>> always live abc seven news starts right now. >> the fbi and the irs raided specialty towing in san francisco today, adding to the troubles of a company that has a history of illegally towing vehicles. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us. specialty towing is the company that tried to hook up a car in traffic with people inside. what the are you doing? that was back in april, and that wasn't the end of things? no. >> in july, san francisco city attorney banned auto towing, which owns specialty towing, from doing business with the city. >> abc seven news reporter louis pena following the story for us and is in the newsroom with today's developments. louis >> yes. dan and i spoke to a witness today who said fbi agents and law enforcement officers arrived at specialty towing around six a m hours later, the department of justice confirmed the owners of the towing company appeared in federal court to face multiple

charges, including insurance fraud. fbi agents descended on a troubled san francisco towing business with law enforcement personnel staging outside for two hours, according to a witness. they were watching the place listos con sus and they were ready with their guns. multiple agents came out of specialty towing with evidence bags, and others questioned people inside. one of the evidence bags listed ten items and multiple keys and key fobs. all found under a tv by a wall on main street. that's one of the three locations federal agents checked today. maria lives next door to the business she said. agents began the operation between 6 and 7 a.m. she feared for her safety after hearing loud noises. and i looked outside because i thought they were maybe fireworks. so i saw what was going on and then i just went back inside my house. specialty towing and its owners have been under fire for months. in april, we reported on a

specialty towing tow truck that tried to hook a vehicle waiting at a red light with a driver and passenger inside. then san francisco city attorney david chu confirmed his office had been investigating auto towing, a company owned by the same owners as specialty towing. the city suspended auto towing and several of its affiliates, including specialty towing, from doing business with san francisco, telling us then i did enough evidence such that auto towing could be permanently barred from doing business with the city for the next five years. after the raid, the u.s. department of justice confirmed to abc seven news that jose badillo and jessica najarro, who owned or operated jose's towing and auto towing, appeared in federal court today to face mail fraud, wire fraud and money laundering charges related to an alleged scheme to defraud an auto insurance company, saying the couple conspired to defraud an insurance company by submitting a fraudulent insurance claim on a wrecked car. the indictment says that

one of the accused bought a car, said it was damaged and undrivable obtained an insurance policy on and later took title to the car before falsely reporting to the insurance company. in july of 2019 that she had been in a single car accident in it in san francisco. the insurance company approved the claim and sent a check for over $34,000. this morning, neighbors were shocked to see fbi agents taking over the area. >> having it be your neighbor next door is a little alarming. sometimes, you know, like what else was really going on there? i don't know. >> if convicted, jose badillo and jessica nazario could each face up to 20 years in prison and a fine of $250,000, we contacted specialty towing and did not get a response. luz pena, abc seven news. >> remarkable story. louis, thank you. now to developing news. life is returning to normal on the uc berkeley campus after part of it was on lockdown

while police searched for a shooter. it all started with gunfire near the clark kerr dorms. this morning. abc seven news reporter lena howland has the latest on the investigation. >> gunshots at uc berkeley set off an hours long manhunt, just as summer session comes to a close. it started thursday morning when campus police say a man fired at least two gunshots toward the clark kerr campus track. a neighbor told us he heard the shots. >> i think about us laying in bed about 737. i don't know what time. and i thought i heard a pop, you know, a gunshot and then all of a sudden, about two minutes later, all you heard was sirens and everything going off for about ten minutes. >> no injuries were reported, but the nearly seven hour search for the suspect put both the clark kerr campus and the hillside campus on lockdown. seven bay area law enforcement agencies did an exhaustive search of the area, including the popular hiking trails right behind clark kerr. >> seeing an earnest response is, you know, it's reassuring to

some degree. >> rishi garg was in the area to drop his daughter off at a nearby gymnastics class, but the class was canceled as a precaution. >> it's blocked off and we heard from different people, maybe gymnastics classes closed, maybe it's not. so maybe we'll go check it out. or maybe if there's a shooter, maybe we won't do anything. i think our inclination is to maybe go back to school a few hours into the investigation, uc berkeley police say they got a tip the suspect was spotted in the hills of oakland off of panoramic way. >> officers in full tactical gear surrounded a home, but they didn't find anyone inside. that's when uc berkeley police ended their search around 230 thursday afternoon. the suspect is still on the run, according to a uc berkeley. warn me, alert the suspect is described by witnesses as a white male that has bleached hair with possible orange or red highlights. he is believed to be wearing all black clothing and carrying a red

