sonoma. this is a look at the smoke at about 25 to 30,000ft above. and we have light southwesterly winds that want to keep a haze in the atmosphere. this is overnight and throughout the day. today we'll see maybe a little bit of haze out there with those light winds, particularly in the north bay. but as we get into monday, it does lift out. air quality is good overall with moderate air quality throughout the day in the north bay, so the fog clears ten 11:00 this morning with upper 60s to low 70s inland and then by the afternoon we're warmer, some low 80s inland. and it's a sunny day. but notice from san mateo to mount tam and the coastline, we are cloudy and cool. stephanie. >> all right, lisa, thank you. developing news now we are waiting to hear of bart. service at some stations will be operating as normal today. it's after a fire and outage shut down four stations yesterday, forcing hundreds of riders to evacuate. here is a list of the

stations affected. 12th street 19th street. lake merritt and fruitvale. our crews were at the embarcadero station last night and take a look. you see the crowds here? not too long after the giants game, abc7 news reporter anser hassan talked to fans who had to evacuate >> the smoke billowing out onto oakland streets was coming from the 12th street bart station below. it was pretty smoky in the tunnel. >> i don't know how bad the fire was. i didn't see it. once they told us there was a fire, they said evacuate at the back of the car, renee morfin and his girlfriend were among the hundreds of bart passengers evacuated. >> they were stuck on bart for 30 minutes until they were let out. >> it was a bit scary just because we didn't know what was going on, but after they evacuated us, we were like, fine. >> we had an engine company that was here at the 12th street bart station. they were here for a medical call and they smelled smoke, so they continued to investigate and found smoke in one of the tunnels. >> battalion chief linda buell says they located the fire

coming from an electrical room that burned through some wires and immediately cut power, which impacted the bart stations and forced the evacuations. >> the smoke in the tunnels by the bart ventilation system was cleared out, which is why we're able to do the safe evacuations to 19th street and 12th street. we were extremely lucky today that we were able to evacuate with no injuries. >> charlie geter was supposed to meet friends in oakland for an event, but they didn't make it. >> they were texting me from the bart every, like even coming down from berkeley. they're stopping on both sides. >> buell says the fire was contained to just the electrical room. how the fire started is still under investigation. >> any time you have a fire, you know you burn through wires, you burn through cables. so when you have exposed wire and electrical, you know you can't put any power through it or else it's going to your problem is going to continue. we have recommend the uh- until they can get that repair done as not to turn the power back on anser hassan abc7 news. >> bart officials did not give any indication as to when those repairs will be completed. until we hear directly from bart,

riders should keep an eye out for any potential delays. this morning. well, we are following new developments on the park fire near chico showing no signs of slowing down this morning. there are several evacuation orders in place and people are being told to get out. it has burned over 350,000 acres in butte in tehama counties, and that makes it the seventh largest wildfire in california history. yesterday, crews caught a break thanks to the weather. containment is now at 10%. here's abc seven news reporter tara campbell. reporter. >> flames scorching over 350,000 acres. the park fire growing at a rapid rate. governor gavin newsom ordering a state of emergency in butte and tehama counties saturday. the governor getting a first hand look as evacuations continue. >> the fire blows over. i can't make any promise or guarantee that we can get up there to save your life. >> rachael vaughan, fleeing her

home near forest ranch. >> it's been stressful. i mean, i had to leave some animals behind, turn them loose, and my horse. and not having the funds or the means to even provide for my family outside of my home has been difficult. >> the fire destroying numerous structures, including homes as more than 2400 firefighters battled back, including crews from the san francisco fire department. >> they're battling you know, long hours, which is which is typical of these fires and basically unfamiliar territory is also another thing that we try our best to learn the lay of the land while we're up there. we have been sent to the chico area several times uh- historically, in the past, maybe 15 years. we've been up there a handful of times because it's kind of common, unfortunately, to have fires up and around that area. >> this area also saw the deadliest wildfire in state history, the camp fire, killing 85 people. in 2018, the town of paradise once again under threat. it was very impactful.

