day. i'll show you when temperatures will bottom out. coming up always live abc seven news starts right now. >> a hero's tribute for an injured san jose community services officer released from the hospital. just this afternoon. good evening. >> i'm ama daetz and i'm dan ashley. thanks for joining us. veronica bear is back home this evening, four days after the hit and run accident that killed her fellow community service officer. the two were conducting traffic control at monterey highway and palm avenue in south san jose when a speeding dodge charger hit them. >> abc's seven news reporter lauren martinez attended today's memorial gathering and joins us live. lauren >> ama and dan. it was a beautiful show of support for cso veronica bear. she had no idea. over 200 officers with san jose police and neighboring agencies were downstairs, ready to applaud her as she exited the elevator. cso veronica bear, come on, your brothers and

sisters of the san jose police department. >> we wish you a speedy recovery and a warm welcome home. >> the police department put out a special message for bear and then applauded her as she came down the hallway here at santa clara valley medical center. she had tears in her eyes. you could see fellow officers were emotional as well. bear and her partner, cso long pham, were both hit by a suspected drunk driver saturday night. bear suffered a dislocated shoulder, a broken jaw, fractured ribs and a head injury. the crash killed bears 34 year old partner long pham. it's a real mix of emotions today. >> obviously we have sadness for the loss of cso long pham, but we're incredibly grateful that veronica was able to leave the hospital so quickly. you know, she's obviously very strong. she's a fighter. she's going to do everything possible to rehab as quickly as she can. her spirits look good, and it was really gratifying to see the

department come together today like this. for her. >> we saw officers and csos come to show their appreciation to bear chief joseph said she's been positive through this ordeal and said she has the complete support from the department and the community as she heals a police escort followed her home after she left the hospital. now, the driver suspected of hitting bear and pham while being under the influence, was in court today and charged with murder in the death of cso pham, 44 year old juan huerta. palacio also faces two counts of felony dui. now, huerta palacio has had prior arrests for dui, which enable prosecutors to charge him with murder. live in san jose lauren martinez, abc seven news. >> okay, lauren, thank you so much. police are giving new information in the case of a 12 year old boy who was struck and killed yesterday in san jose. the collision happened on camden avenue near the cambrian park

neighborhood. abc seven news south bay reporter zach fuentes spoke with a friend of the 12 year old, and has more details from police on what happened. >> a small memorial is growing at the corner of camden and lee avenues in san jose, just after 420 tuesday afternoon. a 12 year old boy was hit and killed while crossing the street. >> 12 year old was riding a non-electric or non-motorized scooter northbound across camden when they were struck by a truck that was driving westbound san jose police say that the driver of the truck stopped and is cooperating with the investigation. the person that was driving the truck did have a green light and was just proceeding through the intersection when they unfortunately collided with the child. >> police say they don't believe speed or alcohol were factors. this 13 year old jack said he was with the 12 year old when it happened. jack and his mother came back to pay their respects and add to the vigil, though they didn't want to give an interview, they said that the 12 year old, who was still not been identified by authorities, was a nice, funny boy who loved basketball. jack tells me that his 12 year old friend was

halfway through the intersection when he was hit. this is tragic. >> as a parent, when you send your children out, you want to believe that they're going to come back safe. >> san jose city councilmember pam foley is chair of the city's vision zero task force, which aims to eliminate crashes. she said they're focused on improving infrastructure, education and enforcement, increasing our traffic traffic enforcement unit, installing our speed cameras that will be going up to the automatic speed cameras that we had legislation approved, and we will be implementing those in 2025. this is the 11th pedestrian death in the city this year, and the 30th traffic fatality. >> we had a record an awful record in 2022 when 65 people died on our streets. >> last year saw 49 deaths. the department attributes the high number in part to the city's infrastructure. >> i believe seven expressways in san jose and an equal number of freeways running through the city. and so now what our charge is as traffic safety

professionals is to re-engineer those streets. >> still, the call is also for drivers and pedestrians to follow traffic safety rules. >> it's really about making sure we talk to our loved ones about roadway safety being everybody's responsibility in san jose. >> zach fuentes, abc seven news. >> and distracted driving continues to be a big issue all across the united states. school starts tomorrow in newark. so today the police department conducted a safety operation looking for speeders and drivers who just don't stop for pedestrians. abc seven news reporter anser hassan has the story. here's the stuff that. >> so i'm issuing a citation for failing to yield to pedestrians. >> it happened fast with this driver named jessica. she says she didn't see a pedestrian crossing or she would have stopped, but she doesn't plan to contest the ticket. >> i think cool an option before getting another point in my license. >> jessica is one of the many drivers stopped by newark police. they spent the morning issuing tickets for those who failed to stop, for pedestrians and for speeding. >> the most contributing factor

