beautiful. there's not a lot happening right now, but that is about to change in a big way. sandhya patel yes, heavy snow is coming to the sierra, believe it or not. >> and larry and dion, let's take a look at the winter storm warning that will be going up 4 a.m. tomorrow until 4 a.m. sunday, 1 to 2ft of snow. it's going to be higher over the highest peaks with the snow levels very low 2 to 3000ft by sunday morning, down to 1000ft, and snow rates of two inches per hour possible with those gusty winds, travel is going to be difficult to impossible. all the other big story is the surf is up from our santa cruz camera. you can see it just kind of pounding the coastline there. light level one storm moving in the direction is kicking up the surf. and as we take a look at the beach hazard statement, it's up until 10 p.m. tonight. current wave heights 5 to 15ft. watch out for large breakers. risk of sneaker waves is there. the level one system that is going to be moving in is going to bring us wet weather. as early as tomorrow morning. so tonight you're fine. temperatures later on this

evening in the 50s, dropping down to the 40s and 50s, clouds increase by 10 a.m. we've got rain in the north bay by noontime. it's crossing the central bay, and it is a level one. as i mentioned on our storm impact scale, light to moderate rain tomorrow, slick roads, breezy conditions and rough surf. we have a chill coming that is going to follow this. i'll be back with a detail on a frost advisory and the rest of your weekend timeline coming up. dion. >> all right. sandhya. thank you. >> from high waves is shutting down the popular pacifica pier. the three week closure officially starts today, giving officials time for structural assessment. abc seven news reporter zach fuentes joining us live there now with more on whom this closure will impact zach. yeah this pier is just such a huge attraction for pacifica, not just for the beautiful views you can take in here, but also because it's one of the only piers where people can fish for free. >> but of course, a big number was done here on december 28th that damaged parts of the piers, deck and concrete railing. that

was because of big waves and high tides. but now, starting today through at least january 25th, the pier is going to be closed. while the structure here is assessed. so despite the pier's closure, though, crowds have been making their way over here. and that's really because of one main draw. and that has been today's waves. we've spoken with just several people who say that while they're disappointed that the pier is closed, they're just in awe of these waves. and since they haven't been destructive so far today, they've actually been a big help for the chit chat cafe right here at the base of the pier, the owner, ginger davis. she tells me that local fishers along with neighbors and tourists who visit the pier, make up the bulk of her business. but right now, the pier closure hasn't impacted that business so far. >> the closure of the pier for assessments is going to impact us. if we don't have the draw of the waves, so short terms, she's not too worried. >> it's the long time she's concerned about, but she is hopeful that a couple of days of forecast that king tides will help her out. now again, the city says this closure is planned for at least three weeks. while they evaluate the structure out here. and there's already been some damage out here before for this damage.

this recent damage has only added to that. so the total estimated cost of repairs out here is $20 million. the city is looking at grant funding to help address that right now. live in pacifica. zach fuentes abc seven news. all right zach thank you. >> the oakland police department says a memorial honoring fallen officer tuan lei will be held next wednesday at three crosses church in castro valley. this morning, community members gathered in oakland's chinatown to pay their respects. >> if you are up for the began with the traditional buddhist prayer hymns and a bell ringing ceremony. >> it was organized by the chinatown chamber of commerce. carl chan, the president of the chamber foundation, says it is important to gather in person to remember lei. >> we thought it would be a best way for many. you know, folks, they they couldn't do it online and they want to send the, you know, the messages and the condolence, uh, to the family. so which is very important for

many of us. wednesday service in castro valley is expected to draw law enforcement from across the nation back in september, oakland mayor shang tao said she would declare a state of emergency by the end of the year if the city's police commission failed to send her a list of finalists for a new police chief. >> well, now, a coalition of community groups is demanding that the mayor follow through. abc seven news reporter anser hassan has the latest, including the first steps toward a recall for the embattled mayor. and we're saying to mayor tao on your word and declare a state of emergency. >> for the past few weeks, community groups have been rallying against oakland city leadership and alameda county district attorney pamela price, demanding more be done to address public safety. >> the gun charges are being dismissed, and my husband's case and they have, as of today, virginia nishida says last week's shooting death of oakland police officer tuan lei reminds her of the death of her husband, former bay area police officer kevin ishida. >> he was killed while guarding

