it in a forceful manner. by the time the 90 minutes were up, democrats had key figures from across the party talking about replacing biden on the ticket. rachel scott starts us off from atlanta. good morning, rachel. >> reporter: george, good morning to you. this was the biggest political stage yet of the 2024 campaign and democrats are really looking to president biden to put to rest those questions and concerns about his age. but this morning his performance is only fueling more and sending his party scrambling. this morning panic and concern within the democratic party after this debate performance from president biden. >> making sure that we're able to make every single solitary person eligible for what i have been able to do with the -- with the covid -- excuse me, with dealing with everything we have to do with -- look.

if -- we finally beat medicare. >> thank you, president biden. >> reporter: from the start of the debate, the president speaking with a raspy voice, at times stumbling and trailing off, unable to finish his thoughts. even on the issues at the heart of his campaign like abortion rights. >> i supported roe v. wade which had three trimesters. first between the woman and doctor. second time between the doctor and an extreme situation. third time is between the dock -- i mean, between the woman and state. >> reporter: the biden campaign telling reporters the president, who is 81 years old, had a cold, something they did not mention until an hour into the debate. trump questioning biden's mental fitness. >> i really don't know what he said at the end of his sentence. i don't think he knows what he said either. >> reporter: it was the first time the two have come face to face in four years. >> without question, the worst president, the worst presidency in the history of our country. >> you're the sucker. you're the loser. >> reporter: almost immediately the attacks turning personal. >> the only person on this stage

who is a convicted felon is the man i'm looking at. >> when he talks about a convicted felon, his son is a convicted felon. >> reporter: that didn't sit well with biden delivering his direct attack yet on some of the allegations surrounding trump. >> crimes that you are still charged with. think of the civil penaltys? how many billions do you owe for molesting a woman in public? for doing a whole range of things. having sex with a porn star on the night while your wife was pregnant. what are you talking about? you have the morals of an alley cat. >> reporter: biden going after trump for his actions on january 6 and promise to pardon the rioters who stormed the capitol. >> these people should be in jail. they should be ones being held accountable. he wants to let them all out? now he says he'd do it again, such a whiner he is. there would be a blood bath. >> thank you, president biden. president trump? >> what they have done to some

people that are so innocent, you ought to be ashamed of yourself. >> reporter: when pressed on his actions, trump deflected and would not say whether he would accept the results of the november election. >> if it's a fair and legal and good election, absolutely. i would have much rather accepted these, but the fraud and everything else was ridiculous. >> reporter: trump pushed several false claims from insisting there was no terror during his administration, declaring every legal scholar approved of roe versus wade. >> every legal scholar wanted it that way. >> reporter: at one time bickering over their golf game. >> i'm happy to play golf if you carry your own bag. do you think you can do it? >> that's the biggest lie that he's a 6 handicap. >> i was an 8 handicap. 8 -- >> i have seen your swing. i know your swing. don't act like children. >> reporter: while biden tried to address his age head on.

>> he's three years younger and less competent. look at the record. look at what i have done. >> reporter: the most consequential night ended with only more questions. even his own vice president acknowledging he had a rough go. >> listen, he did not get off to a strong start but he had a strong finish. >> reporter: donald trump did make several false and misleading claims, many of which went unchecked or challenged on that debate stage even by president biden. this morning many democrats calling that a missed opportunity. the president did make a late night stop at a waffle house. he was asked directly about his performance. he said he had no concerns, but that is not what we are hearing from democrats. >> george: let's bring in rick klein with what we're hearing from voters. hey, rick. >> good morning, george. cnn did a poll of people who watched the debate and it wasn't close. 67%, 2:1 margin they saw donald trump as the winner. it was driven by concerns over

his confidence to lead the country. if you add these numbers up for trump 36 and 20. that means you've got more than half of the country, people watching the debate, have some confidence in donald trump to lead the country. almost exactly the opposite for joe biden. 57% after the debate say they had no confidence at all in his ability to lead the country. lot of this is driven by concerns we've heard about for a long time about his mental acuity. this is from the 538 poll that came out just a day earlier. 54% of respondents, all adults nationwide, say that joe biden has either poor or terrible mental fitness. they're concerned about his ability to be president. reminder of the stakes and the

