murder trials of the 21st century could be back in the courtroom now at five. the reason the innocence project is asking for a new trial for convicted killer scott peterson. two decades after he was sentenced to life in prison. plus >> channel seven was an answer to our prayers. at least someone giving us the benefit of some coverage, some some public sympathy. that's as much as we've ever gotten, ever. >> a grand theft mystery unfolding in the gardens at lake merritt. several bonsai trees, potentially worth tens of thousands of dollars taken. and after months of delays, crab season finally underway. we're going to take you out to the crabbing boats coming in with this morning's haul. >> good morning everybody. 501 and we are tracking rain returning later on this afternoon and this evening. live doppler seven. currently we are dry. we do expect a dry morning, but our next storm system is approaching. let's widen out the view at satellite on. here's our

storm. an area of low pressure right here. here is our cold front and this will move onshore later on this evening. and bring a return of some wet and windy weather this morning. underneath cloudy skies. we have temperatures right now in the mid 40s to the low 50s. 53 in the city, 51 in san jose and oakland, 50 in saint helena, 49 right now in fairfield. it's a level one this evening for showers and brief downpours. some gusty winds as well. and we even have the chance of a thunderstorm popping up later on this evening. here's future weather as we go. hour by hour by about noon 1 p.m. we'll have some light showers moving onshore ahead of the main front. watch what happens later on this evening by about 4 or 5:06 p.m. there you can see we're in the thick of this storm. we'll have some heavy rain falling at this time. some gusty winds out of the south at about 20 to 40mph. and the showers are going to linger for all evening and night on friday. we even have more rain coming our way this weekend and early next week we'll talk

about the active pattern coming up in a few minutes. let's say hi to sue and see how we're doing with traffic this morning. >> good morning drew and good morning everyone. we are a little bit light for a friday. it's very nice and no fog to speak of on the golden gate bridge, that is. however, we do have a fog advisory for the altamont pass. we'll show you the map in just a minute. traffic is light this morning. san mateo bridge is clear of fog. that is, very few cars heading across. it is 502 and you're looking at about a 14 minute drive from 880 across the causeway, up the high rise and over towards foster city. everything is looking green here on our maps. we do as i mentioned, have a little bit of slowing over the altamont pass. thick fog heading into livermore and limited visibility. so heads up. >> all right. thank you. sue a bombshell development in a decades old case has sparked headlines around the world. the los angeles innocence project is looking to clear scott peterson and the killing of his pregnant wife, laci. laci and her unborn son disappeared just before

christmas in 2002. their bodies were found in san francisco bay a few months after scott peterson is currently serving life in prison, but a new court filings the innocence project says peterson's innocence is supported. quote by newly discovered evidence since. abc seven news i-team reporter dan noyes obtained the legal documents from san mateo county court yesterday. the 1500 pages of motions and exhibits call for a new review of all the evidence and tips that came in and a new trial. the innocence project is a nonprofit legal organization that has been able to exonerate people who've been wrongly convicted. >> the los angeles innocence project has seen it, has seen it as it is, seeing it as a case that is worth their time and their effort. and usually they only take cases where they think that someone is wrongfully convicted, or they have a strong belief that someone's been wrongfully convicted. >> scott peterson has claimed his innocence from the day laci disappeared, and after his

conviction in 2004, in court filings, peterson stated, quote, i had absolutely nothing to do with the disappearance and deaths of my wife and son. i am not a violent person. i have never had a physical fight or violent incident with anyone in my life. peterson was convicted and sentenced to death in 2004. following years of motions. in august of 2020, the california supreme court upheld peterson's conviction, but overturned his death sentence in december of 2021, a san francisco county superior court judge resentenced him to life in prison for laci peterson's murder without the possibility of parole. to look back at how the case unfolded, you can check out a timeline. it's on abc seven news.com. also developing an older murder case. the family of kristin smart is suing cal poly san luis obispo, where she disappeared 28 years ago. her former classmate, paul flores, was eventually convicted of her murder in 2022. reporter

