point. there are evacuation orders and warnings in effect right now for parts of concord and bay point point north of highway four. >> and for the latest on the fire, let's get to abc seven news reporter anser hassan unse, ama and dan. >> good evening. i just spoke to contra costa county fire protection district captain chris toler about 20 minutes ago. he says three sections of the driftwood neighborhood here in bay point are still under mandatory evacuation. here's why. right behind me, these are the homes that are in the line of the fire's path. fire crews have been trying to contain the fire so it doesn't get into the neighborhood. they've been using bulldozers, bulldozers to create firebreaks. firefighters on the front line monitoring where it burns. you can see this is a valley. you can probably hear. it's also very windy. the big concern is wind carrying an ember down into the neighborhood. the top priority is to save these homes, says captain chris toler. here's what he had to say when we spoke to him a short while ago. >> crews are in the field in the

sort of the field or the wildland area to actually, fight the fire directly, direct fire, attack. but we also have crews providing structure protection. there in and around the homes or in and around the neighborhood to make sure that the fire does not affect or get to the homes. >> and cal fire is also out here. they're doing air drops. the other big concern with this wind is embers igniting a fire on the other side of the hill, which runs parallel to highway four. right now, highway four is open. it's commute hours. and as dan and as you mentioned earlie, 0% containment and we will keep you updated with the very latest throughout the rest of the evening. reporting live anser hassan abc seven news. >> okay. thanks very much. answer. all right. >> the weather, of course. important to monitors. let's bring in abc seven news weather anchor spencer christian. >> spencer. the wind seems obviously to be a factor today. blowing pretty strongly, isn't it? that's true. >> dan, right now the wind is the most significant factor, probably because some of the

other factors are changing just a little bit. so earlier we had temperatures up around or even above 90 degrees. it's down to 84 degrees right now relative humidity is coming up from a low of about 12% to 31%. now we typically see an increase in humidity in the evening hours. but of course, this is not a significant enough increase to reduce the fire danger winds out of the southwest. the steady winds at 15mph. but the gusts are at or above 25mph. so you can see it's still dangerously low. relative humidity and strong, gusty winds that are even gustier now than they were in the previous hour. so that's still an issue and i'll continue watching it and reporting any changes in the conditions. dan and ama okay, spencer, thanks very much. >> i just want to update that fire now near bay point. now it is about 20% contained. so that's encouraging. we're also tracking a fast moving fire in the sunol area in alameda county. they're calling this one the creek fire. it's burning along calaveras road near welch creek, close to the sunol regional wilderness. a time

lapse video captures a lot of smoke over the hills. as you can see, it's burned 70 acres since it started just before 4:00. this afternoon. a couple of hours or so. there's no containment and firefighters are evacuating the park. cal fire has a number of aircraft supporting firefighters from the air. >> the biggest wildfire in california right now is the park fire. it's burning in butte and tehama counties and has grown rapidly since starting on wednesday. abc seven news reporter melanie woodrow is here with the latest on this firefight. hi, melanie. >> i'm on the park. fire has exploded in size northeast of chico. the area that's burned is more than 250mi■!s. that's five times the size of san francisco. with thousands of buildings threatened and at least 134 burned. governor newsom has proclaimed a state of emergency in plumas, butte and tehama counties due to wildfires. the park fire has destroyed more than 100 residential and commercial buildings. in addition to burning brush, timber and vegetation. evacuation orders are in place.

