but what happens to the stuff that gets cleared? thanks for joining us. i'm julian glover and i'm dan ashley. >> good evening to you. court rulings both at the supreme court level and at the appeals court level, have made it easier for the city to remove people living out on the streets. >> abc seven news reporter luz pena got an exclusive look into the public works operation yard, where the city is storing the items they're collecting. luis joins us live in the studio with the story. that's a part of building a better bay area. lose. this is so interesting. >> very interesting. julian. the caveat is that san francisco has to allow residents to recover any personal property that is collected during the sweeps. today we got to see firsthand where the city is storing these items and their process. reporter this is where all the items collected during sweeps of san francisco encampments. >> and now this is this contains all the items brought in the month of june. >> we looked inside with edgar garcia, the operations supervisor for public works. his team is in charge of storing and documenting items. >> this one says it was picked

up from 1250 one third street, cross street, china basin. it has the tag number 36 the color. they're all separated by a different tag color. and every month has a different color. >> after every encampment sweep the city street crews leave a note with information on where to collect the items. >> they take a picture out in the field or out at the police station showing what was picked up, and they also take a picture of it in the container, showing that it was brought back to the yard. they usually walk up to the front gate. the security guard gets their information, calls us. >> people have three months to retrieve their belongings. >> 90 days is better than no days. >> in december of 2022, a court required san francisco to follow its own policies by offering shelter before citing or arresting people for not moving their things off the streets. on monday. that part of the injunction was lifted. so with the sweeps poised to resume, dpw is ready to continue storing anything collected. the

coalition on homelessness is concerned about the latest decision. >> currently, homeless people are already under attack and the latest rulings will just exacerbate that, i think it's common sense that if you have your belongings seized or destroyed, that you're losing a part of your humanity. during that process. >> even with legal challenges, san francisco has increased encampment sweeps in 2023, records show. the city's team moved more than 1500 people from encampments to shelters. a 22% increase from the year before, which helped reduce tents on the streets by 17% in the last quarter of 2023. and do people normally come and collect their items? yes. >> how often? it's hard to give an actual count, but i'd say at least maybe 25% of the time they actually come back and get their stuff. >> according to garcia, they frequently store items for more than three months. after the 90 days, what do you do with the

items? >> we dispose of them. >> what does that mean? >> we send them over to the dump. we don't know. you know what can be inside of those backpacks? so for safety purposes, we disposable and to collect items. >> people have to physically go to the public works yard and show their id, along with the tag left behind by the city. and in many cases, those items are everything someone owns. luz pena, abc seven news. >> so true. all right, luis, thank you. after more than five hours of impassioned testimony, south bay water officials decided not to vote on an ordinance to prohibit encampments along creeks and rivers. many santa clara valley water district employees spoke out about not feeling safe while working around these encampments. workers say they have been threatened, some with machetes, while trying to do flood protection work around waterways. but some fear the ordinance would criminalize people facing homelessness, blaming the unsafeness on an unhoused people.

>> sorry, we should be doing more for workers. we've seen security advisories about people throwing rocks, hypodermic needles stuck near locks, and aggressive individuals and dogs. >> the board decided to reconsider the encampment prohibition and look at other options in october. we'll keep tabs on that. and santa clara is the only bay area county to ever top 10,000 homeless in an annual census. the last count done last year was slightly less at 9900. that same year, alameda county tallied 9700 homeless. this year, it's down about 3% or so. san francisco's homeless population went up nearly 10% from last year to this year. the number of homeless is at a record high, roughly 8300 people. >> well, hopefully you got out and enjoy the cooler weather today. a break between the heat waves. but the heat is going to return tomorrow along with the spare. the air alert day. >> yeah, big time heat. actually. abc7 news meteorologist sandhya patel is tracking that for us. sandhya.