backpack. if you see someone matching that description, you are asked to call police right away in berkeley. lena howland abc seven news. >> bart service remains shut down from hayward to fremont because of a network computer issue. the incident began around ten this morning, impacting the green and orange lines that run between hayward and san jose. agency officials say the stations had to be closed out of an abundance of caution. >> whenever anything impacts the train control system, that requires us to respond and to be assured that that is working properly, because that system is what allows us to avoid any sort of, collisions on the system. >> crews restored service at three stations by noon berryessa, milpitas and warm springs by hayward south, hayward, union city and fremont are still closed. ac transit is running bus bridges between stations honoring bart fares. bart says this issue does not appear to be related to the electrical fire that forced several stations to close in oakland. almost two weeks ago, a problem that impacted service

systemwide for days. >> oakland mayor shengtao hu faces a recall vote in november, is fending off powerful new calls for her to immediately resign. this week, the oakland police officers association asked the mayor to step down. they say the city is a more dangerous place now as a result of tao's leadership. earlier today, we spoke with mayor tao on our midday newscast about those claims. >> it was not actually the whole association. you know, i want to commend all of our working officers who come in day in and day out to do the hard work driving crime down. and so what this is, is that it is a four member executive team who took this unanimous vote. four members uh- of the opoa executive board, who is calling for this and who is stating actual fact? i mean, false facts, right? crime is trending down and that is because of the great work of our officers. and i have received so many calls from our rank and file, so many calls from officers who are doing the great work every day

to say, we do not stand with this statement. and i know that our officers will continue to do the job no matter what, because that's what we do as public servants. we do the work, we do the job. and so i commend our men and women who come into work every day to actually save lives and curb crime, because that's what we're doing under this administration. >> leaders of the oakland police officers association have said they will back the recall effort unless the mayor resigns. >> happening. today is the first day of school for thousands of students in the san jose unified school district. safety is on the mind of many families after a fatal traffic incident this week, the city is urging drivers to slow down when they're around school zones and look out for students walking to and from campuses. electronic message boards are warning drivers, and hundreds of school crossings are being upgraded to high visibility crosswalks. it's also back to school for the mount diablo unified school district. and this year there's a new policy for student cell phones at two high schools, students

have to put their phones in sealed pouches for the entire day. abc seven news reporter ryan curry takes a closer look at how this is being implemented, and how it could build a better bay area. >> new classes, new teachers, and new opportunities. but on this first day of class for mount diablo high school, there is a big new rule. everyone has to adjust to. >> we got these on orientation day. it was kind of like mandatory. it was one of the big things we didn't really care about classes or anything like that. it was yondr pouches and data. >> nicky klosinski is holding a new pouch that will carry her phone while she is in class. they are from a company called yonder. who makes these pouches specifically designed to get people off their phones. >> we have to use it. we can't unlock it at all. we can't have it during lunch, brunch, anything. only for emergencies. >> every day. students have to put their phones in these pouches, seal them, and they won't be able to get them back until the end of the day. >> students were finding that they were more engaged in class, that they were actually meeting people on campus that they had never met before, and during during lunch time and passing

periods. >> the district is joining others around the bay area in instituting this new policy. studies have shown that student cell phone use can lead to increased anxiety, bullying, and even suicide rates. but there are also academic improvements. one study by the university of texas in 2015 showed test scores rose as much as 6% after cell phone bans were enacted, superintendent clark says as students return from pandemic home schooling, phones had been their only link to the outside world. >> what we were finding as we were doing class visits and walking around campuses that students were on their phones all the time. and as we're talking to teachers and even talking to students and students, actually admitting, like i'm watching tiktok during class and i should be paying attention to the teacher. >> but on the first day, kluczynski says it hasn't been a smooth transition. >> second period. a lot of kids still don't have it to lunch, and that's about 4 or 5 periods in, so it seems like they can't get to every kid, and it's just it's completely wreaking havoc. kids are getting in trouble for just having them on them. even though they haven't got their

