that destroyed a historic resort lodge on lake superior. the nearly 140 year old lutsen lodge was considered minnesota's oldest. the cause of the fire is under investigation. now the mostrillionecent fire inspection was just last summer and officials say there were three outstanding violations. some involving sprinklers and fire alarms. >> police in the bahamas say they've arrested two men accused of sexually assaulting two american women on vacation. two kentucky moms say they were on a kids free getaway cruise when they were drugged and raped during a day trip to a beach resort. they say they're coming forward to raise awareness, adding that they did not know about the state department travel advisory, telling americans to use extreme caution because of increased crime in the bahamas. >> a mountain top with freshly fallen snow will always attract plenty of skiers and snowboarders from beginners to even professionals, and that can make the slopes feel a bit like a zoo, especially when you add a moose on the loose to the mix.

>> so maybe like making the biggest or largest amount. not like the joey chestnut. no way. my stomach can't handle all that. >> uh, yeah. mine either. we'll tell you what happened with this guy. he spent eight years trying to break this record, so it's a little sad, but we'll tell you what happened. coming up in just a few minutes. we do want to begin this morning, though, with the supreme court just hours away. now from taking on a historic election case. >> yeah, the justices are poised to hear arguments on the colorado ruling disqualifying former president trump from the ballot all over his efforts to overturn the 2020 election. >> it all hinges on a rarely used section of the 14th amendment, and it could have consequences far beyond colorado. abc's andrea fujii starts us off this morning. >> history unfolding at the supreme court. >> justices will hear oral arguments over whether former president trump can be kicked off the ballot in colorado. >> if the supreme court were to hold that donald trump cannot appear on colorado's ballot, it will mean that donald trump will not appear on any ballot in the country in the 2024 election,

colorado took trump off the ballot in december, claiming he engaged in insurrection against the united states on january sixth, violating section three of the 14th amendment, a civil wartime amendment which bars certain people from holding office if they engage in insurrection or rebellion or given aid or comfort to the enemies thereof. >> the exact wording of the amendment will be under scrutiny today because it does not specifically mention the president. only officers of the government. trump and his lawyers argue the amendment does not apply to the president because he's not an officer of the government. they want to silence me because i will never let them silence you. >> and in the end, they're not after me. they're after you. >> despite not being convicted for his alleged role in the january 6th riot, colorado is expected to argue that since trump participated, he can't be on the ballot. >> therefore, donald trump is ineligible to be president of the united states, the same as if he were only 34 years old or not. a natural born citizen. that this is a constitutional qualification and so he can't appear on the ballot.

>> experts believe the high court will ultimately not grant states the ability to decide who gets to be on their ballots. >> the idea, then, that these states would get to now be empowered with the decision of who gets to run for president, would sort of be an odd turnaround for these civil war amendments. they could just say, look, it's up to congress and not up to us, the supreme court. but that itself will be a decision, meaning colorado can't remove him from the ballot. if it's up to congress oral arguments today could last up to three hours. >> the justices are expected to make a decision before colorado's primary on march 5th. rhiannon lionel. >> andrea, thank you. the justice department has confirmed the investigation into president biden's handling of classified documents is finished. attorney general merrick garland said he informed the house and senate judiciary committees after the special counsel submitted his report on monday. it is now being reviewed for potential executive privilege material before it's released. sources do not expect criminal charges, but

they believe the report will highlight mistakes and instances of carelessness. >> stormy weather is still hampering the search for five u.s. marines missing. after the chopper they were in crashed in the mountains outside of san diego. emergency crews found that helicopter in a rugged mountainous area. now they are intensifying the search for those missing marines. they had been on what's described as a routine training mission in the military's largest and heaviest chopper, but they were flying at night in harsh weather conditions. >> now to the turmoil on capitol hill. the bipartisan border bill crumbling as republicans failed to advance it to the senate despite meeting many gop demands. the measure quickly lost support after donald trump repeatedly railed against it. here's abc's rachel scott. >> republicans in the senate. overwhelmingly voting to reject the border security bill. they themselves had demanded full of their own priorities, for cracking down on illegal immigration. only four republicans voted to advance the