>> yeah, we're talking triple digit kind of heat. dan and julian, let's take a look at the warnings that are going up tomorrow morning at 11:00 for our inland areas. it's an excessive heat warning. uh- areas right around shaded in orange. other than the coast and san francisco going under a heat advisory. these will remain up until 8 p.m. friday. the reason for it is we are expecting an increased risk of heat related illnesses with the kind of temperatures we're expecting. so tomorrow, 104 degrees in antioch, 103 in livermore and fairfield. these will be some of our hot spots, not quite as hot along the coastline, which is why, you see, they're not in that heat alert, warning or alert or warning. as you will notice, the heat risk will be in the moderate to major category for our inland areas tomorrow. so definitely take it easy. the spare the air alert is up for tomorrow as the air quality will decline inland, east bay and santa clara valley going to poor air quality as high pressure puts a lid on things. moderate air quality expected on thursday. i'll be back with a

full look at your temperatures for tomorrow and beyond, and let me just give you a hint here, julian. it's only going to get hotter on thursday, but i'll let you know when some relief will arrive. >> can't wait to hear about that relief. thank you so much, sandy. a brief scare this afternoon in the south bay in san jose. a grass fire started just before 12:30 p.m. near santa teresa county park and burned about 25 acres before firefighters got it under control. people were evacuated from the park and part of santa teresa boulevard. it was briefly shut down. no reports of any injuries or damage there. you can see wildfires in california at a glance with our abc seven news wildfire tracker. you can find it at abc seven news.com/fire map. >> we want to update you on just a tragic incident in san francisco. a baby who fell out of a third story window last wednesday. we are sad to say, has died. the 15 month old boy fell more than 20ft from the top floor of an apartment building on mission street to the ground below. rescuers had to break

down part of a fence to reach the child. the baby died at the hospital. child protective services is investigating what happened. an arraignment has been delayed for a third time for a man charged with murder, for shoving a woman into an oncoming bart train last week. the judge is waiting for a mental health evaluation of this 49 year old man. he's accused of pushing 74 year old khairuzan dandan in front of a train at the powell street. bart station. dandan hit her head on the train and sadly died, and a man accused of planting a bomb in san jose, then calling police on himself, is now scheduled to make his first court appearance in the case tomorrow. if he agrees to show up. the 56 year old was originally supposed to be arraigned here. the formal charges against him last friday. then yesterday, then today. but he is has been refusing to go to court. so we'll see what happens. last wednesday, the san jose police bomb squad safely detonated a device found behind a mental health resource center.

the discovery triggered a widespread evacuation in the area around ritter park drive and fox lane. police say it will take more time to determine if the device posed a real danger. >> there are multiple components that make up an ied. those materials are still being tested in the lab. >> police say the motive is still under investigation, but they say the suspect has an extensive criminal history, and court records show he's been in a mental health diversion program since 2021. >> taking a look at covid cases, they are on the rise once again here in the bay area, right now. but a lot of the formal guidelines about quarantining and masking, those are gone. abc seven news reporter leslie brinkley went to the bay area's health experts for advice on the new protocol. >> i just got off the phone with somebody who said she has covid right now and is recovering. >> it's likely, you know, a coworker or family member or friend who is sick this summer, and you wonder, do they have

covid? >> summer is just the time where people travel a lot. they're going out more. they're seeing more people going on vacation. so more time to potentially be exposed to covid 19, particularly as we're seeing just increases in cases. >> so where to start if you have cold or flu like symptoms? >> first of all, throw out any expired test kits. you can't trust the result with a new kit. if you test positive, you are positive. >> if you've got a negative home test, but you've got signs and symptoms of covid, you've got to assume that that could be falsely negative and repeat it the next day and the next day. and the next day. >> if you're positive for covid, do do you stay home until you're feeling better or your fever is resolved for at least 24 hours? >> there are no clearly defined rules anymore. but doctors do have suggestions. >> you don't have to isolate for five days anymore. but going out into the world doesn't mean you're going out. and, you know, sort of being normal. you're