officials say they believe the fire began with arson. the butte county da's office says a man was arrested for allegedly pushing a burning car into a gully. officials think the fire spread from there. this dc ten air tanker is just one of the many tools cal fire is using to help fight the fire. >> we are part of that wheel that gets it all done, but we are supporting the guys on the ground. they are the key people. >> cal fire is able to extend the air fight beyond sunset thanks to night vision goggles, allowing crews to attack fires when they tend to be less active. >> it's a very synergistic where we have to have everybody moving together and coordinating, you know, at the right time. >> the fire has been exhibiting extreme behavior time lapse video shows a fire world yesterday, a tornado like vortex of smoke that can send embers soaring far ahead of the fire. it's extremely dangerous and a sign of just how intense the park fire is in. evacuation center has been set up in chico, and animal shelters opened in oroville. the park fire, highlighting what has already been a busy fire season. cal fire says in a typical year,

with corinne barker, including the fact that she intends to keep working for the sheriff's department. >> and i went through uc berkeley as a pre-med student and was working as an emt at the time. >> 32 year old corinne barker told me in this exclusive interview that she studied to be a doctor, but she became drawn to law enforcement. >> i had a change of heart, i started doing ride alongs and i just loved it. i loved that you could be able to help somebody on their worst day and make it maybe just a little bit better, or make them feel a little bit safer. >> she excelled as a san mateo county sheriff's deputy, receiving the department's medal of honor with her partner for rescuing a woman from a burning mobile home. >> and i was trying to hold my breath because it was pretty impossible to breathe. so i would come back out to take a breath and then go back in to look for her. >> then barker joined the department's swat team, the only female member of the unit. >> that was kind of my pinnacle. that's as soon as i became a

deputy, i knew i wanted to be on swat. >> how long before the problems started? >> i now see that it was almost immediate. i think at the time i was very trying very hard to block it out. you know, i had worked so hard to get on that team and it was everything to me. you know, it was blood, sweat and tears that i put into it. >> the lawsuit against the county lists lewd comments allegedly made by her swat team leader, andre munoz, in front of other officers wanting to have sex with me, wanting to watch me do sexual things with other people, barker tells me. the comments were relentless and that it got physical during a training session out of town in front of other swat team members. >> he wrestled me to the ground and reached his hand through my leg. you know, touching private areas. >> i reached andre munoz on a cell phone last night. he hung up as soon as i said my name and referred me by text to his lawyer, jonathan murphy

confirmed he's representing munoz in a personnel matter, but would not go into detail and would not offer any response to barker's lawsuit or the settlement. she told me her complaints to the county's hr department went nowhere. >> i really, really hoped something would come from that, and when it didn't, i was scared. >> then came my bat mobile investigation. in july 2022, i reported that then sheriff carlos bolanos sent a team of investigators to a garage in indiana to recover a replica batmobile for a friend. >> andre munoz was thought to be the leak, who leaked that information to me? yes. to you? yeah. >> munoz was not my source, but bolanos sent it to internal affairs and corinne barker's sexual harassment complaints became part of that investigation. when it stalled, barker resigned from the swat team and filed a lawsuit that is now being settled for $8

million. >> i think it gave me hope that women can stand up for themselves and be successful, that it is possible i spoke with corinne barker's attorney. >> we were willing to settle the case for much less, much earlier in the litigation before so much testimony came out, zach franklin tells me he began to press for a higher settlement amount after he learned that barker's colleagues on the swat team stood up for her and complained about munoz's behavior. >> the county denied the allegations, but relented. >> and i think they feared, and rightfully so, that if we went to trial, a jury could return a verdict. that's much bigger than $8 million. >> a statement from current san mateo county sheriff christina corpus depicts the harassment as incidents that occurred years ago under the previous sheriff. it says corpus is committed to improving the culture of the department by prioritizing accountability and implementing higher standards, setting the tone that misconduct will not be tolerated under her watch.

