us. i'm dan ashley and i'm karina nova. >> we got word about an hour ago that the search for trapped skiers has ended. and no one else was missing. and and this is a live look at the resort which is closed for the day. the visibility is poor. and several other cameras are covered in snow for those who know the area, this avalanche happened just above the gs gully area of ct 22. >> officials say the avalanche debris field is about 150ft wide, 450ft long, ten feet deep. this is k2 22. at the centeof the map, you can see the r dotted lines here on the gondola to the top of the mountain. abc seven news reporter tara campbell is here now with the latest on what happened tragically on the mountain today. tara >> yeah, dan, we have learned that the three people who were injured during the avalanche are expected to survive. officials say one of them has broken bones . they have not disclosed the extent of the other injuries. this afternoon we spoke with a skier who was seconds from being

struck by the avalanche himself. >> i think it was really just a freak accident that caught everybody off guard, whipping winds and terrifying moments at palace aids tahoe wednesday, a mid-morning avalanche striking one of the mountain's more popular and advanced runs. >> this is a very sad day for my for my team and everyone here. um uh, this is a dynamic situation. we're still undergoing an investigation. >> traffic from palisades tahoe ski patrol is that there's a slide at the mountain with subjects buried. search and rescue teams can be heard responding to the incident around 930 this morning. an update is that we have significantly more possible burials or victims than originally intended. uh accounted for dogs in here. >> this moment caught on camera as search and rescue worked to uncover someone trapped beneath the snow. >> but as we were riding down under the chairlift, some some people on the lift started

yelling at us that there was an avalanche. >> marcus franklin and his friend were right there taking this video. >> i was so shocked to see avalanche happening this early in the morning at 930. >> julia zimmerman is an experienced mountaineer living in the tahoe region. you know, and as mountaineer, as someone who spends so much time in the mountains. >> i'm very afraid of avalanche. right. but, you know, this is why we say know before you go. you have to be prepared. now palisades has excellent team and avalanche management. um uh- system. however, the weather is almighty. >> i'm really sorry that this happened. and i'm really grateful that i was where i was when i was and not a moment earlier. >> now, palisades tahoe remains closed. officials say the avalanche debris field, the scope of it is 150ft wide, 450ft long and ten feet deep. that's bigger than two olympic sized swimming pools. so a huge area

and a reminder this awful tragedy could have been so much worse. dan and karina, yeah. >> no question. and ten feet deep. no wonder it's so hard to dig through that and heroic moves by that man that we heard from earlier today. >> tara, thank you so much. and the avalanche came just after a big storm in the sierra. >> yeah. spencer christian is here with a look at the conditions in tahoe right now. spencer. yeah. >> dan and karina, we still have a rather intense snowstorm going on in the sierra. let's take a look here at our looping satellite radar image. you can see the snow is falling rather heavily, along with a strong, gusty winds and of course, palisades tahoe is getting some of the worst of it because this is at a very high elevation, 9000ft. so some of the coldest air, some of the gusty wind, some of the heaviest snow are all elements right now. and the storm that's hitting palisades tahoe. let's pull back and take a look at our winter storm warning, which will be in effect until 1 a.m. we're expecting snow totals of 1 to 2ft from this storm. snow levels down to between 2500 and 3500ft. snow

rates at about an inch to two inches per hour. winds gusting up to 60mph. and as we look at the wind gusts going into the evening hours, you can see that the winds will lose some of their intensity. after about 8 p.m. or so. but until then, we could still see gusts nearly 60mph. and as we look at the three day forecast, we're including today because the storm is still going on, but tomorrow should be sunny. uh- temperature, high temperature about 32 degrees. a little bit milder on friday with some snow flurries. but for now and until the overnight hours, the storm continues to be rather intense. dan >> all right. spencer, thank you very much. >> abc seven news reporter j.r. stone is on his way to palisades tahoe and he joins us live for i-80 and placer county. j.r. what are the conditions like for you so far? >> well, karina, we are around 56 miles from palisades tahoe right now. >> it is 39 degrees, and this is what it looks like along interstate 80 here in this section of the sierra. and you

