christmas in 2002. their bodies were found in san francisco bay a few months after scott peterson is currently serving life in prison, but a new court filings the innocence project says peterson's innocence is supported. quote by newly discovered evidence since. abc seven news i-team reporter dan noyes obtained the legal documents from san mateo county court yesterday. the 1500 pages of motions and exhibits call for a new review of all the evidence and tips that came in and a new trial. the innocence project is a nonprofit legal organization that has been able to exonerate people who've been wrongly convicted. >> the los angeles innocence project has seen it, has seen it as it is, seeing it as a case that is worth their time and their effort. and usually they only take cases where they think that someone is wrongfully convicted, or they have a strong belief that someone's been wrongfully convicted. >> scott peterson has claimed his innocence from the day laci disappeared, and after his

conviction in 2004, in court filings, peterson stated, quote, i had absolutely nothing to do with the disappearance and deaths of my wife and son. i am not a violent person. i have never had a physical fight or violent incident with anyone in my life. peterson was convicted and sentenced to death in 2004. following years of motions. in august of 2020, the california supreme court upheld peterson's conviction, but overturned his death sentence in december of 2021, a san francisco county superior court judge resentenced him to life in prison for laci peterson's murder without the possibility of parole. to look back at how the case unfolded, you can check out a timeline. it's on abc seven news.com. also developing an older murder case. the family of kristin smart is suing cal poly san luis obispo, where she disappeared 28 years ago. her former classmate, paul flores, was eventually convicted of her murder in 2022. reporter

kayla mueller breaks down the lawsuit. >> the university could and should have prevented kristin's murder, and the university could and should have acted much differently in the wake of her disappearance. >> the family of stockton native kristin smart suing cal poly, saying the school didn't pursue a missing person case fast enough, didn't interview witnesses in a timely manner, and didn't even search paul flores dorm room until 16 days after kristin disappeared. >> they just want justice, you know, and whatever form that takes. and they want the university to take responsibility. >> an attorney for the smart family says they weren't aware of the failures by cal poly until the university president issued a public apology last may, saying in part, we are very sorry for what the smart family has endured. while it is a different administration now than was in place in 1996, we recognize that things should have been done differently and i personally wish they had, for there were a number of reports

of his abuse towards women in, you know, in the in the years leading to up to 1996. >> um, and then the failures after the fact before kristin's disappeared, multiple reports had been made about paul flores to cal poly on the basis of threatening stalking and harassing behavior behaviors. >> the suit claims should have led to flores being removed from campus, which would have ultimately prevented kristin's murder. the smart family said in a statement to cbs 13 there is no question that cal poly failed our daughter, kristin smart, in multiple ways before and after her tragic murder by paul flores had the university acted properly, conducted a thorough investigation into flores past concerning behavior and implemented appropriate disciplinary measures, kristin would still likely be alive today. >> flores should not have been on campus, he he had a history of violence against women and he had the university done its job. um mr. flores would have been

expelled and or suspended or disciplined, or at least at the very least, kicked out of university housing. the university still has never taken responsibility for what happened , and it's finally time for them to do that. >> that was kayla mueller reporting. kristin smart's family is seeking monetary damages from the school. cal poly has not commented on the lawsuit. >> volunteers who run a public garden in lake merritt are asking for help after someone stole $20,000 worth of their bonsai trees. the director of bonsai garden says someone broke through their fence and stole eight rare trees. some um, nearly 100 years old. this is the fourth time the garden has been burglarized within four years. >> it's so sad that people can't respect something that everybody comes and enjoys and can just come by to a very peaceful place . it's hearsay. >> they reached out to oakland police but have not received a response. abc seven also reached

opened up. the season. matt wallace was the first to sell off the dock yesterday at san francisco's fisherman's wharf. he says they were lined up and ready to go by 8:00 wednesday night, waiting for the clock to strike midnight and their hard work in the middle of the night paid off. coming back to a line of people ready to buy right off of his boat, it feels a huge relief off my back. >> like i was like, stressed to the point where you get sick, you know, going out and just all everything builds up and then all of a sudden, like coming back, it was like, oh, like there's something just fell off. so it was, it was great. >> i usually steam it, do it fresh because if you're getting fresh, you want it, you know, straight up, kind of like your tequila. you got to have it straight out. not on ice. >> locals were celebrating the return of dungeness crab season by lugging in their wagons, coolers, buckets and bags to be filled up with the fresh catches. yesterday morning. and one difference between last year

and this year. the these crab are actually much bigger. fishermen tell me that last year they weighed in at around a pound and a half each. but this year the ones brought in were weighing in at more than 2 pounds each. live in half moon bay. lena howland, abc seven news thanks, lena 5-10 this morning it is a dry start to our friday, but we will finish the day with showers, some downpours this evening. >> a live look from the exploratorium camera. we are cloudy. we'll keep that cloud cover in place all morning long, but we are dry for the morning commute. no issues when it comes to the forecast. we'll have those temperatures in the upper 40s to the lower 50s. let's break it down region by region today. first along the coast will likely see some light sprinkles right around lunchtime time, but the heavier rain holds off until the afternoon and the evening. we see those rain chances really ramp up by about three, 4 or 5 p.m. temperatures mainly in the mid and upper 50s along the coast, now around the bay shoreline line will stay dry through the morning, and then that front moves onshore into the afternoon. so you can see we get into the low 60s. so it is

mild out there. but then the rain starts to move through here. and we do expect it to get heavier at times after the sun goes down. now inland, you'll see the rain a little bit later today, probably closer to 3:04 p.m. and then those temperatures stay in the mid 50s. and that rain is with us throughout the evening in the early morning hours tomorrow. so as we take a look at the three day forecast, we are beginning a pretty active pattern across the region today. it is wet and windy in the evening it is a level one and then we'll start to see more moisture move in here over the weekend. showers scattered, some downpours too. it is windy on saturday. it's a level two for some heavier showers and then on sunday another wave of energy moves onshore and looks on sunday, the heaviest is going to be in the evening and that will linger into monday as well. we'll take a look at the full seven day forecast and the niners forecast coming up in just about eight minutes. >> and speaking of that, drew, it is win or go home. the 40 niners host a green bay packers at levi's stadium tomorrow for the second round of playoffs,

out 3.5% of their workforce. one of the locations shutting down is the store at bayfair center in san leandro. the company also plans to lay off 13% of its corporate staff. a program that allowed small businesses to move into empty properties, rent free in downtown san francisco is apparently something the city likes and wants to continue. san francisco kicked off this experiment three months ago to get the downtown space going again. >> so are you thinking of staying past your three months? oh yeah. >> i barely announce that. >> yeah, i'm going to. >> i'll be here for more than three months. i think we need programs like this to help small

twan lee have pleaded not guilty. officer lee was working undercover when he was shot while responding to a marijuana business burglary on december 29th. marquis cooper is the latest of the four men to be charged. he's accused of 16 felonies. mark sanders is accused of firing the deadly shot. allen brown is accused of driving the getaway vehicle. sebron russell is charged with burglary. he is out on bail. attorneys for cooper and russell want a speedy trial. yesterday they raised concerns in court over delays in receiving discovery from the prosecution. >> i'm sure the district attorney is working on it diligently. but, yes, i have not been provided any discovery. we have about 19 pages at this point. it's pretty important, especially since we're moving relatively quickly. >> so we want to get all that information as soon as possible. do our own investigation. >> prosecutors didn't return requests for comment. >> a nonprofit under the san francisco police department is being questioned after a report found it spent at least $79,000 on lavish expenses, according to a report from the comptroller's
