>> look at that. this on a flight from hawaii to oakland. good afternoon. i'm kristen sze and i'm karina nova. >> a historic agreement with two of the bay area's largest refineries, chevron and the martinez refining company, have dropped their lawsuits contesting strict regulations by the bay area air quality management district. >> abc7 news reporter ryan curry looks at what this new agreement means and what the refineries need to do now. >> chevron and the martinez refining company must now comply with regulation six, rule five, a measure that limits emissions from refineries. both had filed lawsuits challenging that measure. but on tuesday, the air district announced a settlement. >> today is really about improving public health for residents who live near refineries. um, every anyone, no matter where they live, deserves or has the right to breathe clean air. >> the air district says chevron must reduce 70% of emissions by july of 2026. they will also

have to pay $83 million for four years of non compliance. and they must pay $20 million in fines for hundreds of other violations. mrc has to reduce emissions by 80% and they have to constantly monitor air pollution. instead of testing every quarter. >> this rule was passed five years ago. while we were asking is the facilities to comply? they chose to sue us instead. and uh, today they have agreed to drop that suit and comply with the rule as written. >> the settlement is drawing differentrillioneactions from the refineries. pbf energy says they are happy to work with the air district on their monitoring system, while chevron said in a statement, we are committed to working with agencies like the baaqmd on efforts to improve air quality. however we remain concerned that the bay schmid's rulemaking process is fundamentally broken. the air district says they pushed for penalties to make sure the companies, especially chevron, comply. >> the residents in richmond suffer the longer it takes to comply with the rule. we would

rather have each facility comply now because there's health benefits, but but the ongoing health impacts mean that we're going to have very high penalties. >> the air district says these are the strictest regulations in the country. they say they will continue to monitor the refineries to make sure they reduce their emissions. ryan curry, abc seven news. >> all right. turning now to the weather and more rain on the way. >> spencer christian is here with a first look at the forecast. and, spencer, we got what, one day of a break, one day break. >> karina, a first look now. but we'll be taking many more looks at our weather over the next few days. here's a look at our live doppler seven with the satellite, and you can see we have a series of storms moving in our direction. the first one, a fairly light storm, will swing through tomorrow on the exclusive abc seven storm impact scale. this is a level one storm. it'll produce rain that will be light, moderate to heavy at times. slick roads for the commute, especially the evening commute, and it will be breezy at times. here's our forecast animation starting at midnight tonight. notice the rain arrives in the north bay tomorrow morning, and by midday to

mid-afternoon it will spread to other parts of the bay area. but then on on friday, a stronger, much stronger storm starts to swing through and that will continue through saturday. so basically our friday saturday storm with just a tiny break before the next stronger, more vigorous storm swings in sunday into monday. so we've got a lot of rain coming our way over the next several days, and the rainfall totals by tuesday, we estimate will range anywhere from two to well over three inches across the bay area. i'll give you a closer look at this and when we might expect a break a little bit later. >> kristen spencer, thanks so much. two mudslides in big sur have trapped at least 50 people near paul slide and led caltrans crews to offer convoys out of the area. the slides happened north of hearst castle within days of each other. last week, highway one is closed from about a mile south of limekiln state park to just south of dolan creek in monterey county, and lime kiln park is closed. the southern section of the highway near paul slide is set to reopen in late spring this year.

>> a valentine's treat for pacifica residents tomorrow in the city is reopening a section of the pier that was damaged during a powerful december storm. for now, only half the main deck will reopen. repairs on the rest of the pier won't happen until next month. crews will keep an eye on the pier as more storms hit the coast, and may close it again if it is deemed hazardous. >> right now, san mateo police are preparing to reveal new information on the four people found dead inside a home yesterday, sources tell abc seven news that the deaths appear to be a murder suicide. apparently, the man shot the woman in the bathroom and then killed himself. police found a nine millimeter handgun near their bodies. two four year old twin boys, who were also found dead in the home, have been poisoned. a neighbor who didn't want to be identified says the deaths left her in shock. >> they were just like sweet little kids, you know, i just wanted to give them a hug. what could have happened? what? on

