clearing homeless encampments. abc seven news reporter laura rodriguez joining us live in san francisco. and gloria, what will this mean for the city and for unhoused residents? >> reporter well, you know, kumasi this has been a debate for some time, and there are many people here in san francisco who disagree with the recent court rulings. but the city attorney believes this will allow officials to more effectively tackle this issue. the ruling from the appeals court yesterday overturned an injunction that prevented the city from enforcing or threatening to enforce laws that ban unhoused people from staying on public property. and now the city will be able to site and even arrest the unhoused. san francisco city attorney david chu says the city has spent billions of dollars on homeless services over the years. >> we could make all the offers of shelter and services that we wanted, but there were many moments where unhoused folks would simply reject or refuse services, reject offers of shelter.

>> we as a community and our political leadership over decades, not just the current leadership, but going back decades, have made concerted choices to disinvest in affordable housing and instead invest in policies that push people out. >> that's nisha kashyap, whose lawyers committee for civil rights was part of a lawsuit that sued the city over the rights of unhoused people. and she believes that these sweeps will only push people from place to place. and ultimately do little to solve the problem. and she's instead calling on elected leaders to invest in what she believes are real solutions. and there's still litigation ongoing about what to do with the property of the unhoused. and a lower court is expected to rule on that soon. live in san francisco gloria rodriguez, abc seven news. >> thank you. gloria. leaders in the south bay are considering a crackdown on encampments, and today it heads to a vote. amanda, this would involve people living and camping along creeks in san jose and reggie. >> we know it's been an issue

for quite some time now. now, valley water says it wants to ban encampments along waterways for safety, citing concerns about pollution in the water and dangerous conditions for staff. advocates for the unhoused say many people living along creeks are there to keep cool, with one person already dying from the heat. since the first of this month. they say there are other ways to solve problems. >> advocates to try and schedule things to have advocates on hand who usually have good relationships with camps, but also keeping the creeks clean. make sure that you always have porta potties with wash stations at all these creek areas. trash, chemicals, garbage, dog bodies, you name it. >> our rivers and creeks are not being environmentally taken care of. we do the best we can, but the destruction is overwhelming. >> enforcement would include a warning and education first, with 72 hours to voluntarily relocate, the next step would be a misdemeanor charge with a fine

or jail time. as punishment. valley water says that would be a last resort. it ultimately hopes local governments and social service agencies can work with them to create an overall solution. the valley water board is set to vote on the ordinance today, and if it is approved, it will go into effect in 30 days. back to you at the desk. >> thanks, amanda. a setback for affordable housing for farmworkers in the peninsula, san mateo county officials say they've decided a 50 acre property formerly known as bay city flour company, is not suitable for building housing, so they're not buying the land. the property was seen as a way to add affordable housing along the coast. after the mass shooting last year at two mushroom farms exposed poor living conditions that many farm workers face. another affordable housing project was just approved in half moon bay last month. >> today, the man charged with murder for the death of a woman at the powell street, bart station is expected to make his first court appearance last week. police say the man pushed 74 year old corazon dandan. she

hit an oncoming train, then the platform, and later died. two prior court dates were delayed because the man hasn't been well enough to attend. it's a story you've been following since the video was shared. a crowd of people rushing into this oakland gas station in the early morning hours of july fifth. now we're hearing from the business owner and the council member who represents the area, who tells us more needs to be done to keep businesses safe. the owner says it took officers nine hours to respond. oakland police tell us they didn't understand the magnitude of the incident until they saw the video. >> they said there was nothing we could do. you cannot just file a report online. that's how you respond. >> the owner tells us the vandals caused more than $100,000 in damage, including $22,000 taken from an atm. oakland city council member trevor reed, who represents east oakland, visited the gas station. she told us it was devastating to see such loss as crime is actually going down in the area. >> overall, there's a lot more

that we have to do to protect these businesses. our workers and just this tourism corridor so that we can really, you know, keep our businesses protected, our workers supported in this court are alive. >> the owner tells us he plans to have two employees working at all times and is considering closing up closer to sunset. >> new developments are french court has ruled a bay area native accused of raping a woman on a college campus in pennsylvania in 2013, can be extradited back to the u.s. the 31 year old ian cleary has been detained since april. investigators say he stalked the victim at a party, followed her back to her dorm room and then sexually assaulted her. the case was reopened in 2020 when the victim received several messages appearing to be from cleary, including one that read so i raped you. it's not clear when cleary will be brought back to the u.s. he's been he has refused to be extradited. that will slow the process forever. giant in san francisco, fans got

