president biden addresses the nation right here on abc seven. his address to the american people airs live from the white house at 5 p.m. >> now to allegations of wrongful death, neglect and fraud exposed by the abc seven news i-team. >> i don't know, like, where to start, because every day i was just fighting with them for adequate care for my father. >> we're hearing from the family of a man who died while in the care of a nursing home in east oakland. i-team reporter stephanie sierra has their plea for justice. she has the story live from our newsroom. steph. >> yes, kristen. the story told in this complaint is sadly a familiar reality among low staffed nursing homes. the allegations accused this local facility of chemically restraining a man for, quote, convenience without any consultation from his doctor. and the lawsuit also claims it was a substantial factor that caused his death.

>> i was hurt, i was scared, like for him, it was just bad. >> kiyomi williams admitted her father, orlando into windsor health care center of oakland following his leukemia diagnosis. it's a skilled nursing facility along fruitvale boulevard on the city's east side. now she's suing them. >> it was a horror movie. >> less than a month after his admission to the facility, her father was found dead in his bed. after what this complaint alleges was reckless. overmedication with sedatives and narcotics. williams allegedly faced untold pain, suffering and injury as a result of the reckless neglect and abuse from staff at the facility, according to the complaint filed in alameda county superior court. >> i was under the impression that it was a 4.5 facility, but when i got there, it was just totally unacceptable. >> on december 14th, 2022, several days after being

admitted, the complaint alleges williams reportedly eloped from the building and his daughter found him by a nearby crosswalk. >> i made a big fuss about it. that's when you know, they start medicating him and every time i come there he was unable to tal. >> the facility allegedly never reported that incident to state regulators, which the complaint claims is required by state law. instead, the complaint alleged the facility secured a physician's order for ativan, a sedative and morphine narcotic, to prevent him from getting away. >> that's basically chemically restraining someone, but it's a it's a very, in compassionate way to deal with people, and it can be deadly, as it was in this case. >> the legal document also claimed during her father's entire stay at the facility, unqualified staff heavily dosed him with sedatives and narcotics without directly consulting with his doctor, which was required by the facility and the physician's order. >> large doses of ativan. that was the ultimate cause of his

his death, and that's a horrible way to die. >> the i-team reached out to windsor health care center of oakland, along with some of its parent companies, for further comment, including the parent company's ceo, billionaire businessman shlomo rechnitz, who owns dozens of nursing home facilities across the state. but we have yet to hear back. the facility is part of a larger network of nursing homes that have been scrutinized in recent years, the complaint alleges. the company presents false representations and manipulates that five star rating system with respect to staffing and quality of care, according to care compare, a federal oversight arm for nursing homes. the facility has a four out of five star rating on medicare's website. >> we've got five current pending cases against him and his facilities, and that's one hallmark in all these cases is that they are significantly understaffed. >> now, we've made additional attempts to reach the facility and its affiliates today following multiple requests last week, but again, have yet to

hear back. and larry and kristen, i do want to mention there was another case out of sacramento county in 2020 that involved the use of ativan and the drugging of a patient, and while that lawsuit did not involve any of the defendants in this case, the outcome resulted in a $42 million verdict. >> stephanie. thank you. now to relief in sight for our heat wave. finally got a live look at one of the hot spots which is walnut creek. >> abc7 weather anchor spencer christian has a timeline for those cooler temperatures. cannot wait. spencer. >> they're right around the corner. kristen and larry, let's take a look at our satellite radar composite image. you can see high pressure, which has brought us this heat wave sort of edging to the east right now, and a trough of low pressure to our northwest, digging down and bringing us the cooler weather that we're going to get the relief over the next few days. but still, until all that happens, we have a heat advisory in effect until 11:00. this evening for the east bay hills, the east bay, interior valleys, santa clara valley, and the eastern santa clara hills. let's move along and take a look at current temperatures. it's hot