a local tv news crew. she wants da price to charge the suspects in kevin's murder case. with the full extent of the law. >> the gun charges are being dismissed in his case, so they will be eligible to get parole. >> meanwhile, oakland city council member noel gallo is joining them, demanding oakland mayor shengtao to declare a state of emergency. >> we know who some of the criminals on the street are. we're not prosecuting them. we're not arresting them. we need to declare an emergency to get assistance from the sheriff, from the you know, from the fbi, us marshals and the highway patrol. i think these people are afraid to say that they want the police department to step up and do more. >> and so instead, they can target the policy makers that create the laws, because that's an easier target. >> oakland city council member carol fife acknowledges the challenges the city is facing with crime operating without a police chief and a historic budget deficit, but adds that the city has implemented new measures such as grants for

small businesses and new police initiatives. >> we've had a number of academies, the police academies for the individuals who are calling for more police on the streets, everything is being implemented at this current, current time and we need time for it to show effectiveness. >> still, pressure is growing. on friday, a coalition of voters will officially begin the recall effort against oakland mayor shengtao chow in oakland, anser hassan. abc seven news. >> joining me now is abc seven news insider phil matier. there's a lot to keep track of here, but let's start with the recall effort of mayor tao. how realistic is this? how much of a threat is it to her situation? it's real. >> in the last couple of days, they've collected over 300 signatures in order to get the process going, they need 250. the next step will be to go out and collect 25,000 signatures from the city. citizens of oakland, the voters of oakland. and larry, given the mood not just in oakland, but across the bay area where people are, feel under siege by crime and both

violent crime and petty crime. whether it's burglaries to your car, burglaries to businesses, uh, it's not out of the realm that they could collect the needed signatures to put this on the ballot for november. >> so you think they'll get it? you think they'll get it? >> i think they could. 25,000 signatures isn't all that much. i mean, you go out to the farmers markets and say, how do you feel about crime and people will sign? i don't even know if they would read it. >> interesting. so regarding the declaration of a state of emergency tsay that would have to come from the mayor, or at least the request. where are we on that at this point? >> you know, that's all over the map. the mayor said initially that she was going if the police commission and her couldn't agree on a chief by the beginning of the year, she was going to declare a state of emergency and name her own police chief. there was a question about whether that was legal or not. there's a question about whether what a state of emergency entails, what it covers. noel gallo, the councilman we just heard from, is working with the city attorney as we speak to write up a state of emergency statement

and then take it to the mayor, whether that will cover and what it will cover remains to be seen, whether it's symbolic or substantive remains to be seen. but the fact of the matter is state of emergency or not, they're still understaffed at the oakland police department, the crime is still going on, and people feel under under threat. and under siege. >> so that was what i was going to ask you next. is, is there a general consensus that we need more force on the ground? we just need more bodies as publicly. >> people say, yes, we need more bodies, but these are the same people in many cases, including the mayor and some of the council members, many of them who just two years ago were saying no, what we need is to redirect police spending into other programs. now, the mayor has got off to a bad start. you know, your first impression isn't the best one, she fired the police chief within the first two weeks of her job, he was very popular. she. he was later found to the. the charges

against him weren't substantive enough to warrant dismissal. the police commission then gave his name as one of three to be hired again. so we don't have anybody in agreement on anything right now aside from all of that. >> everything's going very smoothly. let's talk about the recall effort for alameda county da, pamela price. and to be clear, these are two different recalls and two different groups that are pushing for this. it's not just one common for one group, two groups, okay. >> and the common fear is they feel that that that the consequences for criminality are not there aren't any that simple is that. and we hear that in san francisco, too. mayor london breed says there must be consequences. it's interesting to note that san francisco underwent this uh- about a year ago, with the recall of then progressive district attorney chesa boudin, where people said, enough is enough. we want to change it. now it's being seen in the east bay now. i also noticed that pamela price, the district attorney, is throwing the book at those accused of