despite the treatment she received and how her complaints were ignored, corinne barker wants to remain at the san mateo county sheriff's department. she's now a detective focusing on homeland security. >> i still love this career. i still love what we stand for. but, you know, i'm the first to say that there are problems and we need to fix them. >> but you know that there are women out there who are like, okay, you have the settlement. why don't you just get out of law enforcement? >> i think i would be abandoning who i am. you know, this this is not just a job. my son is proud to say that his mom is a detective. you know, he looks up to me, and i still find a lot of meaning in the work. i do. >> andre munoz was no longer working there. it appears the $8 million settlement for a single plaintiff could be a record for the state, but we can't know for sure. many settlements are confidential, but this is definitely one of the highest amounts the county attorney

the single car crash happened around 1115 this morning. both sides of highway one were shut between pacifica and montara as crews rappelled to the beach below and found the people, unfortunately dead inside. the road has since reopened. the cause of the crash is still under investigation. >> now to your voice, your vote and a major endorsement for vice president kamala harris. it comes from former president barack obama and former first lady michelle obama. >> we called to say michelle and i couldn't be prouder to endorse you and to do everything we can to get you through this election and into the oval office. oh my goodness. >> the former president posted this video to x showing the moment he and the former first lady called harris to tell her

the news. the obamas are some of the last major democrats to endorse harris. the fbi is sharing an update about the assassination attempt on former president trump. investigators say trump was hit by a bullet, though they don't know whether it was whole or just a piece. the fbi director had raised questions earlier this week about whether trump was shot or hit by shrapnel. the former president says he will return to butler, pennsylvania, for a rally to honor the victims of the shooting, though he did not share a date. today, trump met with israeli prime minister benjamin netanyahu at mar a lago. it's the first meeting between the two men since trump left the white house. netanyahu met with president biden and vice president harris yesterday. california congressman and democratic senate candidate adam schiff is in the bay area this weekend after a tumultuous few weeks for his party. schiff called for president biden to step aside as democrats were still divided, and now he's supporting a fellow californian for president. he joined us in studio for abc seven news at three, saying the shift has energized the party and rattled

fire burning right now in bay point and fire concerns in other places as well. here's a look at the satellite radar composite image. excuse me while i clear my throat and you can see we have a deepening marine layer providing a cooling influence thanks to a vigorous onshore flow. in fact, we have wind gusts right now up to 30mph in livermore, 25mph in san mateo, and all around the bay area, right now, the strongest winds are anywhere between 20 and 30mph, and the cool down over the last 24 hours is really significant. 10 to 20 degrees cooler generally than at this hour yesterday, 20 degrees cooler right now at santa rosa and novato. ten degrees cooler in oakland at this time last night, 19 degrees cooler in livermore than at this time last night. and here's a look at that deepening and expanding marine layer from mount tam. looking down onto the low clouds, pushing through the golden gate and out over the bay. it's 57 degrees in san francisco right now. we have mid 60s to low 70s, many other locations. here's the view at the golden gate, where the fog is pretty low and pretty deep. other temperature readings

at this hour 66 in santa rosa, petaluma 5968 napa low 80s at fairfield and concord and 76 degrees at livermore. and this is the view of dark clouds expanding over the bay from our emeryville camera. these are the forecast headlines. the cooldown continues into the weekend, in fact, into next week, actually. and the temperature forecast for this weekend is for below average high temperatures. and the outlook for next week. there'll be minor warming, but it'll take temperatures a while to catch up to the average range for this time of the year. here's our forecast animation taking us into the late night and overnight hours. we'll see that marine layer deepening and expanding and moving across the bay and locally inland. and we'll see patchy drizzle along the coastline and maybe even onshore and out around the bay shoreline during the overnight and early morning hours is latest 10:00 tomorrow morning. we might see some patchy drizzle over in the oakland hayward area and more of it offshore, so let's move along and take a look at overnight low temperatures under increasingly cloudy conditions, we'll see mainly mid to upper 50s for our low

