>> from abc news this is america this morning. >> good thursday morning, everyone i'm andrew dymburt. good thursday morning i'm rhiannon ally. >> we begin with the presidential race and the controversy surrounding a visit to arlington cemetery this week by former president trump. >> at issue is a campaign photo op at the cemetery in what's being described as an altercation between a trump campaign staffer and a cemetery official. >> abc's perry russom has the latest details on this, and the latest from the campaign trail. perry. >> good morning, ryan, and good morning to you. that controversy over trump's visit to arlington is growing overnight. it comes as a new poll shows vice president kamala harris has caught up to trump in some key battleground states. this morning, a new poll finds vice president kamala harris has closed the gap, with former president trump in the sunbelt swing states. the poll, conducted after the democratic convention and after rfk jr. dropped out of the race, shows trump still leads harris in north carolina, but the vice president has jumped ahead in arizona, nevada and georgia. the

gaps are within the margin of error in each state. we're all in it together. harris and running mate tim walz stopping at a restaurant in savannah, georgia, last night after meeting with the high school band. >> sometimes he hit the note. sometimes you don't, right? but all that practice makes for beautiful music. >> it comes as trump's running mate, j.d. vance is defending the former president as he faces growing backlash for an incident at arlington national cemetery. >> there is verifiable evidence that the campaign was allowed to have a photographer there. >> on monday, trump's tiktok account posted a video of trump at the cemetery for an event honoring military service members killed during the u.s. withdrawal from afghanistan three years ago. >> and then they took over that disaster. the leaving of afghanistan. >> the video includes trump criticizing the biden administration's handling of the withdrawal. some families of fallen soldiers buried at arlington say they allow trump to photograph the event, but federal law prohibits political campaign or election related

activities within army national military cemeteries. >> families are not a monolith when it comes to military families. when it comes to families connected to any tragedy. people don't see things the same. the broader issue here is there is a federal law in place, and so far the trump campaign has yet to provide documentation of its claim that it was permitted to do this. >> npr reports trump campaign officials were asked not to take photos or videos in a specific section of the cemetery, which allegedly led to a verbal and physical altercation with a cemetery employee. overnight, the new york times reporting the cemetery official has opted not to file charges, reportedly fearing retribution from trump supporters. the family of one veteran, whose grave can be seen in the tiktok video, says they did not give the trump campaign permission to film his grave, saying trump campaign staffers did not adhere to the rules that were set in place for this visit. the harris campaign calls the incident pretty sad. harris herself has not commented on the incident, but that did not stop

j.d. vance from saying this. >> she wants to yell at donald trump because he showed up. she can she can go to hell. >> and trump could talk about the controversy today as he holds a town hall in wisconsin. harris and walz continue their bus tour in georgia. rhiannon. >> all right, perry, thank you for that. six weeks after the assassination attempt on former president trump, the fbi says the motive still remains unclear. agents released new images of the shooter's weapon and the explosives that were in his car. but they say they have found no evidence that he held any consistent political beliefs. he searched online about events for both trump and president biden. they say he appeared determined to attack an event and saw trump's rally as an opportunity. >> storms have been slamming millions of americans from the midwest to the east coast overnight. this video shows a house sliced in half by a fallen tree in michigan. thankfully, no one was inside the house. those storms that moved east are breaking the heat today, leaving much cooler temperatures behind. meanwhile, this funnel cloud was

seen in south dakota as a tornado warning was issued in parts of the state yesterday. the storm threat today will be from iowa to michigan, and we'll check your full forecast in a few moments. a united airlines flight from cancun to chicago had to make an emergency landing in memphis because of severe turbulence. at least seven people were injured. one person had to be hospitalized. >> we turn now to a listeria outbreak linked to contaminated deli meat. it's now being blamed for more deaths, and it's now the largest outbreak of its kind in the u.s. in more than a decade. this morning, the death toll climbing in a nationwide listeria outbreak linked to boar's head deli meat. at least nine people have now died, with cases reported in these 18 states. 57 people have now been hospitalized, and the cdc warns customers may still have the tainted meat in their fridge. the long shelf life for certain products, like bacon and salami, means some recalled meats have best buy dates through october. >> he always ate lunch meat,

always boar's head gershon morgenstein says his father, a holocaust survivor, was in good health until he says his dad got listeria after eating tainted liverwurst. >> he says the infection led to meningitis and brain damage. his father died july 18th. >> we're all still in shock for all of the things you know that he's seen and been through in his life to come to that. >> the family now filing a wrongful death lawsuit, their lawyer saying no one should die from eating a sandwich through this lawsuit and others. we will determine what went wrong at boar's head. boar's head released a statement earlier this month saying, we are conducting a rigorous investigation to identify the root cause of this incident, and the company has said safety is their absolute priority. that family is suing for damages. an inspection report that was first obtained by cbs says health officials found evidence of bugs, mildew, even mold at a boar's head factory that was

linked to that outbreak. but abc news has not independently confirmed that. >> new details overnight about a prominent former politician convicted of murdering a reporter for writing unfavorable things about him. that politician has now learned his fate. this morning, former nevada politician robert tellis has been sentenced to life in prison for first degree murder, convicted of fatally stabbing las vegas journalist jeff german outside gurman's home. >> the jury unanimously finds the murder willful, deliberate and premeditated by means of lying in wait. >> prosecutors argued tellis killed gurman after the reporter wrote a series of scathing articles detailing toxic workplace behaviors. while tellis was the clark county public administrator. surveillance videos allegedly show tellis suv canvasing gehrmann's neighborhood, and tellis dressed in that disguise moments before and after the murder. tellis says he was framed and denied involvement. >> i am not crazy. i am not trying to avoid responsibility.

>> but he was pressed about dna evidence linking him to the crime scene. >> how in the world does your dna get underneath mr. german's fingernails? >> i don't know, because i did not kill mr. gurman. >> the jury not buying it year old tellis won't be eligible for parole until he serves at least 20 years. >> well, the cia now says it helped disrupt the terror plot against taylor swift's concerts in vienna earlier this month. the agency's deputy director says cia intelligence was passed along to authorities in europe, leading to the arrests of three suspects. he says some were found with bomb making material and had access to the venue. three concerts were canceled after the arrests. the cia official says the plot was intended to kill tens of thousands of people. and prosecutors in southern california say they have busted a major international crime ring. they say the owners of a car rental company in la were bringing in criminals from south america and then providing them with cars and information about

expect as little as 23 to $32,000, depending on the airline. some say they're struggling to feed their families, and they say their jobs are only getting harder with more unruly passengers. in recent years, crew members from various airlines have been seen breaking up brawls or enduring physical violence themselves. this tmz video recently showing a woman biting a flight attendant's uniform. united airlines says we remain eager to reach an agreement. to be clear, there is no work stoppage or labor disruption. the union says if no deal is reached, the earliest a strike could happen is towards the end of this year. >> well, caretakers at jacksonville zoo say they're medicating some of their primates after three apes died this week of a highly contagious disease. first, it was brothers jumanji and jenga who died of shigella this week. and then the infection killed a 35 year old female gorilla. zookeepers say others have been quarantined and some have now recovered. they
