the area. >> it's an effort to crack down on crime, including retail theft, vehicle theft and violent crime. abc7 news reporter leslie brinkley has oakland's response to the news. >> in august. the california governor has signed six extra police officers to oakland. today, he announced he's sending 120 more after 2023, crime statistics show violent crime in oakland is up 21. robberies are up 38% and car thefts are up 45. >> for the governor to assign us 120 highway patrol officers as uh, i am in complete support of that and i've asked for even send me the national guard. if you have to. >> the governor's statement described the effort as a targeted law enforcement surge operation to crack down on crime. opd is working with chp on the actual date for the rollout and the plan. >> however, you know we can see it as soon as in a week, i would

say, you know, but of course we are going to be able we need to actually work together to layer on the services so that we can, you know, utilize all the services that we can get from chp. >> the governor's office indicated that could include the actual deployment of long promised license plate reader technology, along with k-9s and air support. >> unfortunately, the data is mixed on whether or not having more police officers is going to impact the foundation of what's causing high crime. i don't care how many police officers you bring in, you know, police can't be everywhere without a top cop. you don't have a vision for law enforcement in the city. >> i'm hopeful that with the new march deadline from the police commission, that they will forward me stronger applicants, you know, during the traffic stops, if you are speeding, if you are running red lights or what have you, they'll be able to do the traffic stops. they will also be in key corridors

like our hegenberger corridor where the airport is at and our business districts. >> the mayor says this infusion of 120 chp officers will focus not only on oakland, but on neighboring communities here in the east bay. i'm leslie brinkley, abc seven news. >> all right. joining me now is abc seven news. insid phil matier. phil, this is a huge injection of personnel, 120 chp officers in oakland and are in the east bay. let's begin with what that means exactly. out on the street. >> well, it's unpressed dan, you usually don't see this side of increase in highway patrol officers in the city unless there's some huge super bowl or apec type or a disaster or a riot or something like that. going on, or massive demonstrations to deploy them to a city simply to try to assist the police in dealing with daily crime is unheard of in these numbers. now, there were chp officers assigned to san

francisco, and they still are to help curb the fentanyl crisis and state intelligence officers from the national guard are cooperating in that effort. and they've made several arrests and made some sizable seizures of drugs in the east bay. they've already had six chp officers there. they have resulted in over 100 arrests, and the recovery of 200 stolen vehicles. this one is going to be on the streets with oakland police officers. we're going to have canine units. we're going to have helicopter units. they're going to be helping not only with the crime, but also keeping an eye on the area. >> so, you know, it's interesting that as we talk about what they're going to do specifically phil, because we think of the highway patrol, they are kings of the freeway, right? they're not the surface street law enforcement. they look for speeders. they respond to accidents. they do. exactly. what are they going to be doing specifically? it's a different set of demands to be on the streets as a helping ordinary everyday cops.

>> well, first of all, they're still going to be on the highways because one of the problems in oakland in the east bay is the dramatic and terrifying highway shootings that have been going on the random shootings from cars along uh, 8-80 and the other corridor that's got to they're still dealing with that. they're going to be putting up the license plate. readers that are going to tip them off when a car is stolen and when that they get a word that that car in front of them is stolen, they'll move to pull it over and unlike oakland police, if that car speeds up and goes away, the oakland police by the oakland rules set by their police commission, can't pursue that in a hot pursuit. they have to let it go. chp is not bound by oakland rules, and that's a quiet little unspoken deal here that it makes a tremendous amount of difference when they're on the ground. with oakland cops, they can do things that oakland cops can't do. >> you know, that's an unspoken advantage. as you say, that's a great point. very quickly, phil, we got about 30s. you know, i've

