you go about your morning commute. there's a slight chance of thunderstorms as well this morning, and also that high surf advisory. rough and dangerous surf along our coastline today. so here's future weather we'll be in and out of the showers throughout the morning, then after 10 a.m, we're drying out, but it is a chilly day. temperatures only in the 50s. that's a look at the forecast. let's see how we're doing with the roads. and gloria good morning. >> good morning drew. well right now we want to tell you about a closure. the wet weather was considered a factor in an overturned big rig that was carrying gasoline. and it happened northbound on highway one just north of jenner. you could see the video right here. and chp says that none of the 8500 gallons of fuel leaked, and no one was injured in the crash. they advised that the road will be closed while they offload

that fuel onto another tanker truck and clear the scene, so we'll have more updates for you on that throughout the morning. guys >> thank you. gloria. well, as drew just mentioned, the high surf advisory means dangerous swimming and surf conditions. abc seven news reporter lena howland in pacifica this morning. but we could see some pretty big waves and powerful waves today. lena kumasi. >> that's right. good morning to you. and we are certainly already hearing the power of those waves crash into the seawall here at the pacifica pier, right behind me and with today's uh- with today's high surf advisory, which just went into effect about an hour ago, the national weather service says they're bracing for waves up to 23ft high. now, today's advisory comes after high surf conditions last week led to evacuation orders and warnings in marin and santa cruz counties, as well. here's a look at some of the aftermath in capitola on the village esplanade, though the damage to the village was not as extensive as last january's high surf

oceanfront businesses still took big hits from the high waves. many of those business owners agree that the hammerings they've been getting are not getting any better. they told us last week they're taking extra precautions to getrillioneady. >> the storms just get worse and more frequent. um, we're installing storm hurricane doors across the back of the restaurant just in preparation for the next one. with today's high surf advisory, along the central and northern california coast line, remember that means dangerous swimming and surfing conditions and some localized beach erosion. >> ian, now the national weather service is also warning people to stay off of rocks and jetties and also to keep yourself and keep your pets away from the water as well. for now, reporting live in pacific, ca lena howland abc seven news. >> thank you lena. now let's take a live look from our camera at zephyr cove. this is in lake tahoe. you can see there is snow coming down. interstate 80 has

turned into a real mess. eastbound traffic is being held at applegate because of spinouts. people heading west need chains just outside of reno on highway 50. chains are required east of placerville to myers and the sierra needs all of this snow. yesterday they had that snow survey. it revealed the snowpack is at just 25% of the historical average for this time of year. and don't forget, you can track the forecast with the same live doppler seven that drew and our weather team uses. just search abc seven bay area and your devices app store to download. >> we're learning a bit more about the arrests made in connection to the killing of oakland police officer tuan lay. he was shot and killed near jack london square last week. lay was working undercover, responding to an early morning cannabis shop burglary. oakland police say they made several arrests but have not said exactly how many people are in custody. abc seven news has learned one suspect was tracked to an l.a. excuse me, a la quinta inn in livermore, and arrested early yesterday morning. barry donilon

is the president of the oakland police officers association. and he says since the shooting, opd has been working nonstop to try to catch those who are responsible. the decision to charge those suspects will now be with alameda county district attorney pamela price. >> i think they understand and the importance of charging the people who killed an oakland police officer or anyone attached to them committing crimes in the city of oakland. >> in a statement, oakland police said the investigation is still ongoing and they will not stop until all those responsible are brought to justice. officer lay is the department's first line of duty. death in more than a decade, and bart is promising to make changes if the investigation into monday's derailment confirms human error was to blame. >> early on, bart said it started with an issue with the computer system that controls track switching. it prompted the train operator to exit the train near the orinda station and manually align the tracks. when the operator got back on the train and began accelerating,

two cars jumped the tracks. investigators are looking into every possible cause for the derailment. lots of things could come out that we don't know right now. >> but what we believe right now is it was not at a track issue. it was not a train issue. what we are left with and what what most of what we know points to is human error. >> if human error is indeed to blame, changes would include new training and new protocols. this was the fifth bart derailment in the last 15 years. all of them in the east bay. >> your voice, your vote. former president donald trump has officially appealed maine's decision to bar him from the state's primary ballot. gray is at the live desk with the legal battle just weeks ahead of the iowa caucuses. >> gloria, good morning, kumasi and their appeal. donald trump's legal team is arguing that maine secretary of state has no legal authority to keep him off the ballot. now, maine cited the 14th amendment insurrection clause as the reason, but trump's legal team is arguing that the clause bars people from

