to kill over the october 7th attack. us secretary of defense lloyd austin did not answer questions about the killing tonight, but told reporters the u.s. is committed to avoiding a wider war in the middle east. >> we're going to do everything we can to make sure that we keep things from uh- uh- turning into a broader conflict throughout the region. >> the killing is a major blow to hamas. haniyeh was a key figure in their political operations. iranian state run media reports. a senior hamas official says the killing will not go unanswered. >> we continue to follow that. but our other top story tonight, the state of homelessness in the city of san francisco. >> you know, it's bad. well, this week's start of the encampment sweeps. cleaning them up comes after legal approval and an order from governor newsom. >> but as abc seven news reporter tim johns shows us, the move has wider reaching implications as nonprofits brace for an influx of new clients. >> new video tuesday shows some of the first homeless encampment

sweeps taking place around san francisco. the city, one of many locales around the bay area, becoming more aggressive in tackling the issue following a recent supreme court ruling. while popular among some many homeless service providers believe it's the wrong approach. >> it's just shortsighted. we will not see a net change in the numbers of homelessness or the visible homelessness in our communities. through this effort, mark shotwell is the ceo of the ritter center in marin county. >> he says besides being ineffective, the encampment sweeps have the potential to do further harm to people living on the streets. >> these abating encampment moments, they're retraumatizing people. they're further ostracizing people from society. >> instead of clearing encampments and forcing people to move. many service providers think that state and local leaders should instead be focusing on the root causes of homelessness. the big one being solving the housing affordability crisis that's plaguing the state. >> now, for folks who are making $60,000 to spend 80% of their

income on housing, is very difficult for them to live and survive, never mind thrive. >> laura bentz is the ceo of samaritan house in san mateo county. she says with the increasing number of sweeps, which are being encouraged by governor gavin newsom, service providers like hers are expecting a potential influx of new people. >> we're prepared to do that. we are ready to staff up if necessary, again to ensure that everyone who comes in on the same day can be evaluated. >> similar preparations are underway at glide in san francisco. ceo gina fromer says while the city has done a lot to tackle homelessness, it still only has about half of the shelter beds it needs for the number of people out on the streets. fromer believes the money spent on clearing encampments could be better used, addressing issues like that housing subsidy or rental assistance for two months to cover their rent so they can get another job. >> those are the services that work. >> but with everyone demanding solutions to one of the state's most pressing problems, how soon that happens is anyone's guess

in san francisco. tim jonze, abc seven news. >> the issue of homelessness is something we have covered from the beginning. in all of its complex angles. we want to make sure you can get the full picture as we work to build a better bay area. for all of our reporting, including expert analysis and how we got here, head to our website, abc7 news.com or your abc7 news app. book lovers and writers in the east bay are mourning the loss of a neighborhood staple, a fire destroyed east bay booksellers this morning in oakland's rockridge neighborhood. the businesses, the business on college avenue has been selling books for more than 30 years and often hosted talks with local authors. this morning's fire burned through the entire store and damaged a neighboring business. investigators are working to figure out how the fire started. the bookstore owner says he is devastated. >> it's still in a state of shock. very much sort of just overwhelmed by the scene, just looking at it. i've i'm slowly feeling like i'm stepping into

the actual moment. whereas for the past couple of hours, it's felt like watching a movie. >> people can now support the store by placing online orders or buying gift cards. there is also a go fund me. the bay area independent bookstore community is also pledging its help. san francisco's city lights and green apple books are posting messages of support on social media. >> also in the east bay, the city of berkeley failed to inspect nearly half of its restaurants and food facilities last year. if you went out there, you'll want to know this. that's according to a recently released audit. the berkeley city council addressed this very issue tonight, and abc seven news reporter j.r. stone spent the afternoon and evening in berkeley looking into that story. he's here with what he's found out and the details of the plan to deal with it. >> j.r, dan, just about everywhere we were tonight in berkeley, we saw people eating. hey, it was dinner time. we get that. but to think that nearly half the restaurant and food facility inspections that were supposed to happen never did, is a bit troubling. there certainly