heard before, you know, my wife's father, who was an attorney, used to say nothing fights crime better than a black and white and just the presence of police officers. is this more than about perception, or will it really make a difference in lowering crime in oakland and around the east bay? >> well, it's it is more than about perception. perception is 1 or 2 squads in there that 100 plus cops. that is something different. it's long been said or in recent years at least, that you can't arrest your way out of crime. and many of the politicians in oakland fervently believe that, that you need to get to the root cause. but at this point, they've got to deal with the symptoms, or else it's going to go completely off the rails. okay, well, she'll see big change 120 additional chp officers helping in oakland and in the east bay. >> phil, thank you very much. phil matier, other news, a judge is throwing out sentencing announcements for four men accused of murder after the arresting antioch police officers sent racist text messages about them to the contra costa county judge says

officers violated the california racial justice act. abc seven news reporter anser hassan has more now on how this ruling could set legal precedent. >> after months of anticipation, a contra costa judge announced his remedies in a case linked to the antioch police texting scandal and the california racial justice act. >> it sends a clear message that the state should never be able to seek life without the possibility of parole. where there's been a racial justice act violation and i think the court has made that loud and clear. >> carmela caamano is the attorney for terrion pugh. he's one of four defendants facing murder charges and a possible gang related shooting from 2021. one of the remedies judge david gholson, struck all special circumstances, special circumstance charges can lead to a life sentence without the possibility of parole and it would just be a fundamental violation of all of our senses of equality and due process to subject somebody to life in prison without the possibility

of parole, where there's been a racial justice act violation. earlier, the prosecutor acknowledged that the antioch police officers did in fact violate the racial justice act, a new state law that allows for those charged with a crime to challenge it on the basis of racial bias. it was up to judge goldstein to decide on legal remedies to address it, caamano says. the judge will also allow the defendants to impeach the officers, or to question the credibility of their testimony or evidence based on the racist texts, and that is crucial because what it acknowledges is that the investigation itself has been compromised. professor greg woods, with the department of justice studies at san jose state university, says striking of special circumstances under the california racial justice act is historic. but he points out that the judge did not reduce the actual charges, as the defense was hoping. >> but it does not eliminate the substance of the very severe crimes that are at issue up to and including those violent crimes, including murder.

>> the contra costa county district attorney's office declined an interview. the lawyer representing some of the officers did not return requests for comment. the trial is set for march 4th in martinez in san hasan. abc seven news. turning now to the weather. >> really nice now and after a mostly dry day, more rain is on the way. >> but at least we had this much needed break. spencer christian is here with the forecast. >> spencer okay, dan and kristen, we're all happy about the break, but now we're prepared for more rain and here it comes. take a look at the live doppler seven image. you can see things are dry right now. little green is showing up there. some moisture in the atmosphere not really hitting the ground here in the bay area, but there will be rain hitting the ground tomorrow. this is a level one storm on the exclusive abc seven storm impact scale. so for tomorrow we're expecting lightrillionain and showers and of course, slick roadways and breezy winds, not powerful wind gusts. here's the forecast animation starting at 11:00 tonight. during the overnight hours, we may see a couple of sprinkles moving through, but nothing really major until after about 8 a.m. that's when that first wave of steadier rain

starts to swing down through the north bay, and continuing southward and eastward into the peninsula and to the east bay and south bay. so it's going to be wet tomorrow, and i'll show you what comes after that a little bit later. kristen. >> all right. thanks so much, spencer. pg and e is calling sunday's storm one of the most damaging single day storms on record in terms of outages. this is a look at everybody who still does not have power on right now . in its latest update, pg and e says more than 54,000 customers in the bay area are affected. the situation is rough for some living in montara. thousands there are still in the dark. abc7 news reporter lena howland spoke with residents to see how they're coping. >> the gusts just like pushed the whole thing down, um, and including our fence as well. >> the downed communication line next to his house opened up a whole new ocean view, but still, he's been without power since sunday. >> no power. um, which is hard because i'm on a cpap machine, so i don't have that going. um,

