a matter of hours, and a major change in our patterns. on the way for later this week, i'll have the forecast coming up. abc seven news at six starts right now. all ways live abc seven news starts right now. two weeks after the primary for one race, just two, two votes make the difference. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us this race is to represent thousands of people who live in the bay area. but just a handful of votes will determine who advances to the general election in november. we're talking about the seat held for decades by congresswoman anna eshoo. she's retiring. >> former san jose mayor sam liccardo has secured a place in the general election. he leads the pack with 21% of the vote. the nail-biter is to determine his rival. right now, only two votes put state assemblyman evan low over santa clara county supervisor joe simitian, abc seven news south bay reporter zach fuentes is live from san jose tonight. >> zach, how much longer do they expect this could take?

>> could be weeks before we have official results. dan, san mateo and santa clara counties have until april 4th to finish final official results. then the secretary of state will certify the election april 12th. right now, both counties are still processing ballots. and that's something that could, of course, leave the fate of this race uncertain. in the race to replace retiring congresswoman anna eshoo has become one of the most critical elections in the bay area. we see a lot of the fears, criticisms and questions around artificial intelligence. >> we've seen a lot of debates and discussions about moderating big tech in general and tiktok in particular, and i think this seat is going to be hugely influential in representing the views of big tech in congress. so i think this is a very important election at a very important time for the industry. >> but who will be in the november general election is still unknown. candidate and former san jose mayor sam liccardo is in first place by a long shot. but who is opponent will be is unclear. santa clara county supervisor joe simitian

and state assembly member evan lowe have been back and forth in the second place spot, at one point separated by as few as two votes. still, votes are being processed. it takes time to count, and it's a it's a long process. >> the congressional district falls within both san mateo and santa clara counties this week. >> both counties still had ballots to process that includes challenge ballots. those were signatures still need to be verified. >> they have time 28 days after election day to hear their ballots. and so we send them notification. the registrar's office has to wait until the end of those 28 days to give voters the opportunity to fix their ballots. a very close race. and i think that's a prime example of why it's so important for people to vote. >> we reached out to simitian tuesday. he sent us a statement saying, sometimes it takes a while for democracy to work. this is one of those times that means counting and verifying all of the votes, every single one of them. we also reached out to lowe tuesday and did not hear back. last week, he sent a statement that said in part to me, no matter the ultimate

outcome, the closeness of this race shows that your vote truly matters. your vote can have a real impact on who represents your community. both candidates will have the opportunity to ask for a recount. they would have to pay for it if it goes in their favor, they would get that money back. >> i could absolutely see a recount with an election that's this close, especially if either of these campaigns have the money to do it, which it looks like they do. >> now, in its last report, san mateo county still had an estimated 20 unprocessed ballots. today, santa clara county said that they had 1300 estimated unpaid processed ballots, and together those counties have 1300 challenged ballots. that voters still have a chance to fix. so this race really could come down to those ballots. >> hey, zach, is there any indication how many voters are actually likely to respond to notifications that their ballots are challenged? >> yeah, that's something that actually, the santa clara county registrar's office said. they said between 40 to 60% of people cure their ballots. in other

words, go back to fix their signatures or whatever is wrong with it. so there's still a chance that those people might come in within that 28 day window to fix the ballot, and then their vote would count. so a lot of moving factors in this as more ballots continue to be processed. ama. >> all right. we'll stay on top of it. thank you. zach. it is still a close contest as they count the votes on california's proposition one. at the moment, it's yes on one by a small margin, 50.2 to 49.8. there is there are about 22,020 2000 vote difference out of more than 7 million votes cast. if proposition one passes, more than $6 billion in bond money will go toward mental health treatment facilities. >> and around the country, five more states held primaries today. it's a foregone conclusion, of course, on the presidential race. both joe biden and donald trump have already clinched their party's nomination. today, president biden set out on a three day campaign blitz to nevada, arizona and texas looking to mobilize the latino voters who played a crucial role in his 2020 presidential victory. >> look, i'm confident, i'm

