people in san francisco the help they need. >> the city pledged 400 new beds for mental health treatment. now for nearly three years later, have they reached that goal? tonight we take the city to task. good evening. >> i'm ama daetz and i'm dan ashley. thanks for joining us. the question is, are officials meeting goals to help those struggling in san francisco tonight? >> abc seven news reporter luz pena takes on our ongoing mission to help build a better bay area by uncovering how efforts to help are falling flat . loose. >> yeah, most treatment beds are not run by san francisco. instead, the city outsources them. they have contracts with private providers outside of the city, and san francisco's board of supervisors budget committee has been waiting for this report since 2020. for two hours, san francisco supervisors questioned the city's public health department, asking where are the treatment beds? >> we have no idea. idea based on the numbers we're looking at today, how many san franciscans with severe for you may know, or

someone in your department may know how many san francisco with severe mental health needs are in those as needed beds. >> in 2021, the city announced a plan to add 400 new treatment beds for mental health and addiction treatment. since then, the city has added about 350 beds of this type. today the city's health department said the expansion has led to a total of 2550 treatment beds, but supervisor mandelman said their numbers may not be accurate. >> they they had a plan to add 400 additional beds. they believe, and they are telling us that they are close to having added those beds. but they have some key footnotes that are concerning to us. one is 15 to 20% of those beds may be unavailable because of staffing challenges. the public health department said the staffing shortage is part of a nationwide staffing crisis for mental health professionals. >> in terms of the intersection between impact of staffing on as needed beds, we don't know that, meaning we apply for a placement

at the facility, accepts or doesn't accept, and we don't track if they're not accepting. >> when it comes to getting treatment, beds, san francisco competes with other counties for access. >> the competition is fierce. we have never replaced the state mental hospitals that have been closed. there's there are these private facilities that are sort of providing that service, but there aren't nearly enough of those beds for the needs of all the counties. and of course, san francisco has a lot of need. >> the salvation army's harbor light center has 136 beds. the city funds 65 of those beds. they are urging the public health department to pay for more treatment beds within the city. >> we have basically 50 to 60 beds open that the city could purchase today. >> you were saying they're empty. >> they're empty. if they chose to do that, we could then fill up harbor light. supervisor mandelman wants the city to change its plan for treatment.

>> beds. >> i think we need to own more of those buildings ourself and the need for treatment. >> beds in san francisco is increasing, and according to experts, the prevalence of mental illness among the homeless population across california is as high as 80. after today's committee meeting, supervisors are now planning to request a follow up with the department of public health for more clarity. luz pena, abc seven news. >> all right, luz, thank you so much. accusations of assault. today during a news conference on efforts to decrease violence in oakland. hey, good day. >> get this, get this, get this. >> recalled town protests clashed with some of the mayor's supporters as she announced a new grant to help improve public safety. the city will get $3.5 million in an ambassador safety program in chinatown. it's being run in collaboration with oakland based family bridges. mayor tao says the new funding is one way to tackle the violence. >> over the past year, we have invested in a robust police department and placed more police officers on the street to conduct patrols and special

operations. >> last september, oakland missed out on millions of dollars in public safety funding after failing to submit forms, data shows there was a spike in violent crimes, vehicle thefts and robberies in oakland last year. >> happening now the bay area is in the national spotlight as president biden spends the evening at local fundraising events. abc seven news reporter suzanne fawn is live at marina green, where the president arrived by helicopter not too long ago. suzanne >> so, dan, there are hundreds of people here hoping to catch a catch, a glimpse of the president at the marina green. now, he took off shortly afterward. now, here's a closer look at the president's motorcade arriving at the getty home about half an hour ago, the president got there for a private fundraiser at in pacific heights. now, today, we heard from a number of people, from a number of people, rather about president biden's visit. >> something definitely exciting happening at marina green. >> lots of barricades and security, and people eager for

