sanders against these charges. good evening. >> i'm ama daetz and i'm dan ashley. >> thanks for joining us in. all three suspects in this case appeared in court today. marc sanders and alan brown are charged with murder. a third man, suburban russell, faces a burglary charge related to the cannabis business. a burglary officer lay was responding to. we're also learning a fourth man is now in custody. >> our media partners with the mercury news are reporting officers arrested a 34 year old man last night in southern california on a burglary warrant. abc seven news reporter anser hassan looks into the charges. mark sanders made his first court appearance back to the cameras, his arraignment waived, but he did not enter a plea. >> he's been identified as the possible shooter of oakland police officer twan lee. i want to remind everyone that a man who is charged with a crime is presumed to be innocent until all and unless the prosecutor proves him to be guilty beyond a reasonable doubt, annabella's attorney for mark sanders addressed the media but did not

answer questions. officer lee was fatally shot while responding to a reported burglary at a cannabis business. though lee was working undercover and in an unmarked vehicle based family members and members of law enforcement were also in court for the hearing. >> i will leverage the full weight of my office against these people who we believe ruthlessly and wantonly murdered an officer of the law wednesday night, alameda county district attorney pamela price announced the charges alongside mayor shengtao and interim oakland police chief darren allison. >> sanders is being charged with murder with special circumstance and special allegations which could lock him up for life without the possibility of parole. if convicted. >> what mr. sanders is facing is a murder charge and special circumstances or a special circumstance. i believe the first special circumstance that has been charged by this administration in the year that that that miss price has been district attorney bella says she

was only given the probable cause declaration and won't respond to discovery except for what comes from the prosecution, adding she's still missing detailed information about the case. i just want to say that i stand ready to defend mr. sanders against these charges. >> a second suspect, alan brown, is also being charged with murder. a third suspect, andre russell, faces burglary charges. court documents show that russell had priors related to kidnaping and use of a deadly weapon. charges which were dropped by the da due to insufficient evidence he was on felony probation when arrested in the lay case. all three men will return to court on january 18th to enter pleas in oakland, anser hassan. abc seven news and oakland city council members demanding answers about why he was asked to leave yesterday's announcement about arrests made in officer ley's killing. >> noel gallo says he took a seat next to an opd union rep in the news conference room, as he's done many times before when an officer approached him and asked him to leave. gallo asked

the officer who who ordered his removal, but he didn't get an answer or an officer to come and tell me that i have to leave. >> have them leave immediately was really an insult, uh, and an embarrassment and uncalled for action. you know, based on my experience and the role that i play. >> gallo has lodged a formal complaint with the police department to find out who ordered him out. we've also asked city officials about this incident. we'll get back to you as soon as we get an answer. a former police officer accused of getting into a lengthy standoff with pleasant hill police was arraigned today. >> chunlian say chao entered a not guilty plea and waived his right to a speedy trial. afterward his attorneys talked about their client and his personal troubles, including dealing with ptsd. this appears to be the focus of their defense . >> we want cities to change the way that they handle people that retire from first responder positions for mental health

reasons. these people serve the community, be they protected us and we need to protect them in return. >> satchell faces a long list of charges, including attempted murder and shooting at police officers, developing news in berkeley, a scuffle just broke out between police and a group protesting the blockade of the historic people's park. >> video just taken minutes ago by our crew on the scene shows police detaining several demonstrators. it comes after a day long protest starting early this morning. opposition into the parks closure for a new housing complex that's supposed to go up. abc seven news reporter ryan curry is on the story. >> chanting to stop crews from closing off a long standing park. >> we need a place where community members can find each other and learn about their history of berkeley. that's a human right. knowing what your culture is, having water, having food, these workers are creating a barricade with shipping containers. >> they want to keep people out of the park. so the school can

build a new dorm. >> what we're doing out here is taking advantage of a time of the year when we have very few students, very few people here to be able to do this as safely and as quickly as possible. >> the work started early thursday morning. police in full tactical gear arrived to close off streets and remove the remaining people living in the park. protesters tried to stop them, but police arrested seven of them shortly after is when they started stacking containers around the park. >> we are stacking those in a perimeter around the park to high, and that will effectively then be able to cordon off the construction site. >> they've set up this small barricade right here at telegraph avenue to keep demonstrators away from people's park. it's just over there, and you can see down the road that's where they have these tall shipping containers stacked up around the park to keep people out. the university tried to close the park in the summer of 2022, but protesters tore down the fence put up to keep them out. the new project will create a separate building for low income people, as well as 1100 units for students at the park, something the university says