confident we get our message out to the american people. we're going to win again >> meantime, donald trump faces new legal hurdles. his attorneys say he is struggling to secure a bond to cover the nearly half billion dollars in damages owed in his new york civil fraud case. if the former president does not find the money, new york can ask the court to start seizing his properties and in miami today, former trump adviser peter navarro became the first former white house official in us history. in prison for contempt of congress. navarro started his four month sentence for refusing to cooperate with the january 6th commission. >> happening tonight, the start of spring. we have just a few more hours of winter, and then we move on. >> felt like spring over the weekend, certainly, but we did. will we get some spring showers this weekend? yeah. >> meteorologist sandhya patel is here with a quick look ahead. sandhya, you know it's

inevitable. just as we start getting used to the idea of this nice weather, dan and emma let me show you what's going to happen tonight at 806. >> the vernal equinox will take place. so the rays of the sun will be directly over the equator. and all areas will receive about 12 hours of sunlight. so if you were kind of looking at the breakdown, the amount of sunlight from the tropic of capricorn, tropic of cancer, excuse me, to the equator, it's pretty much all 12 hours, so enjoy the sunlight a little bit longer as we check out our temperatures. we still have some 70s inland, but it is 50s coast side where the breeze is blowing a little bit cooler for most areas this afternoon and as we go, hour by hour, 7:00 tonight if you want to step outside, it's still nice. 50s and 60s. by 10:00. those temperatures are falling. we do see some high clouds moving in along with some fog. tomorrow morning. and then by the lunch hour, you're already seeing those 60s popping up in the early afternoon. a few low 70s, bigger changes are ahead later on this week. you see those rain

chances coming in. i'll be back with a closer look at the timeline in just a few minutes. dan okay, sandy, thanks very much. >> campbell. police shot and killed a man while investigating a domestic violence incident. this morning. police say they responded to a call in an apartment complex on south bascom avenue near kempsey way. this was just before 3 a.m. when they arrived, a woman told them what had happened and that her two children were still inside the apartment. but along with the suspect, police eventually made contact with the suspect and when they tried to arrest him, there was a struggle. police say the suspect managed to pull out a gun and fire it. an officer shot back, killing him. a 67 year old man was killed and another man injured in a shooting today in pleasant hill. police say it happened just before noon on twin bridge circle near long brook way. it's not far from sun valley shopping center. witnesses heard multiple gunshots, followed by a car speeding away. then they saw two men lying on the ground. he was

just really going fast because he got here fast. >> and then that's how you notice him. and then of course, he took off fast, too. so i heard was he i couldn't tell if it was like that. his muffler, you know, because when he, when he punches on the gas, it goes that pop pop pops out. so yeah, i heard it, but thought it was the car. >> no arrests have been made and police are looking for at least one suspect tonight. the victims names have not yet been released. >> authorities have yet to release the name of a driver killed this morning by burglary suspects who were speeding through the macarthur maze, going the wrong way. this evening, el cerrito police announced a 34 year old oakland man was driving the truck that slammed into two cars around 430 this morning on westbound 580 in oakland. the driver of a bmw was killed and the driver of a white van was critically injured as were the two suspects. the whole thing started in el cerrito when police say the suspect slammed their pickup into a tobacco store on san pablo avenue, then went inside and grabbed everything they could. you're seeing that video, a police officer responded and pursued

the suspects vehicle onto westbound 80 toward the bay bridge toll plaza. >> he knows the suspect vehicle began to make a u-turn movement, and decided that the risk to the public really outweighed the benefits to apprehending the suspects and terminated his pursuit. >> at that point, the accident happened a short time later, causing a backup that lasted well into the morning commute. police say the second suspect is a 56 year old man from san francisco. >> the family killed in that terrible crash over the weekend has officially been identified. now, mom, dad and baby boy all died. another child and infant survived but is critically injured. they were waiting at a bus stop in san francisco on west portal avenue saturday when a speeding car ran into them. the driver has been arrested. abc seven news reporter suzanne fawn has been following this story. has the latest reaction from a really devastated community and from transportation leaders as well. >> these kinds of events are traumatic for all of us. >> at the very beginning of