president joe biden's arrival. >> because i've never met a president before, so i'm seeing one up close. it's kind of cool. >> the president attends two fundraisers in san francisco, including a reception at the gordon getty family home, u.s. representative nancy pelosi, the former house speaker, is expected to be there. >> smart of him to come to come here where his where people are wanting to see him. >> president biden counting on bay area supporters to boost his campaign chest. >> we are the atm for the political world, and there's a lot of folks here with a lot of money who are interested in politics. >> the march primary is just around the corner. president biden reportedly has $130 million in the campaign chest, while the gop front runner, former president donald trump, has about 36 million and mounting legal bills have been a drain on his campaign funds. >> it's often the case in politics that the candidate with more money wins, but it's not always the case. um, and we've seen that on both sides of the aisle and in presidential campaigns. so it's a it's an

indication of, of some enthusiasm for the biden campaign. but it's not necessarily a sign that trump's in trouble. >> and tonight, as the president attends a pair of fundraisers, there are protesters hoping that their voices will be heard. here's a closer look. was live picture now of pro-palestinian demonstrators gathering at the alta plaza park in san francisco . they're hoping to get mr. biden's attention. protesters are calling for a cease fire and an end to u.s. support of israel in the middle east conflict. we're live in san francisco. suzanne phon, abc seven news. all right, suzanne, thanks very much. >> and earlier today, president biden had some strong words about russian president vladimir putin calling him an sob. he spoke to a gathering of wealthy donors, saying, we always have to be worried about a nuclear conflict because of crazy putin and biden made a jab at donald trump for comparing himself and his legal woes to the prosecution of alexei navalny, who died in a russian prison.

biden saying, quote, you got to prevent this other guy from being president onto storm. >> watch a little rain, a little sun. here's a live look at current conditions outside. it's really a mixed bag of conditions today with a fickle forecast. let's get the latest from abc seven news meteorologist sandhya patel. sandhya. yeah, ama, we're almost done with these showers. >> let me show you live doppler seven right now. and you will notice that there are only a few places that are still dealing with the wet weather. so let's get you into street level radar around antioch. they had some light to moderate rain highway for oakley heading out towards the delta. there we have a few showers also moving through parts of the north bay river road. windsor highway 101. so as you're getting out and about, just be careful. there is a flood warning for sonoma county until 9 p.m. tonight. those small streams continue to see flooding occurring statewide. you can see that the snow showers in the sierra winding down the showers in northern and southern california winding down as well. so another hour or two, 7 to 8:00. we'll see another shower or two. and then it's all

done. so we'll keep it as a one for now. through this evening. scattered showers, brief downpours and slick roadways for the commute. some slick roadways. here's a clue as to what's coming over the next few days from our santa cruz camera. just absolutely gorgeous. dan, i'll be back with a full forecast coming up. >> nice shot and a nice clue. cynthia. thanks very much. well, this is not so nice. last year's storms tore up capitola wharf tonight. residents will get to share their thoughts on what it might look like when it reopens this fall. but as abc seven news south bay reporter dustin dorsey explains, it's unclear whether two buildings there will survive the storm. >> the sun may be shining, but storms are still top of mind. capitola boat and bait and the wharf house restaurant have never recovered from the damage caused by monster waves. in 2023, the city has deemed these buildings unsafe and they face demolition, devastating. >> yeah, i couldn't believe we were. we had hopes that our building was able to survive and

we get news that it's being torn down. we walked off the wharf january third, 2023, so it's been about 14 months walking off . >> did you ever think that that might be the last time? >> no. you don't think those things, but that thought may soon be reality for these longtime tenants. >> chloe woodmansee with the city of capitola, said the damage was extensive and safety led to the difficult decision. >> our building official here at the city and our city engineer did an extensive review of the buildings. i do know there is structural damage to the foundation on and some of the walls are caving in, and i believe both the buildings bait and boat manager david morris says the coastal commission may be able to trump the city's decision and save the structures. >> but after decades in business, it's hard for him to look to the future. what future? >> yeah, because we can't afford , you know, a $500,000 building or $1 million building out there. we just can't afford that. so what future would we have if i can't get coastal commission to work with us and help us out? >> so what's next for the wharf? its future may come down to the