no wi-fi, but we do have cellular. i have verizon, so we have limited service here, no internet, which is concerning because people can't call 911 or emergency services. >> his um, we don't get any notifications from pg and e, so. so, um, yeah, we're sort of disconnected down here. >> no hot water for a couple days. um so, yeah, you miss a lot of the bear, you know, the, the bare necessities, you know, pretty quickly, many neighbors in the montara area were told by pg and e power is expected to be restored by wednesday night in areas like montara. >> um, we are having access issues. so things like downed trees, loose soil, um, heavy water, uh, that makes it not only hard for our crews to get, uh, to certain areas and access our equipment. it can also be dangerous. >> p-g-and-e's says. right now they have about 3000 crews on the ground working around the clock to get power restored as quickly and as safely as possible. they are expecting

power to be restored for most customers by thursday night in montara. lena howland abc seven news in the north bay, the safeway on north main street in sebastopol is getting rid of groceries that went bad because of the power outage there today. >> we saw all sorts of items stacked up outside the store in grocery carts, along with pallets, with bags of ice. safeway says the store is open and the power was restored. several people who were forced to stay in hotels due to power outages had items stolen from their cars. insult to injury. right around 20 vehicles were broken into outside the larkspur landing hotel and the hilton garden inn in south san francisco last night they told us valuables that were brought with, that they brought with them from their powerless homes, were taken from their cars. these items include house keys, family photos, passports, ids, even the ashes of a loved one. >> my wife came out with our dog and she ended up looking at our car, and our car got tagged and they stole my wife's

grandmother's ashes. can you believe that? >> the victims have since filed reports with the local police agencies. they believe they were targeted because they had to vacate their homes due to the power outage along the peninsula this weekend. >> storm caused some more damage to tesla road near livermore. check out this westbound lane near mile marker 9.5. you can see a chunk of the road has slid away a sizable hole there. the original damage happened in december, but the recent storm wore away. more of that road. >> that's quite something. all right. the storm is still slamming southern california today. the impact on residents there as we take you down south, the safety concerns about the new community that billionaires want to build near travis air force base and a look back at brock purdy's high school glory days. >> well, that's going to be fun to see. you know, his college career is pretty good. and if he wins a super bowl, it's going to be even better. the cherry on top, so to speak. larry biel, were live at super bowl 58. as we continue to count down to

has more problems. as you can see. abc news reporter jacqueline lee has the latest. >> stunning new aerials out of southern california as rain pummels the region for a third day. >> we thought maybe the storm had finished yesterday, but it came out with a vengeance again this morning, the storm knocking down this towering tree in the affluent pacific palisades neighborhood of los angeles and near beverly hills, a mudslide carving its own path down a steep canyon. >> here you can see the sheer force of this mudslide. this house used to be sitting up on the foundation. it's sliding all the way down, burying this car over here. there's another car underneath the rubble. and miraculously, all the residents got out safely. with more than 300 mudslides, residents are on high alert.

>> as mayor bass and i have surveyed some of the worst slides yesterday, i was reminded of the pure force and magnitude with which a hillside can suddenly come down. >> the national weather service, calling this a historic storm the third wettest two day stretch since records started in the 1870s. >> this is the l.a. river. if you're not familiar with this, normally it's a trickle. >> and first responders saving a man who jumped into the swift moving waters to rescue his dog fire fighters pulled him into a helicopter. his dog was found alive downstream, and officials are increasingly concerned about additional mudslides, which can happen even after the storm passes. there is another storm moving through california tomorrow. jacqueline lee abc news, los angeles. >> been hit so hard down there. >> yeah, glad we're not in southern california, but we do have a little more rain in our future. >> we do. we needed this break. we got it. but, spencer, we need to brace for a little more wet weather right about that, dan and kristen. >> but you you should underscore a little a little more rain is coming our way. not a big drench

here like we had over the weekend. here's a look at the live doppler seven. you can see that we have some moisture in the atmosphere that's showing up as a little pockets of green on the radar screen, but it is not raining in the bay area yet. we have breezy conditions, but not any strong powerful wind gusts. we have gusts up to or i should say wind speeds up to 23mph here in san francisco right now. so let's move along and take a look at conditions. temperature readings under partly cloudy and partly blue sky in san francisco. it's 55 degrees. we have upper 50s right now at oakland, hayward, san jose and mid 50s at san jose and half moon bay. lots of blue sky over the golden gate, but giving way in the over the next few hours to advancing clouds 59 degrees. right now in santa rosa we have mid to upper 50s also at petaluma, napa, fairfield, concord and livermore. so let's move along and take a look at the exclusive abc seven storm impact scale. the approaching storm is a level one storm, so for tomorrow we expect periods of lightrillionain and showers. there may be a couple of isolated downpours there as well. slick roadways of course, and it will be breezy tomorrow.