kayla mueller breaks down the lawsuit. >> the university could and should have prevented kristin's murder, and the university could and should have acted much differently in the wake of her disappearance. >> the family of stockton native kristin smart suing cal poly, saying the school didn't pursue a missing person case fast enough, didn't interview witnesses in a timely manner, and didn't even search paul flores dorm room until 16 days after kristin disappeared. >> they just want justice, you know, and whatever form that takes. and they want the university to take responsibility. >> an attorney for the smart family says they weren't aware of the failures by cal poly until the university president issued a public apology last may, saying in part, we are very sorry for what the smart family has endured. while it is a different administration now than was in place in 1996, we recognize that things should have been done differently and i personally wish they had, for there were a number of reports

of his abuse towards women in, you know, in the in the years leading to up to 1996. >> um, and then the failures after the fact before kristin's disappeared, multiple reports had been made about paul flores to cal poly on the basis of threatening stalking and harassing behavior behaviors. >> the suit claims should have led to flores being removed from campus, which would have ultimately prevented kristin's murder. the smart family said in a statement to cbs 13 there is no question that cal poly failed our daughter, kristin smart, in multiple ways before and after her tragic murder by paul flores had the university acted properly, conducted a thorough investigation into flores past concerning behavior and implemented appropriate disciplinary measures, kristin would still likely be alive today. >> flores should not have been on campus, he he had a history of violence against women and he had the university done its job. um mr. flores would have been

expelled and or suspended or disciplined, or at least at the very least, kicked out of university housing. the university still has never taken responsibility for what happened , and it's finally time for them to do that. >> that was kayla mueller reporting. kristin smart's family is seeking monetary damages from the school. cal poly has not commented on the lawsuit. >> volunteers who run a public garden in lake merritt are asking for help after someone stole $20,000 worth of their bonsai trees. the director of bonsai garden says someone broke through their fence and stole eight rare trees. some um, nearly 100 years old. this is the fourth time the garden has been burglarized within four years. >> it's so sad that people can't respect something that everybody comes and enjoys and can just come by to a very peaceful place . it's hearsay. >> they reached out to oakland police but have not received a response. abc seven also reached

out to opd and we didn't get a response. bonsai tree theft is becoming more common around the world. it's believed they're either being sold to nearby nurseries or for large amounts of money elsewhere. >> all right, go out and take out the butter to melt commercial dungeness crab season finally open in the bay area. it was delayed for two months to protect migrating whales. abc seven news reporter lena howland is live in half moon bay, where crab fishermen are expected to arrive this morning with their fresh catch. hi, lena. reporter hi, kumasi. >> good morning to you. after facing delay after delay, dungeness crab season is back and fishermen we spoke with say they took advantage of getting back to work the minute they possibly could. >> and that's it. that's the money, right there. california gold. commercial crabber faced a delayed season for the past five years. >> it usually starts in mid november, so this is the latest fish and wildlife has ever

opened up. the season. matt wallace was the first to sell off the dock yesterday at san francisco's fisherman's wharf. he says they were lined up and ready to go by 8:00 wednesday night, waiting for the clock to strike midnight and their hard work in the middle of the night paid off. coming back to a line of people ready to buy right off of his boat, it feels a huge relief off my back. >> like i was like, stressed to the point where you get sick, you know, going out and just all everything builds up and then all of a sudden, like coming back, it was like, oh, like there's something just fell off. so it was, it was great. >> i usually steam it, do it fresh because if you're getting fresh, you want it, you know, straight up, kind of like your tequila. you got to have it straight out. not on ice. >> locals were celebrating the return of dungeness crab season by lugging in their wagons, coolers, buckets and bags to be filled up with the fresh catches. yesterday morning. and one difference between last year

