tonight. the message from the oakland police department to the mother of fallen officer twan lay. >> i'm meteorologist sandyha patel tracking the storm that is dumping snow in the sierra and bringing us wet and windy weather. i'll have the hour by hour timeline coming up. abc seven news at nine starts right now. >> building a better bay area moving forward, finding solutions. this is abc seven news. >> and as we ride down through the avalanche debris field, we came across a man, um, who had lost his wife in the avalanche. >> and avalanche sweeps down the mountain at a popular tahoe resort bay, marrying and killing at least one person and injuring several others. good evening. >> i'm ama daetz and i'm dan ashley. thanks for joining us. this all happened at palisades tahoe this morning right after it opened up to skiers and snowboarders. we know one person is dead. he's identified as 66 year old kenneth kidd, who lived in point reyes as well as the truckee area. three other people

were injured, but they are expected to recover all of them were treated and released. >> officials say the avalanche happened around 930 this morning, about 30 minutes after the resort opened. it was about 150ft wide, 450ft long and ten feet deep. palisades tahoe closed for the rest of the day and has not said whether it will reopen tomorrow. >> the avalanche happened on what the resort calls an expert run, and this was the first day that run had opened for the season. >> abc seven news reporter tara campbell has been following this story for us today and joins us now live. she has details from a santa cruz man who was on the slope right after that avalanche hit. tara >> yeah, dan and ama, we've been tracking this story as it's been developing throughout the day. this afternoon, speaking with one man who was on the mountain at the time of the avalanche, just moments from being swept up in it himself. dogs in here. a frantic search at palisades tahoe wednesday as we were riding down under the chairlift. >> some some people on the lift

started yelling at us that there was an avalanche. >> a mid-morning avalanche swallowing one of the ski resorts. most advanced runs, called ct 22. >> traffic from palisades tahoe ski patrol is that there's a slide at the mountain with subjects buried. >> search and rescue teams can be heard on dispatch radio responding to the incident. around 930 in the morning. >> an update is that we have significantly more possible burials or victims than originally intended accounted for. >> this is a very sad day for my for my team and everyone here. um uh, this is a dynamic situation we're still undergoing an investigation. >> we're really grateful that i was where i was when i was and not a moment earlier. >> marcus franklin and his friend were mere moments from being caught up in the avalanche, capturing this video of the search and rescue efforts. >> we came across a man, um, who had lost his wife in the avalanche. there was a couple

other people there at that time. um, um, but we were one of the first few to arrive. >> the santa cruz resident taking action of his own to help find those lost, including that woman who survived. >> i harvested or went and gathered some bamboo poles that were used for marking hazards. ski patrol places them around for to help people navigate. um. there are about ten feet tall, so i grabbed as many of those as i could and, uh, handed them out to people. so we could try to strike the ground. uh, combing the avalanche field to get a positive strike. when you make contact with somebody's body, when they're fully buried, experts say this appears to be an inbound avalanche, which are rare, accounting for about 3% of avalanche deaths in the u.s. >> slides are especially rare on runs that are open to skiers. we'll evaluate the conditions and based on our expertise and our experience and the history, um, if we deem this condition safe, then we will open them. and that's exactly what they

did. opening ct 22 this morning. less than an hour before the avalanche hit. >> and we've had ski patrol up there doing avalanche control assessments since sunday. so for the past few days they've been up there doing control work, evaluating weather conditions, um, setting up all the safety markings, hazard markings, etc. to get it prepared for today's opening. >> now, we're also working to learn more about the man who was killed in this morning's avalanche. as well as when palisades resort and mountain plans to reopen. of. and of course, we'll be keeping you updated as we get more information on dan and emma. >> all right. thank you so much, tara. and palisades calls the ski run where this avalanche happened. north america's shows the front side of palisades trails. here you can see the ct ss trail. the gs gully area where the avalanche happened is at the top of the run, near the gs bowl. >> the last major avalanche at palisades tahoe happened back in march of 2018, when it was known as squaw valley. then a wall of

