later, we are learning the fate of the driver who was behind the wheel. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us tonight. we've learned a plea deal has been reached for the man who hit and killed that professional cyclist in san francisco's presidio last year. >> last april, ethan boyes was riding through the area when he was hit on arguello boulevard near inspiration point. >> and tonight, abc seven news reporter jeff stone is learning the 81 year old driver will not serve more than a year in jail. >> my reaction is shock and appall. >> i think it sets a dangerous precedent, for roadway safety. you know, in our city and in the country more broadly, both gabriela and luke, cyclist and advocate, are referring to a plea deal reached in boys case. >> boys was the world champion cyclist who was hit and killed while riding along this road in the presidio last year. the plea deal reduces all charges, including vehicular manslaughter and operating under the influence of alcohol to misdemeanors, with a maximum of

a year in jail for 81 year old arnold kinman lowe. >> on the one hand, it's good to finally have some measure of closure, but then on the other hand, like i, i worry that the punishment just wasn't severe enough. >> james grady was friends with ethan. he is aware that ethan's family sent this letter to the judge, which at one point reads, it is our sincerest belief that ethan would in no way want to see mr. lowe incarcerated, nor would he have wanted our family or mr. lowe and his family to endure the lengthy and painful process that a criminal trial will surely entail. but while grady does worry about this punishment and what it means for the cycling community, he can't help but think about his friend ethan, who went out of his way to entertain his son one year ago this weekend in santa cruz. it was the last time james saw ethan. >> he interacted with him like just like a wonderful, loving person, you know, i miss him. i

know so many people miss him. >> lowe's attorney in this case tells us that this was an accident, and his client understands his guilt in the case. he does say that while lowe had two glasses of wine before the accident, specific blood alcohol levels could not be determined, and it is still undetermined if alcohol played a role here. still, though, those we spoke with are frustrated that this kind of response and this result isn't really going to show anyone that, like there are consequences for driving a car and potentially injuring or killing someone. >> a life is a life, and i respect what the family has asked for and what ethan's wishes are. >> but i'm so scared that this sends a message that my life as a cyclist doesn't matter. everyone is saying their focus now is to make sure that this road where boys was killed is a safe one. >> going forward for riders and drivers. j.r. stone, abc seven news in the east bay tonight, a

live doppler seven and what is headed in our direction. this is why the clouds will first increase and then our rain chances are increasing. as we head towards friday and saturday. i'll be back with a look at the timeline coming right up. dan and anna. >> all right. thank you sandhya, new at 11. >> people in vallejo say they're fed up with growing homeless encampments butting up against their backyards. tonight they took their frustrations to city leaders who say solutions are easier said than done. >> abc seven news reporter tim johns explains a drive by the intersection of lewis brown and bw williams drives in vallejo, and it's impossible not to see this large homeless encampment. >> it's a public has said it's not safe. our children cannot play there. bringing out rodents. >> willie jean tsay austin has lived in the houses behind the encampment for decades. she says the camp has continued to grow and bring with it an array of problems. tsay austin tells us it's gotten so bad that she and other elderly neighbors are

sometimes afraid to leave their homes. well, this intersection is one of the main areas that the residents wanted to highlight. many of them tell us that encampments like this one are popping up all over the city where we live. >> there is no rules. >> that's why on tuesday, several vallejo residents showed up at a city council meeting to express their frustrations. >> they keep saying, well, it takes time and there's a process, but we've been waiting years and years and years. >> city officials say they're aware of the problem at this and other intersections around vallejo, and told the residents they share many of their same concerns. >> if we had a solution, obviously we would make it. we would do so. >> mayor robert mcconnell says the city can only do so much in response to the public comment at tuesday's meeting, mcconnell says a combination of factors has prevented the city from taking action. some of those, including things such as money as well as public opposition neighborhood groups, have come down and said not in my backyard. and while the council says they're determined to solve the issue for many residents here, it's not happening fast enough.

>> and i want the city of vallejo council to know that we're not going away in vallejo. >> tim johns, abc seven news we now know the names of the family hit and killed over the weekend. >> while they were waiting at a bus stop in san francisco's west portal neighborhood. they were 40 year old diego cardoso de oliveira, 38 year old matilda ramos pinto and one year old joaquin pinto de oliveira. another infant, remain hospitalized. the 78 year old driver of the suv that struck them was arrested. now, abc seven news is not naming her until she is potentially charged in court. her lawyer released this statement tonight. quote while it's understandable to seek more information regarding the causes of this devastating accident, my client and her family respectfully request privacy during this difficult time. as investigators continue to gather relevant information. the attorney adds his client is mourning the tragic loss of life that occurred. >> san francisco is a step closer tonight to installing speed cameras at 33 locations throughout the city. the