inland right now. not quite so hot as the last couple of days, but it's 100 degrees right now at fairfield upper 90s at concord, livermore, up in the north bay, saint helena. so still pretty warm. but as we look ahead, you can see tomorrow a nice cool down, high temperatures inland will be on the warm side, but no triple digits, just a few mid 90s. and then by friday saturday, significantly cooler. i'll have the full accuweather seven day forecast a little bit later. >> kristen chancellor, thank you. in the south bay, where a small business owner is recovering after a violent store robbery, he's determined to get justice. as abc seven news reporter zach fuentes shows us, he's sharing some key evidence in the case. >> the video is terrifying. the owner of dab society smoke shop and cbd pharmacy, shot by masked robbers in his san jose business. his injuries were potentially life threatening. >> about roughly 80 stitches on my body currently and broken bones, of course, my artery was the main artery was shot at, so

there was. i lost a lot of blood, about 35 pints of blood. >> jay patel said it happened around two in the afternoon on july 6th. a man who made him uneasy came into the store. >> i guess that he had seen the watch, the rolex on my wrist based off of the build and clothing, patel believes that same person was one of the masked robbers who came to the store just a couple of hours later, they said, let me get your rolex and i had long sleeves on that day, so my watch was covered. i looked down, i'm like, how do they know i have a rolex on? >> it was just seconds after that a gun was pulled out. >> the gun was about three feet away from me, so i pushed the gun away. and i have a full metal door where my office is in the back room. so i try to run to the metal door and shut the door. he ended up actually just shooting me on the side of my hip, and a shot that patel said has glass worth thousands of dollars. >> those suspects got away with the watch. smoke shops have been a target in san jose just over a year ago, san jose police made an arrest in connection to burglaries at more than ten, the suspects taking stolen cars and

crashing them through the exteriors to break in. san jose police tell us that the investigation into what happened at patel shop is still being investigated, and detectives are still following up on leads. patel is hopeful someone will come forward with information. >> i want these guys caught and i'm very concerned about all the neighboring businesses around me or any other smoke shops back at the store, patel and his manager have already made changes, started to immediately box off the area more, make it more secure, make it visible to people outside. >> what's happening inside while patel is still on the mend, he has at least a six month recovery ahead of him, including physical therapy in san jose. zach fuentes, abc seven news. >> the owner of a popular oakland restaurant, he's absolutely fed up right now after his business was burglarized for the seventh time in the last four years. the latest incident happened early this morning. and this is surveillance video from kitchen story on college avenue in rockridge. you can see the burglar trying to pry open a

door unsuccessfully and then run off. the owner tells abc seven news that door is to an office where money and ipads are kept. now, the burglar didn't get away with anything this time, but outside the restaurant you can see some of the damage. kitchen stories. front door was bashed in. the owner says repairing the glass has cost him thousands of dollars every time this has happened, and now he's questioning why oakland police do not patrol this area. >> you know, i really, you know, sick of it because you know, when they call the police, no one come help me. don't we don't even. you know, i'm going to make a report with the police. i don't have no chance to do that. they just say, like, you know, i can do online. what point? >> we reached out to oakland police for response, but have not heard back yet. you have an opportunity to look up crime where you live. we have data showing trends for oakland, san francisco and san jose. the abc seven neighborhood safety tracker is on the front page of abc seven news.com. >> a closer look at the airline industry. federal officials say they'll launch investigations

least three flights since april, in which planes were at dangerously low altitudes in the most recent case, earlier this month, a flight from ohio to florida flew as low as 150ft from the ground while it was still nearly five miles from its destination. southwest says it's working with the agency and its own team of experts to perform an in-depth analysis and make improvements. >> take a live look at sfo right now. as the department of transportation begins an investigation into what's going on with delta airlines. now, this follows the crowdstrike it outage that affected flights all across the nation last week. and while most airlines were impacted, delta clearly has been hit the hardest. the company admits it's struggling to repair some of its systems. and a company memo delta says it's working to reposition planes and people and expects to return to normal operations by the end of the week. now, today, delta is reporting eight delays but no cancellations at sfo. across the country, an estimated half