snow buried five people, including a bay area couple, near the olympic lady chairlift. all survived before today. the most recent deadly avalanche at a sierra resort happened at alpine meadows that was in january of 2021. skier was killed and seriously injured. another. in the deadliest avalanche in state history also happened at alpine. seven people died on march 31st, 1982, when. a wall of snow buried dozens of skiers and employees. it also caused millions of dollars in damage to the resort. most avalanche deaths happen in the back country, according to the website. at ski california, 5% of all avalanche fatalities in the u.s. since 2010 have involved guests skiing or snowboarding. inbound so what happened today is rare. we have been sending out updates on today's deadly avalanche through the abc seven news app. if you download it and enable push alerts, you'll get updates on your mobile device, and conditions are tough in the

sierra right now. >> it took hours for abc seven news reporter j.r stone to reach tahoe. take a look at what it's like there tonight. >> i'm at palisades tahoe where this deadly avalanche happened today. the snow continues to fall and we are still feeling these strong occasional wind gusts that just come whipping right through here. i've talked with a number of people this evening about that avalanche that happened wednesday morning. so many in this community are shaken up over what happened. some people going so far as to tell me they were surprised that some of these runs were actually open on wednesday morning, saying that the wind gusts tuesday night and even wednesday morning were extremely strong. some of the people telling me they didn't come skiing because they thought they would be closed because of the weather conditions. you'll hear from some of these people tonight at 11:00. >> all right. thank you, j.r. and this is what it was like trying to get up to lake tahoe today. the road. man, look at all that snow there. chains have been required on 50 and 80 since

this morning. so let's bring in abc seven news meteorologist sandhya patel. >> yes, sandhya, what are conditions up there right now in the sierra? >> it's pretty bad right now. heavy snow falling down and ama in the high country at this hour. let's take a look at a live picture right now from mount rose in. this pretty much sums up what's happening. the snow is blowing sideways because of the gusty winds. now take a look at palisades tahoe where it is. let's talk about what possible factors may have contributed. so the sierra snowpack right now in the central sierra is 38% of average. you've got multiple layers here. typically you have a bed layer a weak layer and a slab layer. now with the snowpack not very built up, any precipitation on top of that wind temperature changes can really impact it. so let's take a look at the factors. those are the factors. and humans can trigger an avalanche. as snowboarders and skiers go down the slopes. at the time there were powerful wind gusts nearby about 100 plus miles an hour. one thing to consider is safety. wearing perhaps an avalanche

beacon, especially as we're getting more and more snow up in the mountains. at the time of the accident, it was light snow. as you look at the radar taking you back in time, but it was gusty and the snow has been picking up steadily tonight. winter storm warning until 1 a.m. tomorrow. up to 18in for the peaks with those gusty winds. snow level dropping to 2500ft when you have 1 to 2in per hour, it's going to be very difficult to impossible to get up there on. live doppler seven we do have some rain here locally. it's focused on the south bay, san jose, evergreen, willow glen, heading into the santa cruz mountains, light to moderate showers. right now it is a level one on our storm impact scale, and it is kicking up the winds as well, timing it out for you a few more hours of this wet weather and then by the time you wake up, it is all gone . gusts to 41 at sfo, 39 in oakland right now. i'll be back with a full look at the timeline and let you know when our next storm is coming in. just a few minutes. >> dan okay, sandhya, thanks very much. >> oakland remembered one of its own today. police officer tuan

lay, officers from all over the bay area and across the state attended today's service, which was held in castro valley. >> one even came from as far away as france. it was the final farewell for officer tuan lay, who was killed responding to a burglary nearly two weeks ago. >> now, abc seven news reporter anser hassan was at today's service with that all passing under the american flag. >> over 500 uniformed oakland police officers lined up to greet officer tuan lay for his memorial service at crosses church in castro valley. >> your hurt is our hurt. your grief is our grief. every member of the oakland police department feels the pain of your loss, and i, along with the entire department, stand before you completely broken hearted. >> interim police chief darren allison called officer lay a hero, an officer who brought compassion to policing. lay, who