she was arrested on suspicion of vehicular manslaughter and reckless driving, but she's not yet been formally charged. on tuesday, strangers came out to show their support for the lives lost. some came bearing flowers or stuffed animal. >> it could be anyone. i've waited at that bus stop, nancy buchan says she volunteers with the pedestrian advocate group walk sf. we've seen so many people like 30 a year get killed by automobiles. >> many people are still struggling to make sense of what happened. >> it's just super heartbreaking because i'm, you know, always at west portal. it's just such a horrible tragedy that i feel in some ways could have definitely been prevented. >> today, the mayor shared her sentiments about the tragic incident on abc seven's getting answers. >> this is really hit, people to the core. >> she also talked about the changes san francisco needs to make. >> it means it's more important now more than ever, to make sure that we, as a city are being as aggressive as we can to

online service. the company is trying to pull the plug, saying it's too expensive to maintain service for so few customers. do you have a landline still at your house? there have been several meetings organized by the california public utilities commission, and the last one started just a few minutes ago, about 15 minutes ago at 6 p.m, abc seven news reporter melanie woodrow has been tracking the issues involved here and is in the newsroom with the story. melanie. >> dan in earlier hearing that began at 2:00 this afternoon, lasted for hours. so it's likely this evening one will as well. at&t tells abc seven news it is not canceling landline service in california, and that for customers who do not have alternative options available yet, it will continue to provide existing voice service as long as needed. also that it will work with remaining customers who use traditional landline service to upgrade to newer technologies. still, there are strong opinions on both sides regarding whether the cpuc should approve at&t proposals recently upgraded by at&t to

fiber. >> and, i've experienced nothing but better phone quality, more reliability. and now my, home internet is much, much faster and improved. and so i want to make sure that the commission hears that, you know, there's a lot of folks out here that really want to modernize and move to the new technology. is there any discussion of another company actually taking control and maintaining copper? >> landline service? if at&t doesn't want to do it anymore, landlines are based communications, voip and cell are not secure. and when they go out, which they both have recently, there's no communication. why do that? leaving people vulnerable. >> at&t says fiber and wireless based networks are faster and more reliable and require less maintenance over time. the application with the cpuc is the first step of a multi year process to phase out copper based landline phone service, as demand declines in the newsroom. melanie woodrow, abc seven news. >> all right, melanie, thanks

very much. >> spring starts tonight and so do the allergies that come with it. we brought in abc seven news contributor doctor alok patel to tell us what to do about all the pollen in the air as temperatures rise. >> prevention. look up those pollen counts. you can go online, look to see what it looks like. that's going to differ based on time of day, even weather. also, keep your windows shut and look at getting a good hepa filter, hvac system. the last thing i want to talk about, which we hinted about. i got a prop here, is when you come home, we can carry allergies on our bodies. you want to change your clothes, wash your hair. don't track that in with you. keep your house clean and also sinus irrigation. my trusty neti pot. this thing is a gem. yes, i just kissed it. but keeping all the allergies even out of your nose will help prevent some of those symptoms that can build up at night and mess with your sleep. >> be sure though, to only use distilled water or saline solution for those sinus rinses. doctor patel also notes at least one study suggests our allergy season is longer than it used to be. as temperatures rise, plants

police department. there were calls to create a police oversight committee. the city did finally create one. and last night the committee held its first meeting. >> the mayor was there to emphasize that neutrality will be key to progress. abc seven news reporter anser hassan has more. >> people have been fighting for an oversight commission here in the city of antioch for decades, after decades of trying to form a police commission. >> on monday night, the city of antioch's first ever police oversight commission held their inaugural meeting. >> we're here to make public safety a key to the city and increase the city to have faith in our police department, harry thurston, who has served on numerous antioch commissions, was elected chair. >> the commissioners identified public safety, mental health, the use of force policy and police training as key issues. they are prioritizing. commissioner devin williams, acknowledging a sense of urgency given the antioch police texting scandal because of what's what was revealed last year.

