state from seeking a criminal conviction or sentence on the basis of race, ethnicity or national origin. >> race and social justice are a part of what we're focused on in our efforts to build a better bay area. abc seven news reporter anser hassan found this ruling could set legal precedent. >> after months of anticipation, a contra costa judge announced his remedies in a case linked to the antioch police texting scandal and the california racial justice act. >> it sends a clear message that the state should never be able to seek life without the possibility of parole. where there's been a racial justice act violation and i think the court has made that loud and clear. >> carmela caamano is the attorney for tyrion pugh. he's one of four defendants facing murder charges and a possible gang related shooting from 2021. one of the remedies judge david goulson, struck all special circumstances, special circumstance can lead to a life sentence without the possibility of parole and it would just be a fundamental violation of all of

our senses of equality and due process to subject somebody to life in prison without the possibility of parole, where there's been a racial justice act violation. earlier, the prosecutor acknowledged that the antioch police officers did in fact violate the racial justice act, a new state law that allows for those charged with a crime to challenge it on the basis of racial bias. it was up to judge goldstein to decide on legal remedies to address it, caamano says. the judge will also allow the defendants to impeach the officers, or to question the credibility of their testimony or evidence based on the racist texts, and that is crucial because what it acknowledges is that the investigation itself has been compromised. professor greg woods, with the department of justice studies at san jose state university, says striking of special circumstances. under the california racial justice act is historic. but he points out that the judge did not reduce the actual charges as the

defense was hoping. >> but it does not eliminate the substance of the very severe crimes that are at issue up to and including those violent crimes, including murder. the contra costa county district attorney's office declined an interview. >> the lawyer representing some of the officers did not return requests for comment. the trial is set for march 4th in martinez anser hassan abc seven news. >> we are still on storm watch because of the lingering impact it's having on p-g-and-e's customers. check out the current outage map. this is a big improvement from sunday's storm, when about a quarter million customers lost power. now down to about 52,000. the safeway on north main street in sebastopol is getting rid of groceries that went bad because of a power outage today. we saw all sorts of items stacked up outside the store and grocery carts, along with pallets with bags of ice. safeway says the store is open and the power has been restored. many people have gone days without power and could be waiting even longer. abc seven news south bay reporter dustin

dorsey has a look at conditions in one of the hardest hit areas. >> even though the power was off, the power tools were on and running in san jose's willow glen neighborhood. tuesday >> worst storm in 32 years by far this was all from danny hooper's giant redwoods, but across the street, several trees snapped, bringing lines down with them. >> that was sunday afternoon, 48 hours later, still no electricity here. >> p-g-and-e's has told us three times that it was going to be such and such a time, and they didn't show up, they said it was going to be on at 330 yesterday and then it got moved to ten. and then i heard from other neighbors that it wasn't going to be until 4 a.m. tomorrow. >> so sitting in a cold, dark house has been tough for lacey balog and her eight month old son, wade, to be honest, it's been pretty brutal. >> we've been without without heat power for three days now. he's managing good, but we're trying to do our best. we went out on a walk today and we saw this, uh, the power line that

was down. so we figured, oh, are they working on it? >> but doesn't seem like they are yet. >> p-g-and-e's crews were working just ten miles away in east san jose. a power pole snapped across several backyards on san pablo avenue. the residents of the street were among the 30,000 customers without power in the south bay tuesday morning. >> we've experienced the third most outages of any storm in p-g-and-e's history. it was pretty intense on sunday with hurricane force winds, a first ever for our california coast. >> the utility has more than 3000 workers working 24 over seven since the storm. p-g-and-e's teresa alvarado says the work requires multiple steps for safety reasons, and that takes time. she hopes the lights will be back on in willow glen and beyond soon enough. >> there's one that i know of in willow glen that had 3000 customers out yesterday. today it's down to 900, so we are trying to restore people even in a step fashion, as quickly as we can. >> neighbors hoping for the same

