good thursday morning everyone i'm andrew dymburt happy thursday i'm rhiannon ally. >> we want to begin with that historic decision at the u.s. supreme court. >> the justices have decided to hear an appeal from former president trump. they will decide if trump is immune from prosecution in the january 6th election. interference case. >> this comes as trump suffers a setback in a different case in new york, where he has been ordered to pay more than $450 million for fraud. abc's perry russom has the latest on both cases. perry. good morning. >> rihanna good morning to you. the supreme court's announcement is raising questions about the timeline of a crucial legal case against the former president. this morning, a win for former president trump, the supreme court agreeing to hear his claim that he's immune to prosecution in the election interference case stemming from the january 6th capitol riot. the court scheduling arguments for april 22nd significantly delaying the case brought by special counsel jack smith. >> i think this makes it less and less likely that we'll see the case go to a jury and let the jury decide the facts and

the law regarding the charges that jack smith's grand jury brought against him regarding january 6th. >> earlier this month, a federal appeals court unanimously rejected trump's immunity claim, saying former president trump has become citizen. trump any executive immunity that may have protected him while he served as president no longer protects him against this prosecution. trump appealed that ruling. now, the supreme court will decide once and for all whether a president can be criminally prosecuted for their actions in office. the decision will set a precedent going far beyond trump scholars look back on actions taken by previous presidents, asking could former president bush have been prosecuted for enhanced interrogate techniques during the war on terror? and could former president obama have been prosecuted for the killing of al qaeda member anwar al-awlaki, a u.s. citizen not given a trial with the supreme court hearing arguments in trump's case on april 22nd, a decision may not come until june, meaning it could be fall before a trial begins close to november's election. i think the court can and should move more quickly.

>> in 1974, president richard nixon asked the court to basically hold. he didn't have to turn over oval office recordings. the court heard oral arguments and less than three weeks later ruled unanimously against him. so the supreme court has a very strong unanimous court of appeals opinion. if it wanted to affirm that opinion, it could do it in a matter of weeks. >> the supreme court is also considering whether states can keep trump off the ballot for his alleged role in the january 6th attack. >> i consider it to be more election interference by the democrats as to what they're doing. >> just yesterday, illinois joined colorado and maine in trying to remove him from the primary ballot. although the court has indicated it's likely to side with trump, there is one not so great piece of news for trump. yesterday, a judge rejected his request to delay paying the $454 million judgment in his civil real estate fraud case in new york, meaning he must post bond for the full amount by late next month. trump's lawyers have suggested he does not have enough money on hand to cover the full amount, saying properties would likely need to be sold to raise capital

. new york's attorney general has said if trump cannot pay the judgment, she could soon begin start to seize his properties. andrew perry, thank you. >> at least one person is now confirmed dead as wildfires tear through the texas panhandle, an area larger than rhode island has now burned. one of those fires is the second largest in texas history. powerful winds and dry conditions fueling the flames, damaging more than 40 homes so far. >> we'll be fine. i know we'll be fine. we just. our family unit is so strong and, uh put one foot in front of the other. that's all you can do. >> the fires are only 3% contained and could grow significantly before full containment. meanwhile, the next big weather story is in the west. a new storm could dump 12ft of snow in the california mountains. a blizzard warning has been issued, and we'll check today's forecast in just a few moments. well, the justice department is now investigating that mid-air air door blowout aboard an alaskan airlines

flight that happened last month. >> investigators are looking into whether boeing violated a deferred prosecution deal related to a pair of deadly crashes overseas in 2018 and 2019. in those cases, the faa accused the company of hiding technical information. the faa just gave boeing 90 days to come up with a plan to address quality concerns. >> now to the migrant crisis on the southern border. the president and former president are visiting texas today, both with very different ideas on how to address this growing problem. this morning, with the migrant crisis at the top of voters concerns in this election year, president biden and former president trump are making dueling visits to the southern border. biden is expected to meet with border patrol agents and local leaders in texas, where he'll defend a bipartisan border security deal killed by house republicans this month. the bill called for hiring more officers and immigration judges and would have expedited work permits for migrants when took for months. >> for months of us, the white house working with republicans