>> every once in a while, when we smell smoke or see smoke like that, it does trigger us. it triggers the people here in paradise. it's just part of the when you go through trauma, that's what happens. >> parts of paradise now under evacuation warning, i'm getting evacuation alerts and, you know, be ready. >> and so i'm packed up my dog, my cat. that's all i can do is wait and watch and hopefully get alerts. >> so meanwhile, cal fire is hoping for favorable weather. this weekend can help slow the spread of the fire. tara campbell abc seven news. >> now to the fast-moving fire in sunol. the creek fire has burned more than 700 acres near welch creek and calaveras roads. it started around 4 p.m. on friday and is now 10% contained. forward progress is stopped and there are evacuations in place at the sunol regional wilderness park, as well as some road closures to look out for in the east bay. many families forced

out by the point fire are back home this morning. that fire burned about 470 acres, with containment now at 70% retardant drops. may have helped save these homes, but it's also made a mess. abc seven news reporter suzanne fawn talks to neighbors who are cleaning up. >> thank god i'm so grateful that, the house is here. >> eleanora schwartz thankful for the firefighters who saved her home from the point fire. it blackened hundreds of acres as it raced across ridges and down hillsides, coming right up to her neighbor's property. >> the fire was real close to these people house, and they were running out with bags in their hand. >> abc seven news talked to schwartz friday as she, her husband and dog evacuated their home. her vehicle was hit by retardant right after a sheriff's deputies arrived on her doorstep and ordered her and neighbors to leave. >> this is they said, that the helicopter passed and drench us on this saturday.

>> streets are painted pink. it's the aftermath of all the fire retardant dumped on homes in this bay point neighborhood. families who evacuated have been allowed to come back. scott malone returned and realized retardant is covering everything. yards homes, cars, even playgrounds. >> my wife referred to as barbie ville or something. it was so pink. they told us it's water soluble so it should wash off. >> we saw neighbor after neighbor cleaning, washing retardant off homes and scrubbing the remnants off their cars. kevin pereira knows it won't be a quick process. >> it's going to take a few days. >> pereira says the fire that marched toward his home terrified him. the aerial attacks, including the retardant drops, literally hit home. >> i did see the helicopter like, spray. the, the retardant, right? and, man, it was a scary moment. i was i was scared for these neighbors over here. >> cal fire says these aerial

attacks were a critical weapon against the fire. >> there were multiple air tankers there as well as helicopters. >> and the air tankers are there to put in retardant drops. that helps slow the spread of the fire. >> firefighters now say they have the upper hand on the poin. fire neighbor eleanor schwartz counts it as a blessing that the danger in her neighborhood has passed. >> i think we are kind of a thankful that, we could come back to the house because when things like this happen, people come back to nothing. >> and here's a closer look at all the retardant that's been dropped on this neighborhood. during the joint fire crews have been battling gusty winds as well as dry conditions, but the good news is no homes have been damaged in this fire in bay point. suzanne phan. >> abc seven news reporter cal fire says a fire that scorched nearly 400 acres along the altamont pass is now 95% contained. it started thursday night near north flynn road, just outside of livermore. the cause is still under investigation, but an initial

report from chp shows a car caught fire on westbound i-580 and the flames then spread to the grass. you can track wildfires across the state as well as air quality. with our interactive wildfire tracker. just go to our website abc7 news.com/fire map. happening today, bay area activists will hold a vigil for sonia massai. she's the mother of two who was shot and killed by an illinois sheriff's deputy in her own home. activists are demanding justice as they honor her life, along with others who were killed in police custody. the vigil will begin at 15th street and broadway at 12:30 p.m. today. people will then march to oscar grant plaza for a special ceremony. the oakland community will join over a dozen cities for a day of mourning for sonia massai. this is a abc news obtained new details of a grievance filed for the former deputy, sean grayson. grayson is

the deputy seen in this police body camera footage shooting massey. he claims he was terminated without just cause. he asked for his job back, along with lost wages and benefits. grayson reportedly worked for six law enforcement agencies in the last four years, despite two prior duis. he was also discharged from the army for misconduct. massey's family has been outspoken since she was shot and killed. >> this is the hardest thing that we have ever been through as a massey. it just breaks my heart that our family has to go through this. >> massey's death has been ruled a homicide following a recent autopsy. it also found she was killed by a gunshot wound to her head. all right. turning to weather now, let's check on conditions outside with lisa. how's it looking? >> pretty cloudy out there. stephanie. you can see the view

