the first criminal trial ever for a former president now set. a judge is set to announce his decision in a civil trial that could cost trump hundreds of millions of dollars and his ability to conduct business in new york. charged. the fbi informant at the center of the house republican's case for impeaching president biden indicted, accused of making up a story about president biden and his son hunter, receiving $5 million bribes from a ukrainian company. what house republicans are saying about their inquiry this morning. new details on the deadly super bowl parade shooting. new video obtained by tmz sports shows the moment gun fire erupted, as we learn more about what set it off and the suspect. abc news exclusive. one on one with prince harry on his father king charles cancer diagnosis, his relationship with the royal family now, how he is as a dad, and giving us access to the first ever invictus winter games.

president putin's top adversary has died. maggie rulli is tracking the story. >> reporter: yes. the russian prison service said he died after falling ill and losing consciousness. just moments ago we heard from navalny's wife. she said, i am asking everyone who is here to unite and help punish the russian regime. we heard from kamala harris. whatever story they tell you, be clear, russia is responsible. he was serving a 19 year jail term and late last year was moved to an arctic penal colony, considered one of russia's toughest jails. he died one month ahead of russia's election, where he continued to try to mobilize people against president putin. george? >> okay, maggie. thank you very much. we're going to turn to the testimony of fani willis in the georgia election case against alled. at issue is whether she should

be removed from the case over her relationship with a top prosecutor. she's expected back on the stand this morning. steve osunsami is in atlanta. good morning, steve. >> reporter: good morning, george. the fulton county prosecutor continues her fight today against lawyers who want her removed from the election interference case. the question at the heart of this case is whether she financially profited from her romantic relationship with the lawyer she hired. she strongly said the answer is no. >> it's highly offensive when someone lies on you. it's offensive when they try to say you slept with somebody the first day you met with them. don't be cute with me and not think you're going to get an answer. >> reporter: from the minute she took the witness stands. >> it is a lie. it is a lie. >> reporter: fulton county prosecutor fani willis was pushing back against any idea that her relationship with the special prosecutor she hired was a means to make money off of her prosecution of former president trump and 18 others charged in the georgia election interference case. >> you're confused. you think i'm on trial.

these people are on trial for trying to steal an election in 2020. i'm not on trial no matter how hard you try to put me on trial. >> reporter: the attorney for one of the defendants wants her client's case thrown out and is asking the judge to remove willis from the election interference case because of romantic get aways and cruises with the special prosecutor nathan wade. >> he paid for the flight and the cruise. so, yes, he paid. he tells me how much it is and i give him the money back. if you tell me it's a g, you're gonna get $1,000. i didn't ever make him produce receipts. whatever he told me it was, i gave him the money back. >> reporter: willis told the court she paid wade the money back, sometimes thousands of dollar, in cash. >> you gave him cash before you were going on a trip? okay. and so when you got cash to pay him back, did you go to the atm? >> no. >> so the cash that you would pay him, you wouldn't get it out of the bank. >> i have money in my house. probably the most money i ever handed him is $2500 and the least amount between $500 and $1,000.

>> you never wrote him a check? >> ma'am, i don't have checks. >> i'm asking if you have proof that you paid? >> the proof is what i just told you. >> reporter: when wade took the witness stand, he said she wouldn't let him pay for everything because she's an independent woman. >> it was a point of contention because she was very emphatic and adamant about this independent strong woman thing. she'd pay her own way. >> reporter: one of the big arguments is over when willis and wade started dating. the two say it was months after she hired him but willis' former friend who said she was forced to resign said the two had been romantic since 2019, a year before the election. >> did you observe them do things that are common among people having a romantic relationship? >> yes. >> such as? can you give us an example? >> hugging, kissing with affection.

