voices. >> republican candidate steve garvey now polling second in the race for california's senate seat. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us. new poll now showing the race tightening as the former baseball star made a visit to the bay area today. >> abc seven news reporter zach fuentes joins us live from our south bay bureau with a closer look at the poll and what the numbers could mean as we get closer to the march 5th primary. zach yeah, it's important to remember that in this primary race, the two candidates with the most votes go on to the november election regardless of their party and californians haven't elected a republican to the u.s. senate since 1988. >> but this new poll does show garvey possibly making it into the top two for the race to claim the u.s. california senate seat is heating up. a poll released thursday by emerson college shows where the four frontrillionunners stand. 25% of respondents said they'd vote for adam schiff, putting him in the lead in second place is republican candidate steve garvey, with 18% democratic candidates katie porter and

barbara lee came in third and fourth place with 13 and 8. garvey met with members of the bay area jewish community thursday at the chabad of the tri-valley to talk about the impacts of the israel-hamas war. he reacted to that poll following the roundtable discussion. well we had a good poll come out today. >> yeah, not bad for a guy. three and a half months into this, into this journey. >> abc seven news insider phil matier says voter uneasiness could be a factor into why garvey's polling so high. it could also be the topics garvey has brought up at his campaign stops. >> there's a lot of things that democrats were not hearing a lot about. things like gaza. we're not hearing a lot about the border and other sort of hot button issues between those three democrats. you throw a republican into the debate that could change those topics top of mind at garvey stop in pleasanton thursday. >> we basically have one voice in california. >> it's time that there's another voice. >> leaders at the chabad of the tri-valley are fast to point out that they're not endorsing anyone, but, say, a willingness

under arrest for building a homemade bomb. san jose police say a device was foundn june of 2022 near the intersection of del mass and co avenues. they add it was not far from an elected official's home. now, police shared a picture of what looks like a pipe bomb lying on the ground after a lengthy investigation, the suspect was tracked down this week and arrested during a search of his home. investigators say they found a guide on how to make explosives. the suspect made his first court appearance today and is being held without bail for four men linked to the murder case of officer tuan lei pleaded not guilty today. >> attorneys for two of them are asking now for speedy hearings. abc seven news reporter anser hassan an was in court. >> all four men charged in connection to the murder of oakland police officer tuan lei pleaded not guilty in court on thursday. >> right now, mr. cooper is being charged with murder. uh it's a felony murder theory. um, so there's a certain elements and aspects that they need to prove to try to attach him to the homicide, and we just don't think there's enough there for that.

>> attorney ernie castillo represents marquise cooper, the latest of the four men charged in this case. cooper is charged with a total of 16 felonies. castillo says they want a speedy preliminary hearing because we feel our clients being overcharged in this case, and we want to deal with that right away. >> but it's my understanding my client was not present during the shooting, was not inside this building, had no involvement in what went down at the time of the homicide officer lei was working undercover when he was fatally shot in the head while responding to a burglary call at a marijuana business in the early hours of december 29th. >> mark sanders is accused of firing the fatal bullet. alan brown accused of driving the getaway vehicle a fourth man, cibran russell, is charged with burglary and is out on $270,000 bail. >> we would like to remove mr. russell from this narrative, and we think the best way to do that is to have a quick and speedy preliminary hearing. >> attorney david knudsen represents russell. he and his client also want a speedy preliminary hearing. meanwhile, both knudsen and castillo raised concerns in court over delays in

receiving discovery from the prosecution in. >> i'm sure the district attorney is working on it diligently, but yes, i have not been provided any discovery. we have about 19 pages at this point. >> it's pretty important, especially since we're moving relatively quickly. so we want to get all that information as soon as possible, do our own investigation and figure out exactly the limited role that my client had in this case, a discovery hearing is set for january 24th. >> the preliminary hearing for march 4th, the alameda county district attorney's office did not return requests for comment. in oakland, anser hassan abc seven news. we learned today that a man wanted in the shooting death of a security guard in oakland is in custody. >> lauren gilbert is believed to be the getaway driver in the 2021 attempted robbery and killing of retired police officer kevin nishida, who was guarding a tv news crew at the time. gilbert was arrested yesterday in kansas city, missouri. two other men also face charges. >> abc seven news i-team reporter dan noyes broke big news out of san mateo county superior court earlier today. the los angeles innocence project is seeking a new trial

