viral video. pranking san francisco's car burglars. turns out one of the men caught on hidden camera got arrested by police. that same day. good evening. i'm ama daetz and i'm dan ashley. >> abc seven news i-team reporter dan noyes worked on that viral video with youtube star mark rober. >> yes, and he has continued to follow leads and dance here with the latest dan and dan. >> i consulted on that video and in this case, i ran the guys plates. turns out he used his own car driving to various break ins and i found his two criminal cases. now underway that raise questions about how well the courts address these crimes. i'm so happy. former nasa engineer mark rober set a trap for san francisco car burglars. 25 times over eight months, hidden cameras caught them in the act once they absconded with mark's backpack, it shot out glitter and a foul smelling spray

post it on and it started a countdown that made the thieves toss the bag. ten, nine. eight. >> seven. six. >> rober even outfitted one car with bulletproof glass just for the fun of seeing their frustration. >> when a juicy piece of luggage was just sitting right in plain sight, then it was my turn to dig a little, and then you could run the plates and do more of like a in depth investigation. i think the combination of that worked really well. >> i learned that several of the thieves tried to avoid detection by using stolen license plates on the cars they drove. i showed gerald iseman his stolen plate in rober's video. what do you think about seeing your plate used in a crime like this? >> well, i'm grateful that i reported it some had no plates at all, but in one case, the suspect used his own car with his own license plates and that's how i found 30 year old

chevelle augustine of san francisco on october 12th, the thursday evening he spots one of mark rober's bay cars on bay street near the embarcadero. >> sees traffic coming, so he gets back in when it's finally clear, he emerges and strikes the backpack that rober built, sends a text that it's been stolen. the on board cameras catch augustine going through the bag a minute later comes the message farts spray cannon fired. you can hear the servo motor. no audible reaction from augustine, but he throws the bag out the window a little over an hour later, chevelle, augustine has made his way to the palace of fine arts and another of robbers bay cars from four different angles. you see him break into the car and take the backpack. once i ran his plate and found his information, i checked san francisco superior court records. get this. after he failed to appear in the car burglary case from july, a judge

issued a $35,000 bench warrant for augustine's arrest. but the charges second degree burglary of vehicle and possession of burglar tools. what's meant to be a legitimate car escape tool? in that case, police say they recovered us indian and euro currency from augustine's car and jewelry in a baggie, watches and more in his criminal complaint, prosecutors cited three circumstances in aggravation great monetary value , violent conduct which indicates a serious danger to society, and prior convictions. but in a hearing october ninth, judge loretta giorgi described the case. quote, looks like it would be easily settle a bull. she dropped the bench warrant and allowed augustine to leave or on his own recognizance. three days later, mark robur's hidden cameras caught him breaking into those two cars that that same day, court records show the plainclothes

officers out of central station shot their own video of augustine smashing another car window and connected him to two more break ins, all rental cars police had to use a spike strip to keep him from fleeing in that same car. with the same license plate. we spotted augtine's latest car burglary charges include an allegation of felony committed while on bail. >> you would have thought this sort of thing doesn't happen, but in fact, it does. >> frank noto of the grassroots campaign stop crime sf tells me defendants released while waiting for a trial often commit other crimes and that since the start of last year, the sfpd made 468 felony arrests of suspects who had been freed from custody pending trial. >> that's just crazy. um, the judges are showing poor judgment. there they're saying this criminal is not going to commit a crime, at least not pending trial. but they're dead wrong. >> i've been attending chevelle augustine's court hearings. he has pleaded not guilty to all charges. when i approached him,

he declined to comment. but do those designer jeans look familiar for his deputy public defender beau dewan also declined to be interviewed, but emailed me that augustine is loving and kind and that he takes care of his sick grandmother, she added incarceration does not solve poverty or deter auto burglaries . district attorney brooke jenkins disagrees, her office telling me that incarceration can be a deterrent to criminals from committing more crime. i'll keep track of augustine cases as they move forward. >> fascinating to see this thing happen. >> absolutely. this long record. all right. >> thanks, dan. >> new at 6 p.m. a house caught fire on lowell street in san francisco. 70 firefighters responded and the flames were just contained in less than an hour. the two story house is believed to be vacant, but no one was hurt. the fire caused some exterior damage to the next door three story house. the cause is under investigation. all right, let's turn now to the risks of high surf and heavy snow. >> abc seven news meteorologist