pouches yet. expect the trend to continue. >> the governor has called on legislature to restrict cell phone use in schools statewide in concord. ryan curry, abc seven news. >> a new electric zero emission ferry design was released today and now san francisco bay ferry is requesting bids from shipyards to build it. this will be the agency's first electric vessels for what will become the nation's first high speed, high capacity, zero emission vessels. sf bay ferry calls it the rapid electric emission free ferry program, or reif, for short. it is hoping to have five electric ferries plus and electric charging docks at several terminals. >> coming up, a new name isn't the only change for oakland airport. what travelers are going to notice noticeable changes here today with cooler weather. i'm meteorologist sandhya patel. we'll talk about hazy conditions and an air

termination. after she was fired for failing to stop fraudulent purchases of roughly $5,000. >> the incident happened at the san ramon home depot, three months after a loss prevention officer was shot and killed at a pleasanton home depot while trying to stop a theft attempt. >> abc7 news i-team reporter melanie woodrow is here with the story. melanie. >> dan and ama, we hear about theft in the bay area. all the time. this one's a little bit different. carlene acevedo was fired from home depot last july for creating a security or loss prevention risk. that was according to her termination letter. she says she felt scared

and intimidated by the person at her register who was paying with a suspicious card. >> your phenomenal in every way. we are grateful to have you. >> during her seven years working as a cashier at the san ramon home depot, carlene acevedo says she won multiple awards for exceptional service, including cashier of the year in 2021. >> i loved working there, but last july, home depot fired acevedo after she rung up for fraudulent transactions, resulting in a more than $5,000 loss for home depot. i was so upset, i just i just wanted to get out of there. i was, i was i have never been fired before. >> acevedo says she was working alone in the garden center when a man approached her cash register with a card that had written instructions on the back to process the transaction. as cash. she rung up a purchase for a little more than $1,300. >> the card was suspicious. it was very suspicious, but i went ahead and ran it approximately 30 minutes later, she says. >> the customer returned. >> and then i knew for sure that he was targeting me because i

was alone. >> acevedo says she tried to call her supervisor the head cashier, but no one answered. >> he was demanding he wanted the transaction done as fast as possible. he got upset when i made the phone call to my manager. i was scared. >> according to her termination letter, acevedo ran three additional separate transactions as cash, this time for more than $4,000. she says she kept duplicate copies of the receipts that she took to her manager. >> four days later, i got fired. the incident happened three months after pleasanton home depot lost prevention officer blake mose was shot and killed while trying to stop a theft attempt, a story acevedo was familiar with. >> it was devastating. >> i mean, it was sad. >> acevedo says as an employee, she received annual computer based training by home depot on what to do in the event of a shoplifting or active shooter. what were you instructed to do? >> i was instructed not to do a thing. do not approach. do not touch. do not try to, dissuade,

not to interfere. just let them go. >> she was doing everything she could. she asked for backup. she's making copies of the receipt. you know, she can't risk her life for merchandise. and employees are explicitly taught not to risk their life for merchandise. >> acevedo's attorney, benton hayes, also questions the timing of her termination, according to the lawsuit. six months prior, acevedo learned a teenage new hire at the store had a starting salary of $21 an hour. acevedo, who was 70 at the time and had been working at home depot for seven years, was making $20.17 an hour, she complained, and the following month received a $2 raise. >> they really just wanted an excuse to terminate her the moment she complains she's terminated within a few months by email, a home depot spokesperson told the i-team, i can't discuss ongoing litigation. >> i lost so much. i lost my health care, my health declined because of as a result of that, i had difficulty finding work and paying my rent was put into

question, acevedo says. >> it took a while, but she was able to find new part time work. >> it was a devastating emotional experience. >> acevedo's attorney says that she'll try to obtain surveillance video from the store as part of discovery, as well as any employee handbook or instructions that might exist regarding what to do in a situation like this. dan and ama. if this individual had just walked out with the item, she might still have her job. but because he went to the register and she processed those transactions as cash, she was fired. >> oh my goodness, all the way around. >> yeah, i know you'll follow it. let us know if anything develops. thank you melanie. >> okay, let's get to our weather. definitely cooler today. >> it's nice and we should enjoy it while it lasts. meteorologist sandhya patel is here. sandhya? >> yeah? you're absolutely right. because, you know, around this time of year, dan and ama doesn't always last. but this time around, we have noticed a drop in the temperatures, but also noticing more haze in the atmosphere. this is a live view from okay. and it's hard to make out the skyline there because of wildfire smoke from canada and