landscape coming in. these are the battleground states. our 538 polling there. seven big states. joe biden won six of them four years ago. right now if the election were today based on the polling, donald trump is the leader in six of those states. that makes donald trump the 47th president of the united states. that's why there's a loft concern in democratic circles today, george. >> george: thanks. let's bring in jon karl at the desk. jon, no debate about how this went. >> this was a disaster for president biden. because of what rick just said. he needed a win. instead he had a performance that has top democrats questioning whether joe biden has what it takes to beat donald trump. number one member of congress who's been a strong biden supporter texted me in the middle of the debate a typical response. he said, i am in a state of shock. he is diminished to an extent that has become undeniable. the big question, big discussion now that's happening, at least privately among democratic officials, is whether or not it is possible to replace joe biden as the nominee. >> george: in the end it's up to him, his wife, maybe his sister. >> it's up to him and whether or not his wife and sister or anybody else close to him can convince him. there is no way to force him

out, that i can see anyway. trust me, people are looking at this. unless he voluntarily decides he is going to step down and say the convention should choose another candidate. >> george: mary, you're our chief white house correspondent. what are you hearing? >> mary: they know this was a very bad night for the president. they are aware of this wave of panic we are seeing from democrats. but they insist and argue, look, this was just one night. this race was never going to be determined in a single debate. they are adamant that they are not going to change course. this goes beyond just a rocky performance. the president had to convince voters and democrats that he can do this and he can win. he may have done the opposite validating trepidation about his age. they are quick to point out trump didn't have a super strong night. he spewed statements that were blatantly not true. the president wasn't able to effectively challenge trump. his message, substance of his message lost in the delivery. >> george: trump wasn't challenged by the debate

moderators either on the facts. i assume they think this was the best night they could have had. >> trump was disciplined for donald trump. they believe he did very well. he didn't seem unhinged. but, yes, there was a rapid fire lie after lie untruth after untruth. the real frustration among so many democrats was that there was nothing to effectively push back. he said things that were, frankly, ridiculous. he said everybody wanted roe v. wade overturned. he said nancy pelosi turned down his effort on january 6th to send 10,000 national guard troops to the capitol. this stuff is just completely false. >> george: you eluded to the previous answer. the big question, is there going to be a moment inside the democratic party similar to what richard nixon faced during the watergate crisis when leaders went to him and said, the gig is up, you have to go? >> i really think it's quite possible. normally i would say no way, he's the sitting president. weak debate performance. there's no way you can replace

him. democrats know the stakes couldn't be higher. if biden cannot defeat donald trump you have a return to what democrats say is an absolute disaster crisis for the country and return of donald trump to the white house. >> george: thank you all very much. whit? >> whit: we move on to other news and the supreme court, where several major decisions could be released this morning including a ruling on presidential immunity being closely watched after last night's debate. abc's senior correspondent terry moran is at the supreme court. good morning. >> reporter: good morning, whit. this has been a big year at the court. it's likely to get bigger. six cases left to go including the case brought by a man who stormed the capitol on january 6th who said he and hundreds of other january 6 defendants have been improperly charged by prosecutors because, they argue, the law being used was passed by congress to deal with business and financial crimes. there's a major homeless case

the biggest case on homelessness before the court in years. can cities fine, ticket or jail people who sleep or camp outside in public places when they have no other place to go? major case on social media, on the power of federal regulatory agencies. the biggest case is still to come, donald trump's claim that he is absolutely immune from criminal prosecution for anything he did to overturn the 2020 election, including january 6th because, he argues, presidents cannot be prosecuted for official acts. he said he was acting officially. there are six cases left to go. one thing we know for certain, today is not the final day. they'll be back next week. george? >> george: thank you very much. now ginger for the holiday travel forecast. >> ginger: we're already starting stormy. people are traveling already. you're starting it off with a lot of storms. 110 severe storm reports in the last 24 hours. the lightning too close for comfort. thankfully, they were not hurt. that was myrtle beach. if you go on shore in florida you have problems. big time winds and even a tornado.