holding office but does not keep them from running or being elected to office. this comes as iowa's caucus is less than two weeks away. trump still holds a considerable lead in the polls, despite refusing to attend any debates. republican candidates have blasted his decision before the caucuses, and he's running on things like deporting illegals and building a wall. >> but he did that in 16 and didn't get it done. so i think he owes answers to those questions. >> as of yesterday, abc news partner fivethirtyeight shows trump is averaging about 50% support in iowa. ron desantis trails behind at roughly 18, while nikki haley is third in the lineup at close to 6. now, as for president joe biden, he is set to ramp up his reelection campaign. his first event is this weekend, marking three years since the capitol attack. the president is expected to deliver remarks on democracy and also on freedom. drew. >> hey, gloria, we'll take a

look at live doppler seven this morning. we are waking up to showers. we'll take a tour and press in a little bit closer. we have a heavier downpour. we're working through el cerrito on its way into the east bay. some lighter showers in the north bay . we have some lightrillionain over the city, some scattered light showers along the peninsula for the most part, the south bay you're dealing with mostly cloudy conditions, a little bit of drizzle, but we'll be in and out of the showers through at least 10 a.m. this morning. a high surf advisory is currently in effect until 4 a.m. tomorrow, where we could see waves up to 23ft. we're already seeing waves at 15ft across bodega bay, so we see localized beach erosion and the increased risk of rip current. it is chilly out there this morning with thatrillionain falling. we are sitting in the 40s right now. it's a level one through about 10 a.m. this morning, so it just leads to a pretty slick morning commute. take the umbrella this morning. this afternoon you will not need it. here's a live look outside from our exploratorium camera showing you those drops on our lens. and here's how the day shapes up. we'll have scattered showers

ever. the president of harvard university has stepped down after just six months and two days on the job. that makes it the shortest presidency in the university's history. claude guay announced her resignation in a letter to the harvard community. it comes after growing allegations of plagiarism and criticism of her response to anti-semitism on campus. >> today, house speaker mike johnson and a group of republican lawmakers are planning to visit the southern border to see the situation there for themselves. the visit is happening as texas continues to send busses filled with migrants to cities across the country. now, four suburbs near chicago are taking action. here's abc news reporter ike ejiochi. >> returning from his holiday trip in the caribbean, reporters asked president biden about the record number of migrants at the southern border, something they are. >> give me the money i need to protect the border. a white house official says negotiations on border funding are moving in the right direction, even as

republicans insist new aid for ukraine be tied to increased us border security. >> today, house speaker mike johnson, along with 60 other republican lawmakers, are set to visit the border in texas. the influx of migrants is now hitting american suburbs far from the border. hundreds of migrants were dropped off at bus and train stations outside new york city after mayor eric adams issued an order requiring busses carrying migrants into new york give 32 hours notice. a similar situation in chicago, where four suburbs passed an ordinance last night prohibiting the transport of large groups of people without an approved application before we begin busing illegal immigrants up to new york, it was just texas and arizona that bore the brunt of all of the chaos. >> now, the rest of america is understanding exactly what is going on. >> since 2022, texas governor greg abbott has bussed more than 80,000 migrants from texas to so-called sanctuary cities.

>> what texas is doing is bonkers. >> mayor adams administration furious with abbott even comparing him to the joker in the dark knight. >> there's a line in it that some men can't be reasoned with or negotiated with. some men just want to watch the world burn. greg abbott is that man. >> mayor adams says he does not want to revoke new york's sanctuary city status, but does not want to be required to shelter the migrants. now, here's some good news. border authorities say the high level of migrant crossings has gone down in recent days, allowing them to reopen for border crossings tomorrow. i ejiochi abc news, washington in new developments with the man charged in the killing of rapper tupac shakur, a bail hearing has been postponed because prosecutors say one of the witnesses may be at risk. >> duane keith davis was seeking to be released ahead of the june trial. however, prosecutors say a telephone, recordings and a list of names given to his family members show that davis