temperature range up in the farther north regions like santa rosa and cloverdale, we'll see lows dropping into the upper 40s. and then farther inland in the east we'll see milder readings like 61 at antioch and highs tomorrow under mainly sunny afternoon skies, 60 at half moon bay, 64 here in san francisco. most locations around the bay shoreline will top out tomorrow in the upper 60s, and we'll see mainly mid to upper 70s in our inland areas, where just a couple of days ago we had triple digits inland. and here's the accuweather seven day forecast. they'll be further cooling on uh- going through the weekend. tomorrow will be the coolest day of the forecast period, but we'll have temperatures remaining well below average going into early next week. then midweek next week we'll see high temperatures coming up to upper 80s to about 90. in our inland areas, mid 70s around the bay shoreline. finally low 90s inland late next week. but those temperatures are still below the average for this time of the year. and certainly far from being hot. >> okay. okay. >> nice. all right. thanks. pencil >> warty. the whippet is home

until he could be reunited with his owners. now they're hoping to find that man in order to thank him. >> abc seven news reporter suzanne fawn has the story. >> you like your blanket, you're going to take that outside. >> bob eccles of san francisco walks his two dogs, warty and taylor, often wherever the dogs go. they have a gps tracker on them. but last saturday, the dogs were staying with a pet sitter and warty got loose. here's the escape captured on ring camera video. >> he escaped from our pet sitters house. ten minutes later, a lady captured him, but she grabbed the collars and he backed out and she kept the collars and ran off with his gps tracker. >> came off with one of those collars he was missing for two days. eccles posted missing dog fliers all over the city and shared the information online. with the help of strangers, eccles kept tabs on where warty was spotted. >> he runs all over the mission district. he crosses market street, he goes to hayes valley ward. >> he ended up in the

tenderloin. eccles says an unhoused man found the dog at this park off eddie street. >> the homeless man bought him a little crate, a blanket, a pad, food, dog toys and kept him two days. this is a man who has nothing and he lives in this park. and he took care of our little boy right after warty went missing. >> another dog walker actually spotted him. >> i noticed he had no owner or no collar and he took off down the street. >> monique lee posted about it online and two days later got a call from a different dog walker who saw warty and a man at a bus stop. that dog walker approached the man and warty. the woman showed the man the missing posters and explained that warty had run away. the man handed over the dog and that's when he said, here, take the dog and you have to take the blanket, because he loves this blanket. now woody's home again. >> see, there's your blanket. >> as for eccles, he wants to

highway four. >> and for the very latest on this, on this fire still burning very much out of control, let's go to abc seven news reporter anser hassan anzar. >> diana. good evening. i spoke with contra costa county fire protection district captain chris toler just about 15 minutes ago. he did confirm this fire has grown to 200 acres, 20% contained in the big news. forward progress has stopped. and the reason that's important is because the front of the fire was heading right into this neighborhood right behind me. these homes were in the path. fire's paths. fire crews using bulldozers to create firebreaks, trying to create a barrier. now, as i mentioned, there were mandatory evacuation orders in place. we spoke to one resident waiting at a nearby gas station for the streets to reopen, hoping they can go home. here's how she described the fire. >> i smelled something and then i looked out the window and it looked very smoky and murky, and we've had a couple of brush fires in the past in the span,

probably three in a span of a month. and so i knew, okay, i've seen this before recently, and sure enough, the fire was right up the street. >> a cal fire is also out here doing air drops. one of the big concerns is this is in a valley. concerns that embers could fly over to the other side, which runs parallel to highway four. right now highway four is open. it is commute hours. so they're monitoring that situation as well. again, once again, 200 acres has burned 20% contained. forward progress has been stopped. reporting live. anser hassan abc seven news. >> all right. thank you, unser, for the latest on that. a fire in alameda county near sunol is also now at least 150 acres. it's burning along calaveras road near welch creek, close to the sunol regional wilderness. time lapse video captures a lot of smoke over the hills. you see it right there in the center of your screen. it started just before four today. no buildings

