[ laughter ] good morning america. >> setting the bar high there. coming up the new preliminary report on the alaska airlines midair blowout. how many times the plane flew before the door plug flew off and how boeing is responding. let's get right to the story overnight from capitol hill. house republicans failing to impeach homeland security mayorkas. that was not all. our senior congressional correspondent rachel scott up late and up early with it all for us. good morning, rachel. >> reporter: robin, good morning. this is an embarrassing string of set backs. in the last 24 hours republicans killed a border deal they helped negotiate, failed to impeach the homeland security secretary and couldn't even get enough votes to pass additional aid to israel. overnight an embarrassing defeat for republicans. the house failing to impeach

homeland security secretary mayorkas over his handling of the border. >> on this vote the yays are 214 and nays are 216. the resolution is not adopted. >> reporter: a handful of gop lawmakers refusing to fall in line, saying the party provided no evidence of an impeachable offense. >> this was not a high crime or misdemeanor. this was a policy difference. >> reporter: republicans thought hey had the votes but then texas democrat al green, who just underwent emergency surgery, showed up. wheelchair bound in his hospital scrubs, to cast the deciding vote. moments later a second set back for speaker mike johnson. his bill to provide aid to israel also rejected. johnson out of the chamber, all of this capping off a chaotic 24 hours on capitol hill, with republicans also backing away from a bipartisan border deal their own party helped negotiate. >> it's actually our side that

wanted to tackle the border issue. we started it. >> reporter: that deal would have also provided aid to israel and ukraine. with $20 billion in border security, the most sweeping reform in decades. >> we all see that there's a problem. let's all agree that we need to do something. >> reporter: it's the kind of package johnson said he wanted for months. you said a few months ago that you wanted to see a bipartisan agreement on border security an additional aid to ukraine. senators say they did that. >> they did not send us a border security measure. >> reporter: after donald trump started bashing the compromise, johnson declared it dead on arrival. >> time for republicans in congress to show a little courage, to show a little spine, to make it clear to the american people that you work for them, not for anyone else. >> reporter: as for where things stand this morning senate democrats will force two votes, one on that package, which is expected to fail. another one with additional aid to israel and ukraine. house speaker mike johnson is vowing to hold another vote to

try to impeach the homeland security secretary and trump is celebrating the news that border bill is dead. he wants to run on immigration in november. >> we know trump is still the clear front runner in the republican primary. >> reporter: nikki haley decided to compete in the nevada republican primary. donald trump was not even on the ballot and she still lost. most voters deciding not to go with a candidate at all. the major contest for delegates is tomorrow, for the caucuses, where trump is the only candidate competing. and that contest. this morning we are learning about a major shake-up within the rnc. sources tell us the chair is expected to resign after the south carolina primary. we are told this is a decision she has discussed directly with donald trump, robin. >> rachel, thank you very much. george? now major legal set back for donald trump. a federal court ruling unanimously that the former president is not immune to prosecution in the federal case accusing him of trying to overturn the 2020 election. chief justice correspondent pierre thomas has the story. good morning, pierre. >> reporter: george, good morning.

today the appellate court is rejecting at every level donald trump's claims of complete immunity and is saying his trial for alleged election interference can move forward. this morning a three judge panel, two appointed by a democratic president and one by a republican, has issued a blunt unanimous ruling. former president trump is not above the law. the court writing, we cannot accept that the office of the presidency places its former occupants above the law for all time there after. the judges had signaled their skepticism of complete presidential immunity in a january hearing. >> can a president order seal team 6 to assassinate a political rival? that's an official act. >> it would have to be and would speedily be impeached and convicted before the criminal prosecution. >> reporter: trump has maintained in order to do the job effectively, a president must have complete and absolute immunity. >> you're gonna have to allow a president, any president, to

have immunity so that president can act and do what he feels and what his group of advisers feel is the absolute right thing. >> reporter: but in rejecting trump's claim of immunity, the court made clear the allegations that he tried to illegally block joe biden from being certified as president could be serious potential crimes. the court writing, former president trump's alleged efforts to remain in power despite losing the 2020 election were, if proven, an unprecedented assault on the structure of our government. he allegedly injected himself into a process in which the president has no role, counting and certifying of the electoral college vote, undermining constitutionally established procedures and the will of the congress. trump attacked the court's decision calling it a nation destroying ruling that cannot be allowed to stand. george? >> okay, pierre, thank you very much. let's bring in dan abrams. what an emphatic ruling. >> it was a rebuke of every single argument that donald trump's legal team had made and

every argument that donald trump has been making publicly. it was unequivocal in saying that there is no way that the president can have complete immunity based on any action that he took as president. their position was, well, unless he's been impeached and convicted and the court saying, in effect, that doesn't make any sense. >> there's no way this will be overturned. the only question now is where does it go next? how long does it take? >> it's all about the clock at this point. remember, there's a trial waiting to happen, right? this is an appeal during a trial of donald trump that jack smith's team had brought. the question is, when does it happen? it was scheduled for march 4th. it's now been delayed by that trial judge pending this ruling. but now the question is, where does it go from here? the court has tried to ham string a little bit trump's team with regard to the typing. saying, look, if you appeal to the u.s. supreme court, you've got six days. if you do it, we'll pause it. question one, how long could the supreme court take?