and this year. the these crab are actually much bigger. fishermen tell me that last year they weighed in at around a pound and a half each. but this year the ones brought in were weighing in at more than 2 pounds each. live in half moon bay. lena howland, abc seven news thanks, lena 5-10 this morning it is a dry start to our friday, but we will finish the day with showers, some downpours this evening. >> a live look from the exploratorium camera. we are cloudy. we'll keep that cloud cover in place all morning long, but we are dry for the morning commute. no issues when it comes to the forecast. we'll have those temperatures in the upper 40s to the lower 50s. let's break it down region by region today. first along the coast will likely see some light sprinkles right around lunchtime time, but the heavier rain holds off until the afternoon and the evening. we see those rain chances really ramp up by about three, 4 or 5 p.m. temperatures mainly in the mid and upper 50s along the coast, now around the bay shoreline line will stay dry through the morning, and then that front moves onshore into the afternoon. so you can see we get into the low 60s. so it is

mild out there. but then the rain starts to move through here. and we do expect it to get heavier at times after the sun goes down. now inland, you'll see the rain a little bit later today, probably closer to 3:04 p.m. and then those temperatures stay in the mid 50s. and that rain is with us throughout the evening in the early morning hours tomorrow. so as we take a look at the three day forecast, we are beginning a pretty active pattern across the region today. it is wet and windy in the evening it is a level one and then we'll start to see more moisture move in here over the weekend. showers scattered, some downpours too. it is windy on saturday. it's a level two for some heavier showers and then on sunday another wave of energy moves onshore and looks on sunday, the heaviest is going to be in the evening and that will linger into monday as well. we'll take a look at the full seven day forecast and the niners forecast coming up in just about eight minutes. >> and speaking of that, drew, it is win or go home. the 40 niners host a green bay packers at levi's stadium tomorrow for the second round of playoffs,

out 3.5% of their workforce. one of the locations shutting down is the store at bayfair center in san leandro. the company also plans to lay off 13% of its corporate staff. a program that allowed small businesses to move into empty properties, rent free in downtown san francisco is apparently something the city likes and wants to continue. san francisco kicked off this experiment three months ago to get the downtown space going again. >> so are you thinking of staying past your three months? oh yeah. >> i barely announce that. >> yeah, i'm going to. >> i'll be here for more than three months. i think we need programs like this to help small

businesses not only get that foot in the door, but like, you know, show that, like, you know, cities revolve around small businesses. >> that is wack donuts, which is along the embarcadero. 17 pop ups are currently housed in nine storefronts, eight of those storefronts just got lease extensions with property owners willing to add another three months of free rent through the nonprofit sf new deal. these pop ups also received a grant of up to $8,000. one downside most of the shops have limited hours because many office workers continue to work from home. >> the businesses that we're seeing are not going to be successful solely off the backs of workers. we're they're going to hopefully succeed because we're going to have more people living downtown. we're going to have more events happening at night. we're going to allow people to drink outside at the bars, and those are going to be reasons they're going to come downtown as well. >> the vacant to vibrant program will announce a new group of pop ups this spring. >> one small business gaining popularity in the city is

becoming a success story in its neighborhood. it's a k-pop store called sarang. hello. and it is in san francisco's inner sunset. the shop serves up all things korean music and pop culture. abc seven news reporter tim johns tells us. it's helping spark the local economy. a night to go kick the drum. >> my goal in this show, from the music to the singing to the dancing, step inside san francisco cerundolo. >> and it's like being transported all the way to south korea. the store, located in the sunset district, is the first and only k-pop store in the city. the great thing about k-pop is not just this music, but also like the idols themselves. >> like just how people are able to connect with the idols. >> kevin tang, co-owner and sarang holo, along with his two best friends. he tells me much of their merchandise is imported directly from korea and can't be found in other k-pop stores around the country. >> so if you're a huge collector of like k-pop photo cards, um,