and they released their ideas today. >> abc seven news reporter luz pena joining us live now in studio with a closer look at their vision. luis. >> that's right. well, the advisory council is hoping this report provides a template that could be used to reform prisons across the u.s. the recommending to retrain guards and replace death row with what they're calling dignity guide housing the 150 page reimagining san quentin, a report that breaks down how to turn the maximum security prison into a rehab center, is out. sacramento's mayor, darrell steinberg, co-chaired the council and broke down their priorities, reducing the population single cells will then give us a better chance. >> we believe, to ensure that

every resident has a comprehensive rehabilitation and reentry plan from day one, the advisory council recommended aggressively reducing the prison's population by 30% or more, reducing the prisons population will also lead to getting rid of death row, and that could either be remodeling of death row or reconfiguring or tearing it down and replacing it with quality modular housing. >> the human rights organization ella baker center agrees with the report, but would like the state to give those on death row options after the changes. yes with the with the caveat that some people who are on death row may want to stay at san quentin and we support people's agency and autonomy in where, um, they feel their best path towards rehabilitation lies changing. san quentin was one of governor newsom's 2023 budget priorities. it came with a $360 million

price tag that would turn the prisons 81,000 square foot building, called building 38, into an educational center, the advisory council said. they can do it for less. >> the $360 million price tag should be reduced by at least one third. we believe that for, uh, approximate. $240 million that they can still build a mini education, vocational training campus. >> cat brooks, executive director of the anti-police terror project, doesn't agree with this plan. >> there are a number of flaws, right, with the plan. the first of all, like simon quinton is a very old, very violent, very dungeon like, um, place like to transform it into rehabilitative center. um, would require literally tearing it down and building it back up from scratch. >> brooks would like to see more resources also go towards preventing incarcerations. >> there are countries all over europe where they invest in their communities right? they

invest in their people and they don't have the same problems that we have here. >> the report is also recommending to build two centers outside of san quentin as a clear pathway for people in their last year of sentence to begin transitioning into the community. luz pena abc seven news thank you. >> incarcerated survivors of abuse at the federal women's prison in dublin testified before a judge today. hearings began this week for the judge to decide whether to appoint a special master to oversee reforms at the prison, a class action lawsuit filed last august accuses correctional officers of rape and sexual abuse. the plaintiffs are demanding that the bureau of prisons make immediate changes, so there's really nobody in charge. >> there's no accountability. um, that that we really need someone independent to come in there. um, it's not a case of a few bad apples. >> hearings will continue next week. eight officers at the

prison have been charged with sexually abusing incarcerated individuals. two have pleaded guilty tonight. >> on 2020, a san franc athlete who was gunned down in texas just days before a major race. the hunt for maria wilson's murderer in 2022 went all the way to costa rica. i'm >> i'm mariah wilson. um i also go by mo. she just had this, like, amazing smile that would just pull you in and. >> uniformed cops came in and they just went right for her. this is hardcore. i've never seen that happen in santa. the police don't do stuff like that. so i knew she did something bad tonight at nine. >> three shots in the dark. and the beautiful athlete and the friends jealous girlfriend. now convicted of murder. tonight on abc seven. >> all right, moving on to the weather. if you are a fan of what skiing, snowboarding, outdoor snow sports. this might

be the weekend for you. >> yes. and rain as well. here's sandhya patel uh. >> yes. everything you can possibly imagine. we have it for you. larry and diane. let me show you a live picture right now of a beautiful sun soaked pier 39. as visitors are enjoying the sunshine, there. uh- san francisco right now 60 degrees. it is 65, in san rafael. can you believe this? 64 in concord. pretty mild weather outside as we look at live doppler seven. we are noticing some clouds up to the north, but we're going to have to wait until tomorrow before the storm actually moves in. right now, the energy is right across the pacific northwest. the storm gets in here tomorrow and we will get some rain. so here's a view from san rafael. camera with nothing but blue skies san francisco as i mentioned, 60 oakland 5964. in hayward, it's in the low 60s from sanosto san mateo, 57, in half moon bay, you are looking out towards mount diablo from our east bay hills. camera and you're noticing a few high, thin, wispy clouds, low 60s from santa rosa