for convicted murderer scott peterson. peterson was sentenced to life in prison for killing his wife, laci, and their unborn son. that was in 2002. the innocence project's decision is based on evidence related to a burglary across from the peterson's home in modesto, which one of the thieves says laci witnessed. they want to find out if a van that was found torched near the modesto airport is connected to the burglary. investigators found a blood stained mattress in the van, and investigators want to conduct dna testing for a possible link to laci. >> the los angeles innocence project has seen it has seen it as it is, seeing it as a case that is worth their time and their effort. and usually they only take cases where they think that someone is wrongfully convicted, or they have a strong belief that someone's been wrongfully convicted. >> scott peterson has his innocence since his conviction in 2004. peterson was originally sentenced to death, but that was overturned to life in prison. >> new developments on the ongoing lawsuit against the city

of san francisco over clearing of homeless encampments. our media partner, the san francisco standard, is reporting that the city is petitioning the courts to pause proceedings in that case, pending the us supreme court's review of a similar case. the supreme court plans to consider johnson versus grants pass later this year. a lower court's decision in that case affirmed the right of unhoused people in grants pass, oregon, to camp outside when no other shelter is available. >> all right, let's turn to the weather dry now. but that's about to change. for more, let's go to abc seven news meteorologist sandhya patel. sandhya. yeah, dan. >> and that change begins as early as tomorrow. >> we are looking at a series of systems that will impact the bay area all the way into next week. as we take a look at live doppler seven, you will notice that the storms are all lined up across the pacific. and here is what we are expecting tomorrow through the middle of next week. those series of storms will bring downpours at times. gusty winds possible downed trees and outages, minor flooding on the roadways, those smaller streams

and creeks as they rapidly rise. there is a possibility of shallow landslides now. rainfall projections runs tomorrow through tuesday. the coastal hills 5 to 8in the north, bay 3 to 5in rest of the bay area between an inch and a half and three inches of rain. when the ground is already saturated, it's going to be hard for the ground to absorb any more rain, as those storms come in one after another, so it's a level one for tomorrow. here's a look at the timing. your morning is okay. there might be a spotty shower or two. the main event arrives in the afternoon with wind and moderate to heavy rain, and it continues as we head into tomorrow night. i'll be back with a closer look at that weekend storm that does look stronger in just a few minutes. >> dan, we've got a busy few days. thank you. sandy, don't forget you can track the forecast anytime with the same live doppler seven that sandhya uses every day. just search abc seven bay area in your device's app store to download it. now coming up, promoting small businesses while trying to revive downtown san francisco, we're going to check in on the

better bay area, and one project involved encouraging downtown landlords to host pop up shops over the holidays. >> abc seven news reporter lyanne melendez is here. with how these pop ups are doing. >> well, you know, i have to say it looks promising for them. yeah, yeah, they're very optimistic. so that's very good. now they opened last october, so three months ago as part of an experiment to bring small businesses to the downtown area, rent free. now, after all, there are so many vacant properties downtown, so why not offer them

a space that would have gone empty anyway. some of the stores that popped up in downtown san francisco are uncommon, unlikely, and peculiar. like holistic each a description is optional. >> it's a sewing school in a factory with an alterations department and donation center in a city that prides itself for being unconventional, it may be a great fit for a downtown that's evolving a critical aspect that was the property owners had to be willing to provide free rent for the pop up locations. >> i started sewing jeans. >> it's my idea. natural, organic progression of things. >> as a pop up, he was given the rare opportunity to open a store in a prime location, a startup, if you will, with all the nuts and bolts we provided, the technical assistance and the permitting and all the stuff that that small businesses that that would prevent them from just opening up shop downtown, whack vegan donuts is another pop up. had you not had this opportunity, do you think you would have made it?

