an overnight execution in alabama is making headlines across the country this morning. now at five, witnesses describe the gruesome complications during the first in the nation death by nitrogen gas planes once grounded for safety inspections following the mid-air blowout. >> now cleared for travel. we are at sfo this morning where some are expected to take to the skies, and e is about moving the politics out of public safety. >> san francisco's mayor pushing for a ballot measure which would give police more authority to track and pursue suspects. critics say it will trample privacy rights.

airports across the country this morning. here's reporter ike ejiochi, the faa releasing its final instructions for airlines to ensure those planes are repaired and safe. >> a 12 hour inspection process to examine max nines, the agency laying out an enhanced maintenance process which will require, among other things, an inspection of specific bolts, guide tracks and fittings, and detailed visual inspections of left and right mid-cabin exit door plugs. >> each of the airlines will make sure that these four bolts are properly installed and tightened. boeing will be helping wherever necessary, but each of these airlines knows that their reputation is on the line to make sure that those airplanes are safe to fly. >> united's saying it's putting the planes back in the air by sunday, with alaska airlines saying their 65 max nine jets will be up friday. all this following three weeks of investigation into that door plug that flew off the alaska airlines flight 16,000ft in the air. boeing still facing scrutiny. the faa telling the company it can't expand on

production of the max's beyond what's already being built until there's a full investigation. meanwhile the boeing ceo, dave calhoun, voluntarily traveling to capitol hill taking tough questions from senators, wi-fi safe planes. >> we don't put airplanes in the air that we don't have 100% confidence in, reporters asking calhoun about a seattle times report claiming that the door plug was actually last installed by boeing, not the fuselage manufacturer, spirit aerosystems. >> you know, thanks so much. boeing telling abc news. all updates on the investigation must come from the ntsb. calhoun will be back on capitol hill today fielding more questions from lawmakers. he's also expected to take part in a public hearing in the coming weeks. s ike ejiochi, abc news, washington. >> a first overnight, a new method of execution used for a death row inmate in alabama. the convicted murderer put to death using nitrogen gas in gloria, the state says it's a humane method of execution, but a lot

of people do not agree with that. >> kumasi critics of this method of execution have called it cruel and experimental. the supreme court rejected a bid to stop it late last night. justice sonia sotomayor writing a dissent saying that alabama is using kenneth smith as a, quote, guinea pig. smith was on death row after being convicted of killing a preacher's wife in 1988, in a murder for hire plot alabama made the decision to use nitrogen gas after their first attempt to execute smith by lethal injection was botched. smith's spiritual adviser witnessed the execution and described the moments when he died. >> what we saw was minutes of someone struggling for their life. we saw minutes of someone heaving back and forth action. >> epoxy is one of the three methods of execution, so the inmates choose it. then that's the method we will use. the united nations human rights office says there's no scientific evidence to prove that execution by nitrogen

inhalation will not cause grave suffering. >> lawyers for the state of alabama have argued that the method is painless, with people becoming unconscious in a matter of seconds. however smith appeared conscious for several minutes, and the execution lasted 22 minutes. reggie, gloria. >> thank you. a second body has been recovered in the deadly plane crash off the coast of half moon bay. the coroner has identified the body of 26 year old oakland resident cassidy ray pettit. pettit died along with her fiance and two other people, when their plane went down january 14th. federal investigator say it was a small homebuilt plane. the cause of the crash is still under investigation. police say the two suspects involved in the shooting of. an alameda county sheriff's deputy in union city are dead. we first brought you that story yesterday morning, swat team officers discovered the bodies of a man and a woman inside a business on dow avenue

overnight. after hours of negotiations. at first, police claim both suspects died from self-inflicted injuries. but they later walked that back, saying the deaths are still under investigation. the wounded deputy is still recovering. >> oakland is facing another disappointing headline, according to the new citywide crime report, violent crime rose 21% last year. robberies burglaries, vehicle thefts all increased too. it's coming as oakland nears one year without a permanent police chief. mayor shengtao fired former chief laurent armstrong last february. an interim chief has led that department since then. in december, mayor tao rejected a list of three finalists submitted by the police commission, restarting the process of finding a new chief. >> i do believe that the city. of oakland deserves the best of the best, and if we can just name one person to be chief of the police department and think that, you know, crime is going to go away, that's not how it works. we have to ensure that we have the right person in this role. >> open recruitment for a new chief is happening now. february

