>> new developments in san francisco's efforts to address homelessness. an appeals court ruling means encampment sweeps can resume in a matter of weeks, and a final goodbye to baseball great willie mays, a former president who made the trip to san francisco to join the event at oracle park. good morning and welcome to tuesday, july 9th. >> let's start the check of our forecast with drew. yeah. >> good morning. so we do have one day of what we'll call comfortable temperatures before the heat takes off once again tomorrow. so live look outside. here's your tam cam. we have our morning fog with us in the city. we have some drizzle underneath that fog. it's really just going to be a day where temperatures are pretty close to average for this time of the year. so looking at your sky conditions right now, you can see it's pretty cloudy close to the coast, even around the bay shoreline. we do have some clear skies inland, but today is going to be a day where temperatures are in the 80s and 90s in our warmest spots around the bay shoreline. this morning we're in the 50s and in the 60s. underneath that fog, you open up the picture and 60s in our warmest spots inland at this

hour. so take a look at temperatures today. inland, we're in the upper 80s lower 90s, so close to where we should be for this time of the year. enjoy the brief relief from the intense heat this afternoon around the bay shoreline. we do have temperatures mainly in the 70s, clouds to sun throughout the morning and it will be a nice afternoon. and along the coast, just like yesterday. it's a mostly cloudy day and temperatures in the upper 50s to the lower 60s. but tomorrow those heat advisories are back and temperatures are going to take off once again. we'll show you these numbers coming up in eight minutes. let's check in with amanda. welcome back. good morning. >> happy to be back. and drew happy to show you this a very quiet commute across the golden gate bridge here at 501. there was an earlier fog advisory, but that has since cleared, it seems, and it seems like a clear commute across the bay area really all together here on your tuesday morning. this is minus that typical slowdown on the altamont pass that we've of course, see almost every day. you can see speeds down to 11 and 17mph. there tracy to dublin. that drive will take you 43 minutes. dublin to mission boulevard south 15 minutes and

then 16 minutes from 101 to cupertino. let's get back to your headlines. thank you amanda. >> setback for affordable housing for foreign workers on the peninsula. san mateo county officials say they've decided a 50 acre property formerly known as the bay city flower company, is not suitable to build housing, so they will not be buying this land. the property was seen as a way to add affordable housing along the coast. after the mass shooting last year at two mushroom farms exposed poor living conditions that many farm workers are facing. another affordable housing project was just approved in halfmoon bay last month. >> leaders in the south bay are considering a crackdown on encampments and today that heads to a vote. amanda, this would involve people living and camping along creeks in san jose. yeah reggie, it has been an issue for quite some time no. >> valley water says it wants to ban encampments along waterways for safety, citing concerns. excuse me. let me get this all citing concerns about pollution in the water and dangerous conditions for staff. now

advocates for the unhoused say many people living along the creeks, they want to keep cool, with one person already dying from the heat. since the first of the month. and they say there are other ways to solve problems. >> the advocates to try and schedule things to have advocates on hand who usually have good relationships with camps, but also keeping the creeks clean. make sure that you always have porta potties with wash stations at all these creek areas. trash chemicals, garbage, dog bodies, you name it. >> our rivers and creeks or not being environmentally taken care of, we do the best we can, but the destruction is overwhelming. >> so enforcement would include a warning and education. first, with 72 hours to voluntarily relocate the next step would be a misdemeanor charge with a fine or jail time as punishment. valley water says that would be a last resort. it ultimately hopes local governments and social service agencies can work with them to create an overall solution. now, the valley water

board is set to vote on the ordinance today. if it is approved, it'll go into effect in 30 days. back to the desk. thanks, amanda. >> new developments a french court has ruled a bay area native accused of raping a woman on a college campus in pennsylvania in 2013 can be extradited back to the u.s. 31 year old ian cleary has been detained since april. investigators say he stalked the victim at a party, followed her back to her dorm room and then sexually assaulted her. they reopened that case back in 2020, when the victim got several messages appearing to be from cleary, including one that read so i raped you. it's not clear when cleary will be brought back to the u.s. he has refused to be extradited. that will be slowing the process. >> today, the man charged with murder for the death of a woman at the powell street bart station is expected to make his first court appearance last week. police say the man pushed 74 year old corazon dandan. she hit an oncoming train, then hit the platform. she later died. two prior court dates were