opinions of the community. residents will get to share what they want to see on the wharf at a town hall. we got some public opinion ahead of the meeting, perhaps a bait shop, a little cafe of some kind, some place that leaves us with a destination. >> what i don't want to see happen is that there be a lot of construction and trying to turn the capitola wharf into a fisherman's wharf with all kinds of little shops. >> i don't want to see him pull down the building. we don't need you now. that's a big joke. >> the wharf is on track to reopen this fall, but whether or not these businesses will be there then is uncertain in capitola. dustin dawsey abc seven news and get the latest forecast to track the rain anytime with our live doppler seven radar. >> just search abc seven bay area in your devices app store to download it now. >> a small business in the south bay says tesla took them for a ride. while they're blaming the carmaker for a loss of thousands of dollars. >> also here, it's bad enough that some businesses have said crime is a reason why they're

one closure is tied to rising crime. parents at saint anthony catholic school in east oakland received notice two weeks ago. it says the closure is also tied to homelessness, housing and human trafficking operations near the campus. enrollment at the grade school has declined to just 65 students. the oakland diocese says the school is facing overwhelming financial challenges despite large investments, and our lady of guadalupe school in fremont is also closing. the diocese is assuring families it will help them find alternate catholic schools to attend in the south bay. >> the owner of a san jose small business says she's taken a big hit after tesla placed an order worth thousands of dollars, then canceled unexpectedly. abc seven news reporter zach fuentes spoke with the store owner about her concerns. >> the giving pies is a beloved business in san jose's willow glen neighborhood. each pie, created with intricate details and care. it's not just local residents in love with the pies.

they've caught the attention of silicon valley's biggest corporations. as you work with google, apple, adobe, intuit. >> owner of rodney rusty arenado said tesla reached out to her on valentine's day to place an order of 2000 mini pies to be delivered this week. >> she shared emails and texts that were sent between her and tesla representatives. she sent a quote that a tesla representative approved. still, she did not immediately get a payment from tesla's vendor. >> i'm like, okay, i'm going to wait, you know? and, um, they're professional. they're a big company. so they, you know, once it's approved, it's approved, right? >> rossi sarinana said just after 9 p.m. the next day, she got a call from the tesla representative and she said, oh, i'm so sorry. >> you know that our vendor hadn't paid you yet. you know, i think they kind of knew. and but i have a question for you. can we double the order? after speaking with her staff who planned to work around the clock to double the order they took on the job, she bought ingredients and turned down other orders, but still hadn't gotten her payment. >> after following up, she got this text message and say, oh,

i'm sorry, plans have changed. >> we're not going to need the order anymore. >> the giving pies was out more than $2,000, a big hit for the small business. all rossi netto was told was that the decision came from upper management. she posted what happened to her on social media, where it got plenty of attention. abc seven reached out to tesla and did not hear back. but while we were doing our interview at the giving pies late afternoon, someone with tesla finally reached out to her, explaining to me what happened that it was miscommunication and that the employee, laura, had no authority to, uh, to promise any payment. they offered to find a way to still buy pies from her, something rossi sirenetta says. for now, she's hesitant to commit to after this experience. she said she's reevaluate how she does business with larger corporations, and she hopes that by sharing this story, they can be reminded to respect small businesses. >> it's people's life that they are affecting, and i want them to know that. >> zach fuentes, abc seven news. >> all right, let's turn our focus to the nice and needed

break. we're getting in the rain. yes. >> meteorologist sandyha patel is here with that sandhya. >> yeah, it is definitely nice. and i think people are going to really enjoy the weather over the next few days. so dan and emma let me show you live. doppler seven. good evening to all of you. as we look at the statewide picture here, this is taking you back 12 hours. we still had some snow showers in the sierra and rain showers here in the bay area. and right now we are still dealing with that. but let's talk about the rainfall. the last 72 hours going with 2.09 and napa two and a third in santa rosa, los gatos, almost two inches, almost two inches there in san francisco, 1.83. oakland just over an inch. san jose is 6000/800 and livermore 9200. ben loman got 3.5in of rain. all right. rainfall season to date 106% at sfo. 137 in san jose, santa rosa, san francisco. also well above average, but oakland is at 91% of where you should be. we're hoping for more, obviously, and certainly is

