sure that we continue to strengthen our health care system, making sure that we're able to make every single solitary person a eligible for what i've been able to do with the with the covid, excuse me, with, dealing with everything we have to do with, look, if we finally beat medicare. the campaign later revealing that biden is suffering from a cold. the candidates also clashed over trump's alleged comments that americans who die in war are, quote, suckers and losers, which trump denies saying. >> my son was not a loser. he was not a sucker. you're the sucker. you're the loser. >> first of all, that was a made up quote, suckers and losers. they made it up. it was in a third rate magazine. >> biden then took a shot at trump's felony conviction in his hush money trial. >> the only person on this stage is a convicted felon is the man i'm looking at right now. >> he could be a convicted felon as soon as he gets out of office, as joe could be a convicted felon with all of the

things that he's done, the idea that you have a right to seek retribution against any american just because you're president is wrong of having sex with a star on the night while your wife was pregnant. >> i mean, what what what are you talking about? you have the morals of an alley cat. give me a minute, sir. >> i didn't have sex with a star on the issue of abortion. >> trump took credit for overturning roe v wade. >> every legal scholar throughout the world, the most respected, wanted it brought back to the states. i did that. it's been a terrible thing what you've done. >> the fact is that the vast majority of constitutional scholars supported roe when it was decided, supported roe on border security. >> biden defended his latest executive order limiting asylum, touted a bipartisan border deal that trump helped sink, and took issue with trump's border policies. >> he was taking separating babies from their mothers, putting them in cages, making sure they were the families were separated. >> he opened it up. and these killers are coming into our country and they are raping and killing women.

>> abc's fact checking team found trump's claim is largely exaggerated despite multiple high profile cases, there is no evidence of a major surge in crime caused by recent migrant arrivals. the candidates also debated the economy. >> we created 15,000 new jobs. we brought out the position where we have 800,000 new manufacturing jobs, he also said he inherited 9% inflation, know he inherited almost no inflation and it stayed that way for 14 months. >> and then it blew up under his leadership, trump was also asked about january 6th and pointed to his words on the day of the riot , i said peacefully and patriotically, and nancy pelosi, if you just watched the news from two days ago on tape to her daughter, who's a documentary filmmaker, they say, but she's saying, oh, no, it's my responsibility. i was responsible for this because i offered her 10,000 soldiers or national guard and she turned them down. >> but there is no evidence to back up that claim. >> what we know actually

happened on january 6th is donald trump did no such thing. he made no effort, didn't reach out to anybody in the military, anybody with the capitol police, anybody to try to stop the violence. >> when asked if he would accept the results of this election, trump said yes. if it is fair and legal. fact checkers counted at least 26 false claims by trump last night. biden was also cited for false claims about the cost of insulin and for overstating trump's remarks about covid and the white nationalist rally in charlottesville because of his performance last night, abc news has learned. >> some top democrats are now having private discussions about whether biden can effectively continue with his campaign. abc's perry russom has reaction from overnight. perry good morning andrea. >> good morning to you. after the debate, president biden was asked how he thought he did. his response i think we did. well. it's clear many people do not agree. >> this was an absolute dumpster fire train wreck overnight. >> president biden's performance at the debate, prompting new questions about the future of

his campaign. >> joe biden needed to do two things he needed to articulate a clear vision for what he is going to do as president moving forward, and he needed to do it in a way that gave people confidence that he had the mental acuity to deliver. he failed on both of those marks. >> i think there was a sense of shock, actually, of how he came out at the beginning of this debate, how his voice sounded about, you know, he seemed a little disoriented. he did get stronger as the debate went on. but by that time, i think the panic had set in trump seemingly winning the night. >> a poll shows 67% of people watching the debate thought trump won a pretty disciplined performance for trump. >> i thought president trump did what he needed to do. he stuck to the issues. i think he did very well on immigration and the economy, pointing out where joe biden failed. and then he let joe biden talk. >> trump critics say confidence cannot overshadow the truth.