>> reporter: the judge isn't expected to immediately make a decision, but if he removes her, the state could appoint a new prosecutor who would then decide if this case moves forward. but it would still be a tall order for willis to be removed from this election interference case. george? >> okay, steve. thanks. that was one of several legal developments involving donald trump yesterday. in new york the first criminal trial of a former president now set. the judge is set to announce his decision in a civil trial that could cost trump hundreds of millions of dollars. that could come later today. senior investigative correspondent aaron katersky is tracking it all. good morning. >> reporter: a judge at this courthouse already decided donald trump committed fraud and as soon as today he's expected to issue a ruling that could affect the future of trump's business and his bank account. this morning former president trump awaits a ruling that could force him to pay hundreds of millions of dollars and bar him from doing business in new york, the city where he built his

fortune. >> thousands of people employed. now i have to justify myself to you? >> reporter: trump has repeatedly denounced the case, attacked attorney general general leticia james and dispairaged the judge who already said he overvalued his properties. it's a one-two punch for trump. the ruling in the civil case is expected a day after a judge set trump's first criminal trial for march 25th. >> i'm going to have to sit here for months on a trial i think is ridiculous is unfair. >> reporter: trump looked on as his attorney complained that timing would make it impossible for the former president to campaign. but the judge said that's no legal reason to delay putting trump on trial over allegations he tried to hide from voters accusations of a tryst with porn actress stormy daniels and his attempt to buy her silence. his federal election interference case had been set for court but has been denied because of appeals.

trump asked the supreme court to put the case on pause arguing special counsel jack smith is rushing to trial so he can secure a conviction before the november election. if convicted here in new york, trump would be running for president as a felon and if he wins, he would not be able to pardon himself. rebecca? >> okay, aaron. thank you. we turn now to a confidential fbi source charged with lying about president biden and his son hunter, accused of providing false derogatory information which is central to the house republican's impeachment inquiry. our chief justice correspondent pierre thomas has more on that from washington. good morning, pierre. >> reporter: rebecca, good morning. the fbi informant house republicans have pointed to in efforts to impeach president biden is now being called a liar by a special counsel. this morning the special counsel's investigation of hunter biden is raising serious questions about the credibility of an fbi informant who has been

central to the house republican's case for impeaching president biden. special counsel david weiss has indicted fbi confidential informant alexander smirnov, charging him with obstruction of justice. and making false statements. weiss claims he lied, giving false derogatory information concerning hunter biden and president biden in 2020 after biden had announced his bid for the presidency. the alleged lies concern whether biden was bribed by officials from ukrainian energy giant barisma. >> we also filed a form 1023 an fbi form, alleging joe biden took a bribe. what we learned from this is the fbi never investigated this allegation. >> reporter: but the fbi recently confronted smirnov about his claim. the special counsel flatly said his stories fell apart. the defendant's story to the fbi was a fabrication, otherwise unremarkable business meetings.

the motive for allegedly lying the special counsel said smirnov did not want biden to be president. if convicted he faces up to 25 years in prison. george? >> thank you very much. let's bring in dan abrams. let's start right there. pretty stunning indictment. the house impeachment inquiry was already pretty thin. at its heart was this allegation. >> right. remember, this is what jump started the house impeachment inquiry, this idea that hunter and joe biden had each gotten $5 million bribes. at least that was the allegation. now it's not just unsubstantiated. it's actually a confirmed lie according to the special counsel who, remember, is a republican who was initially appointed by donald trump. >> we have more rulings coming for donald trump. let's start with the civil trial in new york. >> just a question of how bad is it going to be, right? he's already been determined to have committed fraud. the question is what are going to be the damages? how much money will he be prevented from doing business in new york? will family members be prevented from doing business in new york?

and remember. no matter what happens with the election, this sticks if there's no win on appeal in new york state. >> then right in the middle of the primary for the republican nomination, although you could have it wrapped up by then, first ever criminal trial for a former president. >> look. i think to some degree this is a win for donald trump. this is the trial he wanted to go first. this is the weakest of all the cases. there's a reason he goes to this case. >> less serious or because of the nature of the evidence? >> both. it's less serious. also a tougher case. think about it this way. it's a tough argument on this case to get him convicted of a felony. they think they can do it. the more likely conviction might be a misdemeanor or hung jury. if you get anything short of a felony conviction, donald trump walks out, number one, not serving any prison time and, number two, declaring victory. as a result, i think donald trump and his team are pleased about this case. if there was ever a question this case was going to get dismissed.