longer happening. it comes after the abc seven news i-team learned the town sent a letter to the property owner raising concerns about code violations. abc seven news reporter stephanie sierra is in the newsroom to explain exactly what the problem is. stephanie. >> yes, dan, you may have seen that special omakase sushi experience that went viral on social media. diners in the flintstone house were reserved for this friday, july 12th, and the owner says the seatings were fully booked through the end of the month. but now refunds are on the way after concerns over zoning violations. what could be better than visiting the iconic hillsboro flintstone house? how about eating sushi flown in from japan, prepared by michelin chefs? that was the business

venture of shawn fang, owner of stone age omakase. he's the grandson of flintstone property owner florence fang. but that dream is currently on pause. according to this letter from the town of hillsboro, the property is located within a single family residential zone. restaurants and other commercial uses are not permitted in a residential zone, even on a temporary basis. >> so after some looking into it, they sent a letter off uh- to the resident, essentially stating that it appears to be outside of our zoning ordinance. >> was there any communication from the fang family about pursuing a catering business in the flintstone home? >> no, i did not receive any pre notification of it. so again, i kind of learned about it in the same way that most of us did through seeing about it on social media. >> after abc seven contacted john fang monday evening, stone age omakase made this post on instagram saying quote, we would like to inform our valued clients and supporters that due to concerns raised by the city

of hillsboro, we have temporarily paused our catering operations at this location. fang was unavailable for an interview, but texted me, we think hillsboro is wrong, but we respect them and don't want to fight with them. therefore we are refunding reservations and are looking for other venues. there will be more to come soon. >> you know we certainly see catering events and those are fine in town. we have many private uh- events that are catered at the town, but this is the first time where i've seen, what it looks to be an attempt to open up a restaurant within the town. >> fang also told the i-team, we aren't a restaurant, we are a catering company specializing in home okc, bringing michelin starred chefs to create omakase experiences in private homes. unfortunately, we have been incorrectly classified as a restaurant, which has led to this misunderstanding. >> businesses in general are not allowed in hillsboro to run a commercial operation out of your out of a home. >> while it's unclear what the

next step will be, both parties are willing to collaborate, fang told us. we look forward to working with the city to resolve this issue and resume offering our unique culinary experiences to our clients. >> i welcome their ideas. i think we're pretty open to having any conversations that the family or the people putting this on want to have. i mean, our intent isn't to keep people from doing things on their private property. it's just to make sure that everybody is enjoying their own private property without kind of infringing on other people. >> doug davis added if there's some creative ways to actually make this work, the city along with the legal and code enforcement teams, look forward to hearing from the flintstone owners. so dan and jillian, it appears this omakase now referred as home okc in this case may get a second life when that's in compliance with the city. >> all right. we'll follow that and see stephanie thanks very much. >> okay. let's take a look outside. uh- really nice day across the bay area today. lovely >> and we hope we enjoyed it because tomorrow is going to

change dramatically. meteorologist sandhya patel is back with more heat. sandhya. >> yeah, and unfortunately it is going to be intense in our inland areas. dan and julian so be prepared for that the next three days. but for now i want to give you something that will kind of give you this comforting feeling. yeah. our marine layer is from our east bay hills camera. you can see it just kind of rushing in many areas this morning. started off this way. and tomorrow morning we're going to have still the marine influence. so you don't have to worry about the heat right near the coastline. but high pressure unfortunately is going to rebuild. and as it does, we are expecting those temperatures to spike in our inland valleys. it will be warmer around the bay as well. today it was in the upper 80s inland, so warm inland but comfortable in the 60s at the coastline on live doppler seven, you can still see a lot of low clouds along the coast. we still have some right around the bay shoreline as well. never quite cleared. gusts to 32 miles an hour onshore in oakland. that is going to transport that marine