bipartisan bill, including one of the senate's most conservative members, james lankford of oklahoma, who led negotiations with democrats. >> if we're going to solve something, we have to sit down together and solve it. that's how it works. when you make law, you can do press conferences without the other side, but you can't make law without the other side. in the united states senate, the bill included a number of republican priorities. >> $20 billion to strengthen the border, hiring new officers and border patrol agents $650 million to build and reinforce eight miles of fencing and $404 million to hire new judges and support staff to expedite asylum cases. it also introduced a new safeguard when migrant apprehensions reach 5000 a day. the border would automatically shut down and when the border slows down, it slows down for weeks. but donald trump pressured republicans to vote against the bill. he wants to run on immigration in the election. >> in fact, i had a popular commentator four weeks ago that

i talked to that told me flat out before they knew any of the contents of the bill, any of the content, none of nothing was out at that point. that told me flat out, if you try to move a bill that solves the border crisis during this presidential year, i will do whatever i can to destroy you because i do not want you to solve this. during the presidential election. by the way, they have been faithful to their promise and have done everything they can to destroy me. president biden saying republicans had to decide died. >> who do they serve? donald trump or the american people? >> house speaker mike johnson was one of those republicans who demanded a border security deal, saying in november that without it, there would be no new funding for ukraine. >> i think we could get bipartisan agreement on both of those matters. >> but when trump came out against the bill, johnson reversed course, declaring it dead on arrival. instead, he focused on impeaching homeland security secretary alejandro

mayorkas. but in an embarrassing defeat, the resolution is not adopted. >> he didn't have the votes last night. was a setback, but democracy is messy. >> house republicans still focused on impeaching mayorkas rather than working with democrats to fix the border. does this solve any crisis at the border? rather than reaching out rather than reaching out to democrats? >> i don't care. i don't care if it takes a third time. >> bottom line the bill is dead again. republicans were the ones demanding border security provisions, but now they are making it clear they are no longer interested in a bipartisan solution to address. the crisis at the border before the november election. rachel scott abc news, capitol hill. all right, rachel, thank you for that update. >> a big city hospital is in the midst of a days long cyber attack, and it's already compromising patient care. also renewing questions about cyber security. this morning, a cyber attack on a children's hospital in chicago is entering its ninth day since last wednesday. lurie children's hospitals, phones and computers have been offline.

patients medical records are inaccessible, experts warn it could take weeks to get the hospital systems back up and running. >> that's why cybersecurity attacks are so damaging, because there's not an answer about how long it's going to take. >> the fbi is now investigating the attack, which has forced the hospital to cancel some procedures and elective surgeries. the hospital saying we recognize the frustration of not having clarity on when this will be resolved. our investigation remains ongoing and we are working around the clock to resolve this matter. >> they're looking perhaps at the security at their workstation level. >> mobile devices, pcs, masks that level. >> and they're also looking at it at the system level, like who has access to the server hospitals have been a frequent target for hackers. >> and in december, a cyber criminal group targeted another chicago hospital, demanding nearly $1 million to not leak

patients personal information. one month earlier, a cyber attack on a large health care company forced hospitals in three states to close their emergency rooms. that's been an underserved area of cybersecurity investments. >> and so now we need to catch up and we need to make sure we raise the bar a record 725 major security breaches in health care were reported to federal officials last year alone. >> wall street will be watching some fresh jobs data this morning, as the major stock averages open at record highs. the dow added 156 points yesterday, with the s&p 500 and nasdaq also posting gains. the current rally is being fueled by companies reporting better than expected earnings overnight stock futures indicated a mostly higher open. >> all right now to france and an eiffel tower sized controversy over a guinness world record attempt. i really hope this has a good ending. >> well, let's break this down for you. frenchman richard