>> that's like a little muppet. >> well, if you're walking your dog today, good luck. yeah this morning too. >> yeah. those folks who look outside like, oh, man, it's gonna be a short walk this morning. we are tracking rain live doppler seven showing you those showers are at the bay bridge toll plaza this morning. a live look outside showing you it is wet as people cross into the city. we'll show you live doppler seven over the past hour, there's a line of showers that is currently crossing through us. once this initial line moves through this morning, it's just a couple of scattered showers behind. it will keep the wet weather in the forecast through about 10 a.m. after 10 a.m, we'll get a north wind drying us out and that will lead to a dry afternoon. we are getting snow in the sierra. a winter storm warning currently in effect through tonight. our highest peaks could pick up up to two feet of snow. we love to hear that this morning it's a level one for those scattered showers. there's a slight chance of a thunderstorm popping up through 10 a.m. we also have a high surf advisory along our coast for rough and dangerous surf. here's future weather this

then a look at our drive times for this morning so far things are looking pretty good except the usual slow spot on westbound 580 from tracy to dublin. that will take you 36 minutes. >> thank you. gloria watch out for big waves along the coast today, some as high as 23ft. drew has been telling us about this high surf advisory in effect, and abc seven news reporter lena howland is in pacifica to see it herself. hi, lena. >> hey, reggie. good morning to you. this is another day when the ocean is not going to be your friend out here. and this wild weather also has beach boulevard blocked off here behind me, both for flood concerns and safety concerns as well. now, today's advisory comes after high surf conditions last week led to evacuation orders and warnings in both marin and santa cruz counties, as well. high surf crashing into this stinson beach neighborhood thursday, filling streets with seawater in a matter of minutes. the storm surge envelope in most of the beach could be seen coming dangerously close to homes. about a half dozen

streets were flooded. here's what two homeowners told us during the storm last week. >> there was a mandatory uh- evacuation. >> and so what are you doing? >> i'm evacuating. my house is built up a story up, so i'm not concerned about the house. i've been through heavier ones than this with no damage. so i'm sure we'll be okay. we're just trying to barricade to make sure that we're in better hands than last year. >> i, with today's high surf advisory along the central and northern california coastline, remember, that means dangerous swimming and surfing conditions and some localized beach erosion . >> now, the national weather service is also warning people to stay off of rocks and jetties and to also keep yourself and pets away from the water. and it's also a good reminder to try to avoid this area along beach boulevard, just outside of the pacifica pier. as it as it's all blocked off. live in pacifica lena howland, abc seven news thankfully, you can track the forecast with the same live

doppler seven that drew and our weather team uses. >> just search abc seven bay area in your device's app store to download. >> we're hoping to learn more soon about the people now in custody in connection to friday's deadly shooting of an oakland police officer, according to the oakland police department, officers made the arrest and officer tuan lays killing. over the past few days, including a key suspect in livermore. now, their names haven't been released. the president of the oakland vietnamese chamber of commerce says the arrest will help the community heal. >> it really hit home not only because he was vietnamese american, but he really exemplifies what it is that we're trying to strive for with our public safety right, and for our police officers to be from oakland, to be rooted in our community. >> oakland police released a statement saying the arrests are just the beginning of a lengthy legal process. yes, they're hoping that it helps start the healing process for officer lei's family and the department.

>> as oakland approaches a full year without a police chief, certain violent crime and property crime is rising. the abc seven news i-team analyzed new data released in the latest citywide crime report. as of late december, burglaries are up more than 20. motor vehicle thefts are up more than 40, and as for homicides, there were 92. in 2013 that went up to 126 in 2023. in september, mayor shang tao said she would declare a state of emergency if a new police chief isn't selected by the end of the year. but last week, she rejected the three recommendations the police commission made. that means the process is delayed until march. >> it's been just a lazy and a lack of urgency to get a new police chief to restore public safety to oakland. the i-team asked the mayor's office how much money was spent on consultant fees for the ongoing search for a police chief, and we are still waiting to hear back.

>> developing news on the airport disaster in japan. a passenger plane collided with a coast guard plane and it burst into flames. gloria we are now learning how everyone aboard the japan airlines plane escaped. >> we are kumasi horrifying moments at tokyo's haneda airport, a japan airlines passenger jet burst into flames yesterday after slamming into a coast guard plane. five of the six members on board that coast guard plane died all 379 people on the jet escaped within 90s before it was engulfed. passengers were safely evacuated onto emergency slides. japan airlines says that the crew directed people using megaphones because the onboard speaker system was not working. experts are praising the quick evacuation, with passengers following instruction and also leaving their personal belongings behind. they say this type of plane is made with special material to stop fire from rapidly spreading inside the cabin.