is speed, failing the right of way of vehicles and then turning movements patrol. >> lieutenant brian simon is with the new york police department. he says since school starts on thursday, today's a good day to put drivers on alert, especially since the city's only junior high school is just blocks away from this intersection. >> remind our motorists that they need to slow down, be less distracted, giving themselves more time to their destinations so that they can watch out for all of our our young ones going to school. so they're going to send you a mail. >> either you can pay for it online or through the mail. >> lieutenant simon says over the last year, there were 341 collisions in newark, ten involved pedestrians. none fatal. newark boulevard is a major roadway through the city. wide lanes make it easy to spee. another challenge cell phones. >> it continues to increasingly be a challenge, with not only just handheld electronic devices, but, you know, the gps, monitors that people put in their cars to remind them, hey,

you need to you need to be paying attention to what you're doing. >> the city has conducted several traffic enforcements throughout the year. a constant reminder for drivers to pay attention and a warning it's expensive. lieutenant simon says the ticket with penalties and fees adds up to hundreds of dollars in newark, anser hassan. abc seven news. >> police are investigating a shooting that left one person dead in east oakland just before 230 this afternoon, authorities received a call reporting that a person had been shot on hilton street between bancroft and 57th avenue. opd says when the officers arrived, they found the victim suffering from a gunshot wound. the victim was pronounced dead at the scene. no suspect information has been released. >> alameda county district attorney pamela price has 60 days to decide whether to retry a death penalty case. the conviction was overturned because of prosecutor misconduct. the case dates back to 1986, when curtis lee ervin was convicted in the murder for hire. death of an associate's ex-wife. price says the

prosecutor illegally excluded prospective jurors who were black and jewish. the state attorney general agreed. >> deputy district attorney mr. anderson during jury selection, he exercised his peremptory challenges in a way to exclude. i believe it was nine of the 11 black jurors and one jewish juror that price says she will consult with the family of the victim before deciding to retry the case. >> abc seven news spoke with former alameda county district attorney tom orloff, who was a high ranking prosecutor in the office at that time. he says, quote, there was no policy in the office to discriminate against jury selection. >> starting in november, 16 and 17 year olds in oakland and berkeley will be able to vote for their school board members. the implementation of this idea is a long time coming. abc seven news reporter ryan curry spoke with a student who believes this will empower young people. >> erin jarrar is enjoying his last few days of summer, but the rising junior at berkeley high

school is looking forward to the upcoming school year because he will have a say in who runs his school district in this upcoming year. >> i feel like it will definitely be something completely different. i feel like the students can be able to do something that wasn't given before. >> berkeley and oakland unified school district announced wednesday students like aaron will now be allowed to vote in school board elections. >> i feel like this is just like something that's like, great for students, you know? i feel like it will help our voices with what we want to do. like education wise, it stems from two ballot measures passed in 2016, in berkeley and 2020 in oakland, allowing 16 and 17 year olds to vote in school board elections. >> both districts worked with alameda county to implement a registration process they say is now ready for use. >> for the past several years, we've been working with oakland and alameda county and the state to put this new process in place and to now our responsibility is to let as many 16 and 17 year olds know that you can vote, you can participate. the berkeley superintendent says high school teachers and administrators across the district are already

prepared to help students register when they return to class next week, as the educators who work with babies every day will make sure that we're sharing with them information, continuing to share information about what's happening in our district, what's not happening in our districts, what's going on our school boards so that they can be involved and informed. >> mayor aragon says lowering the voting age for the school board elections will help teach teens the importance of voting. >> oftentimes, their their their perspectives and their needs are overlooked by by politicians when really their voice is what we need to hear because they're the future. >> for aaron, he sees this as an opportunity to have a school board that reflects the interests of students. >> it definitely feels like we have the strength to do this now. i feel like it makes us just feel heard. i feel like it makes us feel i don't know, more welcomed into like community. you know, we reached out to oakland unified and their school board president said he is excited to see their students allowed to vote in the east bay. >> ryan curry, abc seven news to bring you here. >> the complaints keep coming. just ahead, the troubling new

san francisco festival are facing more problems trying to get their money back. >> people are jokingly comparing it to the fyre festival. >> seven on your side has learned that organizers of the west coast taco and beer festival have postponed an event. labor day weekend at history san jose. this comes after our reporting on the same event in san francisco last weekend. the event promised unlimited tacos, samples and bottomless beer tastings, but attendees say that isn't what they got. susie tenmile paid 96 bucks for one vip ticket. >> i would like to know what where the money from the ticket, from the tickets. where did it go? and catalina reyes says even the vendors had no idea samples were even part of the deal. >> he said, you know, they told us when we got here this morning that we were supposed to provide, free tacos, samples, and we don't have enough. >> and we did not. we didn't,