>> no, i think we need programs like this to help small businesses not only get that foot in the door, but like, you know, show that like, you know, cities revolve around small businesses. the icing on the cake? >> well, in this case, the donuts was the generous offer that came with opening shop in the pricey downtown area. there are 17 pop ups housed in nine storefronts that means that some of them share a space with another pop up through the nonprofit at sf new deal. these pop ups also received a grant of between 3 and $8000. >> special breakfast, no bacon. okay, anything else? >> this arrangement gave small neighborhood businesses like devils teeth bakery a chance to set foot in the downtown area, something that would have been financially impossible just a few years ago. they share their space with green apple books in the embarcadero center, marrying two of our activators together allowed us to get more bang for

our buck in terms of people we were supporting and businesses we were supporting, and it allowed the street fund to get that much more energy. >> now that there are three month rent free leases are up, we asked how many had been successful and ready to renew. >> so are you thinking of staying past your three months? >> oh yeah, i barely announce that. yeah, i'm going to. i'll be here for more than three months. >> lease extensions were given to eight of the nine storefront sites. we found out that these property owners were willing to add another three months of free rent. what happens next is to be negotiated, and that's when an optimist is born. >> there will be a good amount of people that will campaign and say they need to stay. let's figure out how they can stay. but the downside to any business here is that some people continue to work from home, staying clear of the downtown area. >> that's why most of these pop ups have limited hours. the office vacancy rate in downtown remains at 34.

>> the businesses that we're seeing are not going to be successful solely off the backs of workers. we're they're going to hopefully succeed because we're going to have more people living downtown, and we're going to have more events happening at night. we're going to allow people to drink outside at the bars, and those are going to be reasons they're going to come downtown as well. >> tell me what? tell me what you have learned did from this experience. uh, it's not easy, is it? >> it's not easy. it's not for the faint of heart, but the experience in itself has been the greatest teacher. so we're on a rise. we're on a rise for him now. >> coming up in the spring, they will announce a new group of pop up businesses that will be supported by both the city and property owners. now we want to mention that boston properties, which owns the embarcadero center, offered four vacant spaces, and that's the most of any developer. and i think what they want to do, these developers and property owners, is really attract people. the foot traffic. sure. and bring

more activities and empty stores help no one. exactly and then maybe attract other business owners down the line so they're thinking into the future when the going gets tough, the tough get creative. >> right. exactly. thanks, liane. thank you. >> a bay area city once called a murder capital of america is reporting its lowest homicide rate in decades, according to data uncovered by the east bay times. richmond had eight homicides last year, down from 18 in 2002, and it's the fewest since the city started keeping track in 1971. some officials quoted in the report attribute the total to a multifaceted approach, including prevention and intervention efforts that address crime at its root causes. keep

reporter dustin dorsey has the story. >> athletes are trained to stay in the moment. don't get too far out, but that's not an option for people planning two massive events at levi's in 2026 the super bowl and the world cup. >> can you imagine the excitement that we have with two global events here in santa clara and the incredible opportunity for us to showcase who we are here in the heart of silicon valley? >> assembly member evan lowe has high expectations and with good reason. super bowl 58 years ago pumped nearly $300 million into the bay area. so 2026 is another huge opportunity. >> and leading up to the anticipation of these major events, we need to do what is necessary in helping to ensure that all thrives and that we address any of the type of challenges that exist. >> one of the biggest challenges, he says, is making sure the host committee is on the same page, especially with safety, with tens of thousands of people expected for both the