layer into some of our valleys. once again, temperatures drop some more by nine degrees in concord and livermore, down five in san jose and four degrees cooler in novato. a pretty view from our oakland airport camera. you can see kind of a little bit of sun through the clouds. 60s from san francisco to oakland, 76 in san jose, you're at 75, in redwood city, looking from our mount tam cam. not only are you seeing the marine layer, but you can see why a spare the air alert has been issued, and this is with a good breeze. the breeze will be a weaker tomorrow. so you're going to see more of this haze. 74 in santa rosa. still in the 80s. inland sfo camera. you can see the marine layer, the sea breeze. here's a look at the headlines. next three days. triple digit heat inland coastal areas will remain mild with a fog. sun mix and your weekend weather will be breezy and cooler, so at least the heat will back off by the time the weekend plans begin tomorrow. tonight, excuse me. 70s and 80s inland at 715 50s coast side. the low clouds and

fog will push in across the bay later on tonight and tomorrow morning begin your day. temperatures will be in the 50s and 60s as we head into the afternoon hours quickly where the sun is out early upper 80s to low 90s by the lunch hour, and you will notice triple digits in the afternoon. coast side though we're going to keep you in the 60s, which is where you want to go. if you don't like the hot weather. so your morning temperatures with the fog, we're going to see numbers in the 50s and 60s tomorrow afternoon in the south bay heating up again, 101 in morgan hill, 93 for you in san jose on the peninsula, 90 in redwood city, 64 half moon bay, downtown san francisco, 74 degrees in the north bay. those temperatures anywhere from the 70s at the beaches to the triple digits inland around lakeport. 98, santa rosa 93. in san rafael in the east bay 81. berkeley 82. oakland 90. in castro valley, you get out to the other side of the hills and you're going to feel that heat. 102 in concord,

104 in brentwood. your accuweather seven day forecast. the temperatures are going up a little bit more on thursday. dangerous heat expected inland up to 108. don't worry though, the coast will still remain in the 60s. and then the last day of triple digits will be friday before we cool over the weekend and into next week with low 90s, and i can't wait for it to drop to plummet to 90. yeah, it'll be a nice change. we'll take it. >> yeah. thanks, andy. appreciate it. >> the oakland zoo's only elephant is about to leave for a new home. the zoo says osh is making a cross-country move after 20 years in oakland. osh is packing up and leaving for an elephant sanctuary in tennessee. the zoo says osh is really social and smart, so it's better for his well-being to be around other elephants. >> so he's always been, a very brave elephant, you know, very interactive, which is part of the reason we know that he's going to do so well at the sanctuary, because he's a super confident individual and osh is a spry 30 years old, more than

a young black woman in jogging clothing. that's what you're looking at here. the san francisco arts commission says the work is meant to symbolize inclusion and the power of being seen. they placed it along the embarcadero so both tourists and locals will get to see it often. >> the fact that we have a black woman that is larger than life, standing as a representation of art and culture in san francisco makes me feel appreciated. it makes me feel like i belong that much more in this city. >> the city's arts commission says it's working on improving representation in the city's public art. the installation at the ferry building runs through january. >> an extensive report from bart that was released today looks at

bart's role in the bay area and what the future could hold. it also identifies what needs to change in order to keep the trains rolling. bart relies heavily, of course, on fares to fund the system, and that took a real hit during the pandemic, the report says. bart needs to start looking to the state, the federal government or another option for money. and speaking of the pandemic, the report says 72% of riders have returned. but there's an interesting caveat to that. trips are only at 43, meaning while people are getting on the trains again, in larger numbers, it's just not happening as often. we've heard a lot about the potential for drastic cuts. if bart can't get the money it needs. the report looks at what happens if operating expenses are slashed by 30. well this would result in an 85% reduction in service. >> a new way to travel between oakland and alameda debuts next week. it's named woodstock. that's the new water shuttle purchased by the city of alameda starting on july the 17th. this

little yellow boat will run across the estuary between fifth street in alameda and oakland's jack london square. this provides an alternative to the posey tube for pedestrians and bicyclists. the trip takes about 15 minutes. service on the water shuttle is free and will operate wednesday through sunday. this is a pilot program running for the next two years. >> coming up next. too hot to handle. we can finally put a dollar amount on the extreme heat and it is only going to get worse. >> plus, we're following the story of those fbi raids at oakland. the oakland mayor's home, and others. what we're learning