>> it was very fortunate that the collision did not rupture the fuel tanks on the jal aircraft, and so the fire that you saw was fairly well contained. well, after the airplane came to a stop that gave the passengers enough time to get off and get away from the airplane before the fire consumed the rest of the hull. >> the investigation will focus on communication between the control tower and the pilots to find out why the smaller plane was is on the runway, japan airlines says their crew had been given permission to land. now, as for the french made airbus, it is a total loss. french specialists are headed to japan to assist in that investigation. reggie >> thank you gloria. at least 57 people are now confirmed dead after the magnitude 7.5 earthquake hit japan. new year's day. it flattened buildings, damaged power lines and triggered tsunami warnings. those warnings have now been lifted. the focus now is on the search for survivors. people are still being jolted by aftershocks. there have been 147

his latest piece that you see here, it's about nine feet tall and weighs about 600 pounds, and it's made completely of metal, pieced together by wells, rosenberg says. he brought it outside to rust. he says that's necessary for the design, even bolted it to the ground to prevent it from being damaged. >> did you think somebody was going to be able to move it the way that? no, i really didn't think that someone was going to come with a pickup truck and drag it out of here. >> wow. okay. so look at this surveillance video. you can see this white pickup driving by and parking outside the studio, and then somebody just gets out, puts the sculpture on the back of the truck and leaves. rosenberg says he's hoping to have it back soon. he's filed a police report, and he doesn't want all the time spent on making it going to waste. >> happening now a danger advisory, in effect for a lake in the east bay. state water officials posted the advisory for lake duvall and alameda county. they're warning people to stay away from blue green

algae blooms in the lake. exposure to toxic algae can cause rashes, skin and eye irritation, stomach problems, and in rare cases, even serious illness or death. no word yet on how long that advisory is going to last. >> all right, check this out. an old bomb washed ashore in santa cruz county. it happened at the pajaro dunes on new year's eve. the bomb squad was called out as a precaution, but they quickly deemed this safe. they removed it from the beach. the beach was one of the places that evacuated last week during those huge waves and the high surf warnings . >> some street vendors in san francisco's mission district say they are now home less because of a 90 day street vending ban. the ban has been in place on mission street for more than five weeks now, although i have to tell you, i was at the 16th street station last night and the night before. that's back. the illegal vending is definitely back. this is supposed to be tackling illegal activity in the area. we spoke with one couple who's been doing street vending for the past decade. they say they used to

make $1,300 a week. they tried to sell indoors at one of the two sites. the city opened. they said they only made $25 in a week. they started living in their van with their two year old daughter because they couldn't pay the rent. the city ended up giving them, getting them into a shelter. a week later. >> i had the permits, i pay my taxes. i had everything. i followed the rules, the system, everything. >> it's very unfortunate if that is uh- what has caused them to lose their housing? um, but, you know, we cannot say that this is not a ban in the whole city. uh, this is a ban on one specific street at the street vending ban is set to end next month, but the city is looking into extending it and also adding more public work and works inspectors to that area. >> the changing population of california y likely won't affect the bay area. and what a new study finds that san francisco is becoming. chris is over, but

mr. bungle. the 54 year old is accused of killing his ex-girlfriend alex harriman, who went missing december 3rd. her remains were found at tilden regional park in berkeley. authorities launched a search for lengyel after he was identified as a person of interest. he has since been booked in a santa cruz county jail. >> we're learning the price of eggs may be going up. it's related to the avian flu that's hitting california really hard right now. in sonoma county, outbreaks were detected in petaluma a month ago forcing 250,000 birds to be put down. and now more than a million birds have been euthanized since thanksgiving week. several local poultry producers have been euthanizing chickens and ducks because of avian flu. there were two more outbreaks in sonoma county last week. >> there's going to be an effect on the market. we're going to see perhaps eggs not available in the market. we may see the price of eggs increase in the bay area. there's a lot of wonderful restaurants that rely on local duck production and

2022 and june 30th of last year, and that is a 0.1% decline now, san francisco has recorded the highest population growth in the state, up 4700 people. alameda santa clara county is ranked in the top five for growth. we spoke with the finance department's deputy director about these trends on our 3 p.m. show, getting answers what we see going forward is a return to somewhat normal year over year growth. >> certainly not at the level of the growth that we saw in the peak of the 50s and 60s and 70s. to be sure, but slower rates of growth, um, for a lot of things that are happening demographically that are particular to california, but also happening nationwide. >> now, one of those things is lower birth rates. for context, california's population declined by some 295,000 people during the first full year of the pandemic 2020. over all, california's population now