ef-0, 75 mile per hour winds. nobody was injured but roofs were ripped off. then the northern plains, there were also tornado reports and gusts above 70 miles an hour. today kansas city is right in the heart of who has to watch out for this. it's with the cold front. kansas city is with that cold front that will come through. that southern nebraska, parts of kansas. then watch it as it moves through this weekend. saturday night 11 p.m. right in the middle of west virginia up to the hudson valley. by sunday we have more storms that could become severe right here in the northeast. that includes philadelphia, baltimore, down to richmond and up to boston. so a big couple of days going into the big weekend. just a reminder if you have a sunny start, that's the fuel that severe storms need. don't think, we're safe, it's sunny. that's how they form. >> mary: lots to keep an eye on. airlines are also bracing for the busy holiday travel crush. morgan norwood is at newark airport for us. good morning.

>> reporter: hey, good morning, mary. yes, the summer travel season has already been busy, but today it is about to heat up. it is peak travel day for the july 4th holiday. numbers don't lie. neither do the lines. this is the line at newark liberty airport. it is already starting to build behind me. tsa expects to screen more than 3 million people just today alone. look, that is nothing in comparison to the 32 million that they plan to hustle throughout airports across the country until monday, july 8th. airlines are getting ready too. united and american are expecting their busiest independence day ever. delta is looking at 6% more customers than last year. it's not just air travel. packed train stations, busy roads. aaa projects 60.6 million travellers will take that road trip from saturday through next sunday so the roads will be jammed. you want to remember this. up early or leave late. the worst times to drive are generally between 2 and 7. if you are hitting the roads, good news.

it's going to cost you less to fill up. $3.50 the national average for a gallon of gas. that's down $0.08 from last month and $0.06 from last year. george? >> whit: the huge ruling against the nfl. the league ordered to pay billions of dollars over a sunday ticket subscription service. demarco morgan is here with that. demarco, the nfl says they'll fight this. good morning. >> whit, good morning. $4.7 billion to be exact. since damages can be tripled, it could end up costing the nfl more than $14 billion. at issue is the league's sunday ticket service which offers people the chance to watch games if they are not broadcast in their market on free network tv. the lawsuit argues the league violated anti-trust laws by offering the package at an inflated price and only offered it only on direct tv. the jury's decision awards $4.6 million to the 2 million residential subscribers and $96 million to the 48 businesses to subscribed from 2011 to 2022.

the package moved to you tube tv last season. the nfl is vowing to appeal the ruling saying in a statement, we are disappointed with the jury's verdict an we continue to believe our strategy is the most fan friendly distribution model in all of sports and entertainment. we will contest this decision as we believe the class action claims in this case are baseless and without merit. it's a decision that could change the way the nfl offers out of market games to football fans. guys? >> george: okay, demarco. thank you very much. coming up, the new clue in the search for the chicago who vanished while on a yoga retreat in the bahamas. >> mary: a safety alert about beach umbrellas. >> whit: it's the summer of sequels. with "inside out 2" leading the way, why hollywood is betting big on franchises. but first let's go back to ginger. >> ginger: good morning, whit and everybody. dallas, they are in an excessive heat warning.

for them, they have hot summers but their temperatures are going to be around 100 not just today but for many days in the future. the feels like, that's important. it's what your body feels. will be up around 110. that's why they put out that excessive heat warning saying don't spend extra time especially doing strenuous activities outdoors. that's when we see heat stroke, heat death. from there to oklahoma city, you have a lot of heat. that high pressure system backtracks, focused there. all along the gulf you saw the heat advisories. that's the area where you don't want to spend too much time outdoors. and the overnight lows do not get any reprieve. when your body can't cool down, that's a problem. look at oklahoma city, staying above 100. these are actual air temperatures. not the heat indexes. birmingham upper 90s, jackson. sacramento above 100. we're going to build heat out west. excessive heat watches from the sacramento valley all the way down to southern california. your local weather in 30 seconds.