to napa. also. fairfield 64, concord 61. in livermore from our kgo roof camera, we do have a little bit of a breeze along the embarcadero. here are the headlines. large breakers today. beach hazard statement remains in effect, a level one storm moves in tomorrow, bringing us rain and we do have cold mornings ahead with frosty areas. sunday and monday mornings, so they already issued it well in advance. sunday midnight until 10 a.m. all these areas here will go under a frost advisory. temperatures dropping to the low 30s. this means frost will form and so protect any of your sensitive plants and don't forget about your pets. as we check out our storm impact scale. it's a light level one for tomorrow. light to briefly moderate rain, slick roadways and breezy conditions, and rough surf will continue. we're going to time this out for you tomorrow. early plans are just fine, but by 10 a.m, rain begins to move into the north bay. it starts to cross the central bay as we head towards 1 p.m, right

across san francisco, parts of the east bay and then it's in the south bay. by 2 p.m. we're going to see some brief pockets of moderate rain. as i mentioned, maybe even briefly, heavy south bay by 330 and then just isolated shower or two for the remainder of the evening. so your saturday late afternoon through evening is just fine. rain fall totals anywhere from about 507 inch in places, or 600 in richmond. all the way to three quarters of an inch in ukiah. everyone else will be pretty much in between that range. your morning temperatures in the mid 30s to the upper 40s. clouds will thicken the rain arrives, and then the rain continues for parts of the bay area for the afternoon in your high temperatures are coming down. so if you're getting used to this idea of sunshine and nice weather, well, it's going to change. this is just a sign that winter is here. 40s and 50s for your highs. so you will need the heavier coats, the umbrellas tomorrow and a look at the accuweather seven day forecast. you might want to hang to on both because look at the seven day forecast. rain and cool breezy level one tomorrow. cold sunday, monday mornings, cool

would open up fisheries south of mendocino and the mendocino county line today, but an aerial survey still found endangered humpback whales off the california coast. i think eventually here we're going to get to a point where we won't have these whales listed on the endangered species list. >> they're actually doing very well population wise. they're increasing in numbers regardless of ship strikes or any other interference by humans. >> the state says it will check the waters again next thursday, and barnett says he's optimistic that crab season will open for his members by the end of the month. >> there's a big egg shortage at grocery stores in the north bay. shoppers are finding empty shelves in the egg section at many big name retailers. there's a lot of that has to do with the devastating avian influenza outbreak at poultry farms, particularly in sonoma county. operators are having to euthanize large numbers of their flock to stop that spread. >> people in san francisco fillmore district are worried, worried about where they're going to get their groceries. now that their safeway is

shutting down. that safeway is located at 1335 webster street. it's the only major grocery store in that neighborhood. next closest safeway is in the castro, though lucky and trader joe's both have stores there about a mile away. a spokesperson says the fillmore safeway store entered into an agreement with a line real estate, which plans to turn safeway, webster plaza shopping center into a mixed use development with both housing and commercial space. >> i think they should have found some place else. we need a store. we need a store other than a corner liquor store, there's a lot of vacant buildings that you can open up and have housing. you don't need to take the store that safeway is expected to close in march. >> the store is calling this an opportunity to bring much needed additional housing to san francisco. >> up next, a glitter bomb prank reveals more than just some viral video. how the prank showed a much bigger issue in the criminal justice system, and we revisit those viral travel mugs that caused all kinds of