is the valuation period and march 1st. the final names will be sent to mayor tao and then she will decide who to hire. this morning there's an update on the effort to recall mayor tao. today. the recall campaign will take the next step, posting an official notice in a newspaper called the inter intercity express. the organizers have formed a recall campaign committee. they plan to start collecting signatures next month. they hope to gather 25,000 signatures to present to the city. >> san francisco mayor london breed is advocating for a ballot measure that would give police more authority to track and pursue suspect. prop e would give police more leeway in vehicle pursuits. it would also clear the way for drones to monitor specific crimes and allow license plate readers and public safety cameras in high crime areas. opponents of the bill worry about privacy, which the mayor addressed. >> i can't have a private moment , you know, heaven forbid i take my wig off when i go to get my hair done. like it's like i got

of rain into the pacific northwest here. locally, we're just adding additional cloud cover to the sky. this morning. we will remain dry, but once that warm front passes through, it's going to allow some very warm air move in here. by the end of the weekend. but the morning drive no issues, no fog out there. it's just a mainly overcast sky. we'll get those temperatures right now we're in the 40s. we'll go into the low 50s as the morning goes on. so looking at the forecast region by region along the coast this morning, starting out in the 40s, we'll get you into the upper 50s and lower 60s. but you see a lot of cloud cover throughout the entire day, not nearly as bright as yesterday. similar story around the bay shoreline, but it will feel mild underneath the cloud cover. we'll get you into the mid 60s for daytime highs. here's a look at our inland forecast. same story. we'll have mostly cloudy skies, temperatures feeling very pleasant though. we'll get into the low 60s later on this afternoon. now, the three day forecast will keep the cloud cover tomorrow. there's an isolated chance of a shower, but by sunday those temperatures are taking off. the sunshine is back

people were killed and 240 others were taken hostage. four council members voted yes on that motion, two others and the mayor against it. the four companies targeted are caterpillar for intel, chevron and hyundai. the mayor says there was no time to review, vet or analyze the policy before voting. and he adds this vote can be reversed if we find what they're doing are good practices and good corporate responsibility, then absolutely, we're going to reinstate them. hayward city council is not allowed to take a stand on international issues. so activist, it's organized around the global bds movement. it uses boycotts, divestment and sanctions to protest israeli actions in palestinian territories. >> the department of justice and the securities and exchange commission are now investigating the autonomous car company cruise. it follows october's incident where a cruise vehicle

dragged a pedestrian about 20ft in san francisco after that pedestrian was hit by another car cruise, paused all operations on public roads in november after the dmv revoked the company's permits. cruise says it is fully cooperating in all investigations. if you use bart to commute, the agency wants to save you money, according to our media partner, the san francisco standard. there's a proposal to consolidate fare payments. when you transfer between agencies. so, for example, if you take bart, you get a discount on muni in san francisco or on ac transit in the east bay. bart hopes to start the program when the new clipper card system rolls out later this year. bart's board could vote on that proposal next month, and the east bay a transformation could be in the works for the bishop ranch in san ramon. >> our media partner, the mercury news, is reporting a new complex called orchards would replace the 92 acre chevron park . it's on bollinger canyon road, just off of 680. now, chevron would move to a new location in

bishop ranch. the move out of the current site could start by the end of the year, which is expected to be modeled after san jose's santana row. there are plans for 2600 homes, 125,000fts of retail space, a park and an outdoor performance theater. >> just months after taking over the struggling san francisco center, the artist, formerly known as a westfield mall, the new managers are reportedly vowing to keep the mall open, according to our media partners at sf standard, representatives from the two companies held a meeting with the remaining tenants wednesday. reporter kevin wynn was on our 3 p.m. show, getting answers to talk about the plan to draw people back. >> the message from the custodians were that, hey, this mall is here to stay. it's open. our job here is to preserve the cash flow until this mall could be sold off to a new owner. so they're going to invest in more security and also they're thinking about bringing events and live programing to the mall to activate those spaces. again

