a stolen plane crashed on a beach, but the pilot was not inside. now, at five, the investigation into what happened in half moon bay and how police were able to track down the suspect and president biden fiercely pushing back on statements made in a new report by federal investigators. >> what it claims about the president's mental health. >> supreme court justices appear to be skeptical when it comes to colorado's attempt to keep donald trump off the ballot. the decision, expected in the coming weeks. plus running for what? >> like i ain't understand that y'all not lying. >> it did go off for a little bit. um, i just kind of closed

the door in my bathroom and sat there until it turned off. >> first, the practice field and now this. >> the drama continues in las vegas for the 40 niners. the hotel high jinks that isn't sitting right with a lot of the players. this is beginning to feel like hazing, leading up to a big game. >> what is happening here? what is happening? >> well, it's so funny because i've heard larry talk about the media hotel and how, you know, lights were off and water wasn't working with the players to wow, wow, can't wait to hear all about that. >> tough going around there. all right, well, how about us? >> lights are on, lights are on. >> we're warming up. it's a little chilly out there this morning. here's a look at our frost advisory for more of the region compared to yesterday. this lasting until about 9 a.m. this morning. it's for most of the north bay, the inland east bay, the santa clara valley where we do have temperatures this morning well into the 30s. that means frost could have a appeared on some of your plants, even your car. this morning we're taking a look at

temperatures at. you can see clearly it is chilly out there right now 37 in concord. we're at 40 in fremont. we're down to 36, though in santa rosa, 40 in san rafael, 45. that current temperature in the city. so we take a look at the planner today. we are dry today. it's a mix of sun and clouds throughout the afternoon. temperatures a little bit warmer than yesterday , but we'll warm ourselves up even more so as we head into the weekend. the weekend looking fantastic. we'll show you that in eight minutes. let's check in with gloria and see how traffic is doing this morning. yeah jerry, you're right about it being chilly this morning, so maybe give yourself an extra minute or so just to warm up that car today. >> but you know what? right now it's looking pretty good out there on the bay area roads. you can see a lot of green, which is what we like to see. not too many slowdowns at this time. of course it is friday, so we expect a lighter commute today as a lot of people work from home these days. here's a live look outside at our walnut creek camera and traffic is moving nicely there. amanda. all right. >> thanks so much, gloria. now, how did a small plane end up on

a bay area beach? that's what authorities are trying to figure out. they say it was stolen from the palo alto airport yesterday before landing near poplar beach in half moon bay. at last check, the small plane was still there. let's go live to abc seven news reporter ryan curry and ryan crews are now trying to figure out how to remove the stolen plane from the beach. >> yeah. amanda. good morning. it's actually unclear to see really what is going on with the plane because the beach is closed and we can't get anywhere near it this early morning hour, so we're going to have to wait to see later on to see if the plane is still there and kind of what efforts are going on from the crew standpoint to get it removed from the beach, which is just a bizarre situation. but yes, so many questions about what led up to this incident. san mateo sheriff's office say a man stole this plane from palo alto airport and took it for a joyride. they don't know why he decided to land it on the beach. the sheriff's office says they got the call around five last night of a plane that had landed on the beach. dispatch audio says the pilot left on foot, and

a witness says they were able to help officers track them down. and they say they heard the plane flying low towards the ground. >> the first buzz was so fast it was a normal speed and it flew right over my head like 20ft over my head. >> i've been doing this for almost 20 years and this is a first for me. god, just such a bizarre situation. >> authorities arrested a 50 year old man from miami, florida. he has been booked into jail right now and we're still waiting for an update about the efforts to remove that plane. but yes, a bizarre situation. luckily, nobody else got hurt from this incident for now. reporting live in half moon bay, ryan curry abc seven news a bizarre situation indeed. >> thank you ryan starting next week, alameda county will get some help prosecuting suspects in violent crimes. we first told you about this story yesterday on abc seven mornings. governor newsom and state attorney general rob bonta are sending attorneys to help with criminal prosecutions. their focus will be on violent crimes, fentanyl

dealing and property crimes, things like retail theft and auto burglary. >> see, that's what we do when there are when the evidence and the data show what exists here in oakland, that there are spikes in crime, uh- much higher than other levels in the state of california. so we need to be responsive to it. we need to hold people accountable. accountable. we need to work together to deliver the results that the people of oakland and the east bay deserve, and they deserve their leaders working together and we're delivering that. meanwhile of course, we've been telling you about the push to recall alameda county district attorney pamela price. >> well, dia price says she accepts the extra help from the state, calling it consistent with the plan to bring more chp officers into the county. abc seven news insider phil matier shares his take. >> it's meant as a smart move in that, okay, let's say he says, i'm bringing in prosecutors to help out, whether it's for organized crime or very serious crimes or something like that. in other words, nothing that sort of violates the progressive