beautiful to see this snowy view from homewood sierra snowpack is going up compared to earlier this year, 86% of average statewide. we're looking at live doppler seven right now, and there is still a few more light showers for right around the north bay. highway 101, windsor area. just very spotty, very light. as we take you in towards the antioch area. also seeing some light showers out towards oakley area. so if you do run into one of these showers, it's just for another hour or two. and then we're done. dense fog advisory 2 to 10 a.m. for solano county. visibility will drop to a quarter mile or less, so driving will be difficult to hazardous. so just be careful. plan on a longer commute. a lovely view from our emeryville camera. the sun has set temperatures mid to upper 50s from san francisco to oakland and hayward. san jose you're at 58 and half moon bay 55 degrees. a view from our mount tam cam. you can see as we look back towards richardson bay, sausalito. there are still some clouds around temperatures, mainly in the 50s and from santa

cruz. camera gorgeous view right now. tomorrow some dense fog and then sunshine. friday and saturday it's going to be warming up and we are looking at sunday afternoon evening into monday morning. a chance of showers. a one model is really going wet, so through this evening, another couple of hours we'll keep it as a level one. scattered showers, little in the way of accumulation in some slippery roads though that's pretty much the impact. so as we go, hour by hour, 7:00 a few more showers and then this is done tomorrow morning, 5:00 clouds, areas of fog. that's what you'll need to watch out for. but the fog burns off by noontime. everyone is seeing the sun. temperatures will be in the 30s and 40s tomorrow morning. watch out for the fog. and then tomorrow afternoon, it's a milder day, mostly 60s. a few 50s up around lakeport. here's your accuweather. seven day forecast. fog giving way to sunshine. tomorrow we have plenty of sun, but right after that friday and saturday, a little bit of cloud cover and we'll go with a warmer pattern

has experienced domestic violence. so keep that in mind. we will tell you about some resources for survivors in a moment. >> yes, dan noyes has been digging into the case and joins us with the story. you see, only on seven. dan well, and dan, i've read over a thousand pages of court records in this case and have obtained police body cam videos, recordings of phone calls, photos and other court exhibits. >> it may be difficult to see for some people, but keep in mind this survivor wants you to see it to hopefully bring about change. jordan at caian tells me the night of february 5th, 2022 started out great. her parents and grandmother came for dinner in the san francisco apartment. she shared with her partner antonio gomero. >> you try to be like me, the only thing is you're not slick like me. >> he was 12 years older than jordanna got her a job working for him in commercial real estate, and he liked to cook, so he made dinner for my family, cooked lamb shanks for them, and then he made me sea bass because i don't eat meat.

>> and we had a great time. it was really nice. um, everyone was getting along and laughing until he fell behind a surveillance camera caught her family leaving after 1030 that saturday night. >> jordan and antonio seemed in good spirits as they walked back upstairs, but he was actually seething about something her father had said. jordan had got in trouble as a 13 year old for texting an older man, even though she never met him in person. >> and it was. there's just something so small, right? um, that that i didn't share with him because i knew how volatile he was and how violent he was over things that nothing like he would find any reason to become violent with me. >> antonio exploded and told jordan to get out of the apartment, throwing all her clothes into two garbage bags. >> he punched me a few times here and then he grabbed my clothes here and threw them out of that window on the right. >> the building's front door camera caught jordan at 10:58 p.m, rushing outside to retrieve her belongings for ten minutes, she agonized over what to do

then and antonio came down. she told him she didn't want to go home to her parents. all right >> why are you going to leave tomorrow? i already got you a hotel. >> what do you mean, you got me a hotel? what daetz. mom >> jordan tells me as soon as they got to the third floor, the violence started again and i had tried to, like, leave out the front door because he started to punch me. >> and then he had grabbed me with one arm and then, like, slammed the door on me repeatedly and closed it and locked it and he started punching me and jordan says when she fell to the floor and tried to protect her face, he kneed and kicked her, then dragged her down the hallway to the bedroom, and he had grabbed me by the back of my head and was like, repeatedly slamming my face into the door. and then he, like, pulled my mouth open and put his fingers in my mouth and said he was going to rip my mouth open.