just desperate for answers. the urgent search is still under way, but no sign of taylor casey. investigators now uncovering a few key pieces of evidence as they try to piece together what happened to her. this morning the urgent investigation unearthing new clues, but few answers in the mysterious disappearance of taylor casey. the chicago woman vanished more than a week ago in the bahamas. >> we are going to continue to do our part in the investigation, to see if we can find taylor and bring her back safely from wherever she may be. >> reporter: casey, sending this photo to her mother the day before her disappearance writing, thank you, ma. love you. >> we need taylor home. this shouldn't have happened, whatever happened. we need answers. >> reporter: police now say, with the help of casey's family, they've recovered the 41-year-old's cell phone in the ocean near the yoga retreat where she was staying. >> based on the ping that came, we were able to find coordinates and so we were able to have our

divers go and retrieve that phone. >> reporter: casey's journal also now in the hands of investigators. authorities speaking with everyone from that retreat after casey didn't show up for her yoga class on the morning of june 20th. staff alerting police, who issued this missing persons poster and launched a full scale island-wide search utilizing drones, canines and divers. >> we've been working around the clock in an effort to find out exactly what happened to taylor. it doesn't stop now. >> reporter: casey's panicked mother and friends flying into the area. >> we have gone out to the locations. we've met with the police here. we've now gone to the ashram. it's still an active investigation. >> reporter: loved ones desperately hoping to bring her home. >> we need taylor back with us. we miss taylor.

>> this is an abc news special report. >> good morning. i'm whit johnson in new york. we're coming on the air because the supreme court has just issued a ruling involving hundreds of people convicted for their actions during the january 6th attack on the u.s. capitol. justices weighing whether to reverse the convictions of hundreds of january 6th rioters charged with obstruction under a 2002 financial crimes law applying to evidence tampering. the case brought by former pennsylvania police officer joseph fisher, who entered the capitol on january 6th and was charged with obstruction of an official proceeding moments ago. the court limiting what charges can be brought against those january 6th defendants. let's get right to abc's senior national correspondent terry moran at the supreme court. so terry, break down what this decision means. >> what? this is a potential win for this defendant, a man who stormed the capitol on january 6th and was charged with this obstruction of an official

proceeding crime. and for those other defendants, perhaps even including donald trump, i want to say potential because how this is applied matters. but here's the bottom line. this law, as you say, was originally written to address financial and business crimes passed in the wake of the enron scandal. and the first part of it says that whoever alters, destroys, mutilates, or conceals a record, a document or other object, and then it says or otherwise, obstructs an official proceeding. and the question was, is this crime? are these crimes limited to documents and records, as the first clause sugges three opinion written by chief justice john roberts. roberts says you can't transform this statute that has to deal with documents and business, crime and the like into an all purpose catchall obstruction of justice, obstruction of official proceedings count. so it's a win

for mr. joseph fisher, the man who stormed the capitol and brought this case. it seems because the question is in a does that get him off the hook? does it get donald trump off the hook? and there is a possibility that in storming the capitol, they interfered with the process of documents. the electoral count, votes that were being certified that day. that's a question for the lower courts. but the court has essentially shut down what the special counsel and the justice department was trying to use this law for obstruction of official proceeding, to use it to apply in general to anyone who stormed the capitol. that can't be. it has to be tethered to documents, records and the like, just as the first part of the law says, terry moran for us. >> thank you. let's also bring in abc's senior washington reporter devin dwyer. and devin, i know terry was talking about those 300 defendants, those january 6th rioters. but also, what do we know about what this could mean for former president

donald trump? >> well, we're two of the four charges against donald trump in the election interference case that jack smith has been assembling involved this particular part of the law. 1512 c2 in that financial law that terry was just talking about. and so there was real concern here that if the supreme court would throw out this, this particular charge against january 6th rioters, that it would mean donald trump half the case, potentially about donald trump could get tossed out or invalidated. that is not the case here. this decision by the supreme court is very measured. it's narrow. it's basically laying out, as terry just said, that anytime those charges are going to be brought under that part of the law, there has to be some connection to documents and records being destroyed. that's still very much in play. so should the special counsel be able to proceed in his prosecution? and that's an open question. we'll hear from the supreme court on monday whether donald trump has immunity or whether this can go forward. uh- special counsel, jack smith, will have to show very specifically that obstruction is