people say, oh, the case is moving forward. that's a big loss for donald trump. of course this case was going to move forward. >> it may say more about our times. pretty unbelievable. finally, fani willis. does she survive? >> look, bad day for her personally. i think she may still survive the effort to disqualify her. >> okay. dan abrams, thank you very much. >> fascinating case. now mortgage rates on the rise at the highest levels in ten weeks. elizabeth schulze is what's behind it and what it could mean for the housing market. good morning, elizabeth. >> good morning, gio. this is a little bit disheartening for anyone trying to buy a home. the average rate on a 30-year fixed rate mortgage just reached 6.77%. that is up from last week. it's now the highest level in two months. the timing here is critical because we are gearing up for the spring housing market, which is typically the busiest time of year to buy or sell a home. these higher rates could keep some buyers on the sidelines. why are mortgage rates up? they are very sensitive to inflation data and the fed. this week's inflation report showed prices increased more

than expected so the fed might have to wait a little bit longer to lower interest rates, with that first rate cut in may or june instead of march. here's what it all means for your bottom line. if you are taking out a $400,000 mortgage your monthly payment is $2600. one year ago, when rates were closer to 6%, your payment would have been $2481, about $120 cheaper. two years ago -- this is really where you can see the difference. when rates were near historic lows at 3%, your monthly payment would have been nearly $800 cheaper at $1,839. most analysts are expecting rates will stay in this 5% to 6% rate this year. if you're looking for the silver lining, it's still better than 18% we saw four decades ago. guys? >> four decades ago. doesn't seem that far off. thank you very much elizabeth. we're going to turn to college basketball sensation caitlin clark. she broke the ncaa women's all-time scoring record. rebecca, she did not stop there. >> this was classic caitlin clark.

therapy. tai chi, that we know is so popular. number four, mixed aerobic exercises like dancing or swimming. number three, strength training. rebecca, this was found to be specifically important for younger women. they found to benefit from this. number two, yoga. number one jogging or walking. i want to say although we listed these from 5-1, the difference between them is very small. it's about picking what you love, sticking with it. it can be really helpful. >> so you actually do stick with it and make it part of your lifestyle. what else can people do? >> i think understanding there are therapies out there such as medications and behavioral therapies, cognitive behavioral therapy, for example. it's most important to understand that depression is an illness, much the way we look at high blood pressure. the importance in that is that it's something you might not be able to fix by yourself, so reach out to your primary care provider, to a friend if you need help. remember that it's okay to ask for help. >> always great advice, dr. sutton. always great to do these exercises even if you're not confronting

>> we were 2-8. the kids battled. we made a lot of young player mistakes. >> the morale was very down after the season. people even referring to us as one of the worst teams in the program history. >> they had a lot to prove and a lot stacked against them. for starters, this was their weight room in the off season. outside and caked in rust. while their indoor gym was finally being renovated. their inner city practice field wedged between the school and the metro north train line, came up just a little short. >> you're running 50, 40, 30. said quite a few prayers that the kids stopped in time. kickoff! kickoff! >> it was playable, at least until it got dark, because the field has no lights. to finish practice, the team would walk ten minutes along the train tracks to a borrowed field. >> having to walk from another field to another field, just something that other teams don't do. >> and their game field, a public

park maintained by the city, deemed too unsafe for official play this season. >> just a ton of good size divots. there's a wave in the field right now. it's not safe. >> they would spend the entire season playing games on the opponents' turf, the city telling us it continues to explore ways to maintain the field. >> vast majority of our opponents have sprawling campuses and have plenty of facilities. we have to make due. it is what it is. we're located in the poorest congressional district in the nation. most of the students come from the surrounding area. one thing we're guaranteed is we're gonna get knocked down. the question is how we respond. >> let's go, come on! >> refusing to let their circumstances define them, they dug in and got the work. during the off season, training in the hallways. >> higher, higher! >> we all knew what we wanted. >> we don't have the most money of anybody in the league. i feel like we just have to outwork them. our coach really told us a lot. >> turning those obstacles into the strength that define them, starting with their outdoor