>> antonio dragged her by the hair to the living room couch and started choking her. but she broke free. >> i ran over to the window to throw it open because i thought i was going to have to jump out of the apartment, because he wasn't going to let me leave. >> antonio grabbed jordan, threw her onto this marble table, breaking it, and gashing her forehead. she tells me he continued to punch her until he started to cry. and then he looked at me in the face. >> i was covered with blood and said, you deserve this. you know that, right? >> san francisco, 9-1-1 police fire medical a teenage girl happened to be parked across the street with her friends and called for help. we heard screaming, so i turned and i looked and the window was open and some guy was hitting her. >> i wonder what word you have now for that teenage girl who called 911. >> i'm incredibly grateful to her. she saved my life. i don't think i ever would have been able to get out of that relationship with him. hi. hey. where do you live? >> when police arrived, antonio opened the building's front door and told officers a series of lies. first, that he lived on

the second floor, not the third floor. >> did you hear anybody fighting upstairs? i did hear something across the street. what's wrong with your face, dude? why is your face all scratched up? yeah, i can see scratches. scratches on your chin. just. just stay down here. >> he later claimed his cat had scratched him. who's up there with you? >> no one's up there. no one's on. yeah, as officers arrived at the apartment, they found the door wide open. >> anyone in here? police >> are you hurt? >> they searched but couldn't find jordana. >> there's a back door here. >> finally, one officer walked past the laundry. through the door that leads to the back stairwell. antonio told her to hide from police. there ma'am, talk to me. >> come here, come here. >> talk to us. come here, come here. yeah come here, come here. get up here, come here jordanna wouldn't tell the officers what happened, but she

did identify antonio as her boyfriend and said they had been dating a year and a half. >> ma'am, would it be okay if we documented your injuries? >> a little more from side jordanna. >> suffered a broken nose, fractured eye socket, deep laceration to her forehead that required two sets of stitches. a black eye, bruises to her ear, legs, arms and body. she had to undergo invasive surgery to address facial asymmetry caused by the attack. it still feels numb. cuffs officers arrested antonio gomero and during his domestic violence trial, his attorney, deputy public defender elena yanez, tried to turn the focus to jordan kagan. >> i was constantly bombarded with like, why did you stay? why didn't you leave one? it's extremely dangerous to try to leave a domestic violence relationship. but two, there's so much shame and guilt and embarrassment surrounding it already. >> from court transcripts, yanez told the jury she's obsessed with antonio, so this isn't the

story of the poor, vulnerable, abused woman over and over. this is more fatal attraction. this is a woman who couldn't let go, but but phone calls antonio made from jail didn't help his case. here he talks to a family member about jordan's testimony at the preliminary hearing. >> the truth. hearing her testimony as well. you know, i was really trying to hear if she was going to inflate anything or, you know, be hyperbolic, but honestly, she wasn't. >> and here he talks to his downstairs neighbor about mitigating or trying to avoid the harshest penalties. >> i'm here to mitigate. this is where i'm at. yeah, i'm mitigating. i'm not going to. i'm not going, dude, santa claus didn't hop down the chimney. he beat her, bro. it was me. i'm sorry. you know, i get it. i was me for that incident. >> the jury found camacho guilty of torture, domestic violence with great bodily injury, battery and false imprisonment, and several more felonies associated with three other incidents the year before, for which jordan cahan kept notes

and photographs of her injuries. >> he wouldn't hit me every time he drank, but if he drank, it did cocaine. he was going to become violent. like for sure. >> the judge gave guerrero two years in state prison, followed by seven years to life in determinate sentence and now district attorney brooke jenkins is considering filing for sanctions against deputy public defender elena yanez. >> it's something that we are taking very seriously about what our next steps may be. >> so there could be a next step, correct. coming up next, i look at what concerns brooke jenkins about the case and jordan kane's complaints about how she feels the public defender treated her. now, if you need help to take action against violence at home, the national domestic violence hotline is one 800 799 safe. we also have a long list of resources here in the bay area at abc.

a bout of domestic violence over the course of a year. it ended with the arrest of her former partner, sentenced last month to seven years to life in state prison and now she wants to come forward with complaints. it's how she feels. the san francisco public defender's office treated her. >> come on. he's turn around. he's. wait. is it him? right now? >> antonio gomero is an inmate at north kern state prison outside bakersfield. he's being processed and will find out soon where he'll serve his sentence of seven years to life for torture and domestic violence. his public defender, elena yanez , may also face sanctions for some of her actions during the case. >> it's something that we are taking very seriously about what our next steps may be, so there

could be a next step, correct? >> san francisco district attorney brooke jenkins is concerned about four issues. number one, do you the survivor in the criminal. case, jordana chehon fillled, an $8,000 small claims court complaint against antonio guerrero for back rent and other money he owed. this email exchange shows the deputy public defender, elena yanez, got involved in the matter and she was trying to propose like an alternative amount and settle without us going to court. >> it is absolute, in my view, inappropriate because it brings her in contact with the victim who has been traumatized by the person she's represent. you don't want to cross those lines and those boundaries. >> retired santa clara county superior court judge ladoris cordell explains some small claims. court is supposed to be one individual against another. no attorneys. she's concerned guerrero's deputy public defender may have been trying to arrange a payment to his victim.