ideal of we don't want to just lock up everybody, but we're going to go after, as they like to say, the bad actors. uh, so it's good politics. on the governor's part. and it also makes a statement to the rest of the country that when asked, he says, yes, i am doing this. i am making these moves. >> this this shift is similar to a move governor newsom made last april when he announced a partnership to combat fentanyl trafficking in san francisco. chp officers started patrolling the tenderloin and the south of market neighborhoods. abc seven news tracked the numbers and found just in the first three months, officers seized 103 kilos of narcotics, nearly half of that being fentanyl. more than 300 suspected drug dealers were arrested. this morning. >> president biden is defending his handling of classified information and his memory after the special counsel report found he willfully retained and shared some classified documents. and gloria, the report found no criminal charges are warranted. but it also highlighted his age and his mental capacity.

>> that's right, amanda, special counsel robert herr released a report after his investigation into president biden's handling of classified documents. now in the report, herr, who was appointed by former president trump, wrote that his assessment of mr. biden's mental acuity and his power of recall was hazy, fuzzy, faulty and having significant limitations. the report suggests that the documents could have been brought to his former office in dc and at his home in delaware by mr. hirsch said the evidence does not establish mr. biden's guilt beyond a reasonable doubt. the president is lashing out at his assessment of his memory, especially his statement claiming he did not remember even within several years when his son beau died. >> how in the hell dare he raise that? frankly, when i was asked a question, i thought to myself, wasn't any of their business. >> former president trump called this report selective prosecution action since he is facing criminal charges over his mishandling of classified

documents at mar a lago. now, in contrast to president biden, who cooperated with the investigation, he says trump not only refused to return the documents for many months, but he also obstructed justice by enlisting others to destroy evidence and then lie about it. julian. >> okay. thank you. gloria. supreme court justices appear skeptical about banning donald trump from primary ballots during an election year. yesterday yesterday, they heard oral arguments in the case over colorado's decision to remove trump under the 14th amendment's interaction clause. now, the justices question if a state has the authority to make such a decision. >> i think that the question that you have to confront is why a single state should decide who gets to be president of the united states. it just doesn't seem like a state call. >> judges also questioned whether those who framed the 14th amendment intended to give states more power after the civil war. it prohibits an officer of the u.s. from holding office if they've taken the oath

to the u.s, then engaged in insurrection. trump's lawyers drew a distinction, arguing the amendment only applies to appointed officials and not elected presidents. the attorney for colorado disagrees. >> by engaging in insurrection against the constitution, president trump disqualified himself from public office. >> it's not clear when the high court will rule on this case. colorado's primary is set for march the 5th, 508 this morning. >> we'll take you outside the exploratorium camera showing you it's not totally clear out there this morning. we do have of partly cloudy skies to deal with as we take a look at temperatures right now, though, it is chilly. we have 30 again in our coldest spots this morning. we're at 33 in danville, 38 right now in livermore, 37 in concord. as we head towards the north bay, we have those temperatures in the mid 30. so frost advisories are up. you may find some frost on your windshield again this morning. it's just chilly out there. we'll have periods of sun

hoping for a smoother start to the morning today after they had a pretty rude awakening yesterday morning. the fire alarm went off at their hotel around 6:00 in the morning. now staff on site, they were able to determine that it was not an actual emergency, so the team did not have to evacuate and leave the hotel. players say it was still irritating though to start off their thursday like that, but they say they're not surprised. >> man bro, i don't like a fire alarm going off at six in the morning. for what? like i ain't understand that y'all not lying. >> it did go off for a little bit. um i just kind of closed the door to my bathroom and sat there until it turned off. >> as soon as the fire alarm went off, i just laughed. i'm like, of course this would happen. you know what i mean? it's part of it, you know? is it random? no, i think there's no way it's random. but it's part

of it, you know, i mean, it's just more wood throwing in the fire depot. >> let us know exactly how he really feels. right. the hotel tells the chronicle they're investigating what triggered that alarm and the fire marshal is involved in that investigation. but we all know vegas is known for its performers. we track down one of the most well known in town. and abc seven news reporter tara stone found the owner of the graceland wedding chapel, who apparently is a die hard san francisco 40 niners fan. elvis is in the house at the graceland wedding chapel in las vegas. >> brendan paul is his name. weddings are his game. he sang at at least 60,000 of them this weekend. he's singing the tunes of the san francisco 40 niners. >> i told my kids we'd always go up to candlestick and over the years, and now we'd still go see him. and i said, if they make it to the super bowl, i said, in our backyard in las vegas, we'll go to the game. that was before i found out the tickets were