housing report finds landlord boards in marin and two other counties are discriminating against latino renters and families with children. >> those are the findings uncovered by fair housing advocates of northern california. the organization investigated 60 rental property landlords at random in marin solano and sonoma counties and found some level of discrimination at 58% of the properties, 52% of test calls to landlords revealed evidence of discrimination against renters with children, 31% against latinos. >> the latina called up and they said she said i believe she had two kids, so it would be her and two children for a one bedroom apartment. and they said, sorry, that's just too small for a family of three. and then the white tester called up and they said, yeah, that should be fine, no problem. we can make it work. >> advocates for rental property owners questioned how the report was conducted, and a lot of people of color say their general mistrust and fear in police stems from being stopped by law enforcement more than others. >> and now data

justrillioneleased appears to back that up. abc seven news south bay reporter dustin dorsey looks into the issue of racial profiling among hispanic and black communities. >> an extensive study and look into law enforcement stops across california highlights a trend many say they already know. >> the data is pretty clear that year over year, and now, um, agency over agency. we have a problem. we have a problem with disparities in law enforcement, stops racial and identity profiling. >> advisory board co-chair andrea guerrero says the numbers from their annual report looking at nearly 4.6 million vehicle and pedestrian stops in 2022 from all california law enforcement agencies, showed a pattern of profiling in the state. the data represents the race perceived by officers and not the race people may identify with. because that's what drives bias, the report found. police reported hispanic or latino people made up about 43% of traffic stops above their 32%

share of california's population . it also found that black people account for nearly 13% of traffic stops in california, above their 5% share of the state's population. >> no surprise, it's the same data that we get each and every time one of these reports come out. but anti-terror police project executive director pat brooks says the problem is racially profiled stops, leads to problems like mental health issues, and sometimes serious injury or death. >> we need to know that, according to the data, these preemptive stops right by law enforcement in the name of public safety, actually do little to nothing for public safety. >> um, what they do do, however, is increase engagement between vulnerable communities and police officers that lead to incidents of violence and people of color are experiencing similar struggles here in the bay area, according to stats, our abc7 news data team pulled from oakland, san francisco and san jose police. >> the hispanic latino population in san jose represented nearly 54% of stops, more than double. their percentage of the population in oakland, 49% of total stops came

from the black community, who only represent 21% of the population, and black people accounted for 23% of traffic stops in san francisco, which is far above their 4% share of the city's population. >> i hope that the public finds us uh- opportunity in a report that is as eyes wide open as it can possibly be to recognize and address the issue of profiling, guerrero says the numbers represent a statewide problem, and she hopes solutions can be found to move away from identity based policing and move towards evidence based policing. >> dustin dawsey, abc seven news all right, we reached out to several police departments and police unions for a response to this report, but we have not yet heard back. >> we'll keep trying. >> fighting covid 19 just ahead, the new study out of ucsf that might make you think twice about the popular treatment paxlovid. and later, the effort by oakland's new minor league team to play a game at the coliseum is denied by the team that

but they maintain there are still some benefits. >> abc7 news reporter zach fuentes has the story. >> reporter paxlovid has been a treatment known to work for high risk, unvaccinated people with covid, but until recently, not much was known about whether it could protect vaccinated, low risk groups from getting long covid. >> the earlier evidence suggested there might be a benefit in preventing long covid

. >> but researchers at ucsf said their newly released findings show that using paxlovid to prevent long covid might not be effective. our study, as well as two other really well done studies, now have come out with the same results using slightly different approaches, and so i feel pretty confident that together, our studies really suggest that there that paxlovid unfortunately, does not really prevent long covid. doctor matt gerstenfeld said that they surveyed thousands of volunteers who were vaccinated and didn't have covid before paxlovid came out. they surveyed the volunteers once they were infected and then later again after they took paxlovid to see if they had long covid symptoms. taking paxlovid at the time that you have covid. >> the during the acute infection does not seem to be associated with a lower risk of having long covid down the road. among the people who are already vaccinated and having their first infection, doctor gerstenfeld said that researchers also found a higher than expected number of patients getting covid rebound symptoms after taking paxlovid. >> we reached out to pfizer, who makes paxlovid? they sent us a statement that said, in part, we are continuing to monitor data