>> well, he's willing to give you this money. he'll give it to you and maybe that'll soften her attitude. and she won't be as concerned about maybe seeing that he's prosecuted. very scary stuff. >> i approached elena yanez after the sentencing to discuss the case. elena, hi, i'm dan noyes. no she didn't give me a chance to ask specific questions . i later sent them to her office in an email, and even though i gave her boss, public defender manu raju, precise details about what i was investigating, he would not agree to an interview. his staff sent a statement that reads in part. there was nothing improper about miss yanez conduct on the guerrero case. it's commonplace for public defenders to convey information from our clients to victims, since in domestic violence cases our clients are often barred from communicating with victims except through their attorneys issue number two in this text exchange, jordana turns down the public defender's request to meet in person about the small claims case, writing

after speaking with my lawyer, i think it would be best if your team could pose any questions regarding this in an email, but the very next morning, elena yanez cold called jordana at work, spoke briefly about small claims court and focused on the domestic violence case. >> she essentially tried to make me feel bad for him. >> what did she say? >> she said, you know, he had a effed up childhood and she said he said he was sorry when the victim said, i will communicate with you, but only by email. >> that should have been respected. >> david josephson is an expert in legal ethics from santa clara university school of law. >> that was in direct contravention of the victims expressed wishes with respect to being contacted. so i think that was a violation. i think that was unethical and could certainly subject the defense attorney to bar discipline. >> in his statement, public defender manu raju argues it is commonplace for public defenders to speak to victims to get a sense of what kind of resolution they are looking for, and to

convey information to them from our client's issue number three, on the day the jury announced its guilty verdicts, guerrero's attorney, elena yanez, bought drinks for several jurors at this bar near the courthouse. one juror signed this declaration, saying he did not feel comfortable with what seemed like victim blaming by yanez and some of the jurors. >> when you are buying them things, even a drink in order to potentially persuade them to assist in your argument for sentencing. that too, is very disturbing and inappropriate. >> according to the declaration. yanez informed the jurors in that bar because of their verdict, guerrero would be looking at a life sentence after three jurors wrote emotional emails asking the judge to be lenient, one stating mr. guerrero deserves a second chance. the conduct is inappropriate under our our ethical rules. >> we are not to be sharing information with jurors, post

conviction that they weren't entitled to receive or consider during the trial itself, elena yanez boss manu raju did not address her buying drinks for the jurors, but did confirm she went to the bar with them, adding it is extremely common for attorneys to speak to jurors after a verdict to gather feedback on the trial, jurors asked her what mr. guerrero sentence could be and she told them finally, issue number four on the day of sentencing, the judge asked elena yanez if she'd like to make any final comments. >> i was there in all my time covering courts. i've never seen an attorney sob so hard that he or she was difficult to understand without my knowledge. someone made a recording of the session that leaves the world a little bit less full of pain. yanez cried for the bulk of her comments and several times she had to stop drink some water and try to compose herself because life is worth more than what we dispose of every day. a

statement from public defender manu raju's offi says miss yanez served her client impeccably throughout this case, and to criticize her for showing emotion and caring about her client is offensive and sexist. but judge cordell believes it raises questions of competence. >> the sobbing and crying in court where you can't even speak when you're there to advocate for your client, particularly during a sentencing. if you're so enmeshed with the client, you cannot you cannot adequately represent your client. you just can't do it. you have to have boundaries. you have to draw that line. and i didn't see that happening here. >> one final point through his attorney, elena yanez, antonio gomero turned down a plea deal in which he would have received six years in prison. he wound up with a much more serious sentence than did. yeah, much more. >> yeah. dan, you know, you report that antonio guerrero was convicted for four incidents over what time period of a year?
