versus anderson, the justices ruling in trump's favor saying colorado has no right to keep his name off the ballot. the state argued he should be disqualified under the 14th amendment because of his actions leading up to the january 6 attack on the capitol. the supreme court just moments ago saying donald trump will remain on the battle. let's go to terry more ran at the supreme court. >> reporter: all nine justices of the supreme court agree that states cannot kick candidates off the ballot under the 14th amendment, that clause which passed after the civil war held that people who had sworn an oath to up hold the constitution and then engaged in insurrection are banned from holding federal office further. and what the supreme court said is that states can't enforce that. that it requires congress to pass a law to outline how that

clause should be enforced concluding very simply that responsibility for enforcing that part of the constitution rests with congress and not with the states. the supreme court expressing real concern that states could go different ways. some states would perhaps ban one candidate. some states would perhaps ban another. other states would keep them both on the ballot. they expressed concern about the disruption that would work. they also said the text of that constitutional article is clear and that it requires congress to pass, quote, appropriate legislation in order to explain outline the enforcement procedure for someone who has done as people have alleged, sworn an oath to the constitution then engaged in insurrection and run for office again. nothing will happen. trump will stay on the ballot in all 50 states. >> his name is on the ballot for super tuesday tomorrow in colorado. voting will continue as planned.

>> reporter: that's right. because the colorado supreme court which originally held the opposite, that under the constitution donald trump would be banned from running for office from appearing on the colorado ballot. they said secretary of state should go ahead and prepare both, for both possibility, pending supreme court opinion. here we are the day before the colorado primary. supreme court once again speaking with a unanimous voice. can't express how rare that is in a contested case. all the liberals joining with the conservatives in saying that congress has the authority to keep people off the ballot under the 14th amendment, not the states one by one. >> up to congress, as you point out. terry moran leading off our special report. want to bring in kate shaw, our legal analyst. kate, as we heard terry point out, unanimous in this decision, the justices on the court. sending a strong message that when it comes to significant national issue of this sort, it should be congress and not the states that decide here. >> reporter: welsh david. the justices did agree with that

proposition. interestingly this opinion means there's no specific identified author. it is a depersonalized opinion of the court. but i should mention there are a couple concurring opinions. justice barrett and there's a joint separate concurrence by justices sotomayor and kagan and jackson. all the court then further than needed essentially saying the only way to enforce this provision of the 14th amendment is by congress. just as terry said, the bottom line is unanimous, that colorado has to keep president trump on the ballot and so does every other state. i think we are done seeing state litigation around this subject. >> we had a preview that this was coming, including the liberals on the court when they heard arguments in this. elena kagan said the question you have to confront is why a single state should get to decide who gets to be president of the united states. this was at one point to a lawyer arguing against trump's position. she went on to say, in other words, you know, this question

of whether a former president is disqualified for insurrection to be president again just say it, she said. it sounds awfully national to me. strong suspicion that she would go this way along with the other liberal justice. >> that's right, david. it was interesting at oral argument you did not see the ordinary divides on display. everyone on the court seemed quite concerned about what it would mean for a nationwide election in which we choosing a national leader for everyone, for individual states to have so much control over something as important as whether a presidential candidate appears on the ballot. that's an argument about consequences. that's not grappling with the history of this amendment. it's really about consequences. you saw that in oral argument and i think you see it on display in this opinion. >> bottom line, what does this mean for other states who have found similar findings as colorado. as you know, a number of states have gone in this direction. >> that's right. colorado, maine, illinois.

i think this opinion puts those to rest. at this point none of those separate state decision, whether by court or secretary of state to keep trump all the ballot can go into effect. he will remain on the ballot in every state. i don't think there's any way for any state to circumvent this. >> it would appear this issue is off the table for good, straight through the presidential election. kate shaw, thanks. want to bring in devin dryer. you are reading a bit of a warning also from some of the liberal justices. >> that's right. kate just touched on that here. liberals are saying the court didn't need to go as far as it did. take a step back for a second, david, just how historic this decision is. never before has the supreme court considered this part of the constitution, so historic in that way. but not in more than 20 years has the supreme court directly weighed in on a presidential election months before voters are going to the polls. obviously going to the polls now

in the primary. but the general election in november, this is a really big deal. it is just the appetizer. the supreme court, in this opinion, they don't talk about donald trump's conduct. there's no specifics about what is alleged to have done around the 2020 election. all of those questions are still to come next month as you know when the supreme court takes up another major case on misconduct. >> you bring that up. the fact that this was a bit of a set back for jack smith, special counsel, in the federal elections case, the interference that involves january 6. they will take up this issue of presidential immunity. much different from what we're covering right here. but as you bring up, they will hear arguments. earliest they could make a decision is may or june. everyone at home simply wants to know, is there a chance this goes to trial before the election? that window is very small. >> a very small window for the supreme court to hear this case, this other case, give a decision, have a trial go forward before the presidential