deaths. >> kumasi officials in texas say hurricane beryl has killed at least six people. five of those people died from falling trees. an employee with the houston police department drowned after driving through flood waters on his way to work. barrel dumped more than 13in of rain in some parts of the houston area. winds topped 90mph, causing widespread damage to businesses and homes. as the hurricane moved inland, transformers blew, causing nearly 3 million power outages. >> if we can get power restored, hopefully tomorrow afternoon, even that will be great. if not, every day that goes by certainly gets to be a more debilitating. >> in galveston, the mayor warns it could be two weeks before some people get their power back and feel-like temperatures in the coming days will approach 100 degrees kumasi back to you. >> thanks, amanda. 13 hikers who disappeared near the royal fire in the tahoe national forest are now safe at home with their families. this group was missing

since sunday night. the placer county sheriff's office says that these teens, ages 16 to 19, hiked the palisades tahoe trail before, so they were familiar with the area. deputies knew the group might be in trouble when they found their cars parked near the trailhead. a search and rescue team found them yesterday morning. >> so relieved, so happy. it's just, you know, that period of time when you don't know what's going on and it's like, i know all these kids are capable, but yes, it's a pure relief. >> the royal fire has burned about 200 acres so far. >> cal fire says there's no containment. >> happening today, the san francisco arts commission and port of san francisco will celebrate a new art installation. it's happening along the embarcadero. we were there as crews set up a nine foot bronze sculpture between the ferry building and pier one. yesterday, the san francisco arts commission and the port of san francisco tells us the statue is called. as sounds turn to noise. it shows a young black woman in jogging clothes meant to challenge, who gets to be

racetrack. the animal rights group kill racing, not horses, says two horses collided. one of them flipped, fractured its neck and then died. the group says this is the 44th horse death on california racing tracks this year, and the fourth at this year's alameda county fair. horse races. a new study is giving insight into how two of the most popular weight loss drugs compare overweight and obese people taking manjaro saw more weight loss than those taking ozempic. the two drugs are made with different active substances. the study, done by a health analytics company, was published today in the jama internal medicine medical journal. experts say it's hard to account for other factors that influence people's weight loss, so more research needs to be done. next, at 630, an

yesterday, an appeals court ended an injunction that prevented the city from removing unhoused people from the streets. this came after a recent supreme court ruling san francisco city attorney david chu believes this will allow officials to more effectively tackle the problem, according to the chronicle. until now, the city has been clearing parts of encampments. if they posted a health or safety risk on sidewalks. but they could not force unhoused people to leave, even if they refuse shelter or services. this was a big topic at last night's mayoral debate hosted by ktvu. the two candidates currently not in city government promising stricter measures. >> i believe our sidewalks belong to everybody in san francisco. they belong to young children. they belong to young families. they belong to the elderly. >> under my watch, we are going to stand up 1500 shelter beds in the first six months of my administration, people will no longer be able to resort to, nor will they be allowed to stay on

separated by 700 to 1000ft vertically. it's unclear how close they were horizontally. now this incident came after another mid-air scare involving a united airlines aircraft. a boeing 757 lost a tire after it took off from la. flight crew told passengers to brace before the plane landed safely in denver. you might remember a very similar thing happened here at sfo this morning. >> there are calls for tougher regulatory measures to mandate metal tests for menstrual products. a new uc berkeley study found tampons contain more than a dozen toxic metals, including arsenic and lead. but the authors say it's not clear if the metals detected in the study are causing negative health effects. they say little research has been done to measure chemicals in tampons. researchers hope this raises awareness and demand for better safety standards. >> jury selection begins today in alec baldwin's rust movie set shooting trial. the judge has already issued what could be a critical ruling in the case. the judge ruled the prosecution

cannot present evidence about baldwin's role as a co-producer of the movie. prosecutors wanted to show that baldwin fostered an environment of negligence and recklessness by allegedly rushing people to save time and money. that includes the movie's armorer, hannah gutierrez, who loaded the gun in the death of cinematographer halyna hutchins. now, she's already serving an 18 month prison sentence for involuntary manslaughter. the judge ruled only baldwin's role as actor will be considered at trial. >> and that's good for the defense because they get to make the argument the same thing as the actor's guild and unions have said that the actor isn't responsible for the gun. that's the producer, or especially the armorer. >> if convicted, baldwin could face up to 18 months in prison. there's an urgent request from first responders in the russian river valley. don't go into the river without a life jacket. if you aren't a strong swimmer. that plea, coming days after two people drowned in separate incidents on the russian river. the circumstances of the deaths are still under investigation. warning signs about river danger
