the case. >> and a man looking to take a dive into this local swimming hole talks about his unexpected 60 foot plunge from abc news. >> this is america, this morning. >> good tuesday morning, everyone. >> i'm rhiannon ally i'm andrew dymburt. we begin with the rising death toll after hurricane beryl. yeah. >> the storm now taking aim at the midwest with the threat of flash flooding today from missouri to indiana in southeast texas, widespread damage and power outages 24 hours after the storm made landfall, even nrg stadium, home of the houston texans, suffered apparent damage after the fast moving but very dangerous storm this morning, the death toll rising after barrel swept into texas as a category one hurricane. dangerous storm surge flooding parts of the coast. >> he's got the life jacket on and they are lifting him out of the water. look at that. >> at least six people have now died in texas, including an elderly woman killed when a tree fell on a home, and a civil

employee with the houston police department who drowned after driving through flood waters on his way to work. >> we're in an emergency. we're in a rescue mode. life safety barrel dumped nine inches of rain in some areas. >> winds topping 90mph, causing widespread damage to homes and businesses. >> look at this community here on this side of this condominium complex. the roofs were ripped off by strong winds. this is all this brick wall pushed over just from the sheer force of barrel transformers blowing up as the hurricane slammed inland, causing nearly 3 million power outages. >> if we can get power restored, hopefully tomorrow afternoon, even that'll be great. if not every day, that goes by certainly gets to be a more debilitating. >> oh, oh, in galveston, the mayor warns it could be two weeks before some people get their power back and feel like temperatures in the coming days

will approach 100 degrees. a woman was also killed by a falling tree in louisiana as the remnants of beryl now moved northeast. we will check your forecast in just a few moments. >> president biden's doctor has released a new statement amid questions about why an expert in parkinson's disease has visited the white house. it comes as more democrats publicly call on the president to end his reelection campaign over concerns about his mental fitness. abc's lionel moise has the latest. >> overnight, president biden's physician releasing a statement explaining the new revelation that a parkinson's disease expert visited the white house eight times in eight months. doctor kevin o'connor, in a letter released last night, clarified that the parkinson's expert, doctor kevin kennard, was a neurological specialist that examined president biden for each of his annual physicals and that president biden has not seen a neurologist outside of his annual physical, adding that the findings of biden's last physical were made public in

february and no signs of parkinson's were found. the letter, coming just hours after the white house was pressed about doctor visits. >> has the president being treated for parkinson's? no. is he being treated for parkinson's? no. he's not. is he taking medication for parkinson's? no. the white house press secretary refused to give specifics yesterday due to privacy concerns. >> i certainly could clear this all up just by saying what he was doing here and if it was connected to the president, yes or no, i am not going to confirm the a particular neurologist, anybody. >> it doesn't matter if they're a dermatologist or a neurologist. i'm just not going to do that. i shared with all of you that the president has met, has been with the neurologist three times as it relates to his physical, three times such visits to the white house are not unusual. >> the president's physician says the neurologist regularly meets with thousands of active duty military members who work in the white house complex. this same neurologist also appeared on the visitors log dozens of

times during the obama presidency. meanwhile, at least six house democrats have now publicly called for biden to step down following his debate performance. >> we've got issues, but right now the president is not capable of articulating that message, and we are distracted by health care concerns that they refuse to address. >> but biden remains defiant, dismissing so-called party elites who've called on him step aside. >> i don't care what those big names think. the roar in 2020, the wrong in 2022 about the red wave and the president insists he does not need a cognitive test. that's why i've been out. i've been testing myself and testing everywhere i go, going out and making the case. >> former president trump, speaking to fox news last night, accused democrats of a cover up. >> well, they cover for him and they still are sort of covering. but now it's getting very difficult to do that. and you know, it looks to me like he may very well stay in. he's got an ego and he doesn't want to quit.