it could take whatever time they want. >> how long could the supreme court take? >> even in allowing the arguments, how long will it take to decide to make their argument. option two would be asking this appellate court. remember this is just three judges in this appellate court. they could ask the whole court to hear the case. if they do that though, the court is saying you are now risking the trial court resuming its process here. >> bottom line, have the odds increased that the trial happens before election or do we not know? >> it's about the same. i think it's going to be tough to believe that this trial will happen before the election. in particular because the justice department has its policy of nothing within 60 days of the election. that moves the time frame even back a little further. >> dan abrams, thank you very much. linsey? >> talk about adding insult to injury, a new storm warning headed for southern california following the historic rainfall over the past few days with hundreds of mud slides reported. rob marciano back in los angeles for us once again. good morning, rob. >> reporter: good morning, linsey. we finally got a temporary break

in the rain. as you can see behind me, the rainfall runoff is still coming off these hills. the damage is done. this home behind me, the bottom floor was completely blown out by mud and rock, one of 300 landslides around the los angeles hills. this car is still pinned up against the wall an crushed by the brick pillar. yesterday, more evacuations in santa barbara county. look at this video of this drone of this cliff being eroded by the surf. this apartment complex teetering on the edge. 45 people evacuated. not sure if they'll be able to go back. we have another system coming down northern california in the form of rain. this was a faster mover, should drop less than an inch of rain. we can't take any more moisture. folks here will be glad when this week is done. robin? >> i don't blame them at all. thank you. now the preliminary report from the ntsb on why the door plug blew out of an alaska airlines

jet last month when bolts that were supposed to hold it in place were missing. our transportation correspondent gio benitez join us with those details. good morning, gio. >> reporter: hey, robin. good morning. incredibly, this plane made nearly 150 flights all with those bolts missing until, of course, that terrifying moment a month ago. this morning early answers from the ntsb. federal investigators say all four crucial bolts designed to hold the door plug in place on that alaska airlines 737 max 9 were never there. the head of the faa telling lawmakers changes must be made. >> it's not delivering safe aircraft. >> reporter: the ntsb's preliminary report says during manufacturing, an unrelated problem with the fuselage needed repair. to make the fix, the door plug had to be removed. when the door plug was reinstalled, the ntsb says the bolts were never put back on. >> perfect logical to assume the bolts were in place before the door was open for maintenance on

the line. but once the door was closed up again behind the insulation, the problem was, nobody had put the bolts back in. >> reporter: a photo shared between boeing staffers showed at least three of those crucial bolts missing after the work was completed. all of this happened before alaska airlines even took delivery of that 737 max 9. the plane went on to fly nearly 150 times before the door plug flew off. >> what's really terrifying is that this airplane flew about 150 times with this situation just ticking away like a time bomb. >> reporter: the faa now in the middle of a six week audit of boeing and the fuselage manufacturer. >> going forward, we will have more boots on the ground monitoring production and manufacturing activities. >> reporter: boeing's ceo saying in a statement, whatever final conclusions are reached, boeing is accountable for what happened. an event like this must not happen on an airplane that leaves our factory. and that photo of the door plug without the bolts was found in text messages between boeing

the shooter had already pleaded guilty, charged as an adult. but this jury found his mother is also responsible for her son's school shooting. >> guilty. guilty. guilty. >> reporter: jennifer crumbley now the first parent held criminally responsible for a school shooting, found guilty of four counts of unvoluntary manslaughter. she sat motionless looking down as the verdict was read before being taken away in handcuffs, one count each for the lives of the four students who were killed november 30, 2021 by her then 15-year-old son. >> first thing that popped in my head was the people spoke. and that's how our system is supposed to work. the people spoke. >> reporter: the fathers of justin, tate and hana speaking together with abc news. >> i didn't truly believe they would come back with a guilty verdict and they have. they looked at the evidence and

used common sense and came back with the right verdict. >> reporter: the jury deliberating nearly 11 hours over two days. six men, six women, some parents, some gun owners, finding jennifer crumbley failed her duty as a parent, gifting her son the gun he used in the shooting and ignoring signs of his deteriorating mental health. >> because of that four kids died. >> reporter: the defense tried to show jennifer knew little about firearms and that securing the handgun was her husband's responsibility. but the jury foreperson saying after the verdict -- >> the thing that really hammered it home is that she was the last adult with the gun. >> reporter: and soon after the verdict was read, the prosecution hugging those families of the victims. >> given the fact that we've been through so much, i welcome this day with open arms. gives you a little bit of hope

this was a particularly bad fact pattern for her. this was basically as bad as you could get, right? it's not just that you had warning signs. literally the parents are being called in the morning it happened based on this drawing that he made. but do i think there will be prosecutors who will be looking at say a slightly lesser case and say, remember that case in michigan? that one worked. maybe this is the time to hold more parents accountable. it's certainly possible. >> the dad will be tried in march. how do you think this case will impact his trial? >> so on one hand this will help him. he now gets to see everything that happened. what worked, what didn't. he's now got the road map. on the other hand, look, he is the one who theoretically more culpable here. right? he was the one responsible for the gun. he went and bought the gun. he was the one responsible for the storage of the weapon. that case could be a tougher one but he'll have a little advantage in having seen how this case went. >> the mom but not the dad convicted?