was 36 years old, was working undercover when he was fatally shot and killed while responding to a burglary at a cannabis business on december 29th. >> he had a true true heart for service. his desire to better the lives of others was ingrained in his identity. it was just simply who he was as a person. >> lay was a vietnamese refugee who came to the bay area when he was seven years old. jennifer tran, president of the oakland vietnamese chamber of commerce, says the story shared speak to officer lays character friends that telling stories from, you know, elementary. >> he was a toddler to how he was and how he continued to show that character of integrity and love and dedication. you know, from throughout high school into his his time as a police officer, lay grew up in oakland, graduated from oakland high in 2006, many calling him a true representative of oakland like he was so oakland to look at the pictures, even from his engagement, like wherever they

alaska flight and there were no cancellations. today at oakland. >> on to storm. watch this weekend's planned closure of six 8-80 in pleasanton has been canceled because of rain. caltrans needs to repair deteriorating pavement on the highway. the closure will be rescheduled for sometime in february. and check out the rain that fell today. this is video from washington square park in san francisco capturing a quick downpour late this morning. wow, it's a rainbow two today. >> did you really? oh, that's always nice. all right. uh, a lot of rain and a lot of snow in the sierra. yeah. so let's get to sandhya patel for the latest. >> sandhya. yeah. >> dan. and let's take a look right now as to the three day forecast for tahoe. and then we'll talk about what's happening on live doppler doppler seven. excuse me. tomorrow. mostly sunny skies. if you want to head up to the mountains to enjoy the snow. tomorrow is your day. 32 degrees, mostly cloudy, gusty on the peaks. we are looking at heavy snow on saturday so definitely not a good day to go on saturday. now let's take a

look at the current conditions up in tahoe. it is 27 degrees. they are chaining up on all roads leading up to the mountains. heavy snow falling at tahoe right now with a south wind. so looking at live doppler seven, you will notice that thunder snow in the sierra. and then the snow continuing to fall across the region. scattered showers here locally and i do want to show you where it is focused at this hour between morgan hill and gilroy. we are seeing some light to moderate rain also around san martin, santa teresa boulevard, monterey road. this is where it is wet at this hour. santa cruz mountain seeing those scattered light showers and really this is going to continue for a few more hours before all is said and done. slick on the golden gate bridge. low 50s from san francisco to hayward, san jose, 5252 degrees. right now 52. in half moon bay, our rainfall has ranged anywhere from a few hundredths in places like santa rosa to about a half an inch in some of our wetter spots, 48 right now in santa

rosa, 49 in napa, it is 51 in concord and 41 right now in livermore. oakland airport camera. you can see that the runway was wet as well. here's a look at the headlines tonight. showers gusty winds tomorrow. cold and frosty in the morning and friday night going into saturday. our next storm arrives. this one looks like it's going to get give the north bay heavier rain than what they have been seeing today. so a coastal flood advisory begins at 9 a.m. tomorrow. it is going to run until noontime and this is for the same reason that we've been seeing the flooding today. we saw it due to the king tides once again tomorrow morning. watch out if you're going to be out and about. a frost advisory goes up from 3:00 until 10 a.m. all areas shaded in blue, which is the mountains and the valleys. temperatures as low as 32 degrees. you can bet there will be frost, so you'll want to protect any tender plants. it's a level one through tonight. scattered showers, some brief downpours, gusty winds with slick roads. it's not a widespread rain event for the rest of the night. we are looking at those showers at

10:00 along the coast around the south bay. you will notice at 1130 still in those general areas before this system, pretty much winds down and you get a break. but it will be cold tomorrow morning. rainfall totals will be an additional quarter, maybe a half an inch. as we look at your morning temperatures, they'll be in the 20s to 40s. it is going to be very cold and tomorrow afternoon you're looking at highs that will range from the 40s to the 50s, but at least there are sun will be out. you get a chance to dry out. here's a look at the accuweather seven day forecast. and it does feature a cold morning tomorrow. uh- with the frost around chilly again friday morning. although i think the clouds increasing will help out. and then on saturday we have rain windy conditions. it's a level one right now. early morning chance lingering on sunday, but if you do have plans on martin luther king junior day, morning fog and then clouds right now it's looking like it's okay. milder pattern for tuesday wednesday with more more rain at least a chance coming into the picture beginning on wednesday.