threatened. this is an open space. as you see, there is also no containment and firefighters are evacuating the park. and we just got an update on the biggest wildfire in california. the park fire has burned more than 239,000 acres in butte and tehama counties. there are evacuation orders and warnings in effect for this fire. governor newsom has proclaimed a state of emergency in plumas butte and tehama counties because of wildfires. >> all right, let's keep tabs on those. but let's move on a fee for this, a surcharge for that. you know, it's become common on restaurant bills, but does it add up to building a better bay area business owners say these fees are to make sure that workers get a decent living wage and health care coverage. >> yeah, but now some customers have started to push back. abc seven news building a better bay area reporter lyanne melendez is here with a deeper look into those. you experience them. got a bill right here to prove it. >> you've received this right and a lot of people just really dislike these surcharges. now

how many times do we get that check and without looking we just hand down that credit card? well i have news for you. start looking because you may be dishing out a lot more money than you're supposed to be paying. and i promise you, once you watch this story, you will be an empowered customer. if you eat out, you've likely seen them. surcharges tacked on to the tab with different names, service fee, labor surcharge, fair wage, employer mandates, health care security ordinance, sf safety and benefit charge. why so many terminologies? i mean, this is very confusing for the customer. i mean, what the heck is a safety and benefit charge? you know what? >> at the end of the day, there are always people that are going to try to get around something and find a way to make it work better for them. folks just have to vote with their feet, get up and get out and go somewhere else. that has more transparency. >> state senator bill dodd initially wrote the legislation to do away with all those

surcharges, only to then exempt restaurants. >> and here's why we read we here on tv that how many restaurants are going out of business in the bay area? it's a tough time for restaurants. >> he's right. according to the san francisco consumer price index, prices for food away from home in the san francisco bay area went up by 5.2% in the past year. you know what else has gone up for restaurant owner rene dennis, his rent, minimum wage and that city health permit that in 2008 cost him $600 a year, is now up to $1,500. >> it keeps going up. we can't keep raising our prices in line with that because then our customers get sticker shock. >> so restaurants across the state have started adding surcharges to their menus to make up for the rising costs. but sometimes those fees are not so obvious according to the law, any extra charges must be

clearly and conspicuously displayed with an explanation. take this menu for example. i can read the prices no problem, but at the very bottom and not so conspicuous is this note. i need my glasses for this one. it says to help defray the rising cost in west hollywood, a 4.5% administrative fee will be added to your check. go on social media sites and the conversation is heated. here are two examples. when i receive a bill that has a service fee or a mandatory tip on it, i don't tip. san francisco has been doing it for years. hence the fact. one reason i no longer dine there once a week as i did years ago. lauren hyman created a site called c physica, inviting customers to record the surcharge of each restaurant. >> you know, so i created this website to make it easy for me

and other, you know, consumers to just to easily understand how much something is going to cost before before they purchase them and they visit a restaurant and sit down and that kind of disclosure worries some restaurant owners who have already seen a backlash. >> this is really controversial, and some restaurant owners didn't want to be interviewed. why is that? what are they afraid of? >> oh, it's hot right now, i read things like reddit and a lot of social media and people are either posting, oh, 13% on my bill for this restaurant and they'll call out that restaurant at rene dennis charges an extra 5% to help supplement wages. >> faced with some disgruntled customers, some cafes and restaurants are eliminating that surcharge and just increasing the prices. instead, if they were kind of confused, perplexed, sometimes thrown off in a way that made them discouraged from buying product and stuff like that at craftsman

and wolves along the valencia corridor. once they eliminated the surcharge marked on the bill, it made things a lot easier for everyone. in fact, most people we spoke to would rather pay more for a meal if it meant not paying that surcharge. >> i have $37.65, and that way you can put a meal together from the menu without having to worry about. is there going to be some fee? i don't have enough for the fee because that's a that's that's a deadly moment. when there's a fee. >> i think there's a simplicity in that, and i think it feels a little more transparent. we just got back from europe, where we were encouraged, basically not to tip. >> that's what they do at zazzy, a popular french style restaurant in the coal valley neighborhood. so let me see if i get this right. you don't charge a service charge? no. or you don't add any health insurance? no. okay the tip. you don't even ask for a tip. no so how do you make that work,
