college political science professor melissa michaelson does think that while the budget deficit may not get him recalled, it could impact newsom's presidential ambitions. i think it's going to be challenging for the governor to move on to the national stage if he doesn't have a strong economic record in california to build on, and during the 2021 recall attempt, governor newsom raised more than $70 million from donors and the recall movement raised 8 million. >> professor michaelson said this latest recall could potentially lead to governor newsom getting more donors. luz pena abc seven news okay, thank you. >> lose an effort now underway to block the proposed merger of albertsons and kroger, america's two largest national supermarket chains, today, california attorney general rob bonta announced that california is among the states joining the federal trade commission lawsuit to stop this deal. the suit claims the merger violates federal law and presents a significant risk of reduced competition, which would lead to higher food prices.

challenging the florida law, drawing a clear distinction between a government and a private party engaging in content moderation. >> is it anything more than a euphemism for censorship? >> if the government's doing it, then content moderation might be a euphemism for censorship. if a private party is doing it, content moderation is a euphemism for editorial discretion, a ruling that would force tech companies to have no editorial discretion could affect their business model, which relies on curation to attract advertisers and users. >> a decision is expected in june. ike ejiochi, abc news, washington. >> a celebration in emeryville today to honor the legacy and achievement of bay area african american firefighters, students, faculty and local firefighters gathered at anna yates elementary to commemorate the 11th annual chief is my belief event at the center of the celebration, a film highlighting the work of african american firefighters who dedicated their lives to serving their communities.

youngest person ever charged in this country with attempted murder. so what became of those two young children that was the subject of our new documentary, unthinkable. it police say an intruder broke into a home, severely beating a baby boy, came in the house and killed, and they got the baby. >> and i don't know what happened. an attack that stunned the nation. >> an we believe the infant was kicked and punched and perhaps struck with a stick. >> a shattered skull, brain damage. the child was hospitalized. doctors did not know if ignacio bermudez would survive his injuries. >> it would be very unlikely that the baby would have a full, complete recovery and be completely normal in the future.

>> outside the hospital, his parents wept. that's when i first met ignacio and carmen bermudez. >> do you feel any bad feelings towards these kids? was was just i do i do they were struggling to comprehend how someone could beat a def. >> the suspect was just a six years old. identify as brandon toliver. police say he forced his way into the bermudez home to steal a big wheel tricycle. police say he heard the baby crying. it was that short encounter that forever changed the lives of both families. his my heart really goes out to the bermudez family, you know? >> and i'm really it's a terrible tragedy. and i'm. i'm in disbelief.
4:32 pm
>> the six year old became the youngest person in the u.s. ever charged with attempted murder. though it is rare felony assaults by children under the age of ten are not unheard of, according to the california department of justice. to 34 children under the age of ten were charged with felony assault between 2017 and 2022, but decision by the prosecutor brought criticism and controversy. i've never done that to a white boy. a battery of child psychology eventually determined that brandon toliver was not able to understand the assault charges against him, or to assist his attorney in defending him. therefore, the case could not go forward. >> this this kid fall through the crack. do we just send them home and say go and sin no more?

the team had the rooted in oakland since 68 signs removed from the coliseum, the a's began using that slogan back in 2017. today's removal comes two days after the successful fans fest at jack london square, organized by local groups and our casey pratt emceed that big event. and casey, you and i walked into the building together to work today. you told me more than 10,000 people showed up massive crowded fans fest. >> i took a great selfie on stage. it was really cool. everybody was vibing and positive and happy. and then this happened today. uh, what i actually learned, i reached out to the a's to get some more information. they insist that it's been rainy out. they had intended to take the sign down earlier, but they had to do it today because of the weather. we'll see if that's the case. i actually reached out to the
4:39 pm
person taking down the actual sign because i said, can i have it? i want to put it up in the sports department, like, can i get some pieces of it? and he said, it's a tiny vinyl sticker. it comes off in these little teeny pieces. so there's no salvaging the sign. but i wanted that sign, guys. >> yeah, that would have been incredible. >> so the sign is cheap. like they're hiring practices at the. >> you said it is continuing to rip the hearts out of a's fans for sure. yeah it's so sad. it is. it is. this is also kind of sad, right. the clock is ticking on the moon lander. the odysseus house is expected to stop communication tomorrow, which is a lot earlier than expected. the lander were the lander was supposed to collect data until its solar panels were no longer exposed to light. so far, only one image has been released. as odd as it's affectionately called. approached the moon, spencer. this held so much promise here. it's it did, it did. >> now all of a sudden it's. i'm not trying to be funny. sort of a brief odyssey for odysseus. just, uh, we expect you so much more and will we get more? can
4:40 pm
it? can whatever is wrong be corrected? >> yo, i did some research on this. you guys. it turns out that when it landed, it didn't land right. so it's kind of tipped over on its side, which means it's not getting the right light for its solar panels, which is why it's going to have to end early. but what i think is really interesting is they actually landed on the moon, right? like we have more technology in our phones now than they probably had when they landed on the moon. it's crazy. we haven't been back. and it's crazy that an unmanned rover can't even land correctly. you know, many, many times the computing power in our phones than the apollo missions, for sure. >> that's right. and it did flip over on its side. you're exactly right, casey. so unfortunately, this is not going to be a spencer to answer your question, like the hubble, where they could go do a little fix, right? they may not be able to do that. right? right. the chinese company that recently overtook tesla as the leading seller of electric vehicles is showing off its new supercar, the yang loooooong u9, from byd features four motors, all wheel drive, and it goes as if to from 0 to 60. in 2.3 seconds, all for

$230,000. >> the low, low price exactly a bargain at twice the price. >> byd has western automakers concerned, though, because of its ability to sell evs for prices comparable to gas cars, its electric suv, for example, sells for just $38,000, so that's not the supercar, but you know, spencer, as we know, competition brings prices down over time. and certainly the technology continues to improve. >> it's fascinating dan, it really is, especially that an electric car can go from 0 to 60 and 2.3 seconds. that's pretty amazing. not that i'm into speed, but that's pretty impressive. but the price tag. mhm. >> yeah too much. but $38,000 for a more user. >> the other version right. the more. yeah. yeah. the other version casey i've compared it to if you've ever been in these cars, uh, you know the electric vehicles that are fast like this, like the tesla, it's like when we were kids, slot car machines, you know, it's instant torque, right? >> yeah. 0 to 60. >> it's amazing. all electric cars actually jump off the line. uh, whether it's a tesla or a supercar or just a normal one, they all accelerate very fast