super bowl and the world cup, public transportation will be critical. the valley transportation authority held the first planning meetings thursday, basically putting all of the players that would be involved in those large scale events in one room to sort of talk through the process of how they would handle different scenarios. aston green is vta's chief system safety and security officer. super bowl 50 was great practice, but it's a whole new ball game now. >> we didn't have the access to security technologies that we do now. we did not necessarily have the tools to be able to prepare virtually, right, in terms of training and exercises. so we're basically looking at how things have changed and training to make sure we can handle that change with the whole world watching two years from now, the athletes aren't the only ones getting ready for game day in santa clara. >> dustin dorsey, abc seven news i just want to stand outside without rain on me as much as i can today. >> yeah, take today's the day to do it. >> i think we're going to run

out of options. the next couple of days. is that not right? sandia you're absolutely right. >> dan and ama, the next six days you're going to need to have your umbrella handy. it's not going to be raining all day long every single day. but but it is not going to be completely dry. so let's take a look at our headlines for the week ahead. level one system moving in with wet, windy weather in the afternoon evening a stronger storm sunday monday with downpours. thunder chance and possible damage. we're talking about minor flooding, streams, creeks, those smaller streams and creeks, the roadways and wind damage is certainly possible with downed trees and the potential for power outages. so as we look at the pacific, the storms are lined up. this first one coming in tomorrow. so right now ahead of it, we are seeing a lot of cloud cover. but you still have today to get out and get some stuff done. if you do need to, and prepare for the upcoming storms, 50s and 60s on your temperatures right now, today's highs were anywhere from the upper 50s to the mid 60s. a few degrees above average for most of you. as we look at live pictures from our tower cameras all pretty views you can see the

high clouds streaming through here. a level one storm for tomorrow afternoon evening rain in brief downpours, gusts to 40 miles an hour, slick roads and poor visibility is what you can expect. winds come up out of the southeast tomorrow afternoon, over 30 miles an hour near the coast. not terribly windy inland, but along the coastline is where you'll see those strongest winds. 4:00 pm to 5:00 pm, 35 to almost 45 miles an hour there along the coastline. and that pattern continues into the evening. so if you do not have a reason to get out tomorrow might be a good idea to stay indoors for the afternoon evening rush and obviously for the getaway, because it is going to be a bit challenging. 930 tomorrow morning, maybe an isolated shower or two, but 4:00 is when you start to notice some moderate to heavy rain moving in 8 p.m. still seeing some heavy rain at times. this goes on at 10 p.m. and then it turns over to scattered showers for the night. saturday morning the focus is on the north bay. we see some scattered showers going into noontime for the rest of

the region. as you will notice, at 5:00. big game happening at levi's stadium. there will be some showers around 7 p.m. more rain coming into the picture and this continues to carry on. so here's a look at the forecast for the playoffs. niners take on the packers 57 degrees at kickoff. showers breezy. fourth quarter. you are looking at a rainy night. good idea to pack a raincoat or a poncho if you are going sunday and monday. it's basically between sunday monday that we're expecting potential for excessive rain. that means flash flooding is possible on those smaller streams and creeks. something to keep an eye out on. rainfall estimates through saturday night, anywhere from a third of an inch to almost two inches here. but ukiah, you're going higher than that now. when we add up the additional rain, many of you will be in that inch and a half to almost five inches of rain with isolated totals going up to the eight inch category, especially in places like the russian river. santa cruz mountains could see heavier rain as well. winter storm watch 10

p.m. tomorrow until 1 a.m. tuesday. heavy wet snow snow levels are going to be high and then they will rise a little bit sunday night. so we're talking about 1 to 3ft above 7000ft, gusts to 45 miles an hour travel will be very difficult, tim. possible tomorrow morning. clouds temperatures in the 40s and 50s. tomorrow afternoon. 50s, 60s. it will be a wet, windy friday as we check out the accuweather seven day forecast. it's a one for friday level two on saturday, but not so much because it's a stronger storm. it's just because the ground is going to be so saturated and anything that falls on top is going to aggravate the area. so we'll see some minor roadway flooding level two for sunday into monday, a stronger storm heaviestrillionain is sunday night into early monday. chance of thunder and then a weaker system tuesday into wednesday. that's a one dan and omar. wow. >> all right. >> thank you sandhya. it's