onshore, not gentle brisk onshore breezes and gusts up to 33mph at oakland right now. so locations near the coast and bay will feel a little bit cooler tonight, but inland areas will still be warm and generally across the entire region. you can see the 24 hour temperature change shows the inland areas, although they're still sizzling, are several degrees cooler than they were at this time yesterday. so the cooling is underway and on we go to current temperature readings 72 right now in san francisco, 78. in oakland we've got 86 at hayward, 90 at san jose, 85 redwood city and 66 at half moon bay. looking down from mount tam right now under blue skies, 91 degrees at santa rosa, 88 petaluma, 85 at napa, 100 right now at fairfield. mid to upper 90s at concord and livermore. and on we go to our forecast headlines. today's heat advisory. it's expires late tonight. tomorrow and friday it will be breezy and much cooler. this weekend will bring us even below average temperatures which will be quite refreshing. but again, we still have this heat advisory in effect until 11:00 tonight. and it's in effect for the east bay hills. the interior east bay

valleys, the santa clara valley and the east santa clara hills. and under those conditions, of course, there's still an elevated risk of heat related illness. overnight, we'll see marine layer trying to form. and along the coastline there will be numerous pockets of drizzle, maybe even light showers, mainly off shore. but some of it may make its way onshore overnight. low temperatures in the inland areas, as i mentioned. still quite mild, low to mid 60s inland but near the bay and the coast will see some lower overnight temperatures and highs tomorrow. 60 two half moon bay 68 san francisco, oakland 75. many locations around the bay shoreline, though, will heat up into the low to mid 80s. inland areas mid to upper 90s tomorrow. no triple digits likely down in the south bay. a high of 89 at san jose. up in the north bay. we'll see upper 80s to low 90s. and here's the accuweather seven day forecast. look at the cooling continuing on friday and saturday. inland highs saturday will barely reach 80 degrees. that is quite a cooldown from what we've had the last few day. and barely 70 degrees around the bay shoreline. and then we'll

white house shared some excerpts from his upcoming speech, and the president will say, the defense of democracy is more important than any title. i draw strength and find joy in working for the american people. but the sacred task of perfecting our union is not about me. it's about you. your families, your futures. it's about we the people. i've decided the best way forward is to pass the torch to a new generation, and that is the best way to unite our nation. let's delve into what we can expect from the president's address tonight. >> all right. phil is here with us. phil, this has got to be just so, so incredibly difficult for him. the toughest one of his life, his political career. >> yeah, we're talking about, you know, 48 years being a senator, vice president and president. and basically he's saying he's that he's he's stepping out. he's stepping aside, and he's not stepping aside to do a victory lap. although he hopes to have kamala harris replace him in the white house. we have to be honest, he was pressured out. now this is also coming after a week of isolation because he tested positive for covid. so one of

year again. the start of school shopping, back to school shopping. and it's stressing many people out. a lendingtree survey found nearly 3 in 4 shoppers say they're stressed over how they'll afford school supplies. nearly 70% of shoppers expect to spend more than last year, and about 30% say they're unable to afford it. that's up about 5% in 2023. despite that, more than 8 in 10 shoppers say they will take on the extra expense of helping to stock classrooms with needed supplies. and of course, teachers have been doing that for a long, long time, a long time, but so expensive. how much are you budgeting, >> you know, i will say i'm very fortunate to be able to afford what we need, but actually, i don't know that i've thought about anything i need to get at this point. she's still so little. but, yeah, the teachers spend a lot. my dad was a career

that reason? >> yeah, it's phased out pretty much in our home. but you know, i'm curious how severe can the effects of this be and how long might they last. that's i didn't see that in the report. >> i feel yeah, i feel like it's one of those where yeah, there's no proof yet, but i guess if you can avoid it because you see the little bits and pieces over time that start to come off. >> so during the pandemic, i did go down the rabbit hole and i'm like, i'm killing my family with cooking utensils. so i got rid of all the pots and pans and switched to stainless steel. but i will say there is a learning curve, especially if you're making eggs. yes, it took it took a little bit of figuring out. but yeah, you know, once you know how to use it, it's just a little different, >> open question here. so what's the best? is stainless steel. is it cast iron? is it something else? do we have any. >> i guess it also depends on what you're cooking. yeah. i mean, i settled on again. it was like that i was going to all these different websites and consumer reports and trying to figure out what, what is probably the least damaging to our health.