delayed because the man hasn't been well enough to attend. it's a story we've been following since this video was shared. a crowd of people rushing into and stealing from this oakland gas station in the early morning hours of july 5th. now we're hearing from the business owner and the council member who represents the area, who tells us more needs to be done to keep businesses safe. the owner says it took officers nine hours to respond. oakland police tell us they didn't understand the magnitude of the incident until they saw the video. >> they said there was nothing we could do. you cannot just file a report online. that's our respon. >> the owner tells us the vandals caused more than $100,000 in damage, including $22,000 taken from the atm. oakland city council member trevor reed, who represents east oakland, visited the gas station. she told us it was devastating to see such loss as crime is going down in the area. >> overall, there's a lot more that we have to do to protect these businesses. our workers and just this tourism corridor so that we can really, you know,

keep our businesses protected, our workers supported, and this court are alive. >> the owner tells us he plans to have two employees working at all times and is considering closing up closer to sunset. >> new developments involving unhoused people in san francisco. the city could start large scale encampment sweeps in just a matter of weeks after a court ruling cleared the way. abc seven news reporter gloria rodriguez joining us live in san francisco and gloria, there is some pushback from some people who argue enforcing these encampment sweeps is not the solution. >> yeah, there is kumasi there are some people here in san francisco who disagree with these recent court rulings, but the city attorney says that this will allow officials to more effectively tackle this issue. now, san francisco says it will resume sweeping homeless encampments in just a matter of weeks, following a recent supreme court ruling. yesterday, an appeals court overturned an injunction that paused the city's efforts to enforce laws preventing people from staying

out on the street. san francisco city attorney david chu says the city has spent billions of dollars on homeless services over the years. >> we could make all the offers of shelter and services that we wanted, but there were many moments where unhoused folks would simply reject or refuse services, reject offers of shelter. >> we as a community and our political leadership over decades, not just the current leadership, but going back decades, have made concerted choices to disinvest in affordable housing and instead invest in policies that push people out. >> that's nisha kashyap, whose lawyers committee for civil rights was part of a lawsuit that sued the city over the rights of unhoused people. she believes those sweeps will only push people from place to place and ultimately do little to solve the problem. and she's instead calling on elected leaders to invest in what she believes are real solutions. and there's ongoing litigation over

the property of the unhoused. a lower court is expected to rule on that soon. live in san francisco gloria rodriguez, abc seven news. thank you. >> gloria. >> forever giant in san francisco, fans got to say one last goodbye to the say, hey, kid willie mays powers to bring people together was evident by the attendance at oracle park. >> baseball greats, local leaders and even two former us presidents. bill clinton was here in the city to attend the event in person. former president obama helped eulogize mays in a recorded message. >> i'll never forget giving willie a ride to the all star game back in 2009. and let me tell you, as president, it was rare for me to be the second most important guy on air force one. but with willie on board, it wasn't even close. >> and willie mays for former san francisco mayors were also in attendance. former mayor willie brown recalled mays impact on local housing laws in the city because willie was not just a baseball player. >> willie was a world changer

for us in san francisco. >> the say, hey, kid, willie mays died nearly three weeks ago. he was 93. >> let's get you going. this morning in the accuweather forecast. we have a lot of cloud cover out there along the coast and around the bay shoreline. even some pockets of drizzle along the coast. so this morning you can see we're fighting the cloud cover through about 9 a.m. after that we'll get sunshine prevailing. but just like yesterday, the warming process is slow. we get to enjoy a comfortable day today. it's just for one day this week. temperatures very close to where we should be for this time of the year, maybe 1 to 3 degrees above average, but it feels refreshing inland compared to the intense heat of late last week and over the weekend. so our warmest spots will be in the 80s and in the low 90s today. here's future weather. we'll fight that fog still around the bay shoreline through 9 a.m. it pulls back to the coast for lunchtime. i think it's actually pretty cloudy over san francisco

today. cool in the 60s, but away from the coast we are sunny and we're warming up into the upper 80s lower 90s, which is pretty close to where we should be for the middle of july 70s around the bay shoreline, and a pretty comfortable evening on the way as that marine layer surges back inland to finish out the day today. so highs close to average a one day reprieve from the intense heat. i say that because tomorrow temperatures are going to get intensely hot inland once again. so our heat wave will continue starting tomorrow with a new heat advisory that will last through friday. so we have three days starting tomorrow of hot temperatures. in fact, you look at the three day forecast. we're very comfortable today. and then tomorrow we are heating up and then dangerous heat inland again on thursday we're approaching 110 and our hottest spots. reggie we'll show you those numbers coming up in a few minutes. drew. >> thank you. tens of thousands of households in texas still don't have power this morning. coming up, the aftermath, the aftermath of hurricane beryl and more than a dozen people rescued from the tahoe wilderness just miles from an active wildfire

threat of flash flooding. it left widespread damage and power outages in texas and amanda. the storm is responsible for at least six deaths. >> yeah, kumasi officials in texas say hurricane beryl has killed at least six people. five of those people died from falling trees. an employee with the houston police department drowned after driving through flood waters on his way to work. now, beryl dumped more than 13in of rain in some parts of the houston area. winds topped 90mph, causing widespread damage to businesses and homes. as the hurricane moved inland, transformers blew up, causing nearly 3 million power outages. >> if we can get power restored, hopefully tomorrow afternoon,