>> a lot better than $21.5. >> you are so right on that. rebecca jarvis, thanks. now to a gm a health alert. a new study published in gama neurology found the mediterranean diet may be one aspect in protecting the brain from signs of alzheimer's disease. our chief medical correspondent dr. jen ashton joins us with more. it feels like whenever we're talking about diets with the potential benefits, mediterranean tops the list. how does it figure into this study? >> it does top the list. this study, the real headline here is that it's not just one thing. it's a combination of lifestyle factors. mediterranean dash diet figured very prominently. let me take you through it. researchers at rush university looked at a combination of adults eating a mediterranean dash diet, exercising at least 150 minutes per week and followed them over time and found they had better cognitive function, less data protein in their brain on autopsy, which is a hall mark of

alzheimer's disease when associated with not smoking, limited alcohol intake and in that full picture there was a significant association. that is behavioral modification. >> if someone wants to modify, and maybe begin. you're a nutritionist. how would you recommend they get started? >> really the mediterranean diet is about what you are leaning into and what you're avoiding. so what you want to increase are foods like fruits, vegetables, whole grains, nuts and seeds, olive oil should be the primary source of fat in that diet. then foods you want to avoid, minimize, decrease, low moderate amounts of eggs, dairy, fish, protein. limited red meat. that's important. then limitation on sugary drink, highly processed foods, processed meat. this is well known, if not controversial. we all can do this. it's just about making a commitment. >> making that shift. all right. good tips there for us dr. jen, thank you as always.

talking about money so they can make financial independent choices? >> if you want to start with kids from preschool to age 7 you want to teach them about, what is money and how is it used? you can start with books and music. kids love that. elementary age children you want to lean into giving and start them off with a charity drive. kids really love to give especially to other children. then middle school, this is when kids can start to learn, how can you make money? we've all had popup lemonade stands. continue to do so. or start to give them an allowance, but not based on chores. >> that's good advice. good advice. i have a question from a viewer. this goes to you. all right. so we have a viewer question for rachel from angela, a mom of four young kids. listen up. >> my husband and i really want to teach our children how to take care of money at an early age. we're not ready to do allowances just yet. but what are some ways we can

teach them how to manage money and build wealth? >> such a great question. as tiffany was just saying, we want to be careful to separate allowance from chores. we've got to get kids helping out in the house early and not because they're getting paid for it, but because they're helping. i tell my daughter, thanks for sweeping you helped this house run better today. we know that's how kids know they matter. and matter gives them resilience, more self-esteem. that i think is worth more than any dollar they get paid. that being said, once they have the money, give them three jars. one to save, one to spend, one to donate. >> we did that. very helpful. >> decorate it. they can physically see what they've got and manage that money with them together right in front of you in those jars. >> really interesting advice not to tie the allowance to the actual chore. our next question is from shera in new jersey. >> hi. my daughter just got her first part-time job. is there any room for negotiating her hourly wage? >> wow. yes, in a word.

negotiation is one of the most important skills kids can learn. to that question, a friend of mine's daughter was going to become a life guard. she found out the boys were making more. >> at that young age? >> at that young age. it can start at age 18. so we gathered evidence about appropriate hourly pay for her experience level and she successfully asked for more. >> that's fantastic. >> yeah. it really starts that young. to rachel's point, it's important for kids to have a part time job or responsibilities around the house. it's less about, i'm walking the dog and more about, i'm learning how to budget my time, how to be accountable as part of a team, in this case, my family. for the teenagers, the older set, you want to help them think about pairing their interests with impact. what you like to do and how you want to help your community.

>> what age might you recommend a child start getting potentially a part time job? 4? [ laughter ] >> i hope my daughter's listening. starting around age 14 kids can get paid in most jobs. but there are some instances where they could work even younger and certainly they could be volunteering. >> all right. i think we have time for one more if we get a quick answer. this one is from terea in chicago. she has a question about credit cards. >> hi. my son is a sophomore in college. does he really need a credit card or should i be helping him build his credit? >> what do you think? >> absolutely help him build his credit. you can help him get a secured credit card, which is when you put the money inside an account and that is the limit for the credit card. have a statement come to your house. lastly, add him on as an authorized user to your card. he can inherit your good behavior.
