again. after that residual backup, the chp hopes to have all lanes open in the next 15, maybe 20 minutes or so. good afternoon. thanks for joining us. i'm dan ashley and i'm julie anne glover, a san pablo neighborhood is also at a standstill due to a standoff that's been going on for hours now. >> police blocked the streets as officers monitored an armed person locked inside of a home. >> all right, take a look at this map. the red that you see shows the areas under lockdown down, including an elementary school. the school canceled classes today. since early this morning, neighbors have been unable to come and go. but this afternoon, remaining residents were asked to leave the area. some say they're they've been hearing gunshots since 9 p.m. last night. >> i1i started hearing more shots and i looked around. you know what? i always think it's always fireworks. but it really wasn't. it was. it was gunshots. and then it kept going out like every hour. and by like around three, i started hearing them say, oh, can you uh- leo ortega, you must come out with your hands up and weapon, no weapons

in hand. >> police have been urging neighbors to report any suspicious activity to the sheriff's office in the north bay. >> a woman and two sonoma county sheriff's deputies are recovering after being rescued from the russian river. officials say the deputies were trying to pull the victim from the cold water, but they didn't expect the woman to fight back. abc seven news reporter cornell bernard spoke with the rescue team, who jumped in to help. >> it's one of those calls that once in a career, you don't expect it to happen. firefighter jonathan bowers says. >> that call came sunday in guerneville on the russian river. >> as the radio traffic started picking up, we knew we had a legitimate rescue on our hands. >> as far as i know, we have two deputies and a juvenile in the water. i don't know if we have additional people in the water at this time. >> okay. are the deputies injured? >> not that i'm aware of. >> officials say it was actually an adult woman. the two sonoma county sheriff's deputies, sergeant gary larson and deputy cody mccready, were trying to rescue from the super cold river. >> two deputies and the victim were basically clinging on to a bush in the middle of very fast

moving water. captain spiegel says it's not clear how the woman got into the river. >> the district swift water rescue team launched their boats , but minutes later they knew this rescue wouldn't be easy. one thing first responders did not expect when they got here is to have the victim fight them off. the sheriff's department says the victim was trying to push the deputies underwater when the rescue team arrived. >> at one point when the lady was fighting the deputies and then she started fighting me. i had to reach down and i was able to get a good grip on her arm and i was able to pull her into the boat. >> but when you add somebody who's combative at the same time, um, it adds a whole new level of complexity. my understanding at this point is that she may have been intoxicated. >> both deputies were in the water for about 25 minutes before being pulled to safety. >> both deputies out of the water and the rescue boat enroute to johnson's beach here to be a wet, tired, but okay. we're just happy to be there and help them out, you know? >> hats off to those guys for jumping in and trying to save someone's life. >> bringing the deputies on

board that boat and bringing them to safety immediately. there was a lot of gratitude, a lot of thanks. >> the victim is recovering in the hospital. sheriff's officials say she faces arrest on multiple charges, including assault on deputies and firefighters in guerneville. cornell bernard abc seven news. >> the lives lost in san francisco due to the fentanyl epidemic were commemorated today . people held a march outside of city hall to prevent fentanyl deaths. organizers say they want to raise awareness on the dangers of fentanyl and promote resources for those dealing with addiction. last year was the deadliest year on record for overdose deaths in the city. earlier this month, the county health department released new numbers saying accidental overdoses in january were down 21% from january of 2023. all right. >> it's happening again. just a week from the primary election, activists set their sights on governor gavin newsom. >> a new recall effort comes just two years after newsom, successful. he beat that previous attempt to get him out of office. abc seven news reporter luz pena spoke to the campaign director of the new

