because the sun will peek out later on today. a level one until 10 a.m. this morning. for those scattered showers thatrillionough surf along our coast. even the slight chance of a thunder shower until 10 a.m. so here's that isolated chance. by 9 a.m. we're drying out midday. it's breezy, bright and brisk today, temperatures staying in the 50s for daytime highs. that's a look at the forecast here on the roads with gloria. good morning. yeah. >> you know drew right now we do have some slick roads. but the good news is we're not seeing any major issues because of that. but look at this camera right here. they're hard to even see on the road because of the rain on our camera right there. this is a bay bridge toll plaza and the metering lights did flip on at 541 this morning. keep in mind chp has issued a high wind advisory for the bay bridge, so be careful when you're driving out there. and then also, if you're taking bart, there are some delays today because of the wet weather. trains are running at slower speeds this morning. thank you gloria. >> well, as you just mentioned, that high surf advisory. it

means danger for swimming and surf conditions. abc seven news reporter lena howland in pacifica this morning, where we could see some pretty powerful waves today. lena >> kumasi. that's right. and we are certainly already hearing the power of those waves crash into the seawall here at the pacifica pier right behind me. and with today's high surf advisory, which just went into effect about two hours ago, the national weather service is expecting large breaking waves up to 23ft high. and with today's advisory comes today. this advisory comes after high surf conditions last week led to evacuation orders and warnings in marin and santa cruz counties. here's a look at some of the aftermath in capitola on the village esplanade, though the damage to the village was not as extensive as last january's high surf oceanfront businesses still took big hits from the high waves. many of those business owners agree that the hammerings they've been taking are not getting any better. they told us last week.

jack london square last week. lay was working undercover, responding to an early morning cannabis shop burglary. oakland police say they made several arrests but haven't said exactly how many people are in custody. abc seven news has learned one suspect was tracked to a la quinta inn in livermore and arrested early yesterday morning. barry donilon is the president of the oakland police officers association, and he says since the shooting, opd has been working nonstop to try to catch those responsible. the decision to charge those suspects will now be with alameda county district attorney pamela price. >> i think they understand the importance of charging the people who killed an oakland police officer, or anyone attached to them, committing crimes in the city of oakland. >> in a statement, oakland police said the investigation is still ongoing. they will not stop until all those responsible are brought to justice. officer lay is the department's first line of duty. death in more than a decade. >> bart is promising to make changes if the investigation

into monday's derailment confirms human error is to blame. early on, bart said it started with an issue with a computer system that controls track switching. it prompted the train operator to exit the train near the orinda station and manually align the tracks. when the operator got back on the train and started accelerating, two cars jumped the tracks. investigators are looking into every possible cause for the derailment. lots of things could come out that we don't know right now. >> but what we believe right now is it was not not a track issue. it was not a train issue. what we are left with and what what most of what we know points to is human error. >> if human error is to blame, changes would include new training, new protocols. this was the fifth bart derailment in the last 15 years, all of them in the east bay. >> your voice, your vote. former president donald trump has officially appealed maine's decision to bar him from the state's primary ballot. gloria is at the live desk with this

legal battle just weeks ahead of the iowa caucuses. gloria. >> good morning, kumasi and their appeal. donald trump's legal team is arguing that maine secretary of state has no legal authority to keep him off the ballot. now maine cited the 14th amendment's insurrection clause as the reason. but trump's legal team is arguing that the clause bars people from holding office. but does not keep them from running or being elected to office. this comes as iowa's caucuses, less than two weeks away. trump still holds a considerable lead in the polls, despite refusing to attend any debates. republican candidates have blasted his decision before the caucuses, as he's running on things like deporting illegals and building a wall. >> but he did that in 16 and didn't get it done. so i think he owes answers to those questions. >> and as of yesterday, abc news partner fivethirtyeight shows trump is averaging about 50% support in iowa. ron desantis trails behind at roughly 18, while nikki haley is third in

survey and they found the snowpack is at just 25% of its historical average for this time of year. >> yeah, and reggie will probably get some more snow this upcoming weekend. live doppler seven, along with satellite. the bigger picture those heavier snow showers are wrapping up, so we have seen the bulk of the snow fall in the sierra with this current storm. we still have some scattered snow showers today, but we're going to total that accumulation and some of our highest peaks at two feet of fresh powder. once the storm wraps up locally, we are dealing with some showers, some isolated downpours. i'll take you down into the east bay right now where a heavier shower moving through lafayette, walnut creek, alamo, danville, right now, some heavier showers around moraga. we're in and out of this wet weather through about 10 a.m. it's wet on the bay bridge toll plaza. camera scattered showers this morning. we're done with the wet weather by noon. we are dry and it's bright and breezy. later today, we'll have winds gusting up to 20mph. that dry northerly wind will create a chilly day. temperatures your daytime highs. that sunshine peeking out later this afternoon . only in the mid to upper 50s.

