lauren martinez was there for this bittersweet day for the force. we wish you a speedy recovery and, well, alcohol. >> we have all been thinking about you for the past four days, and you will forever have our love and support. >> community service officer veronica bear was touched to see the surprise show of gratitude. over 200 san jose police officers and first responders lined to the hospital hallway to applaud her. on wednesday afternoon, there was released from santa clara valley medical center just days ago, bear and her partner were both hit by a suspected drunk driver saturday night. bear suffered a dislocated shoulder, a broken jaw and a head injury. the crash killed bears 34 year old partner long pham. it's a real mix of emotions today. >> obviously we have sadness for the loss of cso long pham, but we're incredibly grateful that veronica was able to leave the hospital so quickly during this

tragic time. >> bears described as remaining positive. >> when i visited her a couple of days ago in the hospital, she told me that she can't wait to heal up and get back out there and continue serving our community, and i think it's that spirit of public service, of self-sacrifice that is so strong in the san jose police department. >> the community service officer program started in 2014 with an spd, csos respond and investigate lower priority calls while putting the well-being of others before their own csos. >> just like the police officers are out there risking their safety, risking their lives in the service of this community. and we need to recognize that and when someone does make the ultimate sacrifice or a huge sacrifice like veronica did, we've got to acknowledge that the driver suspected of hitting barron pham while being under the influence, was in court wednesday and charged with murder in the death of cso pham, 44 year old juan huerta palacio has had prior arrests for dui, which enabled prosecutors to

charge him with murder. >> look, there will be accountability for this reckless act, and as a community, we all we need to do better. it comes down to the little individual decisions we each make every single day. after photos and well-wishes, a police escort followed cso bear home after she left the hospital in san jose. >> lauren martinez, abc seven news. >> welcome home. this comes as family and friends are coping with a separate tragic death in san jose. police now say it was an 11 year old boy. at first, he was reported to be 12. he is 11 who was struck and killed while riding his scooter yesterday. it was in the afternoon at the intersection of lee and camden avenues in the city's cambrian park neighborhood. today, police told us it appears the boy was crossing the street against a red light when he was fatally hit by an oncoming car, which had the green. >> this is tragic. as a parent, when you send your children out,

you want to believe that they're going to come back safe. >> police say they don't believe speed or alcohol were factors. it is the 11th pedestrian death in the city this year and the 30th traffic fatality. >> school starts tomorrow for san jose unified schools and then many more start next week. so concerns over traffic safety are definitely on parents minds. it's a time of transition. >> people are not in regular routines yet, you know, new parents, new kids at schools may be trying to find their way around the neighborhood. so just if you can avoid your neighborhood school on your way to get to work in the morning, please do so. and if you're going through a school zone, just drive with the utmost caution and care. >> san jose police will be stepping up enforcement as well as setting up electronic message boards near schools. a long term initiative has also started to upgrade hundreds of school crossings to turn them into high visibility crosswalks. >> all right, let's switch gears now because the mild

temperatures this summer, the last few days have been few and far between. but we're on a nice stretch. >> yes, tomorrow morning looks much different. abc7 news meteorologist sandhya patel is taking a peek ahead at our thursday in our 24 hour accuweather forecast. sandhya. yeah, ama and dan. >> we're going to start off the day with fog and it is also going to be damp in spots. let me show you a live picture right now from our mount tam cam. this is giving you an indication of what the day will begin like, and you will notice that the temperatures are already trending lower, nine degrees cooler in concord, down four in san jose and santa rosa compared to this time yesterday. so your planner tomorrow morning watch out for fog and drizzle, 50s and 60s. partly cloudy at noontime, and we are looking at breezy and cooler conditions than today. tomorrow afternoon in the mid 90s inland, low 60s coast and the clouds will be back on the increase. we do have even bigger changes coming as we head towards the weekend. i'll be back with the forecast coming right up ama. >> all right. thank you sandhya. we'll check back. the family of an 18 year old richmond man who

was shot and killed by los angeles police, says that they are now going to sue the city for wrongful death. the family of ricardo or ricky ramirez junior, also called on state prosecutors to file criminal charges against the lapd vice sergeant involved in last month's shooting. ramirez was visiting southern california after his high school graduation, according to the lapd. the plainclothes sergeant was investigating a possible dispute between the occupants of two vehicles. the officer fired through his window, fatally striking ramirez. >> his journey was just beginning, and that was taken away from us by a police by sergeant from lapd. and the only thing that ricky did that led to his death was to go wire you. >> and before he could say anything more, he was shot in the chest and killed. arms out, hands open. no weapon. >> according to the lapd, ramirez was unarmed. the shooting is being investigated by state attorney general rob bonta.

