cocktail has the margarita been dethroned? >> from abc news. this is america, this morning. >> good monday morning, everyone. i'm andrew dymburt. >> i'm andrea fujii in for rhiannon. we begin with the race for president and what's expected to be a historic day at the supreme court. >> the justices could rule whether or not former president trump has presidential immunity from criminal prosecution. a decision with major implications ahead of november's election. >> as for president biden, there's new fallout from his debate performance thursday night. members of his family are now reportedly pushing for change in the campaign. abc's em nguyen has details beginning at the supreme court. m good morning andrea. good morning. yeah. this decision expected today. the supreme court could upend the january 6th case against donald trump and could have implications that reach far beyond the former president. >> this morning, the supreme court is expected to issue its ruling on whether former president trump has broad presidential immunity. that would shield him from criminal

prosecution. facing four felony charges related to efforts to overturn the 2020 election, trump has taken his claim of absolute immunity to the supreme court. in oral arguments earlier this year, the conservative justices seemed open to allowing some form of presidential immunity. >> he makes a mistake, he subject to the criminal laws just like anybody else. you don't think he's in a special a peculiarly precarious position. >> many legal experts say it's highly unlikely the court will grant trump absolute immunity, and will instead grant immunity only for so-called official acts . much of the oral argument centered around what constitutes as official versus a private act , the justices hinting they might send the case back to the lower court to sort that question out. the decision could have lasting implications for the office of the presidency, trump posting late yesterday. it is a big decision, an important decision, a decision which can affect the success or failure of

our country for decades to come. meanwhile, in the race for the white house, new fallout over president biden's debate performance last week, politico reports biden's family is urging him to fire or demote top campaign aides for not preparing him to go on the attack and for overworking him before the debate. a new poll shows 72% of registered voters do not believe biden has the mental or cognitive health necessary to serve as president. that's up from 65% before the debate. among those now calling for biden to step aside the new york times editorial board and even some top democrats are now entertaining the possibility. >> there are very honest and serious and rigorous conversations taking place at every level of our party. >> but the biden campaign insists the president will continue to seek reelection, arguing that biden dropping out would lead to weeks of chaos and leave his replacement in the weakest possible position. >> he's had a great few days,

and it's building on a great few years. no one has been a stronger and more consequential president in my lifetime than joe biden. >> the biden campaign, also citing this poll showing candidates floated as possible replacements, including vice president kamala harris, michigan governor gretchen whitmer and california governor gavin newsom, all losing to trump. former presidents obama and clinton are among the democrats doubling down on their support for biden. >> and with just weeks to go into the convention, there isn't much time left to make a change. andrew m, thank you. >> new evacuations have been ordered in parts of the southwest as heavy rain triggers flash flooding. this was the scene in a resort town in southern new mexico hit by a wildfire last month. the national guard, bringing dozens to safety, follows extreme flooding in parts of albuquerque, where about two inches of rain fell in just 90 minutes. meanwhile, storms in the northeast are blamed in part for more than 1000 flight

cancellations on this busy holiday travel week. thousands of power outages were reported around new york city, but the big weather story right now is hurricane beryl. it's the earliest ever category four storm in the atlantic. it's it is expected to hit jamaica wednesday and possibly cancun thursday. we'll check the full forecast in just a few moments. >> the other big story this morning, a possible plea deal for boeing in connection with two plane crashes that killed hundreds of people. it could help the company avoid a trial. families of the victims reacting overnight. here's abc's alison kosik. >> this morning, some families of the hundreds of people killed in two deadly boeing 737 plane crashes are crying foul over a proposed plea deal between the justice department and boeing. >> i'm feeling denied, justice attorneys for the families say the proposed deal would allow boeing to plead guilty to a conspiracy charge for misleading the faa during its evaluation of the 737 max aircraft.

>> that's the plane involved in the two crashes in indonesia and ethiopia in 2018 and 2019. but under terms of the deal, boeing would not have to acknowledge that its alleged conspiracy killed the 346 people lost in those crashes. the deal would allow boeing to avoid a public trial, which families wanted, and would find the company about $200 million. well short of the $20 billion families have requested. >> we need to hold boeing accountable, not have them just pay fines as part of the cost of their doing business. this is just another sweetheart deal between the department of justice and boeing. >> nadia milleron, whose 24 year old daughter was killed in one of those crashes, claims the deal would compromise safety. last month on capitol hill, boeing's ceo was grilled about the company's safety record. more recently, in the spotlight after a door plug blew off this plane mid-flight.

>> you're cutting corners. you are eliminating safety procedures. you are sticking it to your employees. you are cutting back jobs. >> i don't recognize any of the boeing you described. >> boeing insists changes have been made to protocols and procedures to improve safety. and overnight, another major development. boeing has agreed to buy the supplier under scrutiny after that door plug incident. spirit aerosystems, for more than $4 billion. boeing spun off spirit in 2005, a move critics say represented a focus on cost cutting. the family's attorneys say the deal being offered would also require an external corporate monitor for boeing, and the company has until next week to accept the deal or face prosecution. neither the company nor the justice department commented overnight. >> andrew, andrea allison, thank you. a developing story overseas now, several u.s. military bases

in europe are on a heightened state of alert. a defense official says the bases are now on their second highest state of alert, which applies when intelligence indicates the potential for a terror attack. officials are not elaborating on the potential threat or the bases affected. u.s. european command said it's constantly assessing a variety of factors when it comes to safety and security. breaking overnight protests erupting in france as polls show the far right party led by marine le pen holding the lead in the first round of national elections, president emmanuel macron's centrist alliance is currently in third. it's still unclear if the far right party, which is pushing for an immigration crackdown and lower taxes, has enough support to win a majority. the next round of voting is next sunday. >> a former nasa engineer in houston is facing sexual assault charges. he's accused of secretly recording his encounters with women. police say eric sims used glasses with a hidden camera to make the videos at least seven women

across the country this week on good morning america. >> good morning america, good morning america. >> we're back now with criminals targeting cemeteries. this time four suspects are in custody for stealing 2,000 pounds of bronze statues from crucifixes from graves in spain. they're being melted down and sold on the black market, where bronze is currently in high demand. >> now to upstate new york and the investigation into the fatal police shooting of a 13 year old who officers say was holding a pellet gun. this morning, new york's attorney general is investigating this moment when a utica police officer shot and killed 13 year old yan hui. in the video, you see police stopping the eighth grader and another teen for matching the

description of robbery suspects. >> i just pat you down and make sure you got no weapons on you as an officer moves in, yan runs away. >> good good good man. >> good, good. >> the teen appears to point at officers. what authorities say they believed was a gun circled in red and edited freeze frames released by the utica police department. officers then catch up, pulling the boy to the ground. drop it! drop it! >> back up. >> an officer identified as patrick hudson, a six year veteran, shoots nian once in the chest during what the police chief describes as a struggle. >> there's just one shot. it was me. >> authorities also released this photo of what they say turned out to be a pellet gun, a replica of a glock 17. the man's mother overwhelmed with grief. >> i don't think any officer goes on the job hoping to shoot or intentionally try to shoot anybody. say his name. >> hundreds gathered at a vigil to remember nguyen, a refugee
