better today. here's a look at p-g-and-e's outage map. you can see that there are still people in the dark, but it is steadily improving. we're seeing a lot more green and yellow instead of the orange and red, green and yellow means fewer outages. red means a lot more. abc seven news reporter lena howland is live in san jose, where some of the lights have come back on in just the past couple of hours. that's great to hear, lena. >> yeah, it's really good news for folks that live out here in san jose, here at the san jose shopping center. the lights just came back on really within the past hour after they first lost power back on sunday. now, according to p-g-and-e's, as of about 10:00 last night, there were still more than 40,000 customers across the bay area without power. this outage has been affecting everyone from restaurants and families, and now those with specialized needs . one woman we talked to says her husband is currently on the third floor of a skilled nursing and assisted living center in saratoga. she says the facility has been running on an emergency generator since sunday. >> when we're able bodied, we

can do it. they're not able bodied, you know, and the staff can only do so much. this is the kind of power outage that needs to be covered. this is the kind of situation that needs to be covered. >> meanwhile, people whose homes were damaged in sunday's storm are dealing with a new insurance reality. the homeowner of this home in unincorporated scotts valley had a massive redwood tree fall on it and says after getting the runaround from a utility company, a law enforcement and his insurance company, he says his insurance will cover the removal of this tree for an estimated $34,000. now, although the lights have come back on here in this san jose shopping center, p-g-and-e's tells us there are still more than 7000 customers here in the south bay without power. this morning. live in san jose. lena howland abc seven news. >> thanks so much, lena. and families on the peninsula are also feeling the frustration from power outages. abc seven drove to a local resource center

prohibits the state from seeking a criminal conviction or sentence on the basis of race, ethnicity or national origin. the four defendants are facing murder charges in a possible gang related shooting in 2021, along with striking all special circumstance sources, which can lead to a life sentence without the possibility of parole. the judge will also allow these defendants to impeach the officers or question the credibility of their testimony or evidence based on the racist texts, and that is crucial, because what what it acknowledges is that the investigation itself has been compromised and the trial is set for march 4th, a waymo driverless car reportedly hit a cyclist at an intersection in san francisco. >> according to our media partners at sf standard. it happened yesterday near 17th and mississippi. waymo says the cyclist was blocked by a truck that had entered the

intersection. the waymo vehicle waited their turn but wasn't able to see the cyclist. once the cyclist became visible, waymo says the car braked but was not able to stop in time. the cyclist had minor injuries. that waymo incident happened the same day crews met with the california public utilities commission about the october incident in san francisco. thatrillionesulted in all of their cars being pulled off the road, you may remember a cruise robotaxi dragged a woman in san francisco about 20ft after she was hit by another car during yesterday's meeting, cpuc officials were able to ask questions about the incident and cruz's response, which has been criticized. cruz is working to have its operating permits restored and has offered to pay a $75,000 fine to settle with the state no decision was made yesterday. >> another curve ball in the a's plan to make the move to las vegas. the mayor of sin city now saying the team should stay in oakland and las vegas. mayor carolyn goodman says the a's plan for a stadium at the tropicana site in sin city

>> a historic verdict after a deadly school shooting in michigan. the shooter's mother has been convicted of manslaughter. gloria this verdict could set a precedent for years to come. >> that's right. amanda jennifer crumbley, mother of the 2021 oxford high school shooter, was found guilty of four counts of involuntary manslaughter. the four counts are for each of the four students that her son killed, and she is the first parent ever to be convicted in their child's deadly school shooting. the jury deliberated for 11 hours over the course of two days. they determined that crumbley failed her duty as a parent. she ignored her son's declining mental health and gave him the gun that he used in the shooting. >> that's how our system is supposed to work. the people spoke. >> i guess i didn't truly believe that they would come back with the guilty verdict. um, and then obviously just relief that they had. >> crumbley faces up to 60 years in prison, and she is expected

to be sentenced in april. and her husband goes on trial next month, facing the same four counts of involuntary manslaughter. legal experts say that the case sets a precedent that will likely open the door for more parents to be held accountable for school shootings . reggie. >> thanks, gloria, two children in florida have been expelled from school, not for their behavior, but because of a decal on their mother's car. the decal promotes the mother's onlyfans page. the online platform is often used by adult content creators to monetize photos and videos. she says. the private christian school asked her to not bring the car on campus unless the decal is removed, or drop her kids off across the street for me, you know, it's it supports my family. >> this provides a very comfortable way of life for us, and it's legal. you know, i pay taxes just like everyone else. >> school officials say after their initial conversation with mom, she responded by getting an even bigger decal for the

school. eventually terminated the children's enrollment. they accused mom of promoting a site, although they did offer to reenroll her kids again if she removes the decal. san francisco unified is reportedly making big changes to avoid facing a legal battle, according to the chronicle, a bay area attorney is demanding the district shift from city wide board elections to smaller district races by november, after the attorney claims the current process possibly violates the california voting rights act. if the district does not comply, it could face an expensive battle that could result in paying millions of dollars in legal fees. the seven member board is expected to vote on adopting individual district election issues at its meeting tuesday. >> well, things dried up here in the bay area overnight. much of southern california has faced more rain. los angeles seeing more than ten inches since sunday. homes are barely hanging on in santa barbara. the cliff faces are eroding, as you see here, leaving apartment buildings on the edge. we

more than 60mph, according to p-g-and-e's, took down many large trees across the area and people whose homes were damaged in sunday's storm are dealing with a new insurance reality. the homeowner of this unincorporated scotts valley home had a massive redwood tree fall on it, he says. after getting the runaround from a utility company, law enforcement and his insurance company, he says his insurance will help cover the removal of the tree for an estimated $34,000. >> i think that this is going to sound scary, but i think consumers need to brace for large rate increases for home insurance. i don't think companies are going to get back in the market until they can get 50 to 75% rate increases in the preferred markets. >> this as the state continues to see an exodus of big and small insurance companies. some companies have cited wildfire risk, inflation and construction costs, while other agents say price controls within the state system makes it difficult for insurance companies to increase