can see the rain is coming down. it is steadily coming down. it has been off and for on much of our journey from the bay area up into the sierra. now as to visibility, where we are, you can see it looks pretty good, but we have gone through portions of the sierra where you could only see 10 to 20ft in front of your vehicle. we were just at a rest stop, a little while ago, and you could see a lot of those truckers they're putting on the chains right now because we are just eight miles from where the chain control is in effect. so we will be putting chains on our vehicle as well. so certainly, um, certainly concerning situations we aren't seeing strong winds where we are at this location, but it's very slick outside and we are about to see the snow, but it is just such a heartbreaking situation as to what happened in palisades tahoe. so we will be bringing you updates tonight at 9:00 and also 11:00. karina now back to you in the studio. all right,

that. passing under flag. >> over 500 uniformed oakland police officers lined up to greet officer tuan lee for his memorial service at three crosses church in castro valley. >> your hurt is our hurt. your grief is our grief. every member of the oakland police department feels the pain of your loss, and i, along with the entire department, stand before you completely brokenhearted. interim police chief darren allison called officer lee a hero, an officer who brought compassion to policing. >> lee, who was 36 years old, was working undercover when he was fatally shot and killed while responding to a burglary at a cannabis business on december 29th. >> he had a true, true heart for service. his desire to better the lives of others was ingrained in his identity. it was just simply who he was as a

person. >> lee was a vietnamese refugee who came to the bay area when he was seven years old. jennifer tran, president of the oakland vietnamese chamber of commerce, says the story shared speak to officer lee's character friends that telling stories from, you know, elementary. >> he was a toddler to how he was and how he continued to show that character of integrity and love and dedication, you know, from throughout high school into his his time as a police officer. >> lee grew up in oakland, graduated from oakland high in 2006, many calling him a true representative of oakland like he was so oakland to look at the pictures, even from his engagement, like wherever they were on that time that he proposed and he was still representing oakland, he had an oakland hat on. >> and just to see his joy, um, gave a measure of calm in the midst of just the weightiness of just grieving. >> he graduated from oakland high school. he was a beloved

member of our community. he was a beloved graduate. the family also spoke at the memorial. >> his brother in law called officer lee a super hero. interim police chief allison told lee's mother that she should be proud of her son. >> thank you for all the times you covered us and supported us. your brothers and sisters and law enforcement. thank you for all the times you answered the call. i know this was not how it was supposed to end, but you can rest easy. you have given us hope. you've given us love. you've held the line. you are a true hero. just know we have the watch from here. >> anser hassan abc seven news in washington, d.c. >> house representatives announced a new move towards preventing gun violence in america. >> we need comprehensive gun safety legislation. all of us here today are committed to that. but one thing we could do right now here today, is we could ban these high capacity

magazines which have no other purpose than to kill many, many people in a very short period of time. >> colorado congresswoman diana degette forced a vote in the house on a bill to ban high capacity magazines. they've been used in all ten of the deadliest mass shootings in the country. the bill is called the keep americans safe act. democrats need at least five republican to sign on for it to pass a new plan out today to put up some guardrails when it comes to autonomous cars in california, a south bay state senator has introduced a new bill to let local lawmakers decide. abc seven news reporter dustin dorsey has the details. >> the future of artificial intelligence is out there. even driving right past you on the streets. the new wave of technology is something that many leaders like state senator dave cortez, wants to embrace. but when it comes to autonomous vehicles, he wants to pump the brakes on the current regulations or lack thereof.