surfing in san francisco on sunday, a 15 year old was found on the tracks between the balboa park and daly city bart stations on january 29th, 19 year old daniel buren near the same area on the phone, his mom telling me they're grieving for this young man that died recently had done it before. >> back in january. so i know his mother had taken away his phone, told him that he was going to stop his instagram account, and sure enough, he did it again. and unfortunately it was fatal. >> our media partner, the san francisco stars.and, spoke to marina buren at her home in glen park as she sat in her son's bedroom. she confirmed daniel was last seen on bart surveillance video climbing out of the train where the carriages meet as he squeezed between two rubber spaces. she believes daniel may have been inspired by others doing similar stunts shared on social media. >> no social media post, no number of likes, no, no great

footage is worth dying for. >> supervisor, mandelman and supervisor sapphire represent the districts where these teens passed away. they have both contacted bart for solutions, but this is not a san francisco only problem. subway surfing is an issue new york city is familiar with. new york city launched a prevention campaign in september after multiple deaths and injuries last summer, and has even started deploying drones to known subway surfing locations. we're seeing this happening all across the country in big cities, san francisco and new york. so what can city officials like yourself do? >> this is what i this is what i would say i think a call needs to go out to the social media companies. they need to have higher alerts on this the minute they see something like this, they need to remove it. there should be no posting of this kind of uh- activity. >> bart riders like mikita, a mom of two teenagers, once bart to take action at the bart station, probably need to work

better with their security system because it shouldn't have been. >> no way these kids should have been able to get on top of the train. period. we contacted bart and they declined an interview. >> marina said her son, daniel was in college and wanted to go to law school. in the newsroom, luz pena, abc seven news. all right, luz, thank you. >> so devastating. awful a social justice group presented a new report today that's critical of how often police in california are solving crimes. and the report by the center on juvenile and criminal justice found that police cleared just 13% of reported crimes in 2022. that's down 20% from 1985. the group says. during that same period, police funding grew 250. clearance rates for property crimes were even lower. >> the statewide clearance rate for property crime hit an all time low of just 7.2. that means

nearly 93% of all reported property crimes in california that year went unsolved. >> the group supports criminal justice reform as a way to reduce crime. it calls for continued funding of treatment and rehabilitation programs for people. the man accused of stealing a small plane, then crashing it on the beach in half moon bay, appeared in court today to answer to those charges. >> 50 year old luis gustavo ayres of miami, refused a court appointed attorney. he says he wants to represent himself in the case. ayers is charged with stealing a single engine plane from palo alto airport last week. the plane was flown about 30 miles and then made a hard landing on poplar beach. >> flight attendants walked the picket line at san francisco international today, joining a global labor action the day of action happened at 30 airports across the world, most in the u.s. some 100,000 flight attendants from american alaska frontier, southwest and united airlines took part. they're

demanding a 33% pay raise and retire benefits. they also want more workplace protections. >> we're there to take care of the passengers when the bad things happen, and we've just proved that recently, not only at alaska but at jal when they had their fire. we're there for safety and that's our primary focus. and we need to be recognized for that. >> in a statement, alaska airlines tells abc seven it agrees with flight attendants that they need a new contract. the airline says it's working hard to get an agreement and has offered a top of scale, 15% pay raise. flight attendants and passengers stepped in to break up a mid flight fight on a plane that took off from oakland. southwest airlines says two customers became disruptive on board a flight yesterday from oakland to kauai. it's unclear how their disagreements started. the plane's crew and other passengers got between the two. one passenger in particular was

gift around here, but a little more than three weeks ago, she says, something changed. p-g-and-e's crews came through and marked red x's on the backs of more than a dozen trees. trees, she says, an independent arborist deemed healthy. >> it's not okay because it's not something that's being cohesive across the board. you are what feels to be singling us out. um, our our main concern is always to make sure that the neighbors good and the community is kept safe. we do not want to do anything that would put anyone at risk. it's always been okay just trimming the trees. >> now she's hired her own attorney to help fight this battle because she says the utility company has yet to explain why the trees need to go until they showed up tuesday morning, citing compliance issues. >> these trees are everything. um, besides the fact that there is the privacy, i grew up with these trees and they hold memories. they hold my heart.