this case i ran the guys plates. turns out he used his own car driving to various break ins, and i found his two criminal cases now underway that raise questions about how well the courts address these crimes. >> i'm so happy former nasa engineer mark rober set a trap for san francisco's car burglars 25 times over eight months, hidden cameras caught them in the act once they absconded with mark's backpack, it shot out glitter and a foul smelling spray >> push it. push it, push it. and it started a countdown that made the thieves toss the bag. ten. nine. eight. >> seven. six. >> rober even outfitted one car with bulletproof glass just for the fun of seeing their frustration. >> when a juicy piece of luggage was just sitting right in plain sight, then it was my turn to

dig a little, and then you could run the plates and do more of like, an in-depth investigation. i think the combination of that worked really well. >> i learned that several of the thieves tried to avoid detection by using stolen license plates on the cars they drove. i showed gerald iseman his stolen plate in rober's video. what do you think about seeing your plate used in a crime like this? >> well, i'm grateful that i reported it some had no plates at all, but in one case, the suspect used his own car with his own license plates and that's how i found 30 year old charbel augustine of san francisco on october 12th. >> the thursday evening he spots one of mark rober's bay cars on bay street near the embarcadero. sees traffic coming so he gets back in when it's finally clear, he emerges and strikes the back pack that rober built, sends a text that it's been stolen. the on board cameras catch augustine going through the bag. a minute

later comes the message fart spray cannon fired. you can hear the servo motor, no audible reaction from augustine, but he throws the bag out the window a little over an hour later, charbel augustine has made his way to the palace of fine arts and another of robur's bay cars from four different angles. so you see him break into the car and take the backpack. once i ran his plate and found his information, i checked san francisco superior court records . get this. after he failed to appear in a car burglary case from july, a judge issued a $35,000 bench warrant for augustine's arrest. the charges second degree burglary of vehicle and possession of burglar tools. what's meant to be a legitimate car escape tool. in that case, police say they recovered u.s, indian and euro currency from augustine's car. jewelry in a baggie, watch keys and more in his criminal

complaint, prosecutors cited three circumstances in aggravation great monetary value , violent conduct which indicates a serious danger to society, and prior convictions. but in a hearing october ninth, judge loretta giorgi described the case, quote, looks like it would be easily settle a bull. she dropped the bench warrant and allowed augustine to leave or on his own recognizance. three days later, mark robur's hidden cameras caught him breaking into those two cars that same day, court records show the plane clothes officers out of central station shot their own video of augustine smashing another car window and connected him to two more break ins, all rental cars. police had to use a spike strip to keep him from fleeing in that same car with the same license plate. we spotted augustine's latest car burglary. charges include an allegation of felony committed while on bail. you would have thought this sort of thing doesn't happen, but in fact, it

does. frank noto of the grassroots campaign stop crime sf tells me defendants released while waiting for a trial often commit other crimes and that since the start of last year, the sfpd made 468 felony arrests of suspects who had been freed from custody pending trial. >> that's just crazy. um, the judges are showing poor judgment there. they're saying this criminal is not going to commit a crime, at least not pending trial. but they're dead wrong. >> i've been attending augustine's court hearings. he has pleaded not guilty to all charges. his. when i approached him, he declined to comment. but do those designer jeans look familiar? his deputy, public defender beau diwan, also declined to be interviewed, but emailed me that augustine is loving and kind and that he takes care of his sick grandmother. she added incarceration does not solve poverty or deter auto burglaries. district attorney brooke jenkins disagrees, her office telling me that incarceration can be a deterrent

37. majestic, a local artist and a nonprofit, are doing what they can to try and change the narrative of doom and gloom in san francisco. >> today, the civic joy club placed this mural by ian, 75, at the children's day school in the mission district. there they gave students chalk and had them share their favorite things about san francisco. >> to be able to get back and tell what i love about the city and have the kids interact with the art. having art on an urban scale is great for them, interact, and tell what they love about the city. >> the kids wrote things like it accepts me and how about this we don't fear failure. we try stuff. the mural now heads to dolores park so others can share their thoughts. once it's full, the chalk will be erased, providing a clean slate for others to say what they love about san francisco. this is