election in november. david, again, the underlying conduct in this decision today that donald trump cannot be removed from the ballot for engaging in insurrection is about to go back before the court in this other case looking, the special counsel looking to prosecute donald trump for that very same conduct. so these justices, again, are going to be asked to decide whether that trial can go forward. whether a president is immune. it's really going to push this trial up against the election when voters are going to be headed to the polls. >> the point you're making is while they don't address the behavior in today's decision, they're going to have to in weeks ahead. rachel scott covers the campaign trail for us. rachel, reaction in from the former president? >> the former president just responded just minutes ago, calling this a big win for america. i'm also told that former president donald trump is expected to address this decision in just a matter of hours down in florida at mar-a-lago. the trump campaign was not only

hoping this decision would come down in this way. they were confident that it would happen. they called the colorado state supreme court ruling flawed. they said they had the utmost confidence that the justices would ultimately rule in their favor. of course, this all comes now just one day before super tuesday. we know 800,000 voters in colorado have already mailed in their ballots. donald trump's name on that ballot ahead of tomorrow and the justices making sure those votes are counted and it stays that way. >> rachel scott, thank you. jon karl here in new york with me. this amendment was made to reduce the power, not increase power of the states. certainly, what they've avoided is a patchwork of states where donald trump is on the ballot or not. that's simply not going to happen. >> it's fascinating to read this opinion. it makes both of those points. one, they talk about how the 14th amendment coming after the civil war was designed to keep the confederates from coming back into power, envisioning a situation where confederates would take over the state

legislatures of the former confederate states and use that power to try to sway -- to try to sway the federal government. so this talks about how, no, this amenment was not designed to expand state power. it was designed to limit state power. the idea that we would give states to the 14th amendment the power to choose who or who could not be on the ballot simply doesn't make sense. they said you could see different states having different reasons for disqualifying candidates from the ballot and having a different threshold of proof. some states may say if a candidate's been convicted of the crime of insurrection they would be banned. others saying just simply if the secretary of state of election officials believed that to be the case. so they said, you can't have that kind of patchwork, and they used patchwork, different states having different reasons for banning somebody from the ballot that would throw our entire system of electing a president up in the air. >> jon karl, our thanks to you.

want to go back to terry moran at the supreme court. the supreme court will have to take up this issue of immunity in a separate federal interference case that involves january 6th. without going too much further into that case, they did give a strong indication in today's decision that they believe ultimately who should be president really should be decided at the ballot box. >> reporter: that's a great point. the cases brought against donald trump in all kinds of court, not just the supreme court, but courts across the country, all have basically one aim. to stop him from getting back into the white house. what the court says in this case is that the constitution is clear that this route is not available. across the country, there's a sense among voters that there's something not kosher about that, if you will. they are pushing back against this, saying the only way to decide who gets into the white house shouldn't rest in the

court or with prosecutors or jurors. it should rest with voters in the ballot. >> terry moran, thank you. breaking news coverage here live on abc. colorado's highest court has decided donald trump should be kept off the court in that state given what that court believed was his behavior leading up to january 6th. the supreme court speaking loudly on this just moments ago, disagreeing with colorado's highest court, saying that state should not be able to keep donald trump off the ballot. super tuesday tomorrow. voters in colorado will go to the polls and be able to vote for donald trump. his name is already on the ballot. now they have cleared the way, the supreme court has, for donald trump to be on the ballot, not only in colorado, but in every state in this country, as we inch closer to the presidential election. our coverage continues on abc news live, abc news.com. i'll be back much later today with this entire team for "world news tonight." have a great day.

history! >> reporter: caitlin clark has done it. she is now the ncaa's all time leading scorer, breaking the late pistol pete ma record. clark needed just 18 points to break the record but dropped 35 in front of a sold out crowd in a ten point win over conference rival ohio state. she says breaking the record wasn't even on her mind. >> when they announced it and everybody screamed, that's when i knew. >> reporter: just a few days earlier, clark broke the college women's all-time scoring record held by lynette woodard, who got a standing ovation at sunday's game. clark also meeting her childhood hero, maya moore, pregame. >> i feel like a little girl. as a young girl in des moines, caitlin had to join a boy's team because there wasn't a girl's team for her age group.

top headlines we're following right now including the weather happening across the country. more than 7 feet of snow in california, hundreds of drivers stranded. in the east, record heat. little bit of a spring tease. ginger tracking it all. also right now three alaska airlines passengers are suing the airline and boeing for $1 billion after their plane was forced to make an emergency landing when a door plug blew off in midair earlier this year. passengers claim they suffered severe mental, emotional and psychological injuries. four passengers filed a separate suit in january. a new crew headed to the international space station after it was delayed because of bad weather. overnight they arrived at kennedy space center aboard the space x dragon spacecraft. they'll carry out experiments over the next six months. now an abc news exclusive. an interview with the woman behind an incredibly viral tik tok video series. robin, you had chance to sit down with her. >> boy does she have a story to tell. teresa johnson's story of falling in love, marrying and divorcing a man she says turning