and of course dan and ama. this also means more snow for the mountains. one very important thing to keep in mind is as people are going up there to enjoy the slopes, to do it safely and of course, wearing an avalanche beacon would help out. oh, that's a good point. >> yeah. all right. thanks, sandhya. >> well, demolition meant to start today on a los altos strip mall that caught fire on christmas morning. has been delayed. now taking down the parts at risk of collapse means fire investigators can finally get inside to figure out what sparked the fire was just too dangerous. otherwise it also means part of el camino real near san antonio road will be able to reopen. that's expected to happen after the demolition work is completed. all streets surrounding berkeley's people park are open once again. those streets had to be shut down last week as a barrier of shipping containers was installed around the park to keep unhoused people out. uc berkeley plans to build new student housing in that area , but that plan has led to protests. construction is on

hold until pending legal issues are resolved, but the university says 24 hour security will patrol the area until the housing complex is finished. >> a south bay project years in the making is now a reality. a 94 unit permanent supportive housing complex in san jose has given formal unhoused seniors a new home. it's located just east of the airport on north fourth street at east younger avenue. abc seven news south bay reporter zach fuentes got a look inside the location that's hoping to change lives and build a better bay area. >> welcome to my home. thank you , my lovely, lovely home. >> it's been a long journey for patty freudenberg to get to this home. she'd been homeless for five years, but after some tough challenges, freudenberg was connected to services that led her to path villas at fourth street in san jose. when i walked through that door, i burst into tears. >> i did, i literally burst into tears because i never imagined, i never dreamed that this would be my home. >> the newly built affordable housing community celebrates its

grand opening wednesday. the 94 units are for seniors who were unhoused. >> that's one of the largest growing populations of homelessness. and it just it's heartbreaking, right? it's our grandparents. it's soon to be our parents. >> villas at fourth street broke ground in august of 2021. the services at the site are provided by the nonprofit path ventures. a lot of wraparound services. >> that means fun things to like bingo on thursday nights or a movie night. but bringing people together so that they create a sense of community and belonging. >> the project received funds from sources like voter approved measure a and private partners. each resident who moves in is referred by the county's office of supportive housing. their rent subsidy paid by the housing authority based on income, san jose mayor matt mehan said. it's an example of how to get people off the streets and also a reminder when you have seniors who can be stably housed but just can't find affordable housing, it's a clear signal that government needs to do more to ensure that we are producing the market is producing that kind of affordable housing. though wednesday's grand opening is considered a celebration, those involved say their overall work is far from finished.

heart say and deny that the data that we see here today and have seen over the last couple of years is not warranted. if passed, the ban would be phased in over a period of years, taking full effect in 2029. >> today, governor newsom introduced his state budget proposal for next fiscal year, and it's a doozy. the governor is projecting a nearly $38 billion deficit hit abc seven news reporter ryan curry takes a look at how the governor hopes to make that up. >> uh- general fund governor newsom announcing wednesday california faces another budget deficit at 37.86 billion, billion. projected shortfall that we're looking to close. >> it's the second year in a row california has seen a shortfall, newsom says capital gains in the state revenue fell to 5% from a record 11% just two years ago. he also says recent economic uncertainty is partly to blame. >> we've got to reconcile all

the volatility of the capital gains, which i think only will become more and more volatile. on the nature of the macroeconomics, and it's really importt to capture more going forward. >> the governor is proposing to remove 13 billion from the state's reserves or rainy day fund. he also aims to cut over 8 billion from state programs that address climate change and housing. and he plans to defer over $7 billion in future payments in college funding. political science professor steve wolpert says the focus now shifts to the legislature, where it's unclear how they plan to balance the budget. >> two different things going together here. one is strategic. what are the priorities that are most important to protect? and then the other is pragmatic, which which interest groups have the most clout. >> governor newsom says his budget will still include proper funding for major issues. billions will be spent on mental health, housing, climate change and public safety, professor wolpert says the decisions made by certain legislators will be significant come november, but