even that'll be great. if not every day that goes by, it certainly gets to be a more debilitating. >> and in galveston, the mayor warns it could be two weeks before some people get their power back and feel-like temperatures in the coming days will approach 100 degrees. reggie, back to you. >> thanks, amanda. 13 hikers who disappeared near the royal fire in the tahoe national forest are now safe at home with their families. the group vanished in the fire zone sunday night. the placer county sheriff's office says the teens, 16 to 19, hiked the palisades tahoe trail before and are familiar with the area. deputies knew the group might be in trouble when they found their cars parked near the trailhead. a search and rescue team found them yesterday morning. the parents are, of course, happy that they are now safe. >> so relieved, so happy. it's just, you know, that period of time when you don't know what's going on and it's like, i know all these kids are capable, but yes, it's a pure relief. >> the royal fire has burned

about 200 acres so far. cal fire says there is no containment. >> a judge is suspending criminal proceedings against dharmesh patel. he's a man accused of intentionally driving his family off devil's slide last year. fortunately, everyone survived. patel is now being ordered to take part in a mental health program for two years while on supervised release with gps monitoring. the 43 year old radiologist is also been ordered to not practice medicine. not much is left of this powerboat after a fire on the bay. sky seven was overhead yesterday afternoon, capturing these images of flames engulfing the 50 foot vessel called lucid dream. it happened about two miles off the shore of redwood city. a man, woman and dog were on board. all of them got off safely. the regular redwood city fire boat that firefighters used is out of service. by the time they got on another boat, the burning vessel had drifted into the shallows and it couldn't be reached. the boat burned down to the waterline, but the diesel tanks on board stored below the

waterline, could still be intact. no word yet on. no word yet from investigators on how the fire started. >> an electric scooter is being blamed for sparking a fire at a four story apartment building in san francisco's tenderloin district. fire crews responded quickly yesterday morning to leavenworth street, near mcallister. firefighters say the scooter was charging when it caught fire. crews put out the flames quickly. one apartment burned and one person was taken to the hospital with minor injuries. all across the bay area in the 4th of july, illegal fireworks were shooting off for hours. they disrupted neighborhoods, started fires and left. some people hurt. and it left us wondering how did local cities respond? we called around and here's what we found out. oakland pd says they arrested seven people while santa clara county sheriff's office said no arrests or citations were given out in the north bay. santa rosa police made 22 arrests, and sfpd has not gotten back to us yet with any arrest data. in other cities across the bay area, fire crews and law enforcement

agencies were out in full force. you can see the numbers here. santa rosa police had over 2700 calls to its communication center. we spoke to the oakland police captain in charge of their 4th of july deployment. he admits the sheer amount of illegal fireworks makes it difficult to handle. >> there's a lot of fireworks are going on almost simultaneously for several hours throughout the evening and so just resource wise is very difficult and challenging to actually respond to all the calls for service this year. what we did is we actually were proactive in responding to those areas before they're able to set up fire. >> danger was high across the bay area with multiple red flag warnings in various cities. in contra costa, the fire department had over 1100 calls for service, with at least 310 reported incidents. fire officials tell us the majority of the fires that they responded to on the fourth were caused by fireworks. >> happening today, the san francisco arts commission and port of san francisco will be celebrating a new art installation. it's happening along the embarcadero. we were there as crews set up a nine

foot bronze sculpture between the ferry building and pier one. yesterday, the san francisco arts commission and the port of san francisco tells us that this statue is called a sound. as sounds turned to noise, it shows a young black woman in jogging clothes meant to challenge who gets to be memorialized in bronze. the installation will be outside of the ferry building through january. to go check that out now, it almost reminds me of in new york city by wall street. >> we have a little girl in the bowl. very cool statue, i like that. and then right behind her joy ride, right. come on. go. no. i'm waiting. i walk by there frequently and it's not open yet. i saw them training staff recently, so it's got to be very close. it's got to be within days, if not weeks. so i'm excited today. enjoy. one day of heat relief is going to feel nice. and then those temperatures will take off once again tomorrow. you know how we talked about our heat wave