sandyha patel is tracking those dangerous conditions tonight. sandy. >> yeah, and the first thing that we are going to talk about is the winter storm warning dan and anna. this is going up early tomorrow morning. in case you're traveling from 4 a.m. to 4 a.m. sunday. so it starts tomorrow. 1 to 2ft of snow, heavy snow with higher amounts. daetz over the highest peaks. we're expecting the snow level to be very low, 2000 to 3000ft, dropping to about 1000ft on sunday with the snow rates of two inches per hour possible with those gusty winds, travel may be difficult to impossible. the concern right now is the surf. this is a live view from our santa cruz camera, where we have been seeing the rough surf current wave heights along our coast is 12ft for san francisco bodega bay higher at point arena, 16ft there. beach hazard statement until 10 p.m. tonight. large breakers will mean the risk of sneaker waves. never turn your back to the ocean. as you look at the wave heights, they remain elevated all the way into midnight. and

then those wave heights, even though they slowly subside, they're still pretty high until about sunday night when they do come down. live. doppler seven tracking a level one storm. it gets here tomorrow morning and we will see the rain moving in to the north bay. first, around 11:00. also crossing the east bay, and then it starts to move across all parts of the bay area. by early afternoon i'll be back with the rest of the timeline, plus a look at a frost advisory coming up. >> dan okay, sandy, thanks very much. it's been one week since oakland police officer twan lay was killed in the line of duty. this morning. people gathered in oakland's chinatown to pay their respects. amy are all began with a traditional buddhist prayer, hymns and a bell ringing ceremony. it was organized by the chinatown chamber of commerce foundation. the president of the chamber says it's important to gather in person to remember officer lay. >> we thought there would be a best way for many. you know,

folks, they they couldn't do it online and they want to send the, you know, the messages and their condolences to the family. so we're just very important for many of us, tröndlé is the first oakland police officer to die on duty since 2009, and the official law enforcement memorial service for officer lay is on wednesday. >> it's open to the public. the service will be held at 10 a.m. at the three crosses church in castro valley. and one more note here. there is a gofundme campaign set up to support officer officer lee's family. you can find a link to it on our website abc seven news.com. as you see, they've raised $115,000 toward that $125,000 goal so far . >> in september, oakland mayor shang tao said she would declare a state of emergency by the end of the year if the city's police commission failed to send her a list of finalists for a new police chief. now how a coalition of community groups is demand that mayor tao follow through. abc seven news reporter

anser hassan has the latest, including the first steps toward a recall for the embattled mayor . and we're saying to mayor sang tao, honor your word and declare state of emergency. >> for the past few weeks, community groups have been rallying against oakland city leadership and alameda county district attorney pamela price demanding more be done to address public safety. the gun charges are being dismissed, and my husband's case, and they have, as of today, virginia nishida says last week's shooting death of oakland police officer tuan lay reminds her of the death of her husband, former bay area police officer kevin ishida. he was killed while guarding a local tv news crew. she wants da price to charge the suspects in kevin's murder case with the full extent of the law, the gun charges are being dismissed in his case, so they will be eligible to get parole. meanwhile, oakland city council member noel gayo is joining them , demanding oakland mayor shengtao to declare a state of emergency. >> we know who some of the

criminals on the street are. we're not prosecuting them. we're not arresting them. we need to declare an emergency to get assistance from the sheriff, from the, you know, from the fbi , the us marshals and the highway patrol. >> i think these people are afraid to say that they want the police department to step up and do more. and so instead, they can target the policy makers that create the laws, because that's an easier target. >> oakland city council member carol fife acknowledges the challenges the city is facing with crime operating without a police chief and a historic budget deficit. but adds that the city has implemented new measures, such as grants for small businesses and new police initiatives. >> we've had a number of academies, the police academies for the individuals who are calling for more police on the streets, everything is being implemented at this current, current time and we need time for it to show effectiveness. >> former alameda county superior court judge brenda harbin forte, who was removed by mayor tao from the oakland police commission, is set to formally launch the recall