and democrats in the senate to get that done. and obviously republicans have rejected that because of politics. >> trump says the bipartisan deal wasn't strong enough to secure the border. he's promising, if elected to begin mass deportations of migrants. it comes as communities across the country struggle to house the historic influx of migrants. denver's mayor, just yesterday said he needs to close four shelters and scale back services due to budget concerns. >> this allows us to deliver people high quality, dignified services and also reduce the amount of costs we spend, make sure they're successful in the city, successful, and we think that's a path forward that denver should be proud of. >> new york's mayor now calling for changes to the city's sanctuary city policy. just this week, more than 70 migrants were found living in this basement of a furniture store and in georgia. outrage after a college student was brutally murdered during her morning jog, allegedly by an undocumented immigrant previously arrested. but released. >> likens death is a direct result of failed policies on the federal level, and an unwilling miss by this white house to secure the southern border.

>> the president is considering executive action to address the migrant crisis, including tougher asylum laws, but the white house says no such announcement will come today. that announcement could come at next week's state of the union, but the white house insists any real solution for the border crisis needs to come from congress. >> well, biden's doctor has declared him fit for duty after his annual physical. he described biden as a healthy, active, robust 81 year old. the doctor noted that biden's gait had stiffened, compared to the previous year, but said no new concerns were identified. now, the president did not undergo a cognitive test, but the white house said his doctors did not believe one was necessary. >> the los angeles ballerina, jailed in russia for donating money to a ukrainian charity, is set to appear in a siberian court today. casino carolina is appealing her detention on charges of treason. she has dual us russian citizenship and was visiting family in russia when she was arrested. >> well, cameras captured an amazing cliffside rescue in california. crews found a man who had been missing for two days in big sur and then

>> he should get more than a fist bump. wow congrats mom and dad! now to some fast food confusion. wendy's is responding to widespread criticism of its new plan that would potentially change menu prices during the day. this morning, after a so-called dynamic pricing, where customers could see menu prices change during the day. based on demand or a restaurant's location. initial reports about the pricing plan led to wendy's normal grilled food getting roasted in the media, so a burger may cost a dollar more during the lunch rush and $40 more at 3 a.m. >> we know you want it. >> just set a price. tell me the price. don't don't punish me for going at a certain time. >> senator elizabeth warren even accused wendy's of price gouging . here's how the controversy started. wendy's ceo last week announced we will begin testing more enhanced features like

dynamic pricing and daypart offerings, along with ai enabled menu changes and suggestive selling that led to comparisons between wendy's plan and so-called surge pricing used by rideshare companies like uber, which charge more during rush hour. but now wendy's is firing back, saying when it comes to surge pricing, we didn't use that phrase, nor do we plan to implement that practice. it now insists that any shift in pricing would be to offer discounts during slower times of the day. >> when it comes to dynamic pricing, the price will change based on how much supply of that product exists. surge pricing has to do with the time of day, so if there's more demand specifically for a time of day, you have that surge price, which ultimately means that price is probably going to increase dynamic pricing. the price could go either higher or lower for wendy's. >> doesn't plan to test this new pricing until next year. >> california governor gavin

newsom is accused of carving out an exemption in his state's new minimum wage law for panera bread, allegedly to benefit a billionaire donor. the law requires fast food chains, pay workers at least $20 an hour beginning april 1st, but it does not apply to restaurants that bake and sell their own bread. so, according to bloomberg, the donor owns several panera locations. when asked about the exemption, newsom reportedly dismissed it as, quote, part of the sausage making in politics. but a top state lawmaker is now demanding an investigation. >> coming up, we are celebrating leap day. we'll tell you the restaurant chains giving out some freebies today. plus the tributes this morning to comedianichard lewis