lasting 11 days? well, now we have to break it up into two heat waves because the heat advisories take a brief pause today. so that means our first heat wave, which started back on last tuesday. it ended yesterday. so that one was seven days. one day of relief today. and then our second heat wave begins tomorrow. and it's short. it only lasts three days, but it will be intense inland. so one day of heat relief today temperatures are near average. it's going to feel very nice. and then high pressure is back tomorrow. that intense heat returns heat advisories are back. and that means temperatures inland well above 100 degrees. but by the weekend we'll break that heat wave. temperatures near average. lots of sunshine, the weekends. looking fantastic. so here's your day planner today. here's the tam cam behind with that marine layer behind us. clouds and drizzle along the coast. this morning we get sunny skies this afternoon. not too hot inland. that's the takeaway for today. so single day heat relief highs in a microclimates mainly in the 80s and low 90s in the south bay 86 san jose 81 for redwood city, 70 for san mateo low 60s along the coast. pretty cloudy across san francisco today. we'll keep it in the 60s

our emeryville camera where cars are filling in for westbound travel. those headlights are heading toward the bay bridge with the drive time from highway four into the city at 31 minutes. >> number seven nascar has unveiled an electric race car prototype. the car has 1300 horsepower and accelerates twice as fast as a gas powered race car. it's part of nascar's initiative to reach net zero emissions by 2035. >> this morning, there are calls for tougher regulatory measures to mandate metal tests for menstrual products and a uc berkeley study found tampons contain more than a dozen toxic metals, including arsenic and lead. the authors say it's unclear if the metals detected in the study are causing negative health effects. they say little research has been done to measure chemicals in tampons. researchers hope this raises awareness and demand for better safety standards. there's a bright spot to having solar panels on your home, according to new research at lawrence berkeley national laboratory. a median energy savings comes in at about $700 annually. benefits of solar panels varied by

region, with the greatest cost reduction in the west, especially california. >> a new study is giving insight into how two of the most popular weight loss drugs compare overweight and obese people taking manjaro saw more weight loss than those taking ozempic. the two drugs are made with different substances, different active substances. the study, done by a health analytics company, was published today in the jama internal medicine medical journal. but experts say it's hard to account for other factors that influence people's weight loss. so more research needs to be done. walmart is facing a class action lawsuit over alleged deceptive pricing. the retailer is accused of using inaccurate price labels as a part of a bait and switch scheme, in which purchase prices are higher than those that are posted on the store shelves. a federal appeals court ruling opens the door for consumers to prove that the company has violated multiple consumer protection laws. >> in today's gma first look, big box stores costco and sam's club are ramping up the fight

>> thanks, amanda. new developments san francisco will soon be able to sweep homeless camps without previous court ordered restrictions. abc7 news reporter gloria rodriguez is live in san francisco. gloria, you have reaction from people who are for and against this. >> i do, reggie, and we know that homelessness remains a top concern for san francisco residents, and the city says it will resume sweeping encampments in just a matter of weeks. it comes after two critical court rulings yesterday, an appeals court overturned an injunction, pausing the city's efforts to enforce laws preventing people from staying out on the street. and there was also a recent u.s. supreme court ruling. san francisco city attorney david chu believes this will allow officials to more effectively tackle the problem. he argues the city makes offers of shelter and services, but many times the unhoused reject the offers. this was a big debate at last night's mayoral debate, hosted by ktvu. the two candidates currently not in city government promising stricter measures.

>> michael bloomberg's charity is donating $1 million to johns hopkins university. that money will cover tuition for medical students from families earning less than $300,000. the average medical school graduate owes at least $200,000 in student loans. state water officials are looking to see if a seasonal problem has returned to lake tahoe. they're warning about the potential of a toxic algae bloom, which can grow quickly when temperatures heat up. signs went up at el dorado beach in south lake tahoe, warning swimmers to be cautious of the algae. officials collected water samples today and should know in about a week if toxic algae is present or not. it's been a problem at tahoe beaches in the past. >> in the central valley, advocates are blaming an incarcerated woman's death over the weekend on heat exhaustion. state officials say the woman incarcerated at central california women's facility in chowchilla was hospitalized on july 4th and died two days later. the cause of death appeared to be related to an ongoing medical condition and not heat related, according to

critical ruling in that case. the judge ruled the prosecution cannot present evidence about baldwin's role as a co-producer of the movie. prosecutors wanted to show that baldwin fostered an environment of negligence and recklessness by allegedly rushing people to save time and money. that includes the movie's armorer, hannah gutierrez, who loaded the gun in the death of cinematographer halyna hutchins. she's already serving an 18 month prison sentence for involuntary manslaughter. the judge ruled only baldwin's role as actor will be considered at this trial. >> and that's good for the defense because they get to make the argument the same thing as the actor's guild. and unions have said that the actor isn't responsible for the gun. that's the producer, or especially the armorer. >> if convicted, baldwin could face up to 18 months in prison. >> federal aviation agents are now investigating after a slew of incidents involving passenger planes in just the last week. one of those incidents caught on camera, two planes appearing to be on a collision course with