um. i felt the drop, you know, and then the movement of the ground was like, you know, felt like i was like, off the, like a surfing or something like that. >> the earthquake hit just before 11 a.m. the usgs says it had a magnitude of 4.2. and the epicenter was near little creek by rancho cucamonga seismologist doctor lucy jones says it's where the san andreas and the san jacinto faults meet. the san andreas is the longest fault in california. it runs up through the bay area. that's the fault that caused, of course, the 1989 loma prieta earthquake. >> damage from high waves shut down the popular pacifica pier for three weeks. it will give officials time for structural assessment at abc seven news reporter zach fuentes has a look at who's affected the most. >> work is being done up and down beach boulevard in pacifica , home of the popular pacifica

municipal pier. much of the work on the road was to replace a recent sinkhole, but now city officials have even more work to do on the pier itself, like areas up and down the california coast. in recent weeks, big waves and high tides have been impactful here. the round, seen on december 28th damaged parts of the piers, deck and concrete railing. now starting friday through at least january 25th, the pier is closed while the structure is assessed, a move applauded earlier in the week by the pacific beach coalition. >> i'm really proud of them for making that call. i think it's the right thing to do. we have to be safe. >> but even with the closure in place, large waves are still drawing a lot of people to the area. it's still spectacular to look at these waves. >> they're about ready to knock the whole wharf down, like i'm looking at some of these waves behind us, and i'm seeing like full barrels and i would never expect to see that anywhere on this coast. >> mother nature show has been a big help for the chit chat cafe right at the base of the pier. >> every morning when we open

the door, it's our fishermen that are waiting. they're cold. they're ready for a coffee or a hot chocolate owner ginger davis said that those local fishers, along with neighbors and tourists who visit the pier, make up the bulk of her business. >> yet the pier closure hasn't impacted that business. for now, the closure of the pier for assessments is going to impact us. >> if we don't have the draw of the waves. >> with king tides expected soon, davis, hopeful for the short time, it's the long terme that keeps her concerned. >> it is looking like if they're going to stay closed till the 25th or 26th, it might become a difficult month. >> so again, the city says that this closure is planned for at least three weeks. while they do that structural assessment and this recent damage is only adding to damage that was done in previous storms. so the estimated total repair cost is $20 million. the city is looking into grant funding to help out with that right now in pacifica. zach fuentes, abc seven news. >> all right. and we do have more rain coming our way. we sure do.

due to the slippery roadways. 10 a.m. the rain is in the north bay, starts to cross into the east bay, but it starts to pick up in intensity. 1:00 most of the bay area is getting wet and you will see some moderate pockets of rain. at 3 p.m. across the southern part of our viewing area. eastern portion as well. tomorrow evening at 5:00. it's in the santa cruz mountains and the south bay. and then just isolate showers for the six seven p m hours. rainfall estimates most of you will be in that 10th of an inch to about a quarter, a third of an inch of rain. but there will be some higher totals around clear lake and ukiah. uh- in terms of your temperatures, first thing tomorrow morning in the 30s and the 40s under mostly cloudy skies, rain arriving by about ten 11:00. and then tomorrow afternoon it is going to be a wet day for many parts of the bay area, with cooler readings, 40s and 50s. looking for more storms? you're going to get them here tomorrow. is not the only system. next tuesday we get some showers in here. more sierra snow, and then wednesday another storm comes in and look at this

endless debate. there is a definite answer about which is to blame for a current shortage on store shelves. it's the chicken. >> the recent outbreak of bird flu has impacted millions of egg laying hens, and people in the north bay are seeing the results. >> abc7 news reporter cornell bernard explains how grocery chains are reacting and how small family farms are seeing a spike in business. >> i'm not seeing any eggs. >> michelle fahey from nevada was looking for eggs but not finding many on her local grocery store shelves. inventory running low as i was in here earlier in the week when they were empty. >> there's not an egg on the shelf, just an empty area. >> stores like safeway are posting signs asking customers to limit their egg purchases to two packages per family. we saw the same request posted at this lucky supermarket, all due to a nationwide egg shortage that's largely blamed on the highly contagious avian flu, which has impacted millions of chickens. officials say 11 commercial farms between marin and sonoma counties had to euthanize their