>> donald trump came in as the rally trump. joe biden had a difficult task tonight, and that was to tell the american people, give the narrative, here's what i'm doing. and here's what i plan to do over the next four years. instead, i think he was trying to fact check. >> still, many voters are now wondering where they go from here. >> there are lots of democrats who are quietly, for now, asking the question, do we need to reconsider? do we need to for the for the good of the party, the good of the country, the potential to win this election? >> the biden campaign, responding to the criticism overnight, calling in an off night saying president biden is the only person who has ever beaten donald trump, he will do it again. >> let us not decide the outcome of who's going to be president of the united states. based on a 90 minute debate this morning, democratic party insiders privately expressing doubts about the future of biden's campaign. >> one current biden supporter responding to biden's debate performance, saying i am in a state of shock. he is diminished to an extent that has become undeniable. >> i think you're going to hear discussions that i don't know

will lead to anything, but, you know, there is a there are going to be discussions about whether he should continue. >> i think the fallout is going to be pretty severe, the question to my mind is, are democrats coming out publicly with their names attached with the concerns they have around biden? are there people that that start to raise serious alarms in public settings? >> and biden would have to decide to step down before democrats could choose another nominee? no sign that's happening, and no serious challengers have stepped forward. andrew. >> all right, perry, thank you. meanwhile, the middle east also came up during last night's debate. we've learned rising tensions on israel's northern border have prompted the pentagon to beef up assets in the region. the uss wasp, with 2000 marines on board, is now headed to the eastern mediterranean. the website politico quotes us intelligence saying a war between israel and hezbollah in lebanon is now growing more likely. >> another major story this morning what's being called a new step toward justice following the deadly school

shooting in uvalde, texas. this morning, the first criminal charges against law enforcement for what is widely viewed as a botched police response to the massacre at robb elementary school in uvalde, texas. more than two years ago, which left 19 children and two teachers dead. >> i think it's a really strong message not just to the community of uvalde, but any law enforcement officer, you know that you can't not hide behind immunity, that there's something called consequences. >> a grand jury now indicting former school district police chief pete arredondo, another former officer, also reportedly indicted victims families reacting with mixed emotions. >> but there is still 374 other officers that did nothing. while our children died and they're getting to walk scot free. as of right now, investigators found children inside robb elementary waited more than one hour for help from police, despite frantic 911 calls during the shooter's rampage. >> surveillance video shows dozens of heavily armed and

shielded officers crowding the halls outside the classroom, finally taking down the shooter 77 minutes after the carnage began, an official tells abc news. former chief arredondo, one of the first officers to arrive on the scene, now faces ten charges of child endangerment. he surrendered last night and was released on $10,000 bond. arredondo has said he never considered himself the scene incident commander and has said officers prioritized evacuating the children over taking down the attacker. but the justice department finding law enforcement did not follow generally accepted practices and an active shooter situation. >> most of the families tell me that they have not gotten any word or any feeling that more people could be indicted, but again, they are meeting with the district attorney to figure out what the next few steps will be over the next few months here. >> no word yet on the next court date in this case. if convicted, the charges could carry a minimum prison sentence of five years. well, it's expected to be

evil or is it just sick? 2020 tonight on abc. >> welcome back. oklahoma is now following louisiana, placing christianity into public school classrooms. the state says all schools will now incorporate the bible and the ten commandments into the curriculum. the requirement affects grades five through 12. oklahoma's education superintendent calls the bible a necessary tool to teach kids about us history. just last week, louisiana became the first state to require schools to display the ten commandments. critics of these new moves blame the supreme court. >> i think they are emboldened

by this supreme court. i think the religious extremists saw the success they had with roe versus wade and our our feeling emboldened all around the country. that is one of the reasons you're seeing this wave of christian nationalism rising right now. >> legal battles are expected in oklahoma. louisiana is already facing lawsuits. >> a potential bombshell in the rust movie set shooting case. it involves hannah gutierrez, the weapons supervisor recently convicted of manslaughter for the death of a crew member. she's now reportedly claiming that prosecutors withheld evidence at trial. tmz reports it obtained court papers in which gutierrez claims that evidence would have helped her prove that the gun might have fired without alec baldwin pulling the trigger. baldwin has long claimed he never pulled the trigger. his trial begins next month. >> the annual j.d. power auto quality rankings are out and detroit's big three did well. the dodge ram pickup ranked as the highest brand for overall quality. ford also showed improvement. meanwhile, the

from the train was determined to be non-hazardous. nearby homes were briefly evacuated. the cause of the derailment is under investigation. >> in the bahamas, a missing american woman's cell phone has been found in the water. one week after she went missing during a yoga retreat. authorities have now widened the search for taylor casey, the 41 year old from chicago, was reported missing eight days ago. family says she would never disappear like that. it's not yet clear if there was any foul play. the state department previously warned about crime in the bahamas. >> we turn now to a multibillion dollar verdict against the nfl, a decision that could change the way we watch football games this morning. the nfl vowing to appeal after losing an antitrust lawsuit that could cost the league billions. at the heart of the case, the nfl sunday ticket program, a subscription service that allows customers to watch out-of-market games those played in other cities that are already shown for free on other tv networks. a jury now deciding the nfl broke antitrust laws by inflating the price of that