>> both house and senate democrats are holding closed door meetings today where they're expected to discuss concerns about biden. senator mark warner of virginia is already urging the president to, quote, more aggressively make his case. rhiannon. andrew. >> all right, lionel, thank you for that. as the president faces more pressure to step aside, he is on the world stage today hosting the nato summit. abc's em nguyen has the details on that. and good morning, rhianno. >> good morning. the president begins three days of meetings, speeches and dinners. today he'll open the nato summit with remarks followed by a dinner for more than 30 nato leaders. biden will also meet with ukrainian president zelenskyy. it comes after dozens of russian missiles targeted kyiv and four other ukrainian cities yesterday, killing at least 37 people. the country's largest children's hospital was bombed in one attack. young cancer patients were seen sitting on the sidewalk outside with ivs in their arms. during this week's summit, nato is expected to announce new measures to boost ukraine's air defenses,

including a massive new aid package. sources say. the white house hopes the summit will showcase biden's leadership. one administration official says this event is ideal for the president, but the summit no doubt to be overshadowed by those calls for biden to drop out of the race and the looming possibility of a second trump presidency. trump once called nato obsolete. >> andrew, am thank you. jury selection begins today in alec baldwin's rust movie set shooting trial. and now the judge has issued a key ruling in this case a new setback for prosecutors. as alec baldwin prepares to go on trial for involuntary manslaughter in the shooting death of cinematographer halyna hutchins on the set of his movie rust. >> i'm having real difficulty with the state's position that they want to show that as a producer, he didn't follow guidelines, the judge now ruling the prosecution cannot present evidence about baldwin's role as co-producer of the movie.

>> one more, one more, one more. i forgot to record something right away. right away. let's reload. >> prosecutors wanted to show that in his role as producer, baldwin fostered an environment of negligence and recklessness by allegedly rushing people on the set to save time and money, including the movie's armorer, hannah gutierrez, who loaded the gun. she's already serving an 18 month prison sentence for involuntary manslaughter, but the judge yesterday ruled only baldwin's role as actor will be considered at trial. >> and that's good for the defense because they get to make the argument the same thing as the actor's guild. and unions have said that the actor isn't responsible for the gun. that's the producer or especially the armorer. >> prosecutors claim baldwin disregarded industry rules for handling guns on the set, but baldwin has pleaded not guilty, insisting he never pulled the trigger. >> i would never point a gun at anyone and pull a trigger at them. never, never. that was the training that i had. you don't point a gun at me and pull the trigger. >> jury selection is set to begin today with the trial expected to last ten days. some

legal experts argue baldwin should take the stand, given he's already spoken about the trial to the media and could have a so-called star effect on jurors, who may give him the benefit of the doubt. if convicted, baldwin could face up to 18 months in prison, the same sentence given to armorer hannah gutierrez. she's appealing her conviction. >> well, the blistering heat from coast to coast is impacting the commute, literally. here in new york city, this happened. a bridge got stuck in the open position because the heat caused the steel there to expand and it couldn't close. fireboats cooled it down and the bridge was able to reopen last night. the heat also buckled a state highway north of seattle. temperatures there could set a record today. let's check your tuesday forecast. >> good morning. we're still dealing with major impacts associated with beryl. a tropical depression moving northeast. we're dealing with some widespread areas with strong thunderstorms, even rotation at times east to the center of the storm's path. and here we could see some tornado threats in southern illinois and nearby areas. this afternoon. we're dealing also with 4 to 8in

someone take a case and two other men distracted his workers. the dealer is now offering a $70,000 reward for the return, or information that leads to the return of the card, now to a possible close call near a new york airport. >> video shows two planes, one landing and one taking off, and it caused quite the scare this morning. the faa is investigating another mid-air scare involving passenger planes. audio captured the confusion in the cockpit. wait, who's cleared to take off on 208? watch as a delta plane was taking off from syracuse, new york yesterday at the same time, an american eagle flight was about to land. from the video's angle, it appears the planes came dangerously close as a stunned police officer watches seemingly convinced the planes were about to collide. according to flight data, the planes were separated by 700 to 1000ft vertically, but it's unclear how close they were horizontally. it comes after another mid-air

scare involving a united airlines plane give you a heads up. >> the tower called. they think that you lost a tire on the takeoff. >> a boeing 757 lost a tire after taking off from los angeles. passengers were told by the flight crew to brace before the plane landed safely in denver. united has been under extensive supervision from the faa after a number of maintenance issues this year. back in march, a tire of another united flight fell off. moments after takeoff from san francisco, the wheel crashing down in a parking lot, damaging these cars. back to that incident in syracuse. it was not immediately classified as a close call, but investigators are now taking a closer look. >> a man in florida suffered no serious injuries when the branch he was standing on broke, sending him falling 60ft into a creek, he says. it was the first time he'd ever climbed that high in the tree. he suffered some bruises, but no broken bones. >> very lucky. coming up, the