plagiarism and criticism of her response to anti-semitism on campus after she was on capitol hill with other university presidents. >> this morning we are hearing from the father of the 16 year old boy from tampa, florida, who was accidentally flown to puerto rico instead of cleveland, ohio. so we told you about this earlier this week. ryan lowe's says his son, logan, was flying alone for the first time to visit his mom. he was dropped off at the airport in tampa two hours early and went right to the gate. >> it goes up to the gate attendant. he they check his personal item in the little slot , and then they look at his phone with it, which has the boarding pass. they don't ever scan it and set it down and scan it, which would have just alerted them, saying, hey, this is not the right flight. >> frontier airlines says that both both flights were departing from that same gate, but at different times. logan's dad says he didn't hear any announcements on the plane because he put on his headphones . well, they immediately flew him back to tampa. they

extra time. this is a live look at our emeryville camera and you could see again busier out there on the roads. now if you take bart, you may have some delays today because of the wet weather. trains are running at slower speeds this morning. >> thank you so much, gloria. watch out for huge waves along the coast today, some as high as 23ft. drew has been telling us about this high surf advisory. in effect, abc7 news reporter lena howland is in pacifica with a look at the conditions. hi, lena. >> hey, reggie. good morning. today is another day when the ocean is not going to be your friend. and this wild weather is something that also has beach boulevard shut down right now at the pacifica pier. because of both flooding concerns and safety concerns as well. now, today's advisory comes after high surf conditions last week led to evacuation orders and warnings in both marin and santa cruz counties, high surf crashing into this stinson beach neighborhood thursday, filling streets with seawater in a matter of minutes. the storm surge enveloping most of the beach could be seen coming dangerously close to homes about

department, officers made the arrest an officer, twan ley's killing. >> over the past few days, including a key suspect in livermore. now, their names haven't been released. the president of the oakland vietnamese chamber of commerce says the arrest will help the community heal. >> it really hit home, not only because he was vietnamese, american, but he really exemplified what it is that we're trying to strive for with our public safety and for our police officers to be from oakland, to be rooted in our community, to be. >> oakland police released a statement saying the rest are just the beginning of a lengthy legal process. they're hoping it helps to start the healing process for officer ley's family and the department. >> as oakland approaches a full year without a permanent police chief, certain violent crime and property property crime is rising. the abc seven news i-team analyzed new data released in the latest citywide crime report. as of late december, burglaries are up more

than 20. motor vehicle thefts are up more than 40. and when it comes to homicides, let's look at numbers. from 2013, there were 92 homicides. then in 2023, 126. in september. a mayor shengtao said that she was she would declare a state of emergency if a new police chief weren't selected by the end of the year. last week, she rejected the three recommendations the police commission made. this means the process is delayed until march. >> it's been just a laziness and a lack of urgency to get a new police chief to restore public safety to oakland, the i-team asked the mayor's office how much money was spent on consultant fees for the ongoing search for a police chief, and we are still waiting to hear back. >> a former rock musician has been arrested in connection with the murder of his ex-girlfriend, capitola police released this image of theo lingle being taken into custody yesterday morning. he's also known as milo stone and is an ex member of the rock

band mr. bungle. the 54 year old is accused of killing his ex girlfriend alex herman, who went missing on december 3rd. her remains were later found at tilden regional park in berkeley. authorities launched a search for lingle after he was identified as a person of interest. he's since been booked into santa cruz county jail. >> san francisco business owner manny el says he will not be running for mayor after all. manny told the chronicle he was thinking about running last month, but he's made the decision that it's not the right time. he says he'll focus on making an impact as a private citizen. he plans to do that through his foundation, civic joy fund, and his cafe and meeting space called mayonnaise, which is in the mission. levi strauss era daniel lurie, who is also part of that same fund that we're just talking about with manny, his campaign for san francisco mayor reached a milestone. joan lurie released his fundraising numbers, surpassing his first 100 day goal with $519,000. he is the founder of anti-poverty nonprofit tipping point community. lurie cited city leadership's failure to address

the fentanyl crisis and homelessness as reasons for his decision to challenge mayor london breed, developing news on the airport disaster in japan. >> a passenger plane collided with a coast guard plane and burst into flames. and gloria, we're now learning how everybody on board that japan airlines plane escaped kumasi horrifying moments at tokyo's haneda airport. >> japan airlines passenger jet burst into flames yesterday after slamming into a coast guard plane. five five of the six members on board that coast guard plane died. all 379 people on the jet escaped within 90s before it was engulfed. passengers were safely evacuated on two emergency slides. japan airlines says that the crew directed people using megaphones because the onboard speaker system was not working. experts are praising the quick evacuations, with passengers following instructions and also leaving their personal belongings behind. they say this type of plane is made with