linked to documents and records. >> yeah, that big decision on immunity. still to come. let's go ahead and bring in abc news supreme court contributor kate shaw. and kate, this might be confusing to some of our viewers because we're talking about the interpretation of a 2002 financial crimes law in the wake of the enron scandal, but help us understand more about this decision and what we heard from the justices. >> sure. so, right. the law was passed in response to the enron scandal, which involved, among other things, document destruction. but the question here is, is the statute limited to the context of destroying a document, or does it have broader application? the justice department took a look at the statute and said it criminalizes otherwise obstructing or impeding an official proceeding. that is broad language, and it applies to individuals who sought to obstruct the counting of electoral votes to certify joe biden as the winner of the presidential election. so they thought the statute actually did cover this conduct. and so they went forward with the charge. what the court here says is you have to look both at the context in which this law was passed,

but also surrounding language, which makes reference to documents and records and again, it's not that prosecutors could never charge, you know, storming the capitol under this provision of law, but there needs to be, again, a connection to the destruction of records and documents, not just, you know, blocking a proceeding. and that will be the question, among other things, about whether assuming, you know, there's a prosecution that can go forward against former president trump again, we're still waiting for the big immunity ruling. but two of the four charges, as devin was saying, come from this statute. so the prosecutors, i think, assuming they can go forward, will have a tough decision whether to try to show that this these two charges can still succeed against former president trump after this ruling, or potentially they just drop those two in the interest of time. and, you know, kind of streamlining the remaining two charges, one about defrauding the united states and one about depriving citizens of rights, including the right to vote. so they're, i think, going to have a weekend poring through this decision to decide how to proceed, if at all, using these two charges. >> some difficult decisions going forward. kate shaw, thank

you so much. let's bring in abc's chief justice correspondent pierre thomas. so, pierre, how is the doj likely to respond to this? i know that the number of defendants here is relatively small in terms of the scale of all those who have been charged. >> well, we've been having conversations with sources within the justice department to get a sense of what they were anticipating. obviously, they will be disappointed that the supreme court chose to make the ruling that they did, and they know that donald trump and some of his supporters will use this as a symbol of government overreach. that said, they are out with numbers that suggest they suggest they believe will prove that this has a limited impact, that the number of people actually affected by this ruling is very small. there were 300 and some odd suspects charged and convicted under this particular statute. doj is saying that the overwhelming majority of these people had other charges attached to their case, meaning that they would still serve prison time. and they conclude there are only about 27 people

that had only this case as the primary charge against them, meaning about 27 people would actually see some likelihood of their sentence being significantly reduced. >> all right, pierre thomas, for us, thank you. abc's senior congressional correspondent rachel scott is also joining us. rachel has been out on the campaign trail. you were at the debate last night. you were also at the capitol on january 6th and witnessed this riot as it played out. but how do you think this is likely to play politically for both the biden and trump campaigns? >> yeah, when i was there on january 6th, from the moment the rioters stormed the capitol, watching police being outnumbered and overwhelmed, now , three years later, the former president has really brought this to the center of his campaign. he has promised to pardon the rioters who stormed the capitol on january 6th, calling them hostages, often on the campaign trail. he plays music of rioters who are behind bars singing the national anthem, who stormed the capitol on january 6th. even last night on the debate stage, the former

>> george: back with our gma cover story. drug store giant walgreen's about to get smaller, announcing it will close a large number of its stores. erielle reshef is back with details including what you should do if your local walgreen's shuts down. hello, erielle. >> hey, george. this affects a lot of is. walgreen's will shutter some of its 9,600 locations nationwide, evaluating a quarter of its lower performing location and says it may cut a meaningful percentage of them. the new leadership is also working to scale back its stake in primary care provider village md. walgreen's shares plummeted 25% as the news broke that it had failed to meet wall street's expectations for its quarterly earnings. it comes at a time when the 123-year-old retail pharmacy giant has been losing money on high price drugs and to telehealth businesses that prescribe medicines through

say social media is linked to the death of their children are trying to hold social media platforms accountable. this morning dozens of parents who say social media played a significant role in their children's deaths are pressuring the government to hold social media responsible. >> children's mental health, it feeds on their weaknesses. how could any child be exposed to this? >> reporter: lori's daughter was 18 when she died by suicide. her family says social media exacerbated her mental health issues. todd minor's son matthew was just 12 when he died of accidentally after taking part in a choking challenge. >> we had tall protections in place. >> we refuse to be silent accomplices to this injustice. >> these harms are happening overnight to our average kids. >> reporter: lori, todd and others who have lost children