those that are in competitive districts, they're going to have to, um, make a case to their constituents that this was the best way they, in their view, to deal with a necessity. the governor says the reason the numbers provided from his office and the law are different is because of the tax delay. the irs pushed tax collection back to november of last year, and the state can only spend what it has in hand. even with the cuts, governor newsom says the budget should be easier to balance in years to come. >> this is a story of correction and normalcy. >> this is the january estimate of the budget. there will be a revised plan in may. governor newsom says at that point, there will most likely be a different sort of spending that they're going to have to allocate in the newsroom. ryan curry, abc seven news and california is living up to its reputation as a boom bust state with this latest budget. >> i spoke with abc seven news insider phil matier earlier today about the big swing from surplus to deficit.

>> we make money big. when the stock market goes big, when tech companies sell and make money, and when the highest percentage of earners make big money, that's when we make money because our tax structure is built around the wealthy. it was only a year or two ago that we had $100 million surplus. and so we've gone from surplus to deficit. but on top of this we've also are starting to see the end of the covid spending from the federal level. billions came into california into schools, into transit agencies. >> phil says he expects the legislature to pass the legislature to pass the budget, because if they don't, they don't get paid. >> a colorado town is searching for its next mayor, and only animals can apply. the town is called divide and its only elected animals as mayor for the past 12 years, part of a long running campaign to fund the local animal shelter, the current mayor, clyde the donkey, is three months away from hitting his time limit, but has big plans for his political

seeing issues with autonomous vehicles all across the state, state senator dave cortese wants to make them safer. he's introduced a bill that would put decisions for these cars in the hands of local lawmakers, not state lawmakers. abc seven news south bay reporter dustin dorsey explains the future of artificial intelligence is out there, even driving right past you on the streets. >> the new wave of technology is something that many leaders, like state senator dave cortez, wants to embrace. but when it comes to autonomous vehicles, he wants to pump the brakes on the current regulations or lack thereof. >> we've never really had a system, um, in this country where for, you know, i mean, from from the henry ford days where you just go out and experiment on the streets, you know, without traffic laws in place and without, uh, the kind of, of requirements that keep it safe for everyone after seeing issues involving safety of these avs in places like san francisco and los angeles, senator cortez introduced senate bill 915 to steer driverless car safety into the hands of local governments

this year after 26 years at city hall. all the effort to recall oakland mayor shengtao is quickly turning into a war of words. and tonight we're hearing from one of the mayor's most outspoken critics. yesterday, the mayor's office addressed the recall effort, calling it a distraction and a quote, desperate attempt for relevance. the mayor's chief of staff has called the recall, led by called it a recall led by losers. former alameda county judge brenda harbin. forte helped launch the recall effort, and today she fired back, saying in a statement, quote, it's disheartening to witness the mayor's office respond in such a dismissive and callous way. in the meantime, the murder rate rises, businesses close, and we still don't have a permanent police chief. talbots, the full responsibility for oakland's decline with her incompetent leadership, her office's actions and remarks are offensive to everyone in oakland. end quote. >> so that process is getting more intense. obviously. so is the weather. we want to update that for you. yeah. >> let's get to sandhya patel

storm has been bringing the snow to the sierra nevada. so scattered showers to the bay area. but we're really just watching. is some of these showers off the coast that still are trailing the coastline. so while you're sleeping, those showers will wind down. here's a quick look at it. 1130 still some pockets of wet weather at midnight as well. and then it's all gone by the time you wake up. but it is going to be a chilly one tomorrow morning with frost advisories for the valleys and for the mountains tomorrow morning. tomorrow afternoon, plenty of sun. we're looking at highs in the 40s and 50s. if you're looking for more rain, it's coming back friday night into saturday and this does mean more snow for the sierra. continuing into the early part of sunday before another system arrives the middle of the week. accuweather seven day forecast. it's cold couple of mornings with frost and then a level one on saturday. i think you'll get a chance to enjoy the second half of the holiday weekend. if you have it. milder conditions next week for the afternoons and the mornings. >> ama and dan all right, looks good. thanks, sandhya, barbie and oppenheim lead the way in