special material to stop fire from quickly spreading inside the cabin. >> it was very fortunate that the collision did not rupture the fuel tanks on the jal aircraft, and so the fire that you saw was fairly well contained. well after the airplane came to a stop that gave the passengers enough time to get off and get away from the airplane before the fire consumed the rest of the hull. >> the investigation will focus on communication between the control tower and the pilots to find out why. why the smaller plane was on the runway. japan airlines says their crew had been given permission to land. now, as for the french made bus, it is a total loss. the airbus is a total loss and french specialists are headed to japan to assist in that investigation. reggie. >> all right. thank you, gloria. as for the earthquake, at least 57 people are confirmed dead. and again, it was a 7.5 magnitude that hit japan on new year's day. it flattened buildings, damaged power lines and triggered tsunami warnings. those warnings have now been lifted. the focus now is for the

this morning as low pressure spins onshore, where we had heavy snow falling earlier this morning in the sierra, the heaviest snow is behind us. we'll have some snow showers throughout the day. today. we'll have some showers here locally until about 10 a.m. and then a dry afternoon is on the way. but that winter storm warning is still in effect until 10 p.m. today. for those lingering snow showers throughout the day. once the storm exits and we total up everything, we could see up to two feet of snow on our highest peaks. traveling to tahoe today, some scattered snow showers, slick travel. we have chain controls in effect tomorrow it is sunny and then friday a little bit more snow, but we're only going see about an inch of accumulation with a quick moving system. some heavy rain here locally in the east bay around danville as that cell pushes off to the east, some lighter showers as you approach the peninsula, and then the santa cruz mountains in and out of some downpour. so this morning it's a level one until 10 a.m. by noon, we are dry, the sunshine is back out. it is a bright day, but it's a breezy afternoon with gusts at about

taken responsibility. it's not clear what the motive might be. some street vendors in san francisco's mission district say they are now homeless because of a 90 day street vending ban, so this ban has been in place on mission street for more than five weeks now to push to tackle illegal activity in that area. we spoke with one couple who has been doing street vending for the past decade. they say they used to make $1,300 a week. they tried selling indoors at one of the two sites the city opened, but said they only made $25 in one week, so they had to start living in their van with their two year old daughter because they couldn't pay rent. the city ended up getting them into a shelter a week later. >> i had a permits. i pay my taxes, i had everything i followed the rules, the system, everything. >> it's very unfortunate if that is uh- what has caused them to lose their housing? um, but, you know, we cannot say that this is not a ban in the whole city. uh, this is a ban on one specific street. >> the street vending ban is set

to end next month, but the city is looking into extending it and also adding more public works inspectors to that area in the south bay. >> an artist in san jose is looking for a sculpture that got stolen new year's day. he said he had been working on this for months. aida rosenberg says that metal sculpting is his passion. his latest piece you can see here, it's about nine feet tall. it weighs almost 600 pounds. it's made completely out of metal pieced together by welds. rosenberg says. he brought it outside to rust, but he says it's necessary for the design. he even bolted it to the ground to prevent it from getting damaged. >> did you think somebody was going to be able to move it the way that? >> no, i really didn't think that someone was going to come with a pickup truck and drag it out of here. >> surveillance video shows a white pickup truck driving by parking outside the studio, and someone gets out and takes the sculpture. rosenberg says he hopes to have it back soon, and he's filed a police report. he doesn't want all the time spent

on making this piece of art go to waste. >> we're learning the price of eggs might be going up related to the avian flu that is hitting california pretty hard, right now. in sonoma county, outbreaks were detected in petaluma a month ago, forcing 250,000 birds to be put down. now, more than a million birds have been euthanized since thanksgiving week, and several poultry producers have been euthanizing chickens and ducks because of the avian flu. there were two more outbreaks in sonoma county last week. >> there's going to be an effect on the market. we're going to see perhaps eggs not available in the market. we may see the price of eggs increase in the bay area. there's a lot of wonderful restaurants that rely on local duck production. and ultimately, right now that production has completely ceased . >> the california poultry federation says poultry producers are taking extra measures to protect their birds. farms are being locked down and people are not allowed in and out of the facilities, a new report claims. >> the migration of local tech workers during the pandemic didn't hurt san francisco's

the m today. it's a level one this morning on the storm impact scale for the scattered showers, creating some slick travel. we also have a high surf advisory along our coast with some rough and dangerous surf throughout the day. today we could see waves up to 23ft along our coastline. this morning we'll keep that shower chance in the forecast until 10 a.m. by lunchtime. we're drying out the afternoon at it's breezy, it's bright, but it is brisk. temperatures only in the 50s for daytime highs and number two slick roads today. >> that's creating more issues on the roads. this morning we've already gotten more than 40 reports on the chp log because of accidents. a lot of those are weather related. in fact, a majority of those are spinouts. and then bart is also saying that they have some slowdowns today because of the wet weather. trains are running at slower speeds, so expect delays.