eggs to crab, the season still can't start in the bay area. >> boats and crab pots continue to sit idle at fisherman's wharf. the state fish and wildlife department did allow commercial crab fishing to begin north of the sonoma county line today, but not south of it. an aerial survey still found endangered humpback whales off the california coast. >> i think eventually here we're going to get to a point where we won't have these whales listed on the endangered species list. they're actually doing very well population wise. they're increasing in numbers regardless of ship strikes or any other interference by humans. the state says it will check the waters again on thursday. >> safe bay is closing its store in san francisco's fillmore district. the store, located on webster street, opened more than 40 years ago. its last day will be in early march. the supermarket chain operates 15 other stores in the city, the closest being a mile away in the castro. >> this is the only only store, really, that we have in walking

distance. to some people, and we need a store other than a corner liquor store, and that's probably just about what they're leaving us with. so i think it's horrible. >> safeway officials say there are plans to build a mixed use development project, including both housing and commercial retail space, in the spot where the store has been. >> burglars targeted small businesses in berkeley early this morning. the owner of creekwood restaurant near sacramento and woolsey shared this surveillance video with us. it appears to show the suspect smashed the glass door to get inside. take a look at the damage. just up the street at the puff and go smoke. shop employees tell abc seven news the store was hit around 4:00 this morning. the suspects took off when police arrived, apparently leaving behind a stolen car and at nearby listos cafe, a door was smashed in. we've reached out to berkeley pd for more details about the break ins and have not yet heard back. >> work to double stack shipping containers around berkeley's people's park is on schedule.

that's according to uc officials. the university cleared the park early thursday morning. as we reported, uc wants to build student housing on that piece of land. protesters want the historic space preserved. seven arrests were made yesterday. all were cited and released. >> remembrances are coming in for a legendary bay area swim coach and former u.s. olympic team member rich thornton died yesterday in santa cruz county, preparing to go surfing. abc seven news reporter ryan curry has more on what he meant to those he crossed paths with. swimmer and surfers are mourning the loss of a beloved member, richard thornton died thursday morning at the hook in santa cruz as he was about to go surfing. >> he was following his buddy down the steps and his buddy jumped in the water, looked up for richard and richard was just standing there, kind of at peace, not clutching his heart or anything. and then he just collapsed into the water. >> his brother mark spoke to him the day before he passed. he says richard was excited to serve some of the big waves, while his exact cause of death is unknown, richard battled

multiple myeloma. his family says the cancer wouldn't stop him from surfing since childhood. the water was richard's best friend. he grew up with rob and greg warner, who say richard was always either at the pool or at the beach. >> i remember him telling me in between meets or after meets and after the season, we're like, let's go surfing. he was an anchor. he you knew you were going to get a great performance out of him and you knew if you were going to beat him, you had to be pretty good. richard's father, naught, was the longtime coach of the cal swim team, where richard also swam. >> he qualified for the 1980 national team that boycotted the moscow olympics. rob remembers the moment richard made the team . he had one thing on his mind. >> so i yelled from the stands after he'd won, richard, what are you going to do now? and he kind of goes like this, like in a surfing stance. he wanted to go surfing. that was his thing. man up until he died, he was the coach of san ramon valley aquatics. >> he guided other swimmers, helping them reach their olympic dreams, according to managers

here at the pool. richard sat on this bench every day while waiting for practice to start. his friends and family say he loved mentoring young people and doing anything to help them improve their swimming skills. >> he looked to be a mentor from day one, whether it was with the younger swimmers, whether it was as a coach taking a younger coach, his family says. >> they knew his cancer would be difficult to treat as time went on. as they mourn his death, they find solace knowing he died doing something he loved and he could be in a hospital bed for six months with uh- oxygen tube and drooling on himself and losing weight and everything else. >> and so what a way to go for someone that loved, loved the beach and being in the water in the east bay. >> ryan curry abc seven news. >> actor david soul, known for being half of the crime fighting duo in the 1970s tv series starsky and hutch, has died. the cause of death has not been released, but soul's wife issued a statement saying her husband