proposal was formally presented during today's sfmta meeting. next month, the board is expected to take the important step of approving the locations. there was also almost no opposition during today's public comment on the plan. i'm all for this, this program, and i'm i'm happy to see that there's going to be 33 cameras, but i hope that it expands and it's successful. >> we in san francisco are far behind. other places have the cameras, and they're saving lives as long as it doesn't hit any bumps along the way. >> sfmta expect to have the cameras up and running in early 2025. cameras will snap photos of drivers who go 11mph or more over the speed limit. those drivers will then face fines. >> new at 11 an urgent health warning about measles in alameda county. the health department says anyone at the sons of liberty restaurant in san leandro on march 9th may have been exposed. if you or a family member were there from 445 to

be hiding underneath it all. nail salon workers are among the worst paid in the state, and now the demanding, better. that's according to a new report by the ucla labor center. using census data estimating that the hourly median wage for nail salon workers in 2021 was about $11. that's under the minimum wage for small businesses and for an industry mostly comprised of immigrant women, are more fun. >> the uh- a large portion of elderly workers like me have poor eyesight and are often allergic to chemicals. they're exposed to uh- in dental work, advocates and industry leaders say employers are misclassifying thousands of manicurists as independent contractors. >> so instead of getting an hourly wage, they often only get paid per manicure, making a fraction of the profit. >> a new bill could exempt certain fast food locations from the $20 dollar minimum wage increase. the pay hike for california fast food workers takes effect april first. it

applies to nearly all fast food chains with more than 60 locations nationally. however, assembly bill 610 would exempt locations and hotels, event centers, theme parks and museums. lawmakers say workers in these fields have unions and already receive wages. more than $1,020. the assembly voted yesterday to move the bill forward in the east bay. >> harmful blue green algae blooms have the parks district warning everyone to keep themselves and their pets out of the water. a danger advisory have been posted at a number of parks like livermore's, lake del valle, shadow cliffs lake and pleasanton quarry lakes in fremont. these algae blooms are starting now and they can last all summer. >> do take it seriously with this increasing water temperatures, and we've seen that all through california that they're inching up due to climate change. that gives these blue green algae that a little, advantage over the others. >> experts say if the bloom becomes big enough to drop oxygen levels in the water, fish

will be at risk next. that's much like the bloom that happened in lake merritt two years ago that killed off. remember, thousands of fish? we reported that at the time, one of the bay area's biggest development projects is moving forward. tonight the concord city council advanced a new plan to build on the former naval weapons station. the massive chunk of land north of town along willow pass road has sat empty for 25 years now. the city wants to build thousands of new housing units, parks and commercial space. the multi-billion dollar project is on its third developer. tonight's vote on the rough terms of the plan is the most progress that they've had in years. it's expected to take 40 years to finish this project. >> here is the best thing we saw today a chance at healing heroes in the ocean. military veterans are finding peace through a program called operation surf the ocean. >> you have to be present, completely mindful. i'm here. i'm not back in the middle east. i'm not. i'm not in the past. i'm in the present.

inland 76 in livermore. it was 72. in concord, fairfield, 71, san jose 70, in san rafael got up into the 60s. oakland, santa rosa, san francisco, half moon bay, 58 degrees, a little bit cooler in many areas, as dan just mentioned. let's take a look at the almanac for san jose. so average high is about 66 degrees. today was 71. yesterday was 72. you see that the temperatures were running a little bit higher than where they should be for this time of year. and for the month. the rainfall 1.26. high pressure is in control of the weather. we're going to be getting more rain in san jose and the rest of the bay area as this ridge gets pushed out of here by a couple of systems that are developing in the pacific. first comes the clouds and the cooler weather over the next few days, just gradual cooling. and then by friday we bring the rain in on live doppler seven. we do have some patchy fog out there, temperatures in the 40s and the 50s. here's a look at what you can expect as we look at a live picture from our kgo roof.

camera springs here. the season changed at 8:06 p.m. the next two days. gradual cooling trend and for the end of the week, wet and much cooler weather is headed your way. so first thing tomorrow morning, we had a lot more fog this morning, but tomorrow morning we'll start out with some areas of fog and clouds. 40s to start the day 50s as we head towards noontime, inland areas will pop up into the 60s along the coast. it's still going to be cool. and then clouds begin to increase. high clouds. that is. so for the early afternoon dimming the sun. so our warmest locations will get up into the low 70s, but it's not going to be quite as warm as 76 in livermore today. first thing tomorrow morning. temperatures 40s, 50s out the door. partly cloudy tomorrow afternoon. we're going to go with increasing clouds, which will filter the sun upper 50s to the low 70s. now we're going to fast forward to friday. here comes that system. 7 a.m. in the north bay in the morning. that is light to moderate rain pushing through at 11 a.m. and then really just scattered showers for the afternoon and

the evening hours. and this pattern will repeat as we head towards saturday as well. so here's a look at the rest of friday night. going into saturday the sierra will see some snow this continues late saturday night. early sunday things start to wind down and then another system tees up for next week. in terms of rainfall, we're looking at anywhere from about a half an inch to over an inch in the north bay and the santa cruz mountains. over the course of a couple of days, the accuweather seven day forecast. it is mild inland, cool coast. the next couple of days rains back on friday and it's a level one, a level one for saturday. certainly it will be wet, gusty and cooler. you'll need those sweaters and jackets early morning chance sunday, but a better chance on monday. now with a level one system. dan and