addressed to oakland city attorney barbara parker. the oaklandside posted the subpoena on their website. the u.s. attorney wants the city to hand over various documents. >> that's serious. and, you know, i mean, that's the first time that i've been involved politically here that i've heard of a federal investigation. >> you see, law associate professor jonathan abell says this is the first look at what federal authorities may be after, and that a federal grand jury will be handling this high profile case. a federal grand jury will determine if there is enough evidence to file charges or indictments. >> this is a road map to the things that they're interested in. >> according to the chronicle, last week, in connection with a federal grand jury subpoena, the oakland city attorney reportedly told some city staff to preserve all documents related to mayor sheng tao's partner, andre jones, as well as california waste solutions and the duong family. >> they don't want someone putting them into a shredding machine today. >> among the documents, the subpoena demands communications

related to andre jones, all calendar entries or records of the existence of planned or scheduled meetings with tao or jones from june 22nd to the present. >> we don't really know how all the pieces fit together, but you can see that types of things are interested in. >> the subpoena also requests documents and communications related to the former oakland army base and efforts to fight homelessness that were considered by oakland city council last year. >> so i think what what they're trying to find out is who was involved and who was asking for what. >> we reached out to mayor tao's legal counsel, attorney jeff tsai. he did not want to comment on the matter today. this afternoon, a spokesperson for california waste solutions and the dow jones issued this statement saying, quote, the company is currently working closely with federal investigators to support and expedite their investigation, which is unrelated to kw's operations. >> but it's disturbing. it's really for me, it's, you know, we're losing a lot of confidence. and from the public

in washington, dc. mr. biden opened the gathering, announcing plans to supply new air defenses to ukraine. that's a major boost for the country working to fend off russia's ongoing invasion. >> putin wants nothing less, nothing less than ukraine's total subjugation. and to wipe ukraine off the map. and we know putin won't stop at ukraine. but make no mistake, ukraine can and will stop putin. >> analysts say the summit is also an opportunity for mr. biden to demonstrate that he's capable of meeting the grinding demands of the presidency for four more years. the president says his work at the summit would be a good way to judge his continued ability to do the job, as he faces calls for him to drop out of the presidential race after the debate, the other week. now, barbara boxer is speaking out in support of biden's candidacy today at 3 p.m. on our program, getting answers. the former senator from

billion loss for businesses in the state. >> having a number gets people focused on wow, this invisible silent thing is really costing us money, kathy baughman mcleod is part of the state climate insurance group. >> she says heat events create ripple effects that impact the entire state. >> heat affects the human body, our health. it slows us down. we have worker productivity impacts. you know, we make less money when we're slow and we make mistakes or get hurt in the report, heat events led up to $210 million in labor productivity losses. >> power outages cost up to $230 million and millions went into repairing infrastructure damaged by heat and wildfires. >> then there's the cost to business interruption. schools are closing. metro systems closed down so people aren't getting to work, food systems are affected, supply chains are affected, and as climate change worsens, experts say these heat events will to. >> in the last 25 years or so, because of climate change, because of an ever of a

baldwin said he pulled back the hammer, but not the trigger. >> you never pulled the trigger. >> no no no no no, i would never point a gun at anyone and pull a trigger at them. never, never. that was the training that i had. you don't point a gun and pull the trigger. >> baldwin's defense team scoring a win at a pretrial hearing on monday, the exclusive responsibility of gun safety is on the prop master. >> the armorer, the first assistant director, doesn't say anything about a producer. >> the judge throwing out the prosecution's ability to argue that baldwin's role as a co-producer on the film bolstered the evidence that he was negligent, the judge saying the state can only argue baldwin's culpability as an actor. it's more about his mindset because this whole case comes down to responsibility and foreseeability, and he's an actor. >> he's on a movie set, it's a western. he's being handed a gun now. it's a functioning gun. but for his purposes, that's a prop when that's being handed to him, and he believes that it's safe. >> rust armor hannah gutierrez