you know, we didn't prepare for that. >> so many complaints have been pouring in about the san francisco event. yelp disabled the comments while they investigate the event organizer told us he is accepting refund requests. but when reyes reached out in the facebook comments on the event page, she got asked for information she wasn't comfortable giving. >> they said, you know, send us, you know, your your registration information and your cash app. and then they said, okay, well, to get your money back, we need $30 to verify the payment. >> i have firsthand seen fake customer service accounts pop up on social media. >> melanie mcgovern with the better business bureau says these kind of events happen nationwide, and consumers should be wary. >> it's really important to do those checks. if the account has maybe three followers or it looks brand new, there's not a lot of activity. they're

claiming they can help you if you send them a direct message with your personal information. those are the big red flags of fake customer service online. >> as for the event itself, she's urging people to file a complaint online with the b-b-b to warn others in san francisco. lena howland, abc seven news. >> san jose community leaders are protesting what they describe as a tale of two hospitals. the group is critical of a plan by hca healthcare to downgrade trauma level services at regional medical center in east san jose, while it expands services at good samaritan hospital on the west side of the city. >> hca healthcare is seeking support from the city of san jose to expand emergency medical services for wealthier communities here in west san jose. while it pulls emergency support away from the communities that that need them the most. our working class families on the east side. >> hca health care says its building two new hospital wings at good sam as part of a seismic retrofit at the hospital. contra

costa county is once again recommending people wear masks in crowded indoor settings as covid cases surge across the bay area. the recommendation comes ahead of a new school year. health officials are encouraging students and staff who are at risk of serious infection to mask up inside the classroom. just last month, the san francisco department of public health also recommended wearing masks indoors. >> the san mateo county board of supervisors is considering adding a measure to the ballot dealing with low income housing. they held a meeting today to ask the public to weigh in on article 34. that would ask voters if they'd like to allow the creation of more affordable housing under a new approvals process. many people spoke in support of housing but criticized giving more control to the county than to the citie. >> we have a lot of issues in this community and more affordable housing would solve many, many, many of them. so i want us to be able to better support domestic violence survivors, single parents,

seniors, veterans are most vulnerable. they deserve that, and i think that, our community and our residents want that. >> this was likely the last chance for public comment before the board decides whether to push article 34 to the ballot. >> san jose state is getting ready to house several hundred students in a new residential high rise. signs just went up calling it the spartan village on the paseo. the tower has been transformed into student housing. it was formerly the signia by hilton hotel. sdsu says there will be a gaming lounge, fitness room, film center and study sections in the building. students will begin to move in, starting next week because back to school is upon us. >> yeah, it sure is. well, some like it hot, but i suspect a lot more like it. cool. >> yes, sandhya, who are pleasing. you know what? >> i know you guys want a break. so we're going to give you a break, okay? ama and dan, let's take a look at a live picture right now from our sutro tower camera. here's our natural ac. it's back in business, and it is pretty much obscuring the view

of downtown san francisco. up above you can see the blue skies, though, if you are stepping out this evening in the inland areas. still pretty warm in the 90s with some tropical moisture. so mid and high level clouds there dropping off into the 70s later tonight around the bay you are looking at mid 60s at 7:00 and then falling to the upper 50s. i would grab a jacket if i were you. if you're going to be at the coast, because not only do we have the fog there, but it's cool as well. in the upper 50s tonight, dropping into the low 50s. so we take a look at live doppler seven, and the marine layer is reestablishing. but we've been seeing just some mid and high level clouds coming into the area. this is all in association with what was once tropical systems. they're harmless. they're just going to add a little more color to the sunset. if you do get to see it on live doppler seven, you're seeing the combination of the clouds there in the south bay, santa clara valley in the eastern santa clara hills. still under that heat advisory until 9 p.m. tonight. so risk of heat related illnesses still possible

in that area. gusts to 37 on shore in oakland, which is going to continue to drive that marine layer in towards our bayside communities. the temperatures are already falling 16 degrees cooler in santa rosa, down seven in oakland, 12 degrees cooler there in fairfield. and you will notice it's five degrees cooler in san jose and concord. it is socked in on the golden gate bridge, 60 in the city, 65 in oakland. you're in the 80s around san jose and redwood city. san jose camera showing you kind of a little bit of a murky view with some clouds and sun. 70s from petaluma to santa rosa, 86, fairfield 92, in concord, our warmest spots today, upper 90s to low 100 seconds. but it was only in the low 60s in half moon bay. so from our emeryville camera, as you look at the port of oakland, you can certainly see that the view is dimming a bit overnight tonight. fog, clouds and drizzle tomorrow. it's a cooler afternoon and your weekend forecast will be breezy and below average by sunday. so if you're going to outside lands, here's a look at the forecast. it's changing again to so

