he is expected to defend the bipartisan border security deal blocked by house republicans after trump publicly railed against it. biden is now considering executive action to deal with the influx of migrants . >> the supreme court has agreed to take up former president trump's claim of absolute immunity. trump insists he cannot be criminally prosecuted for his actions taken while in office, and therefore should not be charged with trying to overturn the 2020 election. the justices will hear arguments april 22nd, and a ruling is expected sometime between early may and the end of june. but the high court's decision to take the immunity case will further delay a potential trial. >> arguably, they should have stood down and let a criminal jury make this decision before november. and in this moment, that's becoming less and less likely that we'll have that sort of factual determination by a jury of his peers as to what actually happened on january 6th and whether that crossed the line of criminal conduct. we might just have to leave it to

the ballot box in november. >> all right. if trump wins the election before the case goes to trial, he could have it dismissed or even tried to pardon himself. >> well, the historic run of senate republican leader mitch mcconnell is coming to an end. mcconnell acknowledged the changing political climate as he announced he is giving up his leadership role. here's abc's jonathan karl. >> mitch mcconnell, the longest serving senate leader ever and one of the most influential senators of all time, announced he'll step down as the republican leader in november. >> it's time for the next generation of leadership. mcconnell who turned 82 just last week, has suffered a series of health setbacks. >> but as he hinted, his move is as much about politics. he's a man no longer at home in a party dominated by donald trump. >> i know the politics within my party at this particular moment in time. i have many faults. it's misunderstanding, politic.