in san jose. dustin dorsey, abc seven news some. people who lost power went to a hotel where things went from bad to worse. >> their cars were broken into at 630. you will hear from them. >> third and mission streets in san francisco remain closed while p-g-and-e's investigates a vault fire. the san francisco fire department says they responded to reports of heavy smoke coming from underground just before 2 p.m. they determined it was an underground electrical equipment fire. fire officials are telling people to stay away from that area as they work on the repairs, so seek alternate routes. christopher high school in gilroy was vandalized last night in what appears to be a racially motivated incident. gilroy police confirmed three people broke in just before midnight, ransacked classrooms and wrote hateful graffiti on the walls. a parent called abc seven news about this crime, telling us the graffiti included the n-word. the parent says multiple posters of former president barack obama were ripped down. police say this incident is being investigated as a hate crime.

governor newsom is doubling down on his effort to stop violent crime in the bay area. 120 additional chp officers will head to parts of the east bay, especially oakland. that's a 900% increase in chp officers in that area. they will help with traffic stops, recovery, stolen vehicles and patrolling the hegenberger corridor corridor near the oakland airport. we spoke with abc seven news insider phil matier earlier today. he says the chp has more power to make a difference. >> the chp is not bound by oakland rules and that's a quiet little unspoken deal here. when they're on the ground with oakland cops, they can do things that oakland cops can't do. >> 2023 crime statistics show violent crime in oakland increased more than 20. robberies went up nearly 40, and car thefts rose 45. >> there are new concerns being raised about the plan to build a new city in solano county.

>> now, the issue is the security of nearby travis air force base, an abc seven news i-team reporter, stephanie sierra, is here with the latest on this story. stephanie. yeah, this is the latest of many concerns raised as we've been covering over the past year. >> tonight, we're taking a closer look at what congressional leaders say are key problems with california forever's plan to build a new city. it's the first time we're getting insight from inside travis air force base about potential impacts to their operations. as we've heard a lot about this new proposed city in solano county, it will be smaller than vacaville, smaller than vallejo, everywhere. >> there is actually a mix of uses. >> we have enough water. >> this was all part of california forever's pitch to voters. last month, ceo jan sramek revealed a ballot initiative detailing what it would all look like, including his vision and goals. thisg bel was to make sure that it would be a great neighbor to travis. >> we knew that we had to protect the base. >> congressman john garamendi is raising new concerns. that's not happening. >> if this city is ever built as

proposed in the initiative, travis air force base will be in deep existential trouble following a meeting with high ranking u.s. air force officials , garamendi says travis air force base is concerned because the coordinates for this new city are directly beneath flight zones. >> if built, he says. critical training for combat missions, also known as sorties, would be impossible to do right now 120,000 times a year on average. >> travis air force base conducts night vision sorties as though they were operating in a war zone, having to land on a contested air base that would be impossible if there's a city, because of the ambient light from the city. >> commercial community development, ceramic released these maps last month showing the security buffer around the base seen here in light green. >> he says it's nearly doubled in with the orange on this map. >> we are also locating the community 100% outside of the noise contours and outside of

the accident potential zones. >> but this map obtained by the i-team shows a different perspective. the proposed new city is pushing into the military space designated for radar patterns and airspace. seen here. colored in turquoise and green, the map also shows two red dots labeled museum and creed, where sources say those critical training operations take place. those locations are bordering the city's blueprint. garamendi says that would interfere with practice for combat missions. also known in the military as daytime sorties. >> their daytime sorties, practice sorties would be directly over a good portion of that city where they fly at a high altitude, descend very, very rapidly to 503, make a very tight turn onto a very short runway. they will not be able to do that. if that city has ever built. >> this wasn't a problem until now, in part because the land that borders the base has always been zoned for agricultural use,