isn't a shortage of restaurants and food facilities in berkeley, but a new report out by berkeley city auditor jenny wong and her team found some startling food news. >> there were 45% of restaurants and other food facilities that were not inspected at all in 2023. >> unlike many cities, berkeley does its own inspections, something often done by counties. the report found that alameda county's non inspection rate was just 3%. that is a 42% difference from berkeley's. it also found that only one out of four foodborne illness complaints were addressed within a day. they've had significant and chronic understaffing. >> we found that there were two positions that were left vacant since 2019. >> berkeley residents we spoke with were not happy to hear the news. >> very upsetting to hear that hiring more people and inspect 100% of the restaurants, the

city's new health, housing and city services director went on the defensive during the berkeley city council meeting monday night. >> clearly, the spotlight is on us to fix this and to exceed the public's expectations. you know, if we're not able to pull that off by the end of the year, then i think, you know, my new job should be questioned as to when and if these inspections will ever happen. we will have 100% of inspections for 2023 a complete by the end of this yea. >> whether we do want to take a closer look at at partnering with the county to do this for us because they have all the systems in place, we have to make sure that when people dine in berkeley, they're safe. >> it's not more complicated than that. >> for now, though, the focus will remain on berkeley city officials fixing the problem. so

we talk about those two unfilled positions to help with inspections. they have made an offer to someone on one of those spots. they hope to have that person on board in august. they have open recruitment to fill the supervisor position, and they are trying to bring on some temporary workers to help catch up with inspections. going forward. j.r stone, abc seven news. >> thank you, j.r. and we are following the story as another bay area community grapples with people spreading hate. police in petaluma are investigating a series of anti-semitic incidents sunday, with one group of people hanging a banner on an overpass of 101 and putting fliers on cars. it's not clear yet if the incidents are criminal, but they are certainly alarming to communities increasingly targeted with hate crimes. today, governor newsom announced a new round of grant funding to boost security at synagogues and mosques, as well as as well as black and lgbtq community centers. state senator josh becker of menlo park pushed for the expansion. >> we don't want people to feel

like they can't go where they shouldn't go to their religious institution or to their their nonprofit community center, because there's a risk of an attack and they're safer to stay at home. we want them to feel safe and feel comfortable. >> becker says more than 900 groups have already received millions in grant money for security improvements like reinforced doors, screening systems and more. >> all right, it's another cloudy night in the bay area. our emeryville camera that you're looking at live gives you a look at things in the east bay. but don't let it fool you. there is a warm up on the way. abc seven news weather anchor spencer christian is here tracking what we should expect. >> spencer you're right, dan, we have a warm up on the way, but we have to get through the clouds and drizzle tomorrow morning first. so here's how the day is shaping up. tomorrow, early in the morning, lingering am fog and drizzle temperatures in the 50s. by midday we'll see mainly sunny skies, low 80s in and low 70s around the bay, low 90s inland by 4 p.m. and mid 70s around the bay and the giving

way to partly cloudy skies going into the evening hours. >> but a warm up as dan pointed out, is certainly on the way. by friday we'll see mid 90s inland going into the weekend mid, maybe even mid to upper 90s. so a warm up is coming our way. i'll show you how long it will last and how hot it will be in just a few minutes. dan and emma. >> all right spencer, thank you so much. developing news tonight. as we get a clearer picture of the park fire's devastation in butte and tehama counties, cal fire now says the fire destroyed 274 buildings. it's burned 386,000 acres. the fifth largest fire in state history. only 10,000 acres separated from our fourth biggest fire, the scu lightning complex, nearly four years ago. in a sign of climate change driving worsening wildfires, all of the top five happened in the last decade. the good news firefighters are steadily making progress on the park fire containment is now up to 18%. evacuations are still in place in four counties, and you can track the wildfires across the state as well as air quality with our interactive wildfire tracker. it's easy to find. you

can just bookmark it now. abc seven news.com/fire map. all right, let's take you to the south bay now, where the vendors behind a popular flea market are pushing for san jose to figure out their next steps. >> we've been following this back and forth for years. the berryessa flea markets days are numbered, with a massive housing development planned for the land by north by the north, san jose bart station. back in february, the developer and the city made progress on their plan to redevelop the site into housing and office space. construction is still years away, with a landowner agreeing to let the vendors stay at least until 2026. but the vendors say the city needs to speed up the process of finding them a new location. >> this is actually a crucial because for a lot of the family's livelihood. uh- my mother, she's a single mother and without this business, i wouldn't be at the spot where i'm at today at my job. and on top of that, i wouldn't be able to do the same thing for my son. >> the berryessa flea market creates 450 small businesses and