>> we are here to make sure that the city can never let that happen again, mayor lamar hernandez thorpe addressed the seven commissioners, emphasizing the need for them to remain neutral. >> this commission is not a uh- is not a cheerleader for the police department and it's not a critic of the police department. your role is neutral. >> the commission was created by legislation passed last may. the mayor says the commission will review policies to make sure they fit with the community's values and to ensure trans tsay, a sentiment echoed by interim police chief brian addington. >> i look forward to working with with each one of you, to getting to know you better, and to assure you that i will be open, that i will be transparent . >> the mayor says the commission will begin the process of auditing internal affairs, hiring and promotions, and diversity and equity throughout the police department. commissioner williams says restoring public trust is one of the big battles they face. >> and i wanted to restore that hope that they may have that

little hope they may have left. and i'm not saying that's going to happen overnight. it may not happen at all right away. right. but that's one thing i would love to see that this commission can do in antioch. >> anser hassan abc seven news. >> a congressional committee announced today that it will investigate allegations of anti semitism at uc berkeley. the probe by the house committee on education and the workforce comes in response to several recent incidents. this includes last month's abrupt cancellation of a speech by an israeli lawyer when pro-palestinian students broke down the door at zellerbach playhouse. the university condemned that incident. uc berkeley issued a statement today saying, quote, uc berkeley has an unwavering commitment to ensuring every student feels safe and welcome at all times. >> three suspects in an organized retail theft ring have been charged with more than two dozen felonies for allegedly stealing for more than a year, smash-and-grab robberies that netted more than $300,000 worth of stolen goods. >> we know that the best way to

deter organized retail crime and any crime is to make sure that folks who are thinking about committing the crime know that they will be arrested if they commit it. >> there are local crimes included in the 27 count indictment, including two robberies within a week at the louis vuitton store at stanford shopping center. the indictment says that thieves took a total of more than $25,000 worth of merchandise in june of 2023, and in october of the same year, they reportedly stole nearly $7,000 worth of merchandise from the burberry store at the livermore outlets. most robberies took place at luxury stores in southern california. the three suspects are being held on $1 million bail each >> it's a different kind of closing bell today. chipotle executives rang a makeshift bell from las vegas to celebrate their old managers conference. chipotle stock is soaring lately, up 24% so far this year. all the indices had a good day. the dow was up 320 points. the

nasdaq gained 63 and the s&p added 29 points, closing at a new record high. >> massive changes to the parent company of ben and jerry's, dove soaps and vaseline. unilever just announced plans to cut 7500 jobs. it will also spin off its ice cream business to reduce costs and boost profits. ice cream sales took a hit last year as consumers cut back on non-essential spending. unilever owns brands ben and jerry's, magnum and others. the split is expected to be completed by the end of next year. gas prices are now higher on a year over year basis, and experts predict they will continue to rise in the coming weeks. the national average is now 349 per gallon. that's according to triple a california averages 4.91. in san francisco, it's 507 in harmful blue green algae blooms have the east bay regional park district putting up warnings to keep people out of the water. >> danger advisories have been posted at a number of parks, including fremont's quarry, lakes. abc seven news reporter

lena howland explains where the algae is coming from and how long it might stick around. >> from our sky seven view, an obvious green tint to livermore's lake del valle is spreading on the first day of spring. >> there are a whole wide bunch of organism forms, some of which produce toxins that can be harmful to people or pets or fish. >> john rosenfield, science director at san francisco baykeeper, an environmental watchdog group, says this is called a blue green algae bloom. >> they bloom particularly when, there's enough nutrients, the water is warm enough, there's enough sunlight, but also the water. when the water is moving slowly or not moving at all, the east bay regional park district has posted a danger advisory urging to keep people and pets out of the water, not just at lake del valle, but also at shadow cliffs lake in pleasanton and quarry lakes in fremont. >> do take it seriously, william conklin, an emeritus biology professor at san francisco state

university, says blooms are becoming more common across the globe, and they're starting to happen earlier in the year with this increasing water temperatures. and we've seen that all through california, that they're inching up due to climate change. that gives these blue green algae that a little, advantage over the others. >> for fremont resident matthew stewart, that means not taking his toddler to the beaches of quarry lakes despite living within walking distance. >> i mean, i know that they opened like this stretch of beach over here a long time ago, and since my kid was a toddler, i've wanted to take her there. but i haven't been able to because it's been closed ever since. >> but rosenfield says if the bloom becomes big enough to drop oxygen levels in the water, fish will be at risk next, similar to the red tide, algal bloom that happened in lake merritt two years ago, which killed off thousands of fish. >> they can last all summer, so they're starting now. as long as they have nutrients, the nitrogen and phosphorus