the peninsula now. there are new developments in that deadly crash that happened along devil's slide on friday. the body of a third person was found while the car was being pulled out of the water. it was originally reported there were two people who died in this crash. crews shut down highway

one between pacifica and montara yesterday while they retrieved the car and the victims. the car landed more than 300ft down an embankment, and the cause of this crash is still under investigation. also happening today, more than 500 farm workers will march for higher wages and disaster pay in the north bay. they will meet in the hills, healdsburg plaza in downtown healdsburg at 4:00. they're demanding $25 an hour or $250 per ton of grapes picked. farm workers are also asking for extra pay for work done during dangerous conditions and compensation for lost wages during disasters. now to a story from the abc seven news i-team. the oakland police department is close to getting a technology upgrade that could cost taxpayers millions of dollars. we're talking about a contract that may be worth more than 6 million. police argue this new software will enhance efficiency and help the city's flawed 911 system. yet the process to get

here highlighted another multimillion dollar mistake. oakland is in dire need of new technology. it currently has the slowest 9-1-1 emergency response time in the entire state, and it doesn't help. the city has been crippled with software issues. let me be very clear. >> this is a huge underinvestment. >> years before the ransomware hack that leaked the city's network on the dark web, a crucial decision was made in 2017 to replace the city's 20 year old software oakland city council authorized $12.8 million to install a new 9-1-1 public safety it system that included new dispatch and records management software from motorola, but a civil grand jury report found three years later, it was never fully implemented. in fact, both the software and hardware at the emergency communications center were labeled as so out of date. it is no longer supportable, the report added. opd was forced to buy replacement parts on ebay

because they were no longer available completely unacceptable, unexplainable and certainly uh. >> we need to hold ourselves as governmental employees more accountable. >> staffing shortages and impacts from the pandemic were to blame. now it's been seven years and the problem still hasn't been fixed. but this week there's a push to change that. the city's i.t. department is recommending a new purchase with a tech company to replace opd's record management system with a modern software called mark 43. that's fully cloud hosted. >> i would assume, though, why they're advocating for the utilization of cloud is because it could probably be accessed for more locations if passed, it would cost taxpayers up to $6.1 million, but it's being heavily vetted in the wake of the city's massive 2023 data leak. the idea that any of these records are secure is naive, and we see these data breaches consistently. and so it's really put the population at a much

more vulnerable place. >> according to a report obtained by the i-team last year, opd determined the motorola software was, quote, difficult to use, leading to increased report times and the issues were unable to be resolved. issues like that could have been avoided if the tech was properly vetted. we asked opd that very question did they determine this new software would be compatible with their systems? we were told the software was reviewed by several department subject matter experts to gauge efficacy. opd also visited a local law enforcement department who is currently using mark 43 to obtain their feedback, which was positive. opd may also acquire a new $27,000 subscription with gladiator forensics to collect and analyze call record data. police say it would help arrest wanted suspects and enhance criminal investigations. state privacy law would still require opd to have a warrant in order

the bigger picture, you can see the atmosphere looks quiet, but we are looking at a couple of systems to the north and west of us that will keep our low cloud deck intact. and as you noticed, the early morning numbers in the 50s here, 56 in danville, we've got 61 in hayward, though, and 55 half moon bay up in the north bay. temperatures are in the mid 50s there. 54 santa rosa and that mist and drizzle out there as well. so we will certainly have the below average temperatures stick around for the next few days. and as we get towards the second half of the workweek, a warming trend begins and it is looking warmer into next weekend, which is the first weekend of august. there is a look at the fog footprint all the way to the east of us. although it is clear in fairfield this morning with the southwest wind at about 18. so look how it clears throughout the day. now. yesterday it took till about 3:00 in some areas and didn't really clear at all. and elsewhere with those gusty winds, we'll get sooner clearing