does raise what i like to call the stoke level up pretty darn good. >> saturday will bring the snow. sunday will bring the cold with low temps in the single digits. two things that residents haven't seen a lot this season. the first sierra snowpack survey of the year only showed a few inches quite a bit of difference compared to this time in 2023. it's a tale of two winters, right? >> last year we were talking about 32ft of snow. right now we just finished up a huge set of systems that came through. are events that just left us with six, eight, ten feet of snow. this is like 91 slow start and we've just got to work with it. something ski resorts across tahoe have been doing to the best of their abilities. >> heavenly northstar have 70 and 65% of their terrain closed. kirkwood doesn't have the backside lift operational, just about 55% total open. kirkwood vice president general manager ricky newberry hopes this storm starts off what will be anything but a dry january in tahoe. >> it's a thin base, but this mountain ski is so fun and this snow level. lots of terrain to play with. and yeah, i think,

you know, getting getting the backside and chair for going uh- this weekend. this sunday, ideally, um, we'll be set up for the rest of the season ahead. >> the snow level is expected to be down to 2000ft saturday into sunday, meaning this storm will offer more than just good skiing and snowboarding. we're seeing lake level snow, so all the different types of activities that you can do outside cross country skiing, snowshoeing, the snowmobile tours will start firing up again and that's down at the lake level. >> so anybody that's going to be coming up to the basin, they're going to be able to do a lot more out there. >> driving could be difficult to impossible saturday, but starting sunday it appears tahoe will hopefully be open for full winter mode from here on out. dustin dorsey, abc seven news. >> all right, get a look at the weather for the sierra as well as the bay area. sandias seven day forecast is next. >> the abc seven storm impacts gale. >> it's going to be a two moderate storm from 1 to 5, light to severe. >> know exactly how every storm

up there. heavy snow, windy conditions, 33 degrees. so i would not travel there saturday. sunday mostly sunny, a slight chance of snow showers. that would be your better day. and then monday is partly cloudy, 39 degrees a winter storm warning remains up beginning tomorrow morning until sunday morning, 1 to 2ft of snow higher over the peaks. we're talking snow levels that are very low. 2 to 3000ft by sunday morning, down to 1000 foot elevation. so let's talk about the snow. 13in at tahoe, 14in at donner. by sunday night we have more storms on the way for next week. and when you add all of these up close to three feet of snow in a week from today, so that is encouraging. on live doppler seven, just a few clouds out there, but the storm is coming. it's a level one on our storm impact scale. it arrives tomorrow first thing in the morning for the north bay around 10:00 11:00, and parts of the east bay as we head into the afternoon. soon everyone is getting light to moderate rain. uh- going into the four 30 hour shifts from san francisco down

towards the south bay, parts of the east bay, and at 7 p.m, just some isolated showers remain, so your high temperatures let's just say it's not going to be mild like it was today. today we had high temperatures in the low to upper 60 ends tomorrow upper 40s to upper 50s. you will need your jackets. you will need your umbrellas. it is going to get chillier as we head towards sunday and monday mornings. that's when we have a frost advisories for inland areas. low 30s for your temperatures. it's a level one for tomorrow. rain cool and breezy. you get that break sunday monday with plenty of sun after the chill and then showers arrive on tuesday. more wet weather for wednesday and friday and between thursday there's still an early morning chance. so dan and anna really kind of on this roll and we still have winter to go. so hopefully we continue to well, we'll catch up we hope with the rain. >> thanks, sandy. sandy. all right. on to sports. yeah. larry. >> bill. yeah. the warriors are on a roll to backwards downhill uh. i mean, it really feels like crisis time for this team after last night's devastating loss to the defending champs. and now

building sway. he's in tokyo with a group of about 23 college students for an education trip that he's leading. it was new year's day in japan, and they had just arrived. what a welcome and coincidence that quake, a reminder that we are living on borrowed time in the bay area with the clock ticking. a major quake here is likely. the seismologists tell us by 2032. of course, we all hope that they are desperately wrong about that , but we shouldn't bet on it. according to the head of the uc berkeley seismological lab, the only major bridges likely to be usable after a major quake, the bay bridge and the benicia bridge, the richmond san rafael is an especially bad shape. it's insane expensive to retrofit bridges and buildings in case of a big earthquake, but what really matters it could be far more costly in many ways if we don't. the clock, as i said, keeps ticking. i always love to hear from you. let me know what