supports them, as well as thousands of jobs. >> a 24 hour san francisco donut shop is now closed. the silver crest donut shop has been open for half a century. its neon red sign always boasted that it never closes, but it appears that day has come. the building in the bernal heights neighborhood is now boarded up. the exact reason for the shutdown is unclear. the silver crest was a favorite all night breakfast spot, dating all the way back to the 1970s. >> well, a big part of building a better bay area is protecting our environment. and tonight there is a new push to help a fish found in the waters of the bay area. the longfin smelt used to be one of the most common fish in the bay. actually, they're now in what local activists are calling catastrophic decline. the group san francisco bay keeper took their concerns to the us fish and wildlife service, and today the agency officially declared the longfin smelt an endangered species. it means additional protections for the fish and the waters of the bay and the delta.

language. >> i don't believe he's a racist. i think that he uses people, whether they're black or they're whoever can help him. he will use them. >> with harris in atlanta tonight, trump and vance will be there on saturday. their chance to rally support in the battleground state. perry russom, abc news, washington. >> president biden and brazil's president are calling for the government of venezuela to publish the vote tallies of sunday's contested election. protesters took to streets of venezuela after the election, demanding president nicolas maduro acknowledge he lost. venezuela's national electoral authority proclaimed maduro the winner, giving him a third term in office. but independent pollsters say maduro's win was implausible. >> new developments tonight in the listeria outbreak caused by deli meat. boarshead has recalled an additional 7 million pounds of meat shelves, and some

stores nationwide had already been emptied out after an earlier recall of 200,000 pounds last week. the usda announced a liverwurst sample from a maryland store tested positive for listeria today, the agency said it is recalling all meats produced at a boarshead facility in jarratt, virginia. the products were shipped to stores across the u.s, with sell by dates from july 29th through october 17th. >> the starbucks app is running again after going down for several hours today. a third party cloud service is being blamed. starbucks mobile app and drive thru orders make up more than 70% of the company's sales. starbucks also reported a 3% drop in sales worldwide, its second straight quarter of decline. >> all right, to the weather. the heat is not on just yet, but it is coming back. >> it certainly is. abc seven news weather anchor spencer christian is here. spencer. >> okay. and anna, whatever. it's fine. it's a combination of ama and dan. dan well, anyhow, let's move along and take a look

at what's going on with our weather right now. the satellite radar composite image shows a rather brisk onshore flow, which has helped keep our air quality really good here in the bay area. despite the smoke from the fires over in the northern sacramento valley. so right now we're looking at calmer wind, but it's been a steady flow all day and things are pretty pleasant outside right now. here's a view from mount tam looking down onto the bay. we haven't seen a deep marine layer forming yet, but a little bit. little by little it's developing 57 degrees in san francisco right now. we have low to mid 60s at oakland, hayward, san jose, redwood city and 57 at half moon bay. the view in emeryville, nice and calm and clear as well. other temperature readings at this hour. looking northward. santa rosa 5855 at petaluma. napa 59 and low to mid 60s at fairfield, concord and livermore. and as we look across the embarcadero from our rooftop camera, these are the forecast headlines. we have a week long warming trend coming our way beginning tomorrow. inland highs will range from 94 to about 98. during this warming period, and the heat will reach its peak

early next week, monday and tuesday. so be prepared for temperatures rising up near the triple digit level. meanwhile on saturday, there's some concern about the possibility of some dry lightning up in the northern most part of the state because the heat will be increasing and we expect some monsoonal moisture to flow into that region. so as the moisture builds up with the daytime heating, it could make the atmosphere unstable enough that there could be some dry lightning strikes. and we'll keep monitoring that for you. but right now, as we look at the fire in chico, the smoke continues to blow away from us and looks like containment is improving as well. overnight, we'll see lots of drizzle along the coast, some of it moving onshore tomorrow morning. early morning risers and commuters will likely be greeted by some drizzly spots around the bay and near the coastline. overnight lows will be generally in the mid to upper 50s. highs tomorrow. low 60s at the coast, low to mid 70s around the bay shoreline and low to mid 90s inland where it will be warming up over the next several days. here's the accuweather seven day forecast mid 90s inland through thursday, friday, saturday, mid