the past decade, causing mass bleaching. researchers based their findings by comparing recent ocean temperatures to historical ones by using coral skeleton samples from the coral sea. they say that allows them to reconstruct surface temperature data from 1618 to 1995. they found mostly stable temperatures before 1900 and steady warming since 1960. >> alaska's capital city is experiencing destructive flooding from a melting glacier. look at this. the so-called glacial lake outburst is being called unprecedented, damaging or impacting more than 100 homes in juneau. this is video from yesterday. the events happened when a lake of melting snow, ice and rain drains rapidly after overflowing a glacier. a similar one happened almost exactly a year ago. experts say outbursts are now a regular occurrence as climate change causes glaciers to thin or just melt altogether. >> markham for the presidential

concerts in austria after authorities arrested two people with ties to isis who are accused of planning a terrorist attack. >> yeah, the concerts were scheduled for tomorrow, friday and saturday in vienna, each expected to draw 65,000 fans. >> authorities in vienna say they found chemicals that could be used for explosives in the home of one of the suspects, taylor swift's last european stop is next week at london's wembley stadium. >> the justice department has charged a pakistani man in a plot to assassinate american politicians from both parties, including former president trump. this is just the latest terrorist plot uncovered this year with ties to the islamic state. federal prosecutors say asif merchant flew from iran and tried to hire hitmen to carry

deadly listeria outbreak linked to its deli meats. plaintiffs claim the company misled its customers by not properly warning them of the contamination. in its initial july 25th. recall that recall involved 200,000 pounds of boar's head, ready to eat and deli meat products. it's now been expanded to include 7 million pounds of meat products as of last week, two deaths and 34 illnesses had been reported in 13 states. >> you will soon have to scan your card to get into costco's stores. no more just flashing your card at a worker on your way in. you'll need to scan a card or a qr code to enter. it's part of an effort to crack down on unauthorized entries. the company says it has seen an increase of nonmembers using other people's cards since they expanded. self checkout scanners have already been set up at several california locations. nonmembers can still come in when accompanied by a member midday selloff sunk hopes of

back to back winning days on wall street. the dow jones industrial average fell 234 points, or 0.6%. the nasdaq dropped 1%, the s&p 500 slipped less than 1%. >> a new effort to bring people back to downtown san francisco kicked off at embarcadero plaza today. it is the latest effort to revitalize the city's downtown after the pandemic. abc seven news reporter tim johns shows you how these events are hoping to make a difference for a struggling neighborhood. >> a new initiative officially kicked off in san francisco wednesday. the so-called bricks at embarcadero plaza is set to run through october, with events happening every wednesday through saturday. its goal a familiar one to bring people back into the struggling city center. >> when we talk to people, what they said was just doing an event or a big concert once is not really going to revitalize downtown. what we need is something happening every day. >> wednesday's event was a business mixer, but organizers say they're planning everything from trivia to family fun days. katie birnbaum is the ceo of

into the streets, one of the participants in the bricks program. she says the initiative is about more than just combating the doom loop narrative. it's also a way to help transform downtown into an entirely new neighborhood, different to the one it was pre-pandemic. >> you know, you need all of those elements to be coming together around the same time for people to then think about a neighborhood and a destination to somewhere they want to go. >> over the past couple of months, the city has launched several of these initiatives to try and revitalize san francisco's downtown core, and we wanted to know if everyday people think it's working just outside the event, we talked with teresa noriega lam, who has worked in the area for years. she says while she thinks these events are effective, there's still more work that needs to be done. i think we're still less than halfway there. >> you know, i think people have gotten accustomed to working from home, and that flexibility is now something that people are expecting from their employers. >> steps away at wok donuts, owner vander hill told us a similar story. vander, who spoke to abc seven news in december,

of course, there are tornado watch boxes up as the threat of tornadoes remain and it is crawling. as i mentioned, northerly at three miles an hour. it has strengthened since yesterday packing winds of 60 miles an hour. so tomorrow morning a second landfall is expected at thursday morning across south carolina. and then it will continue to weaken as it rapidly moves up the eastern seaboard across into new england. it is going to remain a major flood threat as a front comes in and interacts with tropical storm debby. so additional rainfall totals could be anywhere from three to about 12in of rain. and here locally you see the fog, you see the high clouds coming through as tropical moisture is streaming in. we'll have a combination of both tomorrow afternoon. partly cloudy coast side, certainly cooler, but lots of sun inland. low 90s inland. here's your accuweather seven day forecast. we'll see temperatures in the hot spots up into the mid 90s. and then we'll notice that by the weekend, numbers are coming down. that's going to be more in the comfort zone for those who
