it gets even warmer around here tomorrow. the weekend looking fantastic. we'll detail that coming up in a few minutes. let's check in with gloria, see how the commute is going. yeah >> you know what? i think a lot of people are starting the super bowl weekend early because traffic is very light out there this morning. we're not seeing too many cars out there. of course, we know that friday's a lot of people do work from home. so the commute is a little bit lighter on fridays anyway. but you look at that map right there, mostly in the green. no major delays, right now, which is what we always like to see. and then you look here, this is our bay bridge toll plaza camera. the metering lights did flip on at 537, but you'll see here it is not busy there at all compared to how it usually is. this time of morning. and then from the toll plaza to san francisco, it will take you 19 minutes. right now. amanda, thanks so much, gloria. >> how did a small plane end up on a bay area beach? that's what authorities are trying to figure out. they say it was stolen from the palo alto airport yesterday before landing near poplar beach in half moon bay. and at last check, the small plane was still there. let's go live to abc

seven news reporter ryan curry and ryan crews are now trying to figure out how to remove this stolen plane from the beach right? >> yeah, you can imagine. this is a very bizarre situation for them to be in. amanda, very rarely do you find that a plane has land on the beach, one that's not involved in a crash that is. and now they're trying to figure out really how they get that plane off the beach. we can't really get close to the beach right now because it's closed off to the public. and of course, it's dark outside, but it's something that we're going to have to monitor all morning long. the san mateo county sheriff's office say a man stole the plane from palo alto, went for a joyride. they don't know why he decided to land it on the beach. still many questions surrounding this whole case. the sheriff's office says they got the call around five last night that a plane had landed on the beach. dispatch audio says the pilot who stole it then left on foot. witnesses we spoke with say they heard the plane flying low towards the ground. >> the first buzz was so fast it was a normal speed and it flew

right over my head like 20ft over my head. >> i've been doing this for almost 20 years and this is a first for me. almost like a hitchcock movie, really. >> if you want to be honest about it. thankfully nobody else was hurt in this situation. police did arrest a 50 year-old man from miami, florida. he has been booked into the county jail waiting for the charges on that case. and yes, we're still waiting to hear about how they're going to get that plane out of the beach. the roads going to it are very narrow, so it's going to be really be a question mark as to how they're going to get it out of the beach. but we're going to keep monitoring it and we'll have more details later on. we're live in half moon bay. ryan curry, abc seven news okay, thanks so much, ryan. >> starting next week, alameda county will get some help prosecuting suspects in violent crimes. we first told you about this story yesterday on abc seven mornings. governor newsom and state attorney general rob bonta are sending attorneys to help with criminal prosecution means their focus will be on

violent crimes, fentanyl dealing and property crimes. things like retail theft and auto burglary. >> that's what we do when there are when the evidence and the data show what exists here in oakland, that there are more spikes in crime. uh- much higher than other levels in the state of california. so we need to be responsive to it. we need to hold people accountable. accountable. we need to work together to deliver the results that the people of oakland and the east bay deserve, and they deserve of their leaders working together and we're delivering that. the move comes amid a push to recall alameda county district attorney pamela price. >> da price says she does accept the extra help from the state, calling it consistent with the plan to bring more california highway patrol officers into the county. abc seven news insider phil matier shares his take. >> it's meant as a smart move in that, okay, let's say, he says, i'm bringing in prosecutors to help out, whether it's for organized crime or very serious crimes or something like that. in other words, nothing that

sort of violates the progressive ideal of we don't want to just lock up everybody, but we're going to go after, as they like to say, the bad actors. uh, so it's good politics. on the governor's part. and it also makes a statement to the rest of the country that when asked, he says, yes, i am doing this. i am making these moves. >> the shift is similar to one that governor newsom made last april, when he announced a partnership to combat fentanyl trafficking in san francisco. chp officers started patrolling the tenderloin and south of market neighborhoods. abc seven news tracked those numbers and found just in the first three months, officers seized 103 kilos of narcotics, nearly half of that being fentanyl. more than 300 suspected drug dealers were also arrested this morning. >> president biden. is defending his handling of classified information and his memory after the special counsel report found he willfully retained and shared some classified documents and gloria, the report found no criminal charges are warranted.