so the only witnesses to these practices are mostly cows, sheep, and endless miles of grazing land. we reached out to california forever about these concerns and received the following statement saying california forever's top priority has always been protecting and supporting travis air force base. that's why we carefully chose a location for the new community that fully complies with all regulations that address the impact of air flight operations on land use around the base. now, the question is, will plans change now? schrameck announced last month they hope to permit solar farms in the area surrounding the base. at least seven other military bases across the country have gone solar, but garamendi says solar panels in that immediate area would pose a reflection hazard to pilots landing at the base. so there are strong opinions on both sides. >> okay, keep us up to date. thank you stefan. thank you. >> and if you have a story for the i-team, you can call this number on your screen. 188840 i-team. or just go to abc7 news.com slash i-team. >> still to come on abc seven

if you will just about everyone above average except oakland. so sfo 109% of average 142 san jose. that sticks out. santa rosa one 2121 in san francisco. so oakland just over nine inches of rain at 89% of average. southern california obviously dealing with that historic storm, the atmospheric river continues to bring them the rain , although the intensity has lessened, the problems continue there. they've seen 6 to 12in of rain in some areas. their historical record setting not just daily records, but even two day records there in los angeles, as we look at live doppler seven here, we definitely have a few isolated showers. as you will notice right around patterson pass road, heading out towards the altamont pass area. so just very isolated in the sierra. still some snow showers 88 and for requiring chains. they have picked up anywhere from 2 to 15in of snow in the last 24 hours. and it is a really nice snowy scene right now from the reno tahoe area. as we look at a

protect. this has got to come to a stop in south san francisco. >> dion lim, abc seven news. >> well, they're frustrated is obvious and understandable. a storm recovery is an ongoing process in southern california. reporter josh haskell from our sister station in los angeles, shows you just how bad it is. >> a terrifying sight in studio city below mulholland drive, part of the hillside is missing mud and boulders took out one home and damaged others. they also left a debris field almost one mile long, reaching laurel canyon boulevard, and the earth continues to move. >> still concerned so we had a storm before this one that saturated the earth. the earth is a sponge. it could only take up so much water. the unique aspect of this storm is twofold, one of which is its longer duration. it's going over three days. so we're on day three. even though the rain is lightning today, it's not as heavy. we still expect earth movement over the next couple days. >> so much debris that we didn't

expect here with the hillside coming down this hillside has been stable for the 21 years i've lived here. the rocks and the and the shrubbery and stuff is all gone. >> scott toro lives in one of the nine homes evacuated in this fryman canyon neighborhood. this home was redtagged and this home was yellow tagged. >> i do feel terrible for them because i know them and you know , our our neighbors, we're all we're all close. it's a close knit neighborhood because we're there's only a few homes on the street. >> street services began the cleanup tuesday, but with constant rain, more of the hillside could come down. the los angeles fire department is urging residents in these hillside communities to stay home, stay alert and avoid non-essential travel. >> last year, it was pretty bad, too, but this year i think it's worse. a lot of water, mud, stones, rocks coming off. it's a hilly area, so the water just pushed everything down. >> the cleanup is also underway in beverly glen and on north beverly drive near franklin canyon, which also experienced mudslides. there's been over 300

mudslides thanks to the atmospheric river. actually i couldn't sleep the uh- sunday night. >> you just heard this, like gushing. it was like, you know, being on the right on the ocean and you heard it there from scott toro. >> he has lived here for 21 years, and he never expected the hillside to give way the way in which it did. this continues to be quite the storm in studio city. josh haskell abc seven news. it is confirmed four bolts were missing from that door plug that blew out in mid-air during an alaska airlines flight last month. >> the ntsb confirmed it in a report released today. inspectors say the bolts would have prevented the door plug from moving upward during that flight, but apparently they weren't reinstalled after work was done to repair a defect. boeing's contractor, spirit aerosystems, was responsible for. now, the federal aviation administration is taking a closer look at boeing going forward, we will have more boots on the ground, closely scrutinizing and monitoring production and manufacturing activities. the ntsb report also