are banding together an swarming capitol hill to lobby for the kids online safety act, cosa. a law that would require social media platforms to protect children and teens online. >> the heart of the bill says that online platforms have a responsibility in how they design their platforms to ensure that they are not causing or exacerbating eating disorders, anxiety/depression, all of the things parents are worried about. >> reporter: the bill, demanding companies like tik tok change their algorithm for kids and teens, to push more innocuous content as opposed to whatever is likely to keep kids scrolling. lori said the tik tok content that consumed anna leigh ultimately encouraged her to take her own life. >> when i opened it on her for you feed, it was constant anxiety and depression and pro harm content. >> reporter: the pressure for change gaining momentum. 41 states now suing meta, which owns facebook and instagram, alleging it deceived users about

the safety of its platform and that their algorithms were designed to push teens to toxic and harmful content. meta telling abc news, we want to reassure every parent that we have their interest at heart. these complaints mischaracterize our work using selective quotes and cherry picked documents. tik tok saying we strive to promote a safe and age appropriate experience on tik tok to robust safety policies and parental controls. lori and todd say that will push forward, hoping they can save other families from their pain. >> we're calling all parents. we're calling all elected officials and anybody who cares about the well being of our youth to help. >> the cosa bill was introduced in 2022 and has bipartisan support in the senate and president biden. it recently passed a key house subcommittee. it hit a speed bump just this week stopping progress for now. these parents activists say it's holding the bill hostage adding

coastal erosion. the wetlands where bull sharks live, is slowly disappearing, hurting the shark population, but also bringing them closer to humans. >> if that coastal erosion is moving these suitable habitats further and further inland, closer and closer to areas of high human development that's where the bull sharks are going to be going. >> the entire wetland is going away. everybody's aware of it but we haven't done anything about it. >> reporter: some groups are hoping to change that. these eco warriors planting grass along eroded marsh lands. >> i fished these waters. i never thought i would walk in them. >> reporter: to help protect sharks and restore the sinking coast line. that's super interesting. shark beach with anthony markie kicks off sunday on nat geo and streams the next day on disney+ and hulu. i have done my time swimming with sharks. i believe you have, too, if i remember correctly. >> ginger: i have done at least three shark dives so, yes, i am right there with you. i'd do it again. i thought it was spectacular.

inward and make those changes. we've got a life time of indoctrine nation, of conditioning to get us to believe one thing. it takes work, some effort for us to be in a position where we can see you for who you are. i think that's why it resonated with some people. i know theo has some things they want to share, too. >> sam: this is a big moment. i love the conversation with your mom. let's talk about the story and how you got there and how david helped. >> well, i mean, i found out that i was queer through like community. lot of my friends are also queer. so it was good to have that. it's always a struggle to know that your parents, the people who are always there, don't accept you. we struggled for a really long time. we had a very rugged relationship.

we kept -- she kept on trying to, like, force something from our relationship and try to make everything back to normal. but there was always that disconnect. so eventually things did get better and i didn't find out about your story, david, until after everything started getting more involved. it's really cool to know there are more families out there, and parents who accept their children later on. >> yeah. >> sam: we watched, david, your story played very publicly. i know it's painful and difficult for you. but how does it feel to know that that story is impacting others in their journey? >> i mean, it's really beautiful because, like you said. it's not unique. sometimes you feel like you are the only person going through this. but to know that you, theo, and you, kate, have gone through something that my mom and i have gone through is beautiful. my mom at first had a hard time. when i told my mom, she said,

david, i love you, but i love god more and i can't about accept you. i said, mom, that's okay. i don't need you to accept me right now. i just want you to respect that i'm doing what's best for me right now. now, with time -- the song came to be because then my mom came to tell me, hey, david, if you're going to hell, then we're going to hell with you. we're a family. we'll stick together. through the good and the bad. >> sam: whoa. that's a lot. that's powerful. that's beautiful, actually. i'm just so happy. i'm so blessed to meet you. your video touched me. here we are.