recall and is here with what she found out. luz. >> yeah, around 9:30 a.m, the group behind rescue california filed a notice of intent to recall the governor. this less than three years after the last recall. governor gavin newsom is facing another recall attempt less than three years after beating the last one. the group behind this one submitting almost 500 signatures to begin the process. >> we got them in three days. um they ranged from mostly just depressed, repressed. and suppressed citizens of the state of california, along with some leadership and law enforcement. and so forth. um, and, and, uh, we're filing and we're not messing around. >> the group rescue california accused the governor of abandoning the state to advance his presidential ambitions, pointing to a list of issues across california. >> the highest homeless rates, highest taxes in the country. um, all of those things are in there as reasons for the recall. and included in that is a public

safety and education issues. >> but granting health benefits to undocumented immigrants and the state's record $73 billion deficit are the biggest motivators now have a $73 billion deficit. >> he's not qualified right now. he's not doing his job. he certainly shouldn't be applying for another one. >> on ex-governor newsom responded to the recall attempt. trump republicans are launching another wasteful recall campaign to distract us from the existential fight for democracy and reproductive freedom. we will defeat them some of california's top democrats, including attorney general rob bonta and senators padilla and butler, rushed to condemn the recall attempt. how serious is this recall? >> it's not very serious, gavin newsom has beat back recalls before, or he hasn't done anything necessarily scandalous since then. and we still have a pretty strong democratic majority in the state, menlo

college political science professor melissa michaelson does think that while the budget deficit may not get him recalled, it could impact newsom's presidential ambitions. i think it's going to be challenging for the governor to move on to the national stage if he doesn't have a strong economic record in california to build on, and during the 2021 recall attempt, governor newsom raised more than $70 million from donors and the recall movement raised 8 million. >> professor michaelson said this latest recall could potentially lead to governor newsom getting more donors. luz pena abc seven news okay, thank you. >> lose an effort now underway to block the proposed merger of albertsons and kroger, america's two largest national supermarket chains, today, california attorney general rob bonta announced that california is among the states joining the federal trade commission lawsuit to stop this deal. the suit claims the merger violates federal law and presents a significant risk of reduced competition, which would lead to higher food prices.

>> there's no other way to say it. it's bad for workers, it's bad for agricultural producers, it's bad for consumers in california and across the country. >> the lawsuit blocking this deal is also supported by labor unions representing grocery store workers. the merger, announced in 2022, would include dozens of chains, including safeway and vons. the companies claim the deal would actually reduce prices for shoppers because of their buying power. >> let's move now to news from the supreme court. and two cases that apply to most of us. the justices are hearing arguments in two cases about how the first amendment applies to social media companies. abc news reporter ike ejiochi has the story. >> the hearing, beginning with the justices considering florida's law, which makes it illegal for tech companies to ban candidates on the ballot in the state from their social media sites. florida solicitor general henry whitacre often likening social media companies to telecommunications companies, argues social media companies are unfairly censoring

up some pretty substantial rainfall coming our way as this cold front, which triggered the sprinkles today, will bring us some colder air overnight. and right now you can see that it's pretty breezy out there. most locations with wind speeds between about 15 and 20mph. no powerful gusts at the moment. it is noticeably cooler right now than at this than at this time yesterday. generally four to 5 or 6 degrees cooler across the region. and we've got a mix of blue sky and clouds. as you can see, 59 degrees right now at san francisco. and san mateo, half moon bay, 57. we have low 60s at oakland, hayward and san jose and mainly blue sky with the golden gate temperature readings up north. pretty cool at petaluma, 57 degrees, but we have low to mid 60s at santa rosa, napa, fairfield, concord and livermore and check out our forecast headlines next two days we'll have chilly mornings, but sunny skies throughout the day relatively mild, especially on wednesday. but thursday through sunday. look for a rainy, gusty and chilly weather. and in the sierra, while we're getting the rain, several feet of snow likely to accumulate during that time period. overnight here in