the western us. that's impacting parts of the bay area. air. purple air. excuse me. right no, showing some parts in the inland east bay are dealing with poor to moderate air quality. you can see air now, which is the official reporting agency has fewer sensors is showing good to moderate now as we look at our hourly smoke forecast, you'll notice that the haze is still with us tomorrow afternoon. it will get a little bit heavier and really going into tomorrow evening as well. it's not expected to be like the orange sky that we experienced a few years ago, but just in case things change, keep that in mind. we do have that air quality advisory for both today and tomorrow. as you look at the air quality thursday, friday right now looking at good to moderate warming climate, let's talk about this. so we're looking at the climate records. july 2024 was the second hottest july on record globally for the bay area. many cities had their hottest july this year. but of course san francisco was not part of it. long term warming trend is driven by human

activities primarily emissions of greenhouse gases. the forecast projection for this is a drop in global average temperatures that is expected, but let's talk about la nina advisory, climate prediction center put it out today near the equatorial pacific lower sea surface temperatures have been reported 65% chance of la nina this september through november, and there's a 74% chance it continues november through january. of course, everyone wants to know what does this mean for our rainfall? it could go either way, so stay tuned. we have seen variations with la nina, so we don't have any definitive answers for our precip yet. isolated thunderstorms showing up in the sierra. we've had some tropical moisture, leftover moisture in the form of high clouds. we've also had the fog around cooler weather for sure. alcatraz showing up from our pier 39 camera. you can see the low clouds are back 60s right now. san francisco, oakland, hayward 76, in san jose and it is in the low 70s in redwood city. blue

footage tonight of police as they frantically search for the gunman who shot at former president donald trump last month in pennsylvania. the video shows one officer being hoisted up to the roof, then quickly dropping down after seeing the shooter. seconds later, the gunman fired at trump, hitting his ear. the footage then shows law enforcement on the roof where the gunman had been shot and killed. donald trump held a

>> today marks the one year anniversary of the maui wildfires that killed 102 people and practically wiped out the town of lahaina. hawaii's governor says the first year was for healing. this second year since the blaze is for rebuilding only a small fraction of the 4000 displaced households are still staying in hotels. a few days ago, hawaiian electric, the county and the state agreed to pay $4 billion to settle claims related to the fire. residents are looking forward to resuming their life in paradise. >> i tell people that i actually lived in the aloha spirit. >> everybody hears about aloha spirit, but i experienced it. >> one bright side the 151 year old banyan tree is coming back to life, and even as fruit growing on it and as we remember the anniversary of the maui wildfires, abc news has an all new primetime special, maui rising the fight for hawaii's future. the special examines how the tragedy ignited a grassroots movement for change.

were also destroyed in wrightsville beach, the wind pushing the sand. it also took down this fishing pier sign. north carolina's governor increasing the number of national guard activated to 374. with the threat of even more flooding and tornadoes. >> right now, 32 counties have states of expect there will probably be more as this storm moves north and west. >> video showing traffic delays with flooding in cumberland county, the same in fayetteville and chapel hill, georgia and south carolina. also saturated nearly 20in of rain falling in some places already. and further south in florida, where debby hit as a category one hurricane monday, this entire neighborhood in sarasota underwater. many saying they had no flood insurance. there is a concern for tornadoes for much of north carolina and virginia. tonight, more heavy rain and flooding also possible. sean coffey abc news, lucama north carolina. >> and of course, sandhya has been tracking the storm very closely. >> that's touch base with her

about what's happening with debby and of course, our forecast. sandy. >> yeah, dan and ama debby is a depression, so it's definitely weaker, but it is still bringing considerable flooding and remains a major flood threat. you will notice the circulation on live doppler seven, so it is definitely weaker as i mentioned, but a lot of rain falling across the region. tornado watch boxes up for parts of the mid-atlantic. they have seen some tornadoes already and it will pick up speed. right now it is moving a little bit faster than it was yesterday. north northwesterly at ten miles an hour. winds are 35 miles an hour. it's going to race up the eastern seaboard, but remains a major issue for much of the eastern seaboard, as they are expecting several more inches of rain, which means the flooding will continue. live doppler seven here locally, we do have the fog along the coastline. it's going to stick around tomorrow afternoon for parts of the coast. breezy as well. low 60s there, but away from the coastline. i think some areas will see an uptick in those temperatures. you're going to be in the low to mid 90s and the warmest spots. the accuweather seven day forecast, mild at the