famous alumni to graduate from the school. he made it look effortless. >> it was very smooth, fluid, athlete and at that point you could tell like, hey, this guy's got a lot of potential. he was the team's most valuable player in 2011 and 2012. >> his coach, massimo reid, says goff took the program to new heights, setting all kinds of school records which still stand to this day. >> you can see it when he first got here, you know, when he was a freshman and you see him throwing the ball around and just, you know, looked really easy. >> he went to cal and spent three years as the bears starting quarterback. he played so well. he became the top nfl prospect for his position in 2016. the los angeles rams made him the number one draft pick in 2021, the rams traded him to detroit this year. he led the lions to their first home playoff game in over 30 years. >> the kind of person it takes to have success at cal. um, it breeds you and it gets you ready for what's next in life. and for jared, that's nfl and that's,

grow like sometimes i'll be streaming and i'll hear people be like, oh my god, like in the back, and i can hear them through the walls. >> um, and, uh, it's just really fun. like, it's really fun seeing people open the packs and , like, find the card that they want. they'd be like, oh my gosh. and like, it's just a lot of fun. >> on wednesday in the middle of the night, surveillance cameras captured their first break in. >> we saw like three people had broken into our side door, which was kind of ridiculous because there's a fridge blocking it. so i don't think it was a targeted attack at all. >> they believe they were going out with your hands up in arms. >> san jose police did respond, but the store says the three suspects were gone in minutes. >> i don't think they were in the hobby necessarily because they didn't know what to take. >> what they did take was the cash register, and more than 35,000 pokemon cards. thatrillionange from a dollar to a few hundred dollars, a special set of cards that only gets released once a year will come out on friday. and these robbery suspects missed that memo. >> a lot of stuff is releasing this week, and we thought it was funny. we're like, oh, these

will be able to serve 2000 more clients by 2028. getting people into permanent housing remains a priority. construction should be done by the end of the year. volunteers are spread out around sonoma county. right now, they're doing the annual point in time count. it's a homeless census. that's all taken on one day. getting an updated count of the homeless population is critical for federal funding. so here are some pictures from san mateo county. volunteers went out before dawn yesterday to take a tally of the homeless there. alameda county also did its count yesterday. about 450 volunteers fanned out across oakland, counting the number of individuals living in encampments and vehicles. contra costa county held its count wednesday. san francisco's is happening next week. results will take a few months to be processed and eventually released. ready for take off. >> for the first time since a dora plug blew off of a plane, alaska airlines says it's planning to safely resume flights of some of its boeing

737 max nine jetliners today, the faa has cleared the way. abc seven news reporter lena howland live at sfo with the details on this. good morning, lena. >> good morning kumasi with the first of its 737 max nine fleet set out to take to the skies this morning. alaska airlines says that they will be adding more planes back into service every day as inspections are complete and each aircraft is deemed worthy. all this following three weeks of investigations into that door plug that flew off the alaska airlines flight 16,000ft into the air, effectively grounding nearly 200 of the boeing jets operated by both alaska air and united. the faa and boeing sending out its final inspection instructions to the airlines to make sure those planes are repaired and safe. alaska says their first max nine flight will take off at 2:00 this afternoon from seattle to san diego. the airline says this grounding cost them $150 million. it's for

what we're getting out of this warm front is additional cloud cover today and tomorrow. and then that warm front will really bring some warm temperatures by sunday, where records are possible today, there's no fog out there. but we do have mainly overcast skies. we'll have those temperatures starting out in the upper 40s, getting you into the mid 50s by about 11 a.m, so really no issues with the morning drive today as we take a look at your sky conditions. really just get used to that cloud cover. it is mostly cloudy throughout the day. we'll call it limited sunshine. you may see some blue sky here and there, some peeks of sunshine, but for the most part the clouds are really ruling the forecast today and we'll keep those clouds even through the evening. but if you have friday night plans, really no issue out there. we will have some mild temperatures that warm front is going to help propel temperatures above average. despite having a lot of cloud cover today we'll get you to 62. in the city, 63 in oakland, 66 in san jose, 63 in santa rosa, a high of 62. in concord. taking a look at the three day forecast, get used to the cloud cover

it really is tragic. the grocery store stew leonard's claims a wholesaler, cookies united, never alerted the store about the change of ingredients, but cookies united released emails showing that a new label was sent, including peanuts, as an allergen. they also say that they send their cookies to stew leonard's, and that the store then repackages them with their own boxes and labels. 25 year old dancer orla baxendale died after having an immediate allergic reaction. once she ate the vanilla florentine cookies at a gathering in connecticut. orla moved to new york from england to pursue her dreams of dancing professionally. her attorney says that her death was due to gross negligence and reckless conduct, since the manufacturer and or sellers did not properly identify the