a one month old baby boy. >> we believe the infant was kicked and punched, suffering severe brain damage with the alleged attacker, a six year old boy charged with attempted murder. >> there was a case that shocked the country and it happened right here in the bay area. >> a new abc seven news streaming documentary follows our lyanne melendez as she revisits a case that has haunted her for decades. >> she's never forgotten it, of course, and she's revisiting it now. leanne is here to tell us about it. we've talked about this truth. >> truth? you know, i covered this back in 1996 when it happened and it stayed in my heart all this time. yeah. so, you know, it's a story about a newborn who was brutally beaten in his own home. now, meanwhile, the suspect turned out to be a six year old child. now you fell for the victim and his family, of course. and also for the accused. now, at the time time, the six year-old was the

youngest person ever charged in this country with attempted murder. so what became of those two young children that was the subject of our new documentary, unthinkable. it police say an intruder broke into a home, severely beating a baby boy, came in the house and killed, and they got the baby. >> and i don't know what happened. an attack that stunned the nation. >> an we believe the infant was kicked and punched and perhaps struck with a stick. >> a shattered skull, brain damage. the child was hospitalized. doctors did not know if ignacio bermudez would survive his injuries. >> it would be very unlikely that the baby would have a full, complete recovery and be completely normal in the future.

>> outside the hospital, his parents wept. that's when i first met ignacio and carmen bermudez. >> do you feel any bad feelings towards these kids? was was just i do i do they were struggling to comprehend how someone could beat a def. >> the suspect was just a six years old. identify as brandon toliver. police say he forced his way into the bermudez home to steal a big wheel tricycle. police say he heard the baby crying. it was that short encounter that forever changed the lives of both families. his my heart really goes out to the bermudez family, you know? >> and i'm really it's a terrible tragedy. and i'm. i'm in disbelief.

>> the six year old became the youngest person in the u.s. ever charged with attempted murder. though it is rare felony assaults by children under the age of ten are not unheard of, according to the california department of justice. to 34 children under the age of ten were charged with felony assault between 2017 and 2022, but decision by the prosecutor brought criticism and controversy. i've never done that to a white boy. a battery of child psychology eventually determined that brandon toliver was not able to understand the assault charges against him, or to assist his attorney in defending him. therefore, the case could not go forward. >> this this kid fall through the crack. do we just send them home and say go and sin no more?

i hope not. why are you so mad at this guy? >> why do you want to hit him? >> what followed was years of therapy while living in several group homes. the family, meanwhile, was focused on their son, who was now close to being a year old and who clearly showed signs of developmental delay. >> there is no brain tissue there anymore, his ct scan showed that once his brain tissue had died, it could not regenerate. >> as a result, ignacio bermudez was not able to push himself up or to make eye contact with the people around him. in fact, he often had seizures, causing his head to suddenly drop. it's a matter, big guy when i checked on his progress a

year after the attack that was the last time i saw ignacio and his family until a few months ago when we found them living in reno, nevada. and is now 27 years old. tomorrow we show you how he and his family are doing now in that documentary, i also talked to brandon toliver, the six year old who's now 33 years old. very interesting what he told me. >> i'll bet you know, i watched the documentary. it obviously stayed with you. all reporters have some stories that haunt us. but why did you feel that now was the time to go back and tell the story again, so many years after you covered it? originally >> you know, i always had that tape at, you know, on my desk, and i kept on looking at it for years and years. and i said, i someday i have to do this. i promised myself, and i think you both know that our viewers really want that from us. they don't want us to just report on

big screen for the very first time. um, did you see your work and say, we, we did it different people like completely different areas or parts of it that makes you like, makes you feel like you've done a good job. >> you know, we were we were invited by yorgos to play with the idea was, and, um, emma stone is very, you know, great collaborators. she's incredibly, uh, creative and imaginative. >> were you happy with what was accomplished? >> well, it was happy. the lighting was fantastic. cinematography was fantastic. it was all everything worked. so you know, you need all these elements to help the makeup to come alive. >> she just needed to look sort of otherworldly in this crazy world around her. she needed to look a sort of slightly odd and slightly strange. >> so we had to make sure that the audience experienced whatever bella baxter was experiencing. >> and there are things visually here that we don't see in most movies. did that mean that