now where it's 55 degrees. also 55 in half bay, moon bay, mid , san mateo, san jose, 60 degrees. other temperature readings right now looking towards san francisco from emeryville. 57, in santa rosa and in fairfield, mid 50s at petaluma, napa and upper 50s at concord and livermore. and let's take a look at our forecast headlines as we'll see increasing clouds continuing overnight. rain arrives tomorrow on valentine's day generally light, but there will be periods of moderate rain , maybe even a couple of downpours. and then over the holiday weekend, the president's day holiday weekend, we'll have a wet and windy pattern intensify. so let's take a look at the exclusive abc seven storm impact scale tomorrow. storm level one storm a relatively light storm once again, mainly lightrillionain, but briefly heavy at times. slippery roads, of course, and breezy along the coastline. we'll see the rain beginning up in the north bay tomorrow morning and beginning to expand. i should say by midday across most of the remainder of the bay area, overnight, low temperatures as we wait for the arrival of thatrillionain, mainly mid to upper 40s. highs tomorrow,

generally in the upper 50s to low 60s. now we'll take a look at the stronger storms coming our way. starting the forecast animation at 7 a.m. thursday. a dry day thursday and a mainly dry day friday. but rain starts to arrive late friday night. this is a stronger storm moving through the bay area on saturday and saturday night, and not much of a break before the next storm arrives late sunday night into monday. we've got a couple of level two storms coming our way and they're going to drench the bay area with rainfall before this is all over. in fact, our estimates right now indicate anywhere from about two to, well over three inches by during between the saturday and monday time period going into tuesday. so here is the accuweather seven day forecast tomorrow. valentine's day. don't let a little rain dampen your romantic spirits. a level one storm. we get a dry break on thursday and mostly dry on friday as well. with increasing clouds. some rain may arrive late friday night, but basically the next storm after tomorrow is a saturday storm. wet and windy

late evening or afternoon rain developing on sunday with some gusty wind, but then that becomes a level two storm on monday with heavy downpours and strong wind gusts tapering off to a level one on tuesday. a lot of rain coming our way. it's going to be a period of quite wet weather. all right, thank you spencer. >> mardi gras season is reaching its peak today with nine parades in new orleans. one of the largest is the krewe of zulu parade. it featured 26 floats with some 1500 people tossing beaded necklaces to spectators. this is the last big celebration before ash wednesday. tomorrow which of course marks the start of lent. fat tuesday revelers are in for a tasty treat at a san francisco restaurant. brenda meat and three is rolling out its king cake beignets. the restaurant makes a special version of its popular dessert for mardi gras. it's made of a cream cheese and berries compote, but the star is of course, that baby figurine.

showing the consumer price index rose 3.1% over last year. that's an improvement, but higher than the forecast. s falling gas prices helped out consumers wallets. last month, however, food prices had the highest monthly increase in a year. the dow closed down more than 500 points today, driven by that inflation report. higher food prices are hitting hardest at the restaurant level, where inflation is up 5.1% annually following the pandemic, consumers have been devoting more of their budgets to services compared to goods. analysts say the shift has led to pressure to increase wages and in turn, raising prices on the menus. >> if you own an electric mobility device like an e-bike, electric scooter or skateboard in san francisco, know the way you charge or store those devices is about to change. >> yeah. today, the city's board of supervisors voted to create

safety standards for some of those popular products, the ones powered by lithium ion batteries. will it help keep you and your family safe and build a better bay area? >> abc7 news reporter lyanne melendez is here to explain what that will look like. leanne >> yeah, and i've noticed here in the city, which is great, more and more of those e-bikes, especially for families, their kids, they take them to school. but, you know, not all batteries are created equal. the problem is that the lithium batteries, if they are damaged, refurbished or if they come from a manufacturer that is not regulated, then we have a problem. new york has had a huge problem with these batteries. 18 people died last year in new york in battery related fires. now we're not new york city. we don't have the density of that city, but the fire marshal here says he wants to get ahead of the situation before it becomes a problem for electric bikes. and e-scooters continue to be a part of san francisco's attempt to improve urban mobility. even