but it also highlighted his age and his mental capacity. >> amanda's special counsel, robert her, released the report after his investigation into president biden's handling of classified documents. it's now in the report. her who was appointed by former president trump, wrote that his assessment of mr. biden's mental acuity and power of recall was hazy, fuzzy, faulty and having significant limitations. the report suggests that the documents could have been brought to his former office in dc and at his home in delaware by mistake. now, he said, the evidence does not establish mr. biden's guilt beyond a reasonable doubt. the president is lashing out at his assessment of his memory, especially his statement claiming that he did not remember even within several years when his son beau died. >> how on the hell dare he raise that? frankly when i was asked a question, i thought to myself, wasn't any of their business. >> the former president trump

called this report selective prosecution since he is facing criminal charges over his mishandled of classified documents at mar a lago, in contrast to president biden, who cooperated with the investigation. he says trump not only refused to return the documents for many months, but he also obstructed justice by enlisting others to destroy evidence and then lie about it. julian, thank you. >> gloria. supreme court justices appear skeptical about banning donald trump from the primary ballot during an election year. yesterday they heard those oral arguments in the case over colorado's decision to remove trump under the 14th amendment's insurrection clause. now, the justices questioned if a state has the authority to make such a decision. >> i think that the question that you have to confront is why a single state should decide who gets to be president of the united states. >> this just doesn't seem like a state call. >> judges also questioned whether those who framed the 14th amendment intended to give states more power after the

civil war. it prohibits an officer of the u.s. from holding office if they've taken an oath to the u.s. then engaged in insurrection. trump's lawyer drew a distinction, arguing the amendment only applies to appointed officials and not an elected president. the attorney for colorado disagrees. >> by engaging in insurrection against the constitution, president trump disqualified himself from public office. it's not clear when the high court will rule on this case. >> colorado's primary is set for march the 5th, coming up, a big honor for christian mccaffrey, the hardware he won at the nfl awards, plus the former niner who is headed to the hall of fame, then a pretty rare sight here, a kangaroo on the run through a neighborhood. and it's not in australia. >> all right, 609 this morning we're taking a look at your morning drive. >> we are dry, but we are chilly out there. we're starting out in the 30. so definitely want to

37 max planes. the inspections focus on potentially loose bolts in the rudder control system on the planes. according to usa today, an international 737 max operator found loose bolts on one of its planes in december. it's a separate problem from that missing from the missing bolts that reportedly led to a door plug ripping off the plane in january. now, dollar stores are known for good discounts, but now critics want to limit store growth. chicago is the latest city to target the stores, claiming they can be a danger to communities the retailers have been facing criticism, accused of violating multiple health and business codes. leaders are proposing to ban dollar stores owned by the

same company from opening within one mile of each other. their stores are filthy. >> they don't keep the trash up in front of the communities. my daughter was asked by her manager to bring her carry and conceal because he did not feel safe. >> now, critics also say the stores drive out grocery chains, leaving less healthy, processed and canned foods as the only options. dollar tree argues it has spent $1.5 million upgrading and repairing stores, along with boosting staffing levels. >> these robocalls, containing voices generated by artificial intelligence, are now illegal. the fcc voted unanimously to outlaw the calls. officials say the decision sends a clear message that exploiting this technology to scam people and also mislead voters just will not be tolerated. new hampshire authorities are currently investigating ai generated robocalls that mimic president biden's voice to discourage people from voting. in last month's primary. well

patrick willis was voted into the nfl hall of fame last night. willis was a first round draft pick in 2007, and became the first player in 40 niners history. selected as an all pro in each of his first six seasons. very cool moment here with x niner. great bryant young telling his old teammate willis he was being inducted into the hall of fame. there are some traffic changes to tell you about starting on sunday, and the closures include some roads in the mission district, as well as freeway off ramps, similar to what happened during the nfc championship game. some muni busses will also be rerouted in various areas in the city. the muni fleet is now repping the 40 niners. we spotted these busses around town getting people excited for this weekend's big matchup. and if you need somewhere to watch the game the niners are hosting, it's official super bowl watch party at thrive city in san francisco. it all starts right outside of chase center at two sunday afternoon. game kickoff is set for three. the party is free, but fans are being encouraged to rsvp on eventbrite to get your

ryan, what are you learning about the pilot? yeah julian. >> good morning. what we're learning is that the pilot is actually from miami, florida. they arrested him shortly after he landed the plane on the beach . witnesses were able to give him a description, give the authorities a description of this man. then shortly thereafter, they were able to arrest him. he's now in jail awaiting charges from the district attorney's office. but just a wild situation. yesterday day, police got the call around five, saying that a plane had landed on the beach and that somebody had stolen that plane. it was just south of poplar beach is where they landed. the plane witnesses again giving that description to police. they were able to track him down, arrest him thereafter. they don't know why. why he was stealing the plane and then landed it on the beach. there are questions remaining about this whole situation. still under investigation, but we did speak with witnesses who saw the whole thing. one of them telling us that the plane came almost close to hitting her a couple times. >> it was very unnerving because it's well below the flight deck.

