other asking to be read back some testimony. jurors will determine whether trump is guilty of 34 felony charges of falsifying business records related to a hush money payment to stormy daniels, and testimony is to resume this morning in the state criminal trial of the man charged with assaulting the husband of speaker emeritus nancy pelosi. opening statements yesterday revealed details about david depapes mental state leading up to that attack in 2022. his defense team says he struggled with a personality disorder that led to, quote, fantastical thinking, including a desire to interview nancy pelosi, his attorneys. >> the most serious charge here is the attempted murder. in order to be convicted of an attempted crime, you need to have specific intent. >> now, his attorneys believe the bizarre behavior does not mean depape intended to kill paul pelosi when he broke into their home in 2022. depape has

5:06 am
item that the san mateo superior court judge will allow for new or additional dna testing is a piece of duct tape that was found on laci's pants. it was tested in 2003 and was found to have human dna, but at the time it could not be traced to anyone, peterson is now 51 years old and watched the hearing virtually from mule creek state prison, where he's serving life without the possibility of parole. his attorneys with the la innocence project claim that laci witnessed a break in across the street from their home the day she went missing, and afterwards the burnt out van was found nearby with a bloody mattress inside. the defense wants the mattress retested for dna, but the judge denied the request, saying the evidence presented isn't enough to warrant a retest. prosecutors say the burglary was two days after she vanished and that the van has nothing to do with the case. but the director of the la innocence project argued that peterson deserves to have the
5:07 am
deaths of laci, and conner investigated further. >> no murder weapon was found, no time or even date of death was established. no cause and manner of death were ever established. >> the defense has never explained how mr. peterson was able to tell people that this would be his first holiday. back in the christmas, his first holiday without his wife, a special prosecutor who worked the first, scott peterson case, talked about the lies that peterson told his new girlfriend , amber frye, in the weeks before his pregnant wife disappeared, and he also said that the defense never explained why peterson was researching tide charts for the san francisco bay. >> and then weeks later, laci and conner's bodies were found in that same location, and the judge said she is not determining whether he's entitled to a new trial, but whether he'll have access to test evidence. and, of course, his attorneys are seeking a new trial, but it's still too early to know if that will happen. the