>> we've never really had a system, um, in this country where for, you know, i mean, from from the henry ford days where you just go out and experiment on the streets, you know, without traffic laws in place and without, uh, the kind of, of requirements that keep it safe for everyone after seeing issues involving safety of these avs in places like san francisco and los angeles, senator cortez introduced senate bill 915 to steer driverless car safety into the hands of local governments who currently have no influence. >> cortez says once the cpuc and dmv permits the cars to be on the roads, there are not enough accountability measures. as piloted vehicles, he believes putting local governments in charge of closing this loophole is best for safety. >> city councils and county boards of supervisors meet every week. uh, they can craft an ordinance they can come back and tweak that. a month later. they're much more nimble than the state of california. >> for ai, experts agree regulation is needed, but some, like uc berkeley professor scott morris, says sb 915 isn't exactly how he would like it done. he thinks a top down

approach from the state is better then it's standardized and uniform at the broadest scale possible, which can ensure best practices everywhere. >> and it's going to be very difficult for av companies if basically every community they're working with, um, has a different form of red regulation. >> san jose state professor omid bernoff says it may be a challenge, but it's still doable. and he adds, these companies better be ready for continued calls for regulation across the board. as ai becomes more mainstream this year, 2024 is the year of the ai application, and the application cannot be accepted. >> and in the market without regulations, senator cortez says. >> sb 915 first policy committee vote will be in march. dustin dawsey, abc seven news a lot more coming here. >> we'll have more on that deadly tahoe avalanche. more from the one skier who just avoided the wall of snow. barely a state spending proposal and a major budget shortfall for california, and later, the warriors taking on the pelicans.

>> yeah. dan. karina, good afternoon. the legislative analyst's office originally claimed the state will have a $68 billion shortfall, much more than what the governor mentioned today. regardless, political analysts tell us lawmakers will have to make adjustments. >> uh- general fund governor newsom announcing wednesday california faces another budget deficit. billion projected shortfall. that we're looking to close. >> it's the second year in a row california has seen a shortfall, newsom says capital gains in the state revenue fell to 5% from a record 11% just two years ago. he also says recent economic uncertainty is partly to blame. we've got to reconcile the volatility of the capital gains, which i think only will become more and more volatile. >> on the nature of the macroeconomics. and it's really important to capture more going forward. the governor is proposing to remove 13 billion from the state's reserves or rainy day fund. >> he also aims to cut over 8 billion from state programs that

address climate change and housing. and he plans to defer over $7 billion in future payments in college funding. political science professor steve wolpert says the focus now shifts to the legislature, where it's unclear how they plan to balance the budget. >> two different things going together here. one is strategic. what are the priorities that are most important to protect and then the other is pragmatic. which interest groups have the most clout? >> governor newsom says his budget will still include proper funding for major issues. billions will be spent on mental health, housing, climate change and public safety. professor wolpert says the decisions made by certain legislators will be significant come november, but those that are in competitive districts, they're going to have to, um, make a case to their constituents that this was the best way. they, in their view, to deal with a necessity. the governor says the reason the numbers provided from his office and the law are different is

because of the tax delay. the irs pushed tax collection back to november of last year, and the state can only spend what it has in hand. even with the cuts, governor newsom says the budget should be easier to balance in years to come. >> this is a story of correction, pain and normalcy. >> now, this is the january estimate of the budget. there will be a revised plan in may which the governor says will most likely change how they allocate the funds in the newsroom. ryan curry, abc seven news dan karina okay, ryan, thanks very much. >> the governor just said phil matier is with me now. abc seven news insider this is a story of correction and normalcy. this does not sound normal to me. this is a huge budget deficit. >> no, no. and rarely do we see budget in california and normal in the same sentence. that's true. the fact is we are a boom bust state where we make money big when the stock market goes big, when tech companies sell and make money, and when the highest percentage of earners make big money, that's when we make money because our tax structure is built around the

wealthy. that's the bottom line. and so it goes up and down. >> we are boom or bust. >> that's true. it was only a year or two ago that we had $100 million surplus. and so we've gone from surplus to deficit. but on top of this we've also are starting to see the end of the covid spending from the federal level. billions came into california into schools, into transit agencies keeping them afloat. those. agencies are still suffering. and the question is now, will the state be there to bail them out, keep them from going over the fiscal cliff, or are they going to be on their own? >> you know, is this given it's an election year, is this going to pass easily or is it going to be tough, rough sledding? it's going to pass. >> it's going to pass because if it doesn't pass, then the legislature doesn't get paid. okay. so it has to it has to. it's the question is will it be workable or will it be constantly needed to be reworked. now there's going to be some tough choices here. the questions are, you know, do you defer the spending? do do you