$7,500 each, but i bought four of them. i figured, life is short. yes it turns out brendon or elvis, the owner of this chapel that has been in movies like fools rush in and fear and loathing in las vegas, is a native of san francisco, born in north beach and yes, he also just dropped $30,000 on four tickets. the king will be there cheering him on. yeah, okay. fans, help falling in love. matter of fact, with joe montana , i did a thing with him one time in the jumpsuit. super nice guy. and that was thrilling as a kid to meet joe montana. you know what i mean? yeah >> and along with cheering for the 40 niners comes backing san francisco and sticking up for the city by the bay. people badmouthed california now. >> oh, it's not what it used to be. i'm like, whatever. there's a reason why people move to california. it's beautiful. the cities have culture. there's a san francisco band, metallica, the king loves playing songs linked to the bay area. >> it's not necessarily the busy wedding season right now. here at graceland chapel, but you better believe they're ready to

people excited for this weekend. if you need somewhere to watch the game, the niners are hosting, it's official super bowl watch party at thrive city in san francisco. it all starts right outside of chase center at 2:00 sunday afternoon. game kickoff is at 330, so know that the party is free. but fans are encouraged to rsvp on eventbrite and get there early. >> i mean, thrive city is always packed for any event hours in advance. yeah it's going to be nuts. okay, super bowl parties combined with lunar new year celebrations means it is going to be a very busy weekend in san francisco. lunar new year begins tomorrow, and the holiday spans more than two weeks. so in chinatown, several establishments are getting ready for both events, including the golden gate fortune cookie factory. of course, the shop owner says they're making some special super bowl themed cookies. they having a super bowl party and they make their own message about both teams and some funny messages. and did you see that one go big or go mahomes? he says he's seen an uptick in orders ahead of both

bay. they say the person who took it, a florida man, is under arrest. >> number two, the mayors of san francisco and san jose are joining an effort to reform proposition 47, in hopes of cracking down on crime. the goal of prop 47 was to lower incarceration rates, which it has. but critics say it has just emboldened thieves. >> number three, president biden will not face charges for his handling of classified documents. a special counsel investigate found he willfully retained and shared some classified information. >> number four, the fcc has banned robocalls that use fake voices to scam people. this includes i the decision follows a rash of bogus calls last month, mimicking president biden's voice. number five, we have a frost advisory out there this morning until 9 a.m. for a big portion of the region, much of the north bay, the inland east bay, santa clara valley, the santa cruz mountains, temperatures starting out in the 30s. >> once again, we'll get some sunshine here this afternoon.

but still not too bad guys. >> okay, thank you so much. gloria. the san mateo county sheriff's office says it's trying to figure out why a man stole a small plane from palo alto. flew it around before landing it in half moon bay. right there, you see? crashed it right on the sand. abc seven news reporter ryan curry live for us in half moon bay this morning with the details. and, ryan, have they tried to remove that plane from the beach yet? >> yeah. julian good morning. it's a little tough to tell because right now the beach is closed off and it's really difficult to access it from the road. and also of course it's very dark out right now. so it's really tough to even get a look at to see if the plane is still on the beach. but crews did say that they're going to have to figure out how they get it off the beach. this is bizarre to them. authorities. that is. and they say they've never seen anything like this before. police say they arrested a florida man as somebody who stole the plane. they say he took it for a joyride and eventually landing it on the beach. they're not sure why he landed on the beach. that's still under investigation. the

sheriff's office got a call around five last night that someone landed the plane just south of poplar beach. witnesses gave police a description of the person who stole it. and then, minutes after they were able to arrest him, those witnesses. >> it was very unnerving because it's well below the flight deck. it's well below 500ft. you know. so that's what i thought. either there was a mayday or they were up to no good. >> now, kennedy there told us that the pilot flew the plane just 20ft above her head at one point, just a scary situation. the man stole the plane from palo alto airport. the sheriff's deputy who told us he again he had never seen anything like this before in his years working for the service. luckily no one else was hurt following this situation. they're still trying to figure out the efforts to get that plane off the sand again, a very bizarre situation for them, and we're going to keep following this and have more updates later on this morning. we're live here in half moon bay. ryan curry, abc seven news.

department. all of them worked extremely hard to bring closure to our family. >> authorities believe farnham may be linked to other unsolved murders here in the bay area. >> a teenager in ohio is being hailed a hero for helping stop a mass shooting at his school. gloria is at the live desk with more on how he helped to prevent the attack. gloria >> good morning amanda. a 15 year old named boom is credited with thwarting a school shooting . now, earlier this week, his father told him that his classmate revealed the plan to shoot people at a cincinnati high school. an investigator said that classmate allegedly planned to kill eight students and a teacher, authorities say text messages reveal the suspect was conspiring with an adult who was out of state. boom saw the teen's plan on paper and told his dad on tuesday. the next day , the teen was arrested and is now accused of conspiracy to commit aggravated murder. the father says the suspect threatened boom if he told