and quickly took over paying her household bills. part of the reason you stayed, was there anything to do with the fact that he said he had money, or you thought that he had money? >> i definitely was not with him for the money. but i will admit that there came a point he was paying all the bills and he was being, as he called, a provider. i had never in my life experienced that before. i really felt like, oh, thank you, jesus. like, i can just exhale. yes, that felt good. >> teresa also says he made promises to buy her thing, including a luxury car, a house, a trip to london. what did you think when he was making these promises and they weren't happening? >> we're touring houses. i physically saw him put an offer in on a house. it is unfathomable to see someone put an offer in and they have no money. so my mind was saying, okay,

congress to describe how to enforce that provision of the constitution. the court warning of a presidential disruption as states go one by one that could result in what the supreme court called chaos. there's nothing in the constitution that requires we endure such chaos. in this case now it is laid to rest that donald trump will appear not just on the colorado ballot, but on other ballots. some of the liberal justices saying the court went too far but agreed on the bottom line in this case, that the state cannot disqualify donald trump from the ballot because of his role in january 6th and the weeks leading up to that, and so he'll remain. >> thanks. super tuesday is tomorrow with contests coming in 15 states. donald trump effectively the nominee already. nikki haley is hanging in.

the sierra nevada are bracing for another winter storm. even as they were digging themselves out of the storm from this weekend. we are here in the downtown area. crews are piling it up wherever they can. wind gusts and heavy snow caused hundreds of people to be stuck on interstate 80. highway patrol officers had to go vehicle to vehicle to make sure they were okay and rescue them from the highway. then get all their vehicles out. we were able to catch a ride to see the treacherous road conditions for ourselves. while we were with him, within 30 minutes he had to rescue two drivers and of course the highway is still closed because conditions are still not ripe to reopen it. schools are also closed as we're waiting for another storm to come through. guys? >> this next story hits hard. this morning we're remembering a dear friend an member of the disney family. chris mortensen. mort was an award winning journalist, covered the nfl for

what is sleep apnea? what are the symptoms? >> two common things here really that we're talking about. sleep apnea which can run the gamut. basically a sleep disturbance. different types of sleep apnea. most of the people who have it or their partners report their breathing stops and starts when they're sleeping. very loud snoring. you can literally hear someone gasping or stop breathing. then gasp when they resume breathing. then things that you might notice if you're the one having it. daytime drowsiness or sleepiness, attention problems, cognitive issues. that's the other thing that's common, that's brought about in this headline which is cognitive issues, memory issues and researchers trying to say there's a deck shun. >> what connections did it reveal? >> this was an abstract published at the biggest neurology conference going on right now. researchers at boston medical center found when they survey people who report these kind of sleep issues they had an 88% more likely chance of also

reporting problems with their memory, cognitive issues. again, we should mention this is based on association and observation, not yet cause and effect. when you talk about sleep apnea, when you stop breathing and your oxygen saturation goes down, your co2 goes up, you can almost think of that as having tiny mini strokes, miniheart attacks, multiple times a night on going. it's a major health issue. >> it's very seriously. every time i see that c pap machine i think, how can people sleep with that? >> first of all, if you think you or someone you're living with has sleep apnea, you should try to get tested. that can be a home test or formal sleep study. these older, full face masks right now are very difficult for people to be compliant with. they are now smaller devices that go right above the upper lip that look like that. they're soft, flexible. they are much less cumbersome, much more likely to be compliant with. george, i can tell you right now, for people who have sleep

trying to stay in this area was just ridiculous. >> but now, after talking about it, we decided it would be perfect for us. >> reporter: the good news for potential buyer, housing inventory is coming back, up 3% from january 2023. but high prices could keep many out in the cold. the current median existing home price in the u.s. is nearing $400,000, up 5% since last year. while mortgage rates have nearly doubled since before the pandemic in 2019. the gallos say homes in their desired area were out of their price range so george anne gave them a nearly $100,000 discount on the apraised value, also bypassing realtors and saving on closing costs. >> it's a great option for the current time we are in. we have no inventory. it's feeling like a consolidation of households

legendary irish rocker u2 wrapping up their las vegas residency. what was originally scheduled to be a 25 night run started back in september. that turned into 40 amazing performances at the grammy venue. to make the night even more special, for the first time in five years all four original members of the band were together under the same roof. drummer larry mullen jr. has been sitting out of performances due to health issues. he cheered on his band mates from the audience over the weekend and wrote on social media, what an incredible night at the sphere. very emotional night for me personally. and if you didn't get to chance to see u2 at the sphere, bono gave the audience some great news, announcing their final shows were filmed and there will be a concert movie a la taylor swift. meanwhile, next at the sphere, getting company with john mayer and fish. as we told you last week, the eagles are also deep in talks to perform there. looking forward to seeing that.

he had weekends with the kids. he wouldn't show up. through therapy i have been able to heal myself. >> america really needs a 12 step program to get in touch and to make amends to that kid who lives inside of us. >> despite his determination, the price of stardom came with its pitfalls, as young ru couch surfed while chasing show business. >> i have always been protected, always been protected. it was the '80s. i like to have fun. could have gotten in a lot of trouble. >> you don't hesitate about talking about, at a time, being dependent on drugs. what was it like for you writing this, to sit back in those dark times again? >> well, because i am still in a 12 step program, it has prepared me to accept life on life's terms. so all of that stuff led me to where i am today. i needed to go through that. you better work!