still look at the fog at the shoreline and then it comes right back into play as we get into your monday morning, that mist and drizzle with us again. there's the breeze. it will kick up to over about 20 miles an hour, but it should be a typical day at the coast without any sunshine. but as we get towards your wednesday, notice mid 90s returning inland, taking it through thursday and it is a typical summer pattern, maybe a few degrees above average, and then by friday looks kind of hot inland, right? with those 60s and 70s around the bay shore. so temperatures today a little warmer than yesterday, so low to mid 80s returning here. we didn't have any 80s yesterday. 82 in livermore, 74 in richmond, looking for those upper 60s in oakland. a sunny but breezy day around the bay, 72 in palo alto and san mateo with about 82 santa rosa. so pretty cool out there. and then overnight tonight, back into the 50s, the mist and drizzle at the coast, the accuweather seven day forecast looking at temperatures

says hezbollah is responsible, but the militant group is denying a role in the attack. the israeli defense minister visited the site, promising hezbollah, quote, will pay the price. it comes at a very sensitive time. israel and hamas officials continue negotiations for a ceasefire and hostage proposal in rome today, closer to home. now, if you dine out a lot, you likely have noticed some extra service charges on your bill. business owners say they're to make sure workers get a decent living wage and health care coverage, but some customers have started to push back. building a better bay area reporter lyanne melendez takes a deeper look. >> if you eat out, you've likely seen them. surcharges tacked on to the tab with different names, service fee, labor surcharge, fair wage, employer mandates, health care security ordinance, sf safety and benefit charge. why so many terminologies? i mean, this is very confusing for

the customer. i mean, what the heck is a safety and benefit charge? you know what? >> at the end of the day, there are always people that are going to try to get around something and find a way to make it work better for them. folks just have to vote with their feet, get up and get out and go somewhere else that has more transparency. >> state senator bill dodd initially wrote the legislation to do away with all those surcharges, only to then exempt restaurants. >> and here's why we read we here on tv that how many restaurants are going out of business in the bay area? it's a tough time for restaurants. >> he's right. according to the san francisco consumer price index, prices for food away from home in the san francisco bay area went up by 5.2% in the past year. you know what else has gone up for restaurant owner rene dennis? his rent. minimum wage and that city health permit that in 2008 cost him $600 a year, is now up to $1,500.

>> it keeps going up. we can't keep raising our prices in line with that, because then our customers get sticker shock. >> so restaurants across the state have started adding surcharges to their menus to make up for the rising costs. but sometimes those fees are not so obvious. according to the law, any extra charges must be clearly and conspicuously displayed with an explanation. take this menu for example. i can read the prices no problem, but at the very bottom and not so conspicuous is this note i need my glasses for this one. it says to help defray the rising cost in west hollywood, a 4.5% administrative fee will be added to your check. go on social media sites and the conversation is heated. here are two examples. when i receive a bill that has a service fee or a mandatory tip on it, i don't

tip. san francisco has been doing it for years. hence the fact one reason i no longer dine there once a week, as i did years ago. lauren hyman created a site called c physica, inviting customers to record the surcharge of each restaurant. >> you know, so i created this website to make it easy for me and other, you know, consumers to just to easily understand how much something is going to cost before before they purchase them and they visit a restaurant and sit down. >> and that kind of disclosure worries some restaurant owners who have already seen a backlash. this is really controversial, and some restaurant owners didn't want to be interviewed. why is that? what are they afraid of? >> oh, it's hot right now. i read things like reddit and a lot of social media, and people are either posting, oh, 13% on my bill for this restaurant and they'll call out that restaurant

at pascal. >> rene dennis charges an extra 5% to help supplement wages. faced with some disgruntled customers, some cafes and restaurants are eliminating that surcharge and just increasing the prices. >> instead, they were kind of confused, perplexed, sometimes thrown off in a way that made them discourage from buying product and stuff like that. >> at craftsman and wolves, along the valencia corridor. once they eliminated the surcharge marked on the bill, it made things a lot easier for everyone. in fact, most people we spoke to would rather pay more for a meal if it meant not paying that surcharge. i have $37.65, and that way you can put a meal together from the menu without having to worry about. >> is there going to be some fee? i don't have enough for the fee because that's a that's that's a deadly moment. when there's a fee. >> i think there's a simplicity in that, and i think it feels a little more transparent. we just got back from europe where we were encouraged basically not to