delay the spending? are you going to not spend as much on housing on climate change? and that is going to get a lot of anxiety going in the state legislature. >> all right. let's shift topics, major news coming out of the presidential race, chris christie dropping out, polling poorly as so many of the republican candidates have been. >> what do you make of this? >> well, it's defining the race and it's narrowing it down. and what you basically have now is donald trump versus nikki haley. and ron desantis and nikki haley has been surging in the polls. she has. and there is a feeling we'll just have to see how it goes that the 12% that was going for christie would add to her 32, and that she might be then neck and neck with donald trump remains to be seen. you know, the entire republican presidential race has been about donald trump without being spoken about him in the debates, even. right. and chris christie was one of the, if not the only republican candidate out there that was openly critical of hammering away every chance he got, actually. so now we see this. it's down to whether or not it served donald trump to have as many other people in the

race as possible, as it winds down. the question is, is where does it stand in the race? right now? is it too late? >> all right. you got 15 seconds. i want to get it. katie porter dropping in the race for the senate. now in the state. first ad campaign hitting the bay area. is that a direct shot at barbara lee? >> it's a direct shot at barbara lee, but it's also a great slap on the back for us in the bay area. two reasons. one, if you're running for office in california, you better get that boat between monterey and sacramento because we are predominantly democrat. if you're going to be in a democratic primary, you want us to. and second of all, we vote more than the rest of the state. we vote more than los angeles. so this is where the races are going to be decided. >> all right. battleground here. >> that's why the air attack right now. >> all right. thanks, phil, very much. all right. >> the young boy taking the chess world by storm. we're going to show you how good he really is. i respect your kitchen. >> with a look at rain

all for us and it continues to come down. >> danny, here's a look at live doppler seven. you can see that the areas of heaviest rainfall right now are over the mountains of santa cruz mountains and over in the mount hamilton area, in the more densely populated areas. we have some showers just moving out of san francisco now, pushing across the bay. lightrillionain in the east bay from concord to walnut creek to orinda, and some steadier, heavier downpours down near san ramon and castro valley and dublin. so we've still got a storm with us and as you can see, it's moving generally from northwest to southeast in bands of showers and the occasional downpours. and it's gusty out there. wind gusts right now range generally, excuse me, from 25mph to over 35mph. but all regions of the bay area are getting gusty wind right now. so let's take a look outside and look at current temperatures 54 degrees here in san francisco, 55 in oakland, hayward 57. low to mid 50s. also at san jose, san mateo and half moon bay. other temperature readings right now is a look at a little break

of sunshine moving through the clouds over the golden gate, 55 degrees up north at santa rosa, petaluma, 5252. also at livermore and mid 50s at napa, fairfield and concord. and these are our forecast headlines for tonight. more showers with gusty wind. gusty winds will start to taper off a bit in the wee hours of the morning. overnight but then tomorrow it'll be a frosty morning. uh- sunny day though, and friday and saturday. friday late i should say into saturday. our next round of showers will arrive, so these. this is a look at our abc exclusive abc seven exclusive storm impact scale. the current storm is a level one storm. a light storm. but through tonight we expect more scattered showers arriving in bands. as i said earlier, some brief downpours, gusty winds, and of course slick roadways. his forecast animation starting at 5 p.m. and notice that movement from northwest to southeast will see pockets of showers and some downpours continuing into the early evening hours. 7:00 8:00 finally, we'll see a little bit of a pause in the activity, but

we'll still have scattered showers continuing into the late night hours. finally just before midnight, or perhaps just after midnight, we'll see the skies clearing, giving way to a sunny start to the day tomorrow. but as those skies clear, temperatures are going to plummet. the rainfall totals from now until about 11:00 tonight, generally between about five hundredths of an inch and 1000/500 of an inch. and on we go to the frost advisory. that will be in effect from 3 a.m. to 10 a.m. for virtually all of the bay area away from the bay shoreline and the coast. temperatures will drop as low. as about 30 degrees, and the coldest spots, and of course, frost is expected to form. now here's a broader look at the low temperatures projected for tonight 30 at santa rosa, 32 over at livermore, right around the bay shoreline, some upper 30s. highs tomorrow right in the mid 50s. about 55 degrees, just about everywhere here. and here's the accuweather 70 forecast. so again a sunny start to the day tomorrow but a very chilly morning. then on friday a chilly in the morning hours once again. but we'll see an increase of clouds later in the day. and