it's well below 500ft. you know. so that's what i thought. either there was a mayday or they were up to no good. >> now kennedy also told us that the pilot flew the plane just 20ft above her head. at one point. just a scary situation. thank goodness she's okay. the man stole the plane from the palo alto airport. sheriff's deputies told us they'd never seen anything like this before. hard to imagine why. of course they're talking about a situation where somebody steals a plane that lands it on a beach. now we're still waiting to get efforts about what's going to happen when they take the plane off the beach. we haven't been able to get close to it this morning because the beach has been closed off to the public. it's also been very dark this morning and it's not easy to access, so we're waiting for those updates and we'll try to get those updates as soon as we can. but for now, reporting live in half moon bay. ryan curry, abc seven news. all right. >> thanks, ryan. and new details on another plane crash, a deadly one also near half moon bay. the preliminary report from the ntsb confirms witness statements that

the plane was in distress with the engine making a coughing noise immediately after takeoff from half moon bay airport. their report includes this image showing the plane's flight path. it took off around 7 p.m. on january 14th and climbed to 250ft in the air that was as high as it got. the last recorded data point was less than a minute after takeoff. debris was found in the ocean nearby. the bodies of three of the four people on the plane have been recovered. >> the mayors of san francisco and san jose are siding with california republicans, calling to reform proposition 47. the voter approved law was passed a decade ago, reduces most drug possession offenses and thefts of property valued under $950 from felonies to misdemeanors. but now mayor london breed and matt mahan of san jose are pushing for a november ballot measure to reclass high theft with two or more prior convictions as a felony. mental health and addiction services will be mandated for felony charges and refused, will lead

school shooting. now, earlier this week, boom told his dad that a classmate revealed the plan to shoot people at a cincinnati high school. investigators say that classmate allegedly planned to kill eight students and a teacher. authorities say that text messages reveal the suspect was conspiring with an adult who was out of state. boom saw the teen's plan on paper and then told his dad on tuesday. the next day, the teen was arrested and is now accused of conspiracy to commit aggravated murder. now, the father says the suspect threatened boom if he told anybody about the plan. but that did not stop boom from doing the right thing. that was more important than his life was protecting his classmates, and i could not be more proud of him. >> and i mean, he's a hero for what he did. >> he sure is. and officials say the adult who is messaging with the suspect was actually texting from a colorado area code. they would not say if that person has been arrested. now, as for the teen, the prosecutor is asking

that her niners are playing the super bowl in her current city. she says it's a full circle, unexpected, unplanned moment in her path to the las vegas stage. i got the things that you need for 24 years. fantasy at the luxor in las vegas has drawn huge audiences with dazzling costumes and beautiful performers. the burlesque show calls itself the strip sexiest tease, but the show is so much more than its visuals. each person involved has fierce talent to back up their captivating looks. a key example the powerful vocals of lorraine apparel, the show's headliner. we got to visit her at soundcheck before she became the star of this show. she was a housekeeper at a bay area nursing home. >> i would just sing while pushing the cart, knocking on doors, calling my mama and just sing while scrubbing the toilets. it was a lot of work. >> work, she says. she was proud and happy to do while she went to business college at night. but one day, the unexpected happened. while on vacation, i. >> i got discovered on an open mic night on carnival cruise line. i was just singing at karaoke and open mic night and i. it changed my life. she

became a cruise ship headliner, eventually making her way here to las vegas. >> she's had incredible high points since becoming a full time headliner in 2000, but as a die hard forty-niners fan, she says nothing compares to the day she got to sing the national anthem for them, a dream for the san francisco native, who grew up going to the games with her family, watching others sing the national anthem. >> we used to sit all the way in the top and my dad said one day, you know you're going to do that. and i was like, i don't know. and that day came. it was a home opener and my dad was on the field right next to the 40 niners. it was a dream. come true. >> she's never strayed from her san francisco roots. six nights a week, she tells crowds from around the world where she's from favorite places and memories of her hometown feeling even more poignant now since her father passed in 2022. >> fisherman's wharf with my family growing up, i just we were there all the time and uh- riding the trolley and just eating cotton candy and just the sound of laughter, you know, and just, oh my god, i'm gonna cry. no. yeah and i miss my dad for the rest. births.