heading into november right now at abc seven news.com and wherever you stream abc seven. >> organizers are still dealing with tons of complaints and disappointment from the west coast taco and beer festival. so much so that another festival in san jose on labor day weekend is now being postponed. many who attended the weekend's san francisco event say they are struggling to get their money back. the event promised unlimited taco samples and bottomless beer tastings, but attendees say that isn't what they got. even the vendors were caught off guard. >> you know, they told us when we got here this morning that we were supposed to provide, free tacos, samples. and we don't have enough. and we did not. we didn't, you know, we didn't prepare for that. >> the event organizer told abc seven he is accepting refund requests, but there are possible scammers online posing as customer service to those reaching out on facebook. >> the forest service is ordering the arrowhead bottled water company to shut down its

california pipeline. bluetriton brands must cease its operations in the san bernardino national forest and make a plan to remove all of its pipes and equipment. the forest service decision comes after an environmental group filed a lawsuit on the agency for allowing the company to operate on an expired permit. they claim the bottled water operations dramatically reduced creek flow, causing significant environmental harm. a bluetriton spokesperson says this we will continue to operate in compliance with all state and federal laws while we explore legal and regulatory options. >> now to the new change. you may have already spotted on your last trip to costco. the chain is cracking down and trying to keep out the so-called membership moochers. >> now you'll have to scan your id card or mobile app instead of just flashing your card to an attendant. >> yeah, many places in the bay area have already rolled it out. >> yeah. to get a first hand look, abc seven news reporter joe stone went out shopping

planning to attack one of her three shows in vienna. with tens of thousands of fans in attendance, this eras tour is already the highest grossing concert tour in history, drawing millions of fans. >> abc news reporter maggie rulli has more on the plot and the suspects thought to be behind it. >> welcome to the eras tour tonight, taylor swift scrapping all three nights of her eras tour, starting tomorrow in vienna after austrian police say they thwarted an isis inspired terror plot targeting her concerts along with swiss team saying in a statement with confirmation from government officials of a planned terrorist attack at ernst happel stadium, we have no choice but to cancel the three scheduled shows for everyone's safety. the decision coming just hours after officials announced the arrests of two suspects they say made detailed plans for an attack after being radicalized online. one of the men, a 19 year old, allegedly pledged allegiance to the islamic state about a month ago. authorities say the bomb

build 16 new retail storefronts. it's all part of a program to bring new stores, retail and vending kiosks to the terminals. work from local artists will be on display inside the stores as well, celebrating the diversity of the east bay. the move comes after oakland rebranded its airport as san francisco bay oakland international airport. >> downtown san francisco's storied history is the subject of a new interactive exhibit on the ground floor of the flood building at powell and market streets. digital displays show snapshots of the downtown area during the 50s, 60s and 70s. that was an era when going downtown was very special for many people. a big event, the photographs have not been seen in nearly 50 years. the team behind the effort hopes that this display will help bring more visitors back to downtown. the public art project will be up through mid-october, but a nice look back into time. yeah, it's great. >> our weather is feeling pretty great too. >> it sure is nice and cool. as

we hit mid-august, sandhya. really something special? >> yeah, it is really special because you know what? temperatures have been above average for a few days, dan and ama and now it's time to dial back. so we can enjoy a little bit of free ac. i want to show you our sunset from tonight. it was stunning from our sutro tower camera, the fog was rolling in. we had some of that tropical moisture up above leftovers of former tropical systems in the eastern pacific, and that added all that extra color to the sunset tonight. i hope you had a chance to enjoy it. here's a look at the live doppler seven. you can see still a lot of moisture off the coast in the form of tropical moistur, so we'll continue to see high clouds streaming in from time to time. down below though, the marine layer as well established. and we've seen it pushing into parts of the bay shoreline as well. so tonight visibility along the coast down to three miles and a half moon bay already getting misty out there. and as you look at these live pictures, you can pretty much see how we're going to start off the day. many of you

will begin with gray skies, some of you with some drizzle 50s to 70 on your temperatures, but those temperatures have come down already and there's a view of the golden gate bridge overnight. tonight, fog clouds and drizzle. tomorrow is going to be a cooler afternoon and your weekend forecast in case you have outdoor plans. it's all good breezy below average by sunday. let's talk about outside lands coming up in a few days here friday in golden gate park. it will begin with some drizzle, sun and clouds for the afternoon temperatures in the mid 60s as we head into the saturday time period, a little milder and a little brighter, and then sunday turns cooler again. so dress in layers and have a great time as we go. hour by hour, 5:00 in the morning. there will be the drizzle around, there will be cloud cover and fog as we head into 10 a.m. still going to be some spots in the afternoon. gray along the coast but inland and around the bay you'll see plenty of sun so your morning will begin with 50s and 60s. it's going to be great sleeping weather tonight. tomorrow afternoon you're looking at low to mid 90s inland. today we had

upper 90s to low 100 inland. it's not going to be quite as hot there along the coastline. low 60s, breezy conditions expected. now one thing to keep in mind is the wind flow could possibly bring in a little bit of light smoke from the fires burning to our north. so that's just something to keep in mind. most noticeable in the late afternoon and evening, turning your attention to debbie. now you will notice that it has moved onshore. it's made that second landfall in near south carolina. it is dumping heavy rain. major flood threat continues. tornado watch boxes are up for parts of the carolinas and into virginia. that major flood threat continues, so it will meander still moving very slow northwest. at five miles an hour. it will continue across the carolinas and then weakened rapidly. but as it interacts with a front, it is going to dump quite a bit of rain all the way up into new england. so we're looking at additional rainfall totals of a half a foot or more across parts of the carolinas. they've already seen