perhaps a late evening or overnight shower leading into saturday when we can expect our next round of showers. another level one storm. a slight chance of lingering morning showers on sunday, but after that, some sunshine in the afternoon. nice day for martin luther king junior day on monday, but increasing clouds on tuesday. a little bit milder on wednesday. look at that. temperatures climbing into the 60s for the first time in quite some time. >> 60s were good. >> yeah, i remember the 60s. >> yeah, yeah i mean it's nice to see all this rain, but also nice to see that sunshine peek in here and there. it certainly is. >> hello. we can use those little sunny breaks. >> yeah. yeah, absolutely. >> thank you. all right. we're coming up next. the incredible rescue efforts that took place moments after that terrible avalanche at palisades tahoe. >> well, it was like, really far from my mind that anything like this would happen on a, on a day like today. >> what this santa cruz man did when he came face to face with a man whose wife was buried under the snow

for at least today. now, more than 100 palisades personnel participated in a beacon search looking for a type of emergency locator beacon. cal fire moved resources and personnel to help with rescue efforts as well. meanwhile, the placer county sheriff's office says the avalanche debris field is approximately 150ft wide, 450ft long, and ten feet deep. the massive snow came down at at an expert run known as kate, 22, an area for the most advanced skiers and boarders. now here's an emergency call to dispatch traffic from palisades tahoe. >> ski patrol is that there's a slide at the mountain with subjects buried. an update is that we have significantly more possible burials or victims than originally accounted for. >> and this morning, the sierra avalanche center issued an alert about a strong winter storm entering the tahoe area today, bringing in intense snowfall and gale force winds. it warned that

the avalanche danger would quickly increase today, with avalanches occurring across a variety. a variety of areas. by this afternoon, the president at palisades tahoe spoke about the avalanche this afternoon. >> first thing that we do in a circumstance like this is really take care of our people. and so our guest and certainly our team members, our employees, and also our community. so that's first and foremost on my mind. um our hearts are out to the condolences to the to the victim , to victim's family. and certainly to everybody else involved in the incident as mountaineer, as someone who spends so much time in the mountains, i'm very afraid of avalanches. >> right. but, you know, this is why we say know before you go. you have to be prepared. now, palisades has excellent team and avalanche management. um, uh, system. however, the weather is almighty. >> no experts say this appears to be an inbound avalanche.

there are. these are rare types of avalanches that account for about 3% of avalanche deaths in the us. slides are especially rare on trails that are open to skiers because patrollers patrollers will typically keep areas of high danger closed until that avalanche risk dissipate. dan and corina all right, tara, thank you for all that information. >> we appreciate it. and a santa cruz man was on the mountain when the avalanche happened. he told us earlier today how he sprung into action to help with the rescue effort. >> so we were one of the first people up on ct when they opened it this morning. um, and we didn't actually see the avalanche occur, but as we were riding down under the chairlift, some some people on the lift started yelling at us that there was an avalanche. um, so then we slowed down, proceeded with caution, and as we rode down through the avalanche debris field, we came across a man, um, who had lost his wife in the avalanche. there was a couple

other people there at that time. um, but we were one of the first few to arrive. um, arrived to him, um, and he was frantically looking for his wife. um so i unstrapped my snowboard and, uh, asked where he had last seen her . um, he pointed to an area, but then somebody else said that that when they were on the lift and they had come down by this point, they said they saw her get swept quite far below that point at, um, i identified another person several hundred feet below that wasn't fully buried. um, and so, so at that point, like, i didn't have any of my backcountry gear with me. it was just kind of an unassuming day at the resort. and so i harvested or went and gathered some bamboo poles that were used for marking hazards. ski patrol places them around for to help people navigate. um, there are about ten feet tall, so i grabbed as many of those as
