sign that drivers are getting sick of all the gadgets in cars >> from abc news in new york. this is america this morning. >> good thursday morning, everyone. i'm rhiannon ally, and i'm lionel moise in for andrew. >> we begin with history being made at the supreme court this morning. >> the justices are taking up a crucial question in the presidential campaign. can former president trump be kept off the presidential ballot in colorado? >> but this case could have consequences far beyond colorado. abc's andrea fujii explains. >> this morning history unfolding at the supreme court. justices will hear oral arguments over whether former president trump can be kicked off the ballot in colorado. >> if the supreme court were to hold that donald trump cannot appear on colorado's ballot, it will mean that donald trump will not appear on any ballot in the country in the 2024 election, colorado took trump off the ballot in december, claiming he engaged in insurrection against

the united states on january 6th, violating section three of the 14th amendment, a civil wartime amendment which bars certain people from holding office if they engage in insurrection or rebellion or given aid or comfort to the enemies thereof. >> the exact wording of the amendment will be under scrutiny today because it does not specifically mention the president, only officer of the government. trump and his lawyers argue the amendment does not apply to the president because he's not an officer of the government. >> they want to silence me because i will never let them silence you. >> despite not being convicted for his alleged role in the january 6th riot, colorado is expected to argue that since trump participated, he can't be on the ballot. >> therefore, donald trump is ineligible to be president. united states the same as if he were only 34 years old or not. a natural born citizen. >> experts believe the high court will ultimately not grant states the ability to decide who gets to be on their ballots. >> the idea, then, that these states would get to now be empowered with the decision of

who gets to run for president, would sort of be an odd turnaround for these civil war amendments. they could just say, look, it's up to congress and not up to us, the supreme court, but that itself will be a decision, meaning colorado can't remove him from the ballot. if it's up to congress. >> oral arguments today could last up to three hours. the justices are expected to make a decision before colorado's primary on march 5th. rhiannon lionel and andrea, thank you. >> the other big story this morning, the search for five us marines missing after a helicopter crash in california. abc's ike ejiochi is here now with the latest. ike. good morning. >> good morning. ryan. and there's no evidence that any of the five marine crew members survived the crash. the helicopter departed an air force base outside las vegas tuesday night on what's described as a routine training mission. an extensive search was triggered after the crew failed to arrive as scheduled in san diego about seven hours later. search teams found a debris field in the mountains outside of san diego in difficult terrain because of

the snow and mud. the chopper is a ch 53 super stallion helicopter known as the marines workhorse. the same type of chopper crashed during a training mission in 2018, also in california, killing four service members. an investigation blamed pilot error for that tragedy. however the case of this latest crash is still under investigation. lionel >> all right, ike, thank you so much for that update. a us airstrike in baghdad has killed a high ranking leader of an iranian backed militia. the targeted vehicle went up in flames. the pentagon says the commander was responsible for some of the recent attacks on us forces in the region. it is the latest strike after last month's drone attack that killed three americans in jordan. >> a bipartisan bill to address the crisis at the us southern border has officially been killed in the senate. it offered the most sweeping border security changes in years, but the bill faced growing opposition as former president trump pressured lawmakers to

block it. the conservative republican who helped write the bill had this message about how things work in washington these days. >> i had a popular commentator four weeks ago that i talked to that told me flat out before they knew any of the contents of the bill, any of the content, none of nothing was out at that point. that told me flat out, if you try to move a bill that solves the border crisis during this, president year, i will do whatever i can to destroy you because i do not want you to solve this. during the presidential election. by the way, they have been faithful to their promise and have done everything they can to destroy me in the past several weeks, the bill also included funding for israel and the war in ukraine that funding remains in limbo. >> a freight train has derailed in upstate new york. ten cars of this norfolk southern train came off the rails north of albany,

officials say two of the derailed cars spilled their contents, including plastic pellets, but it's unclear if any spilled into the nearby river. but officials say the train was not carrying hazardous materials. and in ohio, a truck driver was about to cross these train tracks when his gears froze. he could not shift into reverse. just look there. he jumped out of that cab just in time to avoid being hit by that oncoming train. >> new concerns. this morning about president biden's age. after his comments at a fundraiser yesterday. of course, former president trump also misspeaking recently. polls show more voters are taking notice this morning. age and mental acuity are emerging as key issues in the race for the white house. after recent misstatements from both the president and the former president. last night, president biden returned to the white house after two private fundraisers in new york at both of the off camera events, biden discussed the g7 summit in 2021,

where he said he spoke with former german chancellor helmut kohl, but kohl died four years earlier. the biden apparently confused kohl for angela merkel. the white house says biden's remarks will be corrected in the transcript. >> i'm serious. think about it and sunday in las vegas, biden referred to french president emmanuel macron as francois mitterrand, the former french president who died in 1996, and mitterrand from germany. i mean, from france, looked at me and said, uh, said, you know why, how long are you back for? >> former president trump also making headlines for misstating events while recently talking about january sixth, he appeared to confuse his primary rival, nikki haley, with former house speaker nancy pelosi. >> nikki haley is in charge of security. we offered her 10,000 people. >> trump is 77. if elected in

november, he would be 82 at the end of his second terms. biden is 81. if reelected, he'd be 86 at the end of his second terms. supporters say age is an asset to the presidency with age comes wisdom and well cultivated relationships with world leaders . but a recent poll found 61% of voters support an age limit for presidential candidate, and 30% said that age limit should be 70. >> do we really want to have two presidential candidates in their 80s? nikki haley is calling for competency tests for older politicians. i'm not being disrespectful when i say that, but the issue is these are people making decisions on our national security. >> doctors for trump and biden have said both are in good health. >> lawyers for the man charged in the delphi murders case in indiana are now asking the judge to dismiss the case, claiming key evidence has been destroyed. richard allen is accused of killing teenagers abby williams

overnight. >> we turn now to another cyber attack targeting another major hospital, raising questions about patient care and security. this morning, a cyber attack on a children's hospital in chicago is entering its ninth day since last wednesday. lurie children's hospitals, phones and computers have been offline in patients medical records inaccessible. experts warn it could take weeks to get the hospital systems back up and running. >> that's why cybersecurity attacks are so damaging, because there's not an answer about how long it's going to take. >> the fbi is now investigating the attack, which has forced the hospital to cancel some procedures and elective surgeries. the hospital saying we recognize the frustration of not having clarity on when this will be resolved. our investigation remains ongoing and we are working around the clock to resolve this matter. >> they're looking perhaps at the security at their workstation level. mobile devices, pcs, macs at that

level. and they're also looking at it at the system level, like who has access to the server. >> hospitals have been a frequent target for hackers. in december, a cyber criminal group targeted another chicago hospital, demanding nearly $1 million to not leak patients personal information. then, one month earlier, a cyber attack on a large health care company forced hospitals in three states to close their emergency rooms. that's been an underserved area of cybersecurity investments. >> and so now we need to catch up and we need to make sure we raise the bar. >> 725 major security breaches in health care were reported last year. >> uber has done something it's never done before. it posted a full year of profits. it is the first time ever since the company went public five years ago. it got a boost recently from corporate travel and advertising. >> snoop dogg is suing walmart over his cereal brand. snoop