from our clinical studies and real world evidence and welcome independent research in academic discourse on long covid. paxlovid is not authorized or approved for use as a treatment or prophylactic for long covid, as it relates to rebound symptoms. pfizer said, quote, we believe covid 19 rebound is uncommon and not uniquely associated with any specific treatment. we remain very confident in paxlovid s clinical effectiveness at preventing severe outcomes from covid 19, and patients at high risk, despite the study. gerstenfeld reiterates that paxlovid is still an important treatment to prevent disease in people at high risk of severe covid. i think where our study kind of helps is those people who are at low risk but are taking paxlovid purely to try to prevent long covid. >> i think weakens the evidence for that. zach fuentes, abc seven news. >> the drug, called hydroxychloroquine, may have killed 17,000 people during the first wave of covid 19. >> those findings, from a new study by french researchers in the early days of the pandemic, former president trump encouraged the use of this drug,

touting it as a miracle cure for covid. in reality, the immunosuppressive medicine, which was made to treat malaria, is linked to a higher mortality rate in covid cases. >> egg freezing for fertility is becoming more popular up to 31% in recent years. but a new study finds only two and a half to 3% return for the eggs. they froze. abc news chief medical correspondent doctor jen ashton explains what you need to know before starting this process. >> any woman considered this should ask that center what will happen to these eggs. if i don't use them? oftentimes they're used for research. they might be discarded. they might be donated . and but that is obviously very important information. and i think that also women need to remember this is not like going in for a haircut or a manicure. there are financial reasons. there are financial tolls, physical, emotional, uh- if it all goes well, it's a process that can take place in a couple

the vegas bound a's have blocked the new oakland ballers minor league team from playing a game on the coliseum in june, citing their exclusive rights to the building for professional baseball. the ballers, an expansion team in the independent pioneer league, say they had signed a contract and paid a deposit with the firm that operates the stadium. team officials say they're disappointed, but added nothing will stop them from turning the page on a new chapter for baseball in oakland.

>> draymond green appears close to returning to the court for the warriors. espn is reporting green is going to return to the team's facility in the coming days to ramp up to play. the nba suspended the all star forward indefinitely last month after he hit another player in the face. it was the latest incident involving the warriors star. green needs to meet several requirements, though, and get approval from the nba commissioner before he can play in games again. >> all right, let's focus now on the weather forecast. >> yeah, it was gorgeous out there today. yeah it was indeed absolutely beautiful dan and anna and i want to show you some gorgeous views right now from our tower cameras. >> look as you will from santa cruz to pier 39 to vollmer, golden gate, we are seeing some high clouds moving in as a weak system is going to brush us by. here's a look at the headlines tonight. increased clouds, high surf tomorrow with a beach hazard statement. and on saturday we are looking at cold showers and breezy conditions. so wave heights will be building once again as one system after

another in the pacific line up. so be aware of the fact that those waves will be building current wave heights. 5 to 9ft. beach hazards statement is from 6 a.m. to 10 p.m. tomorrow. large breakers ten foot or higher. the risk of sneaker waves and those waves could come up on you without that warning. so just be aware of that as we go. hour by hour, i'm going to show you those wave heights. they'll be building tomorrow afternoon. you see these shades of oranges here in that 12 to 14 foot category? three. and then the wave heights remain elevated going into sunday morning before they start to come down later on sunday. now here's a look at those temperatures. they're in the 50s for most of you. but today we got up into the mid 50s to mid 60s in places like santa rosa airport. so it was a nice looking day right now we take a look at the hourly forecast tomorrow morning at 1:00. we're going to see some isolated showers in the north bay. those showers really will be quick moving. not a game changer, but

be aware of the fact that there will be some damp spots tomorrow morning at commute time. the level one system comes in on saturday. this is when we're expecting more organized shower activity and more areas will see the wet weather. 8 a.m. saturday continuing at 1030. crossing the central bay and then as we head towards noon, still some pockets of light to moderate showers. but because they'll be fast moving, not a lot in terms of accumulation. isolated showers for saturday afternoon evening and then we are done with this. so rainfall projections through saturday evening will be under 2/10 of an inch for just about everyone. this does turn to snow in the mountains. it's going to be a very low levels. heavy snow, 1 to 2ft, gusts to 55 miles an hour. travel could be very difficult to impossible. winter storm warning 4 a.m. saturday until 6 a.m. sunday. those snow levels. 2 to 3000ft, lowering to 1500 sunday morning. so carry chains if you're going to go up your best day to get up there will be tomorrow because