we're definitely the store to go to. >> everything from the latest albums to photo cards of the hottest k-pop stars. they even have this photo booth. so you have an opportunity to take a photo with your favorite k-pop idol, or even kevin. since launching four years ago, sarang holo has grown from being just online to now in its second brick and mortar location. it's been so successful that it's even gotten the attention of san francisco mayor london breed, who tweeted. the store has played a major role in revitalizing the nearby neighborhood after covid by driving increased sales tax revenue. tang says it's the personal touch that makes all the difference. we're huge fans. >> we're genuine fans, and i think that genuinity and love for like and passion for like k culture in particular really resonates with a lot of people. >> for many, this is more than just a store, though. that includes for otto, who's been a customer for over two years. >> i made a lot of friends here at first, like i met a lot of staff and they become my friends

and i feel comfortable to come here and then it feels like a safe space for me with business booming, tang says sarang has no plans to slow down in the future. >> he and his friends say they hope to open even more stores. >> our main focus this year is to build a much bigger community, make k-pop a lot more accessible here in the bay area and just continue to service the k love in san francisco. >> tim johns, abc seven news okay, so think of the best cities in the country for coffee , and certainly the bay area has to come to mind. >> right? well, two of our cities did make the top five in a new list. according to real estate data company clever san jose came in at number two, only behind portland, oregon. san francisco number five, after san diego and denver. the clever use data like how many coffee shops there are per 100,000 residents. google trends and average yelp score and the average price. >> i'm not mad at this. >> no, we're seattle. isn't that

right around lunchtime time, and then it's the evening here you go. you can see those downpours really setting up along that front. we'll have some gusty winds out of the south as well. 20 to 40mph. and then another wave of energy moves onshore for saturday. early saturday morning we'll have more downpours. i don't think it's out of the question. we may hear a rumble of thunder. that's just how much energy we have in the atmosphere over the next couple of days, and even into saturday, you can see we're in and out of the showers. i'll stop the clock here saturday evening and you can see we still have to have some showers in the south bay forecast. we'll see the niners forecast in one second today. and tomorrow. the rainfall will steadily add up. you can see a lot of areas approaching an inch of rain over the next 36 hours. so take you to levi's tomorrow. we do include the chance for some light showers in the forecast throughout the entire game. your kickoff temperature right around 58 degrees. by the fourth quarter, we'll have those temperatures in the mid 50s. so the extended pattern today through tuesday, we have a series of storms in our coastal hills will likely see 4 to 6in

howland abc seven news thank you, lena, a new poll shows the race for the california senate seat, once held by dianne feinstein, is heating up. >> republican candidate former baseball star steve garvey appears to be in second place. he met with members of the bay area jewish community yesterday to discuss the impacts of the israel-hamas war. abc seven news insider phil matier says the topics garvey has brought up at his campaign stops could be a factor as to why he's polling so high. >> there's a lot of things that democrats were not hearing a lot about it, things like gaza, we're not hearing a lot about the border and other sort of hot button issues between those three democrats. you throw a republican into the debate that could change according to an emerson college poll, 25% of voters are in favor of democratic representative adam schiff. >> garvey is in second place with 18. democratic candidates katie porter and barbara lee in third and fourth with 13 and 8, respectively. >> four men charged in the murder of oakland police officer

twan lee have pleaded not guilty. officer lee was working undercover when he was shot while responding to a marijuana business burglary on december 29th. marquis cooper is the latest of the four men to be charged. he's accused of 16 felonies. mark sanders is accused of firing the deadly shot. allen brown is accused of driving the getaway vehicle. sebron russell is charged with burglary. he is out on bail. attorneys for cooper and russell want a speedy trial. yesterday they raised concerns in court over delays in receiving discovery from the prosecution. >> i'm sure the district attorney is working on it diligently. but, yes, i have not been provided any discovery. we have about 19 pages at this point. it's pretty important, especially since we're moving relatively quickly. >> so we want to get all that information as soon as possible. do our own investigation. >> prosecutors didn't return requests for comment. >> a nonprofit under the san francisco police department is being questioned after a report found it spent at least $79,000 on lavish expenses, according to a report from the comptroller's