city government is testing a pilot program where food delivery workers are using e-bikes instead of cars in an attempt to reduce emissions and traffic congestion. but with more of them on our streets, it was inevitable that new rules for how they are stored and charged would follow. here's why. we sat down with san francisco's fire marshal, who showed us pictures of fires, started by faulty batteries, causing. extensive property damage. since 2017, the number of fires associated with the lithium ion battery has increased every year, with a high of 58 in 2022. the data for 2023 is still being compiled, and during that six year period, one person was killed, eight others were injured. the fire marshal says fires related to overheated lithium batteries are a serious problem. >> we can't put those out. they generate their own oxygen. we can put water on it to cool it

and to keep other things from burning around it. but ideally, we have to wait till that fire burns out. >> in march, a new set of standards for charging and storing batteries used to power mobility devices will go into effect. anyone living in a multi-unit building will now be limited to four lithium powered mobility devices per household, and. they must be parked when charging. each one must be plugged into its own electrical outlet, not a power strip. the new rule doesn't apply to single family homes. >> the other part of our campaign is, is give yourself a chance to get out so if you're charging it, don't charge it by the front door when you first pull it in. >> the new fire code also states that refurbished and damaged batteries are not allowed. san francisco supervisor aaron peskin introduced the legislation. >> number one, they should be buying products that have been certified by underwrite or laboratories. ul approved and that they should not be using different chargers other than

the chargers that were made to go with those that they should not be using. extend cords during charging. >> but repair shops like the new wheels say they now face numerous challenges because of the new regulations here in this warehouse, we have mechanic stands and each one of them is set up with an organized charging station, and typically our mechanics charge the bike while they're working on it, which is a highly safe contact. >> but they're standing there with battery. and because of the new power strip rules, uh, we will have not allowed solution that will likely mean installing new power outlets for each and every battery that needs to be charged. >> the shop says they have never had any issues, and the vast majority of the bicycles they work on have ul certified batteries clearly marked. so here's how we know that. >> so this is classified ul, but the reality is that some of the batteries out there are not ul certified because not everyone

can afford them. >> remember the hoverboard fad of a few years ago and how some caught on fire, 25,000 of them were recalled, some e-bikes and e-scooters have those cheaper batteries as well. >> thousands exist in the city right now that are not ul certified. we want to make sure that people who depend on those devices for their living are able to make a transition to a better devices as quickly as possible, and we want to see the board of supervisors address that. >> the san francisco bicycle coalition is asking for economic incentives to help people buy safe batteries. the city has also been working with companies that rent those mobility devices to actually put them in contained cabinets. >> those that are fire rated, and to have them on wheels so they can be pushed out of buildings. >> the city says. this is not about punishing people, but rather building an information safety campaign. >> that campaign just really needs to promote the use of these devices for the sake of

the city, while making sure that people are doing it safely. >> besides the random inspections by the fire department, who is really going to enforce this now, we suspect the building manager isn't the landlords, because otherwise they could be held responsible if anything were to happen. but for now, they say it's more about informing the public, changing that mindset. there's also a bill in congress that would regulate these batteries and do away with the ones that are poorly made and really, in congress, both sides are saying we have to do this. yeah. >> otherwise it's for a change. >> we'll just looking at the rates of the fires that you see, the increase every single year. so something needs to become more popular. >> thanks, liane. sure >> we do have breaking news right now. the house has voted to impeach homeland security adviser alejandro mayorkas. the vote is secretary. excuse me? the vote is 214 to 213. this is the second attempt to impeach mayorkas. the first one failed. mayorkas is the first cabinet

proposed a $50 minimum wage. california's current minimum wage is $16, an hour. lee cited a united way report that found a single person living in the bay area needs $104,000 a year to survive. that would amount to a $50 an hour wage. oh, interesting. darn it is interesting. >> it sounds great. i'm sure to a lot of people on the campaign trail, but it's simply impractical. maybe we should start focusing on bringing the costs down. i mean, think about it just practically, i've worked in small businesses, manage one many years ago. if you're paying, if you have a subway sandwich shop and have one employee and you probably have more on any shift and they're paying them $50 an hour for an eight hour shift, that's what, $400 just for that one employee. and if the average check charge is maybe $10, which is probably high at a subway, you've got to sell 40 sandwich, have 40 customers come in and spend that amount of money just to pay that one employee. forget about lights, food costs, insurance,