here's the forecast animation starting at midnight during the early early morning hours, we'll just see an increase in clouds, maybe a couple of sprinkles moving through, but by about 8 a.m, we'll see that first wave of steadier and in some places, heavier rain arriving first in the north bay and then swinging southward and eastward. by about 10 a.m, we'll see the central part of the bay area, the golden gate over into the east bay, down to the peninsula, and even the south bay, getting some pretty good rainfall from this system, but it will move rather quickly. and then by about midday noon, we'll see most of the rain concentrated down in the south bay and far to our east. but with a few trailing showers that will swing through as well and then after about 2 p.m, we'll see the showers tapering off and the rain. the rain winding down. that's hard to say. tomorrow night, rainfall estimates by 11:00 tomorrow night, mainly between about a quarter of an inch and a half inch. but some locations, like san mateo, will receive about two thirds of an inch. uh- fremont about uh- 6/10 of an inch. so henrico to overnight

an air back plan to build a city in solano county is raising new concerns about the security of nearby travis air force base. >> i-team reporter stephanie sierra is here with the latest developments on this ongoing story. steph. yeah an interesting development tonight. >> we're taking a closer look at what congressional leaders say are key problems with california. forever's plan to build a new city. it's the first time we're getting insight from inside travis air force base about potential impacts to their operations. we've heard a lot about this new proposed city in solano county. >> it'll be smaller than

vacaville, smaller than vallejo. >> everywhere there is actually a mix of uses. >> we have enough water. >> this was all part of california forever's pitch to voters last month, ceo jan sramek revealed a ballot initiative detailing what it would all look like, including his vision and goals. this being a big one, and our first goal was to make sure that it would be a great neighbor to travis. >> we knew that we had to protect the base. >> congressman john garamendi is raising new concerns. that's not happening. >> if this city has ever built, as proposed in the initiative. travis air force base will be in deep existential trouble following a meeting with high ranking u.s. air force officials, garamendi says travis air force base is concerned because the coordinates for this new city are directly beneath flight zones if built, he says, critical training for combat missions, also known as sorties, would be impossible to do. right now, 120,000 times a year on average. travis air force base conducts night vision sorties as

though they were operating in a war zone, having to land on a contested air base that would be impossible if there's a city because of the ambient light from the city. >> commercial community development. >> sramek released these maps last month showing the security buffer around the base, seen here in light green, he says it's nearly doubled, illustrated with the orange on this map. >> we are also locating the community 100% outside of the noise contours and outside of the accident potential zones. >> but this map obtained by the i-team shows a different perspective of the proposed new city is pushing into the military space designated for radar patterns and airspace. seen here colored in turquoise and green, the map also shows two red dots labeled museum and creed, where sources say those critical training operations take place. those locations are bordering the city's blueprint. garamendi says that would interfere with practice for combat missions, also known in the military as daytime sorties.

they are daytime time sorties, practice sorties would be directly over a good portion of that city, where they fly at a high altitude, descend very, very rapidly to 503, make a very tight turn onto a very short runway. >> they will not be able to do that. if that city has ever built. >> this wasn't a problem until now, in part because the land that borders the base has always been zoned for agricultural use. so the only witnesses to these practices are mostly cows, sheep and endless miles of grazing land. we reached out to california forever about these concerns and received the following statement saying, california forever's top priority has always been protecting and supporting travis air force base. that's why we carefully chose a location for the new community that fully complies with all regulations that. address the impact of air flight operations on land use around the base. the question is, will the plans change now?
